Austin's 1905 Police Case & Street Repairs

Police Misconduct Complaint Dismissed – The Police Committee investigated a complaint against Officer Juan Mallony brought by W.B. Davis but found insufficient evidence to support it, recommending no further action be taken.

Damage Settlement Approved – The city agreed to pay Mrs. Pierce $250 for damages she sustained, resolving a claims matter through the city council.

Street & Infrastructure Improvements – Council allocated $25 to repair Barhouse Street in South Austin and directed the railroad to repair streets and crossings near the railroad yards, threatening legal action if repairs weren't completed.

Financial Management – The city established a dedicated "Interest and Sinking Fund" account to manage bonded debt payments for 1905, and approved financial reports from the assessor, collector, and treasurer.

Public Services Decisions – The council authorized the Water & Light Commission to reduce water usage and drain cemetery hydrants during freezing weather, and approved the Charity Committee to purchase two cars of firewood for the poor.

Regular Meeting of the City Council Austin, Texas, December 04, 1905 Hon W. D. Sheaffey Mayor presiding. Roll Called. Present Aldermen Armstrong Crocker Eanes Haynes Maeken Miller Moore Petri Powell Todd Trumale Smith Von Rosenberg & W. Graham Absent none On motion the minutes were approved as recorded by the Clerk without reading- On motion the resolution or act of ordinances was laid aside, and that all standing Committees be called for reports. Alderman Haynes for the Finance Committee to whom was referred the reports of the Assessor & Collector the Treasurer & the Clerk for the month of Oct 905, presented a report stating the same had been examined and found Correct- On motion the report was adopted. Alderman Powell for the Police Committee presented the following report, which was read and adopted, Austin, Texas, Dec. 2, 1905 To the Hon Mayor and City Council of the City of Austin, Texas Gentlemen; We, your Police Committee, to whom was referred the Complaint of W B Davis, Complaining of Jua Mallony, a Police Officer of the City of Austin, by leave to report, that we on the 25th day of November, 1905, went into and Conducted an exhaustive examination of the matters and things Contained in the Complaint of the said Davis and find that, in our opinion, the Complaint, as made was not substantiated by the testimony of the witnessesWe, therefore, recommend to the Council that thay take no further action in this matter- Respectfully Submitted H. A. Powell W. B. Miller H. B. Haynes. Alderman Petri for the Claims & accounts Committee to whom was referred the Petition of Mrs. Pierce, having to ascertain damages sustained. Presented a report recommending that the sum of $250.00 in matter be paid on the previous report and the recommendation was adopted. --- Page break --- The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong Crooken Clear Haynes Hlaschen Hillen Moore Petri Powell Redd Shumate Smedt Von Rosenberg & Wilhelm Nays none 14 Alderman Haynes offered the following resolution which was read and adopted Be it resolved by the City Council of the City of Austin, that the City Treasurer be and he is hereby requested to open an account on the books of the City Treasurer to be known as the "Interest and Sinking fund account" for the bonded indebtedness of the City of Austin for the Year 1905, and that he shall keep in said account all Monies collected for or on account of the interest and Sinking fund for bonded indebtedness for the year 1905. On Motion of Alderman Haynes the City Clerk, Geo. D. Johnson, was granted leave of absence for five days. By Alderman Hillen An Ordinance appropriating the sum of $25.00 for the purpose of repairing the Barhous street road in South Austin The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong Crooken Clear Haynes Hlaschen Hillen Moore Petri Powell Redd Shumate Smedt Von Rosenberg & Wilhelm 14 Nays none. By Alderman Moore, An ordinance providing for the opening of An Alley through out Lot No.20 Block O. The ordinance was read the first time and on Motion was referred to the Street Committee and City Engineer On Motion of Alderman Shumate the Council adjourned until 8 o'clock P.M. R. Evans Petition: By Alderman Crooker, Petition of F. R. Evans asking to have Extra Patrol box repaired, Read and on motion referred to the Claims & accounts Committee. Citizens Petition: By Alderman Moore, Petition of Citizens of the 7th ward to open street in out lot no. 45, Div. "D" Read and on motion referred to the Street Committee & City Engineer. S. D. Shudgant Petition: By Alderman Moore, Petition of S. D. Shudgant for permission to erect an iron clad building within the fire limits On motion the Petition was granted. J. R. Rubin Petition: By Alderman Moore, Petition of J. R. Rubin asking to have a fine imposed upon him in the Mayors Court remitted Read and on motion the Petition was granted. Reports of City Officers Reports City Officers The Mayor laid before the Council the reports of the Assessor Collector, the Physician and the election fire warden of November 1905, which were on motion referred to their appropriate Committees, without reading. Reports of Standing Committees Reports Standing Coms Alderman Petri for the Claims & accounts Committee to Jno Rogers & wife whom was referred the Petition of Jno Rogers and wife regarding taxes due on Certain property mentioned in said petition presented a report recommending that the petition be granted. On motion the report was adopted. Unfinished business Unfinished business The Mayor laid before the Council an ordinance repealing Plumbing Ordinance the Plumbing Ordinance - The ordinance was read the second time, and on motion of Alderman Gunea was referred to a Special Committee of 5, Consisting of Aldermen Gunea, Smith, Crooker, Van Rosenberg & Macken and the City Attorney with instructions to report at the next regular meeting. New Business New Business Alderman Wilchelen offered the following resolution which was read and adopted. Be it resolved by the City Council of the City of Austin that the Water & Light Commission is and they are hereby authorized to reduce the Consumption of money drawn from the Water & Light fund the City, Cemetery and Convict from which the main will --- Page break --- Running near his place of business for measure is requested to order the hydrants in the Cemetery may be cut off and drained and prevented from freezing in case of freezing weather. Councilman Smith presented the following resolution which was read and adopted. 5th Com. Benjamin. Be it resolved by the City Council of the City of Austin, relating to CR That the City Engineer and Street Committee of the St. Sprins Street. City of Austin be and they are hereby instructed to notify the Iron, & R.R. of Texas to at once proceed to Gravel and repair all streets and crossings on East Guadalupe, Trinity and San Jacinto in what is known as the [illegible] Yards in the City of Austin, and to further Notify them that if some action is not taken towards the repair of such crossings, the City Attorney of the City of Austin will be instructed to immediately institute Proceedings against said Company to compell them to do so or take such other action as to him may seem best. Alderman Crooken offered the following resolution which was read and adopted. Charity Com. to purchase Resolved that the Charity Committee be authorized to Wood for Poor. buy two cars wood to be delivered to the poor upon the order of the Mayor or Charity Committee On motion the Council adjourned.
