472 Reguliar meeting of the City Council Austin, April 30th, 1891 Edw. and Jno. S. Gorton, Presiding. Roll Called. Present Aldermen Armstrong, Bruner, Bremond, Cravens, Nibschke, Storrey, Moore, Morris, and Paxton. Absent None. On Motion the minutes were approved as recorded on the book, without reading.
Petitions etc. J. H. Doyle Pound fees By Alderman Storey Petition of J. H. Doyle asking Pound fees refunded-Read and on motion referred to the Committee on claims & accounts. Jno. S. Gorton to erect Sign 8th St By Alderman Moore Petition of Jno. S. Gorton asking permission to erect a board sign on 8th Street in Connection with the Prades Gas Association Read and on Motion referred to the Street Committee. Austin Gas Co to put in pipe line By Alderman Moore. Petition of the Austin Gas Company for permission to put in water pipe from their plant to the Hays Garden - Read and on motion, referred to the Water & Light Committee. Wm Jarrett Pound fees The Marshal laid before the Council a Petition from Wm Jarrett for Pound fees to be refunded to him from his horse, which was Read and on Motion referred to the Committee on Claims & accounts. Ex Alderman Nibschke invited to seat On Motion Ex Alderman Nibschke was invited to a seat within the bar of the Council. Communication regarding Garbage Alderman Moore presented a Communication from the Sanitary Reduction and Construction Company with reference to Garbage, which was read and on Motion referred to the Sanitary Committee. Reports City officers The reports of City officers The City clerk laid before the Council the reports of the Assessor and Collector, the Clerk, the Treasurer, the Marshal, the Physician and the Engineer, all of which were referred to their appropriate Standing Committees, without reading. Reports Standing Comm. Street on proposition Rampart & 8th Streets Except the report of the Engineer which was read and adopted. The report of the Standing Committee Alderman Smith for the Street Committee, to whom was referred the proposition of Wm Rampart Street & 8th Street. This committee presented a report recommending that the proposition be rejected. The report was adopted. Finance Officer's -Reports Alderman Storey for the Finance Committee to whom was referred the report on the Assessor's accounts, the clerk and the Treasurer on the reports of Alderman Storey, on Motion the report was adopted.

Alderman Haynes for the Finance Committee to whom was referred – an Ordinance appropriating the sum of $2000- for the purpose of purchasing a Rock Crusher & Engine, presented a report, stating that the Committee, in making up the Budget for the year had carefully considered the ordinance, but were unable to provide finance at this time, but would do so later on. The report was adopted.
Alderman Haynes for the Finance Committee to whom was referred an ordinance appropriating the sum of $8000 for the purpose of purchasing a Garbage Crematory, presented a report stating that the sum was included same in the Budget. Ald. Dumes [illegible] was exhausted. On motion the report was adopted.
Alderman Haynes for the Finance Committee to whom was referred the request of the Cemetery Committee to have the sum of $500.00 set aside for improvements in the Cemetery, presented a report stating that the amount asked for had been included in the Budget. On motion the report was adopted.
Alderman Von Rosenburg for the Fire Committee presented an ordinance for the Organization of the Fire Dept., which was on motion referred to the Fire Committee, without reading.
Reports of Special Committees Alderman Wacker for a majority of the Special Committee to whom was referred an ordinance to repeal the Plumbing ordinance, presented a report recommending the passage of the ordinance. Alderman Dumes for a minority of said Committee, presented a report, proposing certain amendments to the Plumbing ordinance and recommending that the ordinance to repeal said ordinance do not pass. Alderman Dumes moved to adopt the report of the minority of the Committee, which motion was lost by the following vote Yeas Aldermen Dumes Moore Powell Shumate Smith and Whelan 6 Nays Aldermen Armstrong Broeken Haynes Wacker Willer Pelri Reid Von Rosenburg 8 Alderman Wacker on motion to adopt the report of the majority of the Committee which motion prevailed by the following vote Yeas Aldermen Armstrong Broeken Haynes Wacker Willer Pelri Reid Von Rosenburg 8 Nays Aldermen Dumes Moore Shumate Smith and Whelan 6 Alderman Smith on motion a Committee, to whom

474 Street in Petition was referred the petition of J.B. Taylor to construct a sign on Jno B Taylor et al Alderman Smith, stated that the Council was ready Crook Lign & Street to make a report on same at this meeting if the Council desired to have it reported, after closely the report of the Street Committee, recommending that the petition be granted was read and adopted and on motion was re-referred Street Committee with instruction to report at the next regular meeting unfinished business Unfinished business The Mayor laid before the Council the following message from the Mayor
Austin, Texas, January 19, 1906 To the City Council Mayors Veto I return herewith, without my approval, an ordinance entitled "an ordinance appropriating the sum of One hundred and Seventy five dollars for the purpose of making part payment to Capt A.C. Watson, for making plans, specifications, etc, on new City Hall" for the reason that on the 20th day of Sept 1905, the Council, by unanimous Vote, passed the Watson Claims following resolution "Be it resolved by the City Council of the City of Austin, that the plans and specifications as prepared by A.C. Watson, Architect, for the new City Hall of the City of Austin, be, and the same are hereby adopted by the City Council of the City of Austin, as the plan and specifications of the new City Hall to be erected when the Council is ready to take up the same. Be it further resolved by the City Council of the City of Austin, that no liability for said plans, on the part of the City, shall be incurred until Contract is let and building completed" It will be seen that the Council, specifically disclaims any liability to Capt Watson by reason of the adoption of his plans, until a Contract to build a new City Hall is let, and the building completed. For this reason, I cannot approve the amount appropriated by this ordinance cannot legally be paid. Respectfully, W.O. Smith, Mayor Alderman Crocker moved to reconsider the Vote on which the ordinance appropriating the sum of One hundred and Seventy five dollars for the purpose of making part payment to A.C. Watson for plans and specifications for the 2nd motion new City Hall, was passed, which motion prevailed. Alderman Watson moved that the rules be suspended and that the ordinance be indefinitely postponed, which motion prevailed.

The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crooker, Hughes, Meachen, Moore, Petri, Powall, Redd, Shumate, Smith Von Rosenberg, Wilhelm Nays none. 14 $100. for Top Patrol By Alderman Ames an ordinance appropriating wagon the sum of $100.00 for the purpose of putting a top on the Patrol Wagon. The ordinance was read the first time and on motion was laid on the table subject to call. Alderman Shumate offered the following resolution which was read and adopted: Resolution repealing “Be it resolved by the City Council of the City of Austin, that a resolution a resolution passed by the City Council of the City of Austin adopting plans for on the 25th day of Sept 1905, be and the same is in all New City Hall things hereby repealed, said resolution to be repealed reading as follows: “Be it resolved by the City Council of the City of Austin that the plans and specifications as prepared by A.C. Watson, Architect, for the new City Hall of the City of Austin be and the same are hereby adopted by the City Council of the City of Austin. The plans and specifications of the new City Hall to be erected when the Council is ready to take up the same. Be it further resolved by the City Council of the City of Austin, that no liability for said plans, on the part of the City, shall be incurred until Contract is let and building completed.” $175.00 to pay By Alderman Shumate an ordinance appropriating A.C. Watson for the sum of $175.00 for the purpose of making plans plans new payment to A.C. Watson for making plans and specifications City Hall for new City Hall. By Alderman Moore An ordinance appropriating the sum of $66°° for the purpose of buying Wood for the poor The Ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas: Aldermen Armstrong, Crooker, Elmendorf, Keanes, Meaken, Miller, Moore, Petri, Powell, Reed, Shearmate, Smith Von Rosenberg & Wilhelm. 14 Nays None. On motion Alderman Crooker was excused from further attendance at this session of the Council The City Engineer reported that the Council Hook and Steam Roller, had been badly damaged and was unfit for use until repaired, Alderman Shearmate moved that the matter be referred to the Street Committee for report, which Motion prevailed.
