Title: Austin's 1906 Street Expansion & Water Rights Debates

Colorado River Navigation Project: City Council endorsed Congressman Burleson's proposal to survey and improve the Colorado River for steamboat navigation from the Gulf to Austin, believing it would benefit regional commerce and industrial growth.

Separate Coach Ordinance Passed: Council passed an ordinance requiring separate railroad and streetcar coaches, reflecting the segregation policies of the era. The substitute ordinance version was adopted nearly unanimously.

Hyde Park Street Dispute Resolved: After contentious debate about opening 9th Street in Hyde Park, the council appointed a 5-member special committee to mediate disagreements between property owners on opposite sides of the issue.

Fire Department Repairs & Regulation: The council approved funds for needed repairs to the South Austin Fire Company wagon and established new rules and regulations for the Fire Department's operations.

Cemetery Expansion & Property Protection: Council appointed a committee to locate additional cemetery land and directed the city marshal to investigate unauthorized occupation of city property near Congress Avenue and the Colorado River.

483 Regular meeting of the City Council, Austin, Texas, March 05, 1906 Hon W. D. Shelley, Mayor, presiding. Call Called Present Aldermen Armstrong, Crooker, Eanes, Haynes, Miller, Moore, Portes, Shunnate, Smith, 12 Vom Rosenberg & Wilhelm Absent Aldermen Wacken & Todd 2 On motion the minutes were approved as recorded by the Clerk, without reading. Petitions, Memorials, etc. Resolutions Burleson, Survey of Colorado River Alderman Crooker offered the following resolution which was read and adopted. Whereas, Hon A.S. Burleson, representing the Tenth Congressional District of the State of Texas, has introduced a resolution in the House of Representatives of the 59th Congress, providing for a survey of the Colorado River, from the Gulf to the City of Austin, to show its adaptability for purposes of Navigation, to the end that an appropriation may be made to improve said stream and to make it Navigable for steamers from the Gulf to the City of Austin. And whereas, such survey and improvement will be of great and inestimable benefit to the several Counties, lying on and Contiguous to the said River and more especially to the Commercial and industrial interests of the City of Austin. Therefore, Be it resolved, by the City Council of the City of Austin, That we, representing the industrial, Commercial and other interests of said City, as well as those of the County of Travis, in part, do hereby Commend and endorse Hon A.S. Burleson, for his far sighted Statesman-ship and his zeal for the interests of his Constituents, in introducing and advocating said resolution, and we do most earnestly endorse his action therein and further most earnestly recommend the adoption of the said resolution, as well as urging the necessary appropriation to carry out the ultimate object of the favorable Consideration of the Congress of the United States, believing it to be a measure fraught with more practical Good to the people of the several Counties through which the Colorado river, than any measure relating to the improvement of said river, that has been brought to the attention of Congress. Resolved further, that the City Clerk be and he is hereby directed to forward a certified copy of this resolution to the Hon A.S. Burleson and a copy of the same to the Speaker of the House of Representatives at Washington D.C. --- Page break --- 484 Alderman Clack entered the Council Chamber S. Hulman The Mayor laid before the Council a petition from S.H. Fund fees Hulman, asking to have certain funds heretofore refunded, which petition was read and on motion referred to the finance & accounts Committee. J. O. Polhemus to By Alderman Smith, Petition of J.O. Polhemus asking use street that he be permitted to use San Marcos Street, between 4th & 5th streets for the purpose of unloading stone and building material from M.K. & T. RR. cars. The petition was read and on motion same was granted W. Maxwell By Alderman Armstrong — Petition of W.R. Maxwell Building permit for permission to erect a Bar on Front and building within the Fire limits. Read and on motion referred to the Board of Fire Commissioners. S.H. Achilles to put By Alderman Redd & Petition of S.H. Achilles for in wagon loads permission to put in a wagon load in front of his place of business on 19th street in Boonesville addition South Austin. Read and on motion the petition was granted. Reports of City Officers Reports City officers The Mayor laid before the Council the reports of the Assessor & Collector, the Treasurer, the Clerk, the Marshal & the Physician for the month of February 1906, which were on motion referred to their appropriate Committees, without reading. Reports Standing Comm Reports of Standing Committees Alderman Smith for the street Committee, to whom Street Lockhart road was referred the petitions of Citizens of South Austin asking that what is known as the Lockhart road, be opened, presented a report stating that after diligent search they had failed to find any record of said road having been opened, laid out or dedicated in or from the place where it is sought to open it in said petition. On motion the report was adopted. Street to open street Alderman Smith for the Street Committee to whom in Hyde Park was referred the petitions of Citizens for and against to open and extend 9th street in Hyde Park addition presented a report recommending that the petition to open said street be granted. Alderman Hachon entered the Council Chamber. A motion was then made and seconded to adopt the report of the Committee. An motion arose in favor of opening said street and those opposed were invited to address the Council. Those in favor were Gen. and W.W. Hupsie & against addressed the Council. Shifhars from fees J. Shifhars, asking that Certain poundage fees to him be refunded. Read and on motion referred to the Committee on Claims & accounts. Mrs P. Daylon The Mayor Laid before the Council a petition from Mrs Poundage fees P. Daylon, asking that Certain poundage fees paid by her be refunded. Read, referred to the Committee on claims & accounts. East Austin & North The Mayor laid before the Council a communication from Austin Hose Co. East Austin Hose Co N° 4 & North Austin Hose N° 5 on rules & regulations asking that action on the ordinance fixing rules and Fire Dept regulations for the government of the fire Dept etc. be deferred until the different Fire Companies can be informed of the terms of said ordinance. Read & on motion laid over to be considered in Reports City officers Connection with the ordinance. Reports of City Officers The Mayor laid before the Council the reports of the City Engineer & Sexton for the month of Feby 1906, which were on motion referred to their appropriate Committees without reading. Reports of Standing Comms. Reports of Standing Committees Finance officers Aldermen Haynes for the Finance Committee, to whom report was referred the reports of the Assessor & Collector, Treas & Clerk, and the Clerk for the month of Jany 1906, presented a report stating that same had been examined & found Correct. The report of Claims & accounts the Committee was adopted. Grant Chappel taxes Aldermen Petri for the Claims & accounts Committee to whom was referred the petition of Grant Chappel to remit Certain taxes, presented a report stating that after investigation they were of the opinion that the Council was without authority to remit the same & in motion the report of the Committee was adopted. Special Reports of Special Committees Separate Coaches. R.R. Aldermen Armstrong for the Special Committee to without pass whom was referred the Ordinance providing for Separate coaches, R.R. Elec. Rds & Street Rds, etc. Street & Common carriers, presented a report stating --- Page break --- that they had had the ordinance under consideration and presented a substitute for said ordinance and recommending the passage of the substitute. On motion the report was laid over to come up with the ordinance under the head of unfinished business. Alderman Shumate presented a report from the Paving Committee regarding paving on O. Eastreek and having served notice on one Chas Krohn and assessing his share of the expense in paving said street in front of his property. On motion the report and action of the Committee was adopted. Alderman Macken entered the Council Chamber Unfinished business The Mayor laid before the Council the separate Coach ordinance together with the substitute offered by the Special Committee The substitute was read and on motion same was adopted in lieu of the original ordinance by the following Vote Yeas Aldermen Armstrong, Crooker, Eumes, Gaynes, Macken McMillen, Pein, Powell, Shumate, Smith, Voit, Rosenberg, Wilhelm. Nays None The ordinance was then passed by the following Vote Yeas Aldermen Armstrong, Crooker, Eumes, Gaynes McMillen, Pein, Powell, Shumate, Smith, Voit, Rosenberg, Wilhelm. Nays Alderman Macken New Business By Alderman Eumes. An ordinance providing for repair and improvement of and paving of the side walks of the City of Austin. The ordinance was read the first time and on motion of Alderman Shumate was referred to the Street Committee and City Attorney. Alderman Powell offered the following resolution which was read and on motion of Alderman Powell was referred to the Street Committee, Viz. Whereas there now exists in West Austin a street the north portion of which is known as the Ruiz street and the south portion of which is known as Fannin Street and where as the portion of said Street which is known as Fannin Street is the oldest thoroughfare in the City of Austin. Therefore be it resolved by the Council of the City of Austin that from and with this date till said portion of said Street shall be known and designated as Fannin Street. --- Page break --- 488 M.L. Curns requested to release certain money tied up in injunction Bond. Alderman Curns offered the following resolution which was read and adopted. Whereas the City of Austin has heretofore placed in the hands of The American National Bank the sum of Fifteen Hundred Dollars to indemnify the American National Bank against loss by reason of having gone on on a certain injunction bond wherein the City of Austin is plaintiff and the Austin Water Light and Power Commission is defendant, and whereas the City of Austin is in need of its current expenses, and it is agreed by some of the members of the Water Light Commission that there can be no damage as a result of said suit. Therefore be it resolved by the City Council of the City of Austin that the Water and Light Commission of the City of Austin be and they are hereby requested to request the District Judge of the Court in which said suit is pending to reduce said bond to a nominal amount and release the major portion of the money now held by the bank as a surety thereon. Alderman Kohlhelm offered the following resolution, which was read and adopted: Engineer directed to Cemetery Committee and Iron Bridges Be it resolved by the City Council of the City of Austin That the City Engineer be and is hereby instructed to deliver to the Cemetery Committee three of the old Iron foot bridges, to be placed by the Cemetery Committee, at their discretion. Alderman Haynes offered the following resolution which was read and adopted: Building permits Whereas, under the present ordinance governing the issuing of building permits, it is absolutely impossible for the City Assessor & Collector to keep advised as to new buildings and improvements in the City, many permits being taken out at much less than the cost of same. Therefore be it resolved, by the City Council of the City of Austin that the ordinance committee be and are hereby instructed to investigate the present system governing the issuing of building permits and to prepare an ordinance whereby the actual cost of buildings or improvements be embraced in such permits; and any other matter that may enable the authorities to keep advised as to improvements in the City. The Cemetery Committee offered the following resolution which was read and adopted. Be it resolved by the City Council that a committee. --- Page break --- of Six who be appointed by the Mayor to investigate on locale more ground for City Cemetery purposes Three members of the City Council and three private Citizens, the Mayor and City Attorney to be added to this Committee. Alderman Petri offered the following resolution which was read and adopted. Whereas it has become known to the City Council of the City of Austin that certain persons are now occupying a certain part of Congress Avenue near the South end thereof and near the Colorado River as a store for produce depot and that certain other persons are vesting Said property, and are claiming an interest in said property, antagonistic to the Claim of the City Therefore be it resolved by the City Council of the City of Austin that the Marshal be and he is hereby instructed to immediately investigate this matter and take immediate charge of any property belonging to the City - and dispossess any Trespassers. By Alderman Wacksm an Ordinance repealing the plumbing ordinance - The ordinance was read the first time. Alderman Aunes moved to defer further action on it until the next regular Meeting, which motion was lost by the following Vote Yeas Alderman [illegible] Porcell Shumate Vorsenbery Swickhelm 5 Nays Alderman Armstrong Crooken Hayner Wacksm Willcox Petri Smith 7 Alderman Wacksm moved to Suspend the rule and place the ordinance on its Second reading, which motion was lost by the following Vote Yeas Alderman Armstrong Crooken Hayner Wacksm Willcox Petri Smith & Swickhelm 8 Nays Alderman Aunes Porcell Shumate Vorsenbery 4 The Street Committee offered the following resolution Whereas the attached map and others dedicating certain Streets extending from The [illegible] Drive or Georgetown road through Hyde Park and Hyde Park Annex intersecting Duval Street on the East Side of Said Park Annex, being 3rd, 4th, 5th, 6th 7th and 8th Streets. Be it therefore resolved by the City Council of the City of Austin that Said dedications be and the Same is hereby accepted and that the same are and do hereby accepted as a street of the City of Austin Texas, and be it further resolved that all obstructions on what is --- Page break --- Known as Fourth Street in said Ward, but in fact the Same are hereby ordered removed forthwith, and if the Same are not so removed within ten days thereof the City Marshal of the City of Austin be and he is hereby instructed and ordered to remove all Such obstructions Invitation to Awaken North Austin Streets Alderman Macken [illegible] an invitation to the Council to attend a [illegible] to awaken North Austin Streets at [illegible] Hall on Thursday [illegible] 15 1896 Alderman Miller moved that the Council should [illegible], which motion was carried by the following Vote Yeas Aldermen Macken Miller Pohle and 4 Nays Aldermen Armstrong Crocken Quesada Penn 8 Fisk Von Rosenberg & Wilhelm Hyde Park Streets Alderman Ethea moved that the matter of opening Hyde Park Streets be referred to a Special Committee of 5 to adjust the differences, between the north and South and Certain Citizens in regard to the opening of Street, which motion prevailed, and the Mayor appointed Aldermen Ethea Smith Macken Wilhelm & [illegible] as Such Committee Alderman Von Rosenberg for a minority of the said Rules & Regulations Fire Dept Committee, to whom was referred the Ordinance establishing rules & regulations for the Government of the Fire Dept. to present a Report suggesting Certain Amendments to the ordinance and with said amendments [illegible] recommend its passage Alderman Macken for a minority of the Committee presented a report recommending that the rules and regulations proposed, be submitted to each of the Fire Companies for examination and suggestions The report of the Majority of the Committee was adopted by the following Vote Yeas Aldermen Armstrong Crocken Ethea Haynes [illegible] Penn Powell [illegible] Von Rosenberg & Wilhelm 11 Nays Alderman Macken Alderman Macken moved that the Council Now adjourn, which motion was lost by the following Vote Yeas Aldermen Macken & Miller 2 Nays Aldermen Armstrong Crocken Ethea Haynes Fisk [illegible] Penn Powell [illegible] Von Rosenberg & Wilhelm 10 The Ordinance establishing regulating the Fire Department of the City of Austin, was read the first time and passed under suspension of the Rules by the following Vote Yeas Aldermen Armstrong, Crocken, Ethea, Haynes, Macken Penn, Powell [illegible] Von Rosenberg & Wilhelm 11 --- Page break --- and with then ways Alderman Wacken The Mayor laid before the Council the following Communication Austin, Texas, March 12th, 1906 To the Hon Mayor and Members of the City Council. Gentlemen! My attention having been called to the condition of South Austin Hose Co. Wagon by the Foreman. of that Company, wish to say that I have examined Same and find that on account of the large amounts of hose which it is necessary for that Company to Carry, together with the chemical apparatus, that the springs are in a badly damaged Condition and in my opinion will necessitate a new set of springs at once as I Consider it unsafe to use the wagon in its present Condition! Also I would respectfully request that Colorado Hose Co wagon be repaired as soon as possible for you to do so, as it is very much in need of Same. Yours Very Respectfully C. E. The given Committee on Fire Dept would recommend that the sum of forty dollars or so much thereof to purchase new springs and other necessary repairs on South Austin Hose Wagon.
