Austin Approves Utility Poles & Fire Hall Repairs

438 Regular meeting of the City Council Austin Texas, Oct 6th, 1905 Hon J. W. Stiles, Mayor Presiding. Roll Called. Present: Aldermen Armstrong, Brooke, Cunce, Haynes Miller, Moore, Petri, Powell, Schumann, Scuit. Von Boeckmann & Wilhelm. Absent: Aldermen Macken & Pede. On motion the minutes were approved as read by the clerk, without reading. Petitions etc Chas Jones pound fees. By Alderman Petri. Petition of Chas. Jones asking to have Certain pound fees refunded. Read and on motion referred to the Claims & accounts Committee. Austin Candy Mfg Co. By Alderman Cuneo. Petition of the Austin Candy Manufactg Coal Conveyor. Company for permission to maintain and operate what is known as a “Coal Conveyor” at the corner of Fourth & Colorado Streets. The Petition was read and on motion Same was granted. Wm. Bourke pound fees. By Alderman Petri, Petition of Wm Burke to refund Certain pound fees. The Petition was read and on Motion was granted to the amount of $2.00 said being the City fees. Jas H. Heison fees Alderman Brooke offered a communication from Ulles & Jaurles Heison asking payment of fees for Collecting Certain taxes, which was read and on Motion was referred to the Finance Committee. Reports of City Officers Reports City Officers The Mayor laid before the Council the reports of the Assessor & Collector, the Treasurer, the Clerk, the City Physician & the Marshal for the month of October 1905, which were on Motion referred to their appropriate Standing Committees without reading. Reports of Standing Committees Reports Standing Comm. Alderman Graham for the Street Committee to whom Alderman Smith for the Street. was referred an ordinance regulating the placing of Telegraph, Telephone & Electric Light Poles in the City, presented a report recommending the pass_sage of the ordinance. On Motion the report was adopted. Alderman Haynes for the Finance Committee to whom was referred the reports of the City Assessor, & Collector, the City Treasurer & the City Clerk, for the month of Sept. 1905 presented a report stating that they had been examined and found gromg correct. Unfinished Business Unfinished Business The Mayor laid before the Council an ordinance regulating the placing of Telegraph, Telephone & Electric Light Poles in the City of Austin Pole ordinance The ordinance was read the second time, and on passed motion the rule was suspended and it passed on its third reading and final passage by the following vote Yeas Alderman Armstrong, Crooker, Cunes, Haynes Miller, Moore, Petri, Powell, Redd, Shumate, Smith Von Rosenberg, & Wilhelm 13 Nays None. The ordinance was read the third time and passed by the following vote Yeas Alderman Armstrong, Crooker, Cunes, Haynes Miller, Moore, Petri, Powell, Redd, Shumate, Smith Von Rosenberg, & Wilhelm 13 Nays None. Cruelty to animals Alderman Shumate moved to reconsider the vote Vote to pass taken on the next amendment to the ordinance reconsider to prevent Cruelty to animals etc. was laid on the table, which motion prevailed by the following vote Yeas Alderman Armstrong, Crooker, Cunes, Haynes Miller, Moore, Petri, Powell, Redd, Shumate, Smith Von Rosenberg, & Wilhelm 13 Nays None. The ordinance was read the second time Col. Joel B. Miller President of the Austin Humane Society was invited to address the Council, which he did. After discussion by several of the Alderman Cruelty to animals and the City Attorney, Alderman Moore ordinance moved to table the ordinance, which motion laid on table prevailed by the following vote Yeas Alderman Armstrong, Cunes, Miller, Moore Petri, Powell, Redd, Smith, Von Rosenberg, & Wilhelm 10 Nays Alderman Crooker, Haynes, Shumate 3 Alderman Shumate offered a resolution authorizing [illegible] the Citizens Committee in charge of the contemplated Carnival and Street fair to be held in this City in Nov. next to use the tracks and sidewalks of the City for [illegible] to move etc. On motion the resolution was adopted. By Finance Committee. An ordinance --- Page break --- 440 $250. for atty fees Case Forvieste Civ Approviating the sum of $250.- for the purpose of employing Attorney to represent the City and its Public Service Commission in the Case of Fraina & Forbes vs the City of Austin. The ordinance was read the first time and passed under suspension of the rules on the following vote Yeas Aldermen Armstrong, Crooker, Eureca, Haynes, Miller, Moore, Petri, Powell, Read, Shumate, Smith, Von Rosenberg & Wilhelm Nays none. 23 Chief ats. recommends Certain repairs & improvements Alderman Von Rosenberg presented a communication from the Chief of the Austin Fire Dept. recommending certain repairs & improvements to East Austin Fire Hallthe erection of drying Towers for Protection Hose Cos. South Austin No.6 & North Austin Hose Co. which was read and laid over to Comittee on ordinance on the subject. $125- to repair East Austin Fire Hall By Alderman Von Rosenberg an ordinance appropriating the sum of $125.- for the purpose of repairing East Austin Fire Hall. The ordinance was read the first time and passed under suspension of the rules by the following vote Yeas Aldermen Armstrong, Crooker, Eames, Haynes Miller, Moore, Petri, Powell, Read, Shumate, Smith Von Rosenberg & Wilhelm Nays None. 13 Fire Committee to advertise for bids for Bells & Driers. Alderman Von Rosenberg offered the following resolution which was read and adopted Be it resolved by the City Council of the City of Austin: That the Fire Committee be authorized to advertise for bids for erecting drying Towers for Protection Hose No.6. South Austin Hose Co. & North Austin Hose No.6. Extra Str Labor By Alderman Smith an ordinance appropriating the sum of $595.00 for the purpose of paying for Extra Street Labor & Drays. The ordinance was read the first time and passed under suspension of the rules by the following vote Yeas Aldermen Armstrong, Crooker, Eames, Haynes Miller, Moore, [illegible], Powell, Read, Shumate, Smith Von Rosenberg & Wilhelm Nays none. 23 [illegible] Alderman Miller was excused from further attendance at this evening's Comal. Nays None. G. D. Payton for By Alderman Smith An ordinance appropriating Services the Sum of $40.00 for the purpose of paying G. D. Payton for extra services guarding prisoners. The ordinance was read the first time and passed Under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Crooked, Eureca, Haynes, Moore Petri, Powell, Redd, Shumate, Smith, Von Rosenberg Wilhelm. Nays None. Amendments to By Alderman Wilhelm an ordinance Hog Ordinance Amending the Hog ordinance. The ordinance was read the first time and on motion was referred to the Police Committee. Alderman Crooked presented a petition from Citizens, asking that the hog ordinance amended which was referred to the Police Committee. Alderman Moore moved that a Committee of Com. to investigate three be appointed to inspect the hog pen of Geo. Washington Geo. Washington which motion prevailed and the hog pen Mayor appointed Aldermen Moore, Armstrong & Wilhelm as Such Committee. On motion of Alderman Haynes the Council adjourned until 8 oclock P.M. Shelton, Mayor, Presiding Roll Called Present Aldermen Crocken, Gurnas, Haynes, Moore, Petri, Powell, Read, Shumate, Smith, Voelkel, Devine, Dunham 11 Absent Aldermen Armstrong, Watson, & Scheller. 3 On motion the regular order of business was dispensed, and Alderman Haynes offered the following Resolution Be it resolved by the City Council of the City of Austin Finance Com. w/Mayor That the Finance Committee of the City of Austin authorized to purchase together with the Mayor thereof be and they are Certain Bonds for the Hereby Authorized and directed to purchase City Hall Funds of the proceeds of such bonds, the following bonds. To wit $13,500.00 Six per Cent bonds of the City of Austin, the same being, bonds, the interest Coupons of which are now in suit in a case of Cox & Watson vs City of Austin, suit Pending in District Court of Travis County, Texas, Said bonds having been refunded April 1st, 1895, and now being subject to Call by the City of Austin. Be it further resolved that when purchased the Said bonds shall be held by the Treasurer of the City of Austin for and on account of the City Hall Fund of the City of Austin, to the extent of the funds of Said account used by Said Committee in the purchase of Said bonds. The resolution was adopted Interest on $13.500. By Alderman Haynes An ordinance appropriating Funding bonds. the Sum of $4106.60, for the purpose of paying the interest on an issue of $13.500.00 of bonds of the City of Austin, issued in 1895, bearing Six per cent interest per Annum, being the bonds involved in the suit of Cox & Watson, Drusheck, V. S. the City of Austin, Now Pending in the District Court of Travis County, Texas, 50th Judicial District. Section 2. That the City Clerk be and he is hereby instructed to draw a warrant payable to the order of the District Clerk of Travis County, Texas, for the above named Amount Section 3. That this ordinance take effect and be in force from and after its passage. The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Crobkey, Cuneo, Haynes, Madden, Moore, Petri, Powell, Redd, Shumate, Smith, Von Rosenberg & Wilhelm Nays none. 13 The following resolution offered by the Police Committee was read and adopted. Resolved by the City Council of the City of Austin that the City Marshal be and is hereby authorized to appoint by the Consent of the Mayor, as special Police - the Citizens Carnival Committee and also such other special Police - said special officers to be on pay of both Police, and to serve during the Carnival.
