Shelley, Mayor, presiding Call Called Present Aldermen Armstrong, Crocken, Haynies, Machen Miller, Moore, Petri, Redd & Smith, Von Rosenberg & Wilhelm 11 Absent Aldermen Oakes, Powell & Humphrey 3 The following call of the Council was read Austin, Texas March 30, 1906 There is hereby called a meeting of the City Council to be held at the City Hall at 8 o’clock on Friday evening the 30th day of March, 1906, for the following purposes viz To take such steps as they the Council may deem by the Council in making an appropriation to pay interest on water and light bonds of the City, which matures April 1, 1906 and to receive and consider, and take such steps as may be deemed necessary in connection therewith, a proposition or propositions, looking towards the rebuilding of the dam across the Colorado River H.D. Wilhelm Pro Moore Austin, Texas March 30/06 I hereby certify that I have served the above call for a special Meeting of the City Council, by reading same to the following named Aldermen, to wit: C.D. Miller H.D. Redd, O.E. Oakes, A.W. Powell, W.M. Grocken, E. Von Rosenberg, G.J. Armstrong, Joe Machen, Henry Petri C.P. Wilhelm, H.B. Haynies, J.M. Humble, Tom Smith and D.N. Moore by W. Morris, City Marshal by A.N. Bush, Austin Policeman $15,000.00 to pay By Alderman Haynies offered an ordinance appropriating Interest on bonds the sum of $15,000.00 for the purpose of paying the interest due April 1st, 1906, on $320,000.00 5% Water Light bonds of the City The ordinance was read the first time and Passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Crocken, Haynies, Machen Miller, Moore, Petri, Redd, Smith, Von Rosenberg & Wilhelm 11 Nays None Alderman Haynies offered the following resolution which was read and adopted Be it resolved by the City Council of the City of Austin --- Page break --- That the Mayor, Finance Committee and City Treasurer, be and they are hereby instructed and directed to take up with prospective buyers, the matter of the sale of a sufficient number of the refunding bonds of the City to take up the outstanding water and Light bonds of the City; and they are requested to at once take active steps looking towards such sale. Aederman [Dunes] entered the Council Chamber The Mayor laid before the Council the following Proposition Councilors: The City of Austin, Texas, March 20, 1906. To the Honorable, the Mayor and City Council of the City of Austin Gentlemen: We submit for your consideration the following Proposition to Proposition for the Construction of a dam across the Colorado Rebuild Dam River, at or near your City: We will Construct a dam at the site, and of the height, of the old one, together with forebay and headgates, unless, after careful investigation by our Engineers we are advised that it is not practicable to permanently maintain a dam at that location If we Construct said dam, we will repair the power house and will equip it with six penstocks, four pairs of 21-inch wheels, one 800 kilowatt generator, one [kilowatt] generator, one 800 kilowatt generator, wire drivers, switchboards and other necessary appliances He will erect a suitable engine, boiler and coal house; And install one, 1,000 horse power Cross Compound Engine, and two, 1,000 horse power boilers – all ready for operation If it is found impracticable to locate the dam at the site aforesaid, we will then erect a dam at some other location – to be mutually agreed upon between us and ourselves. Such dam to be of such height as to develop water power under a head of fifty five feet when the dam is free to its crest; in this event we will Construct a suitable power house, engine and boiler house and install the machinery above mentioned at the location so chosen. Immediately upon their completion we will turn over to your City for its operation, all of the above mentioned appliances, together with exclusive right – to use or sell, the entire water power developed by said dam You shall have the right to install from time to time, such additional machinery as you may find necessary for utilizing the entire power so developed We will maintain the dam, forebay and headgates --- Page break --- 496 So Constructed by us for a period of forty years from the time of their Completion. at the end of forty years from the Completion of the dam and appliances, we will turn the same over and surrender them to the City of Austin as its absolute property. The foregoing is made upon the following Conditions: That the City furnish us with all the plans, specifications, maps, drawings and engineering reports now in its possession relating to the Construction or operation of the old dam That it will turn over to us without expense, all material in the old dam and all machinery now in the power house at the dam. That it will furnish us free of rent during the period of Construction, the right to occupy such City property as may be necessary for the work of Construction. That in the event of the location of the dam at some new point, the City furnish the land necessary for its Construction and equipment, together with adequate overflow rights. That the City, at its own expense, will maintain all buildings, machinery and appliances which is turned over to it, aside from the dam, fire bay and head gates. That the City pay us for use of water power developed by such dam during a period of forty years from the time of its Completion, all taxes and assessments which may be levied against the dam and such property, together with One hundred Thousand dollars a year, payable in equal quarterly installments. The foregoing is, of course, a brief outline of the proposal. If it commends itself to you, the details will necessarily be worked out and embodied in the formal Contract to be executed between us. Respectfully Submitted Consolidated Construction Co by U.S.K. Briggs. Alderman Raynes moved that the proposition be referred to Committee of 8. Council, 5 Citizens and the Mayor, City Attorney and three Alderman. Alderman Elmoore offered the following as a substitute to the motion of Alderman Raynes Be it resolved by the City Council of the City of Austin That the proposition of the Consolidated Construction Co to rebuild the dam be referred to a Committee composed of Three members of the Council, the Mayor, City Attorney and three Citizens and that the proposition be published in Saturdays Statesman, Sundays Statesman, --- Page break --- Tribune, Advertiser, and Mondays Statesman and Tribune. The substitute was lost by the following vote Yeas Aldermen Mackin Moore + Von Rosenberg 3 Nays Aldermen Armstrong, Crooker, Eumes, Haynes, Miller Petri, Redd, Smith & Wiehelm 9 Alderman Eumes moved to amend the motion of Alderman Haynes by adding "the Water & Light Commissions" Alderman Haynes accepted the amendment, and the motion as amended was passed by the following vote Yeas Aldermen Armstrong, Crooker, Eumes, Haynes, Miller, Moore, Petri, Redd, Smith, Von Rosenberg & Wiehelm 11 Nays Alderman Macken 1 The Mayor appointed Aldermen Haynes, Crooker & Smith as the Committee on the part of the Council, and Messrs H.A. Moe & J.E. Eilers and A. L. Goetz as the Citizens Committee On motion the Council adjourned Jno. A. Johnson City Clerk
