Regular meeting of the City Council 505 Austin, Texas, April 16, 1906 Hon. W. D. Shelley, Mayor, presiding Roll Called Present Aldermen Grooker, Gunes, Gaynes, Willen, Moore Cain, Powell, Redd, Shumate, Smith, Von Rosenberg, Wilson 12 Absent Aldermen Armstrong, Macken 2 On motion the minutes were approved as recorded by the Clerk, without reading Petitions, memorials, etc. Petitions etc. The Mayor laid before the Council, a communication from D. W. Posey, attorney for Mrs. Gallatin Cornall H. S. in re Posey for regarding, proposition for building the dam, which was read. Alderman Shumate moved to refer the communication to the Special Committee on the Dam, heretofore appointed Alderman Willen moved as a substitute that it be referred to a Special Committee of 3. To see Mess. Posey and and obtain a more definite proposition Death of Mrs. J. C. R. The Mayor notified the Council that he had just been Alderman Macken informed of the death of Mrs Macken, Mother of Alderman Joe. Macken. Alderman Shumate offered the following resolution, which was unanimously adopted by a rising vote. Be it resolved by the City Council of the City of Austin: That the sincere Condolances of this Body be extended to Alderman Joe Macken, in his sad bereavement in the loss of his Father; and That when the Council adjourns tonight it adjourn out of respect to Alderman Macken and his family, in their great affliction Alderman Shumate moved that the Council attend the funeral of Mrs Macken as a body, which motion prevailed Carrolee, Communication The motion of Alderman Willen to refer the referred. communication of Mess. Carroll & Co. regarding the dam be referred to a Special Committee of 3, was then adopted, and the chair appointed Aldermen Willen, Smith & Gunes as such Committee Alderman Moore moved to reconsider the vote by which the Motion of Alderman Willen was adopted Alderman Von Rosenberg moved to adjourn, which motion was lost on the following vote Yeas Aldermen Gunes, Moore, Von Rosenberg 3 Nays Aldermen Groover, Gaynes, Willen, Cain, Powell, Redd, Shumate, Smith & Wilson 9 Alderman Groover moved that the whole matter lay over waiting the report of the Special Committee, which motion prevailed.

506 Mrs Von Karlow Alderman Crocker presented a Communication from House Fire Park. Miss Von Karlow, asking the use of Peace Park Pavillion for dancing purposes. The communication was read and on motion the Clerk was directed to inform Miss Von Karlow that the Council was without authority to grant the request, which motion prevailed. Alderman Powell moved to suspend the regular Policeman E.D. Caswell order of business, and take up the resignation of Resignation Policeman E.D. Caswell, which motion prevailed. The Chair then laid before the Council a communication from E.D. Caswell, tendering to the Council his resignation as a Policeman, On motion the resignation was accepted. Marshal to Nominate Alderman Powell moved that the Marshal be Policeman requested to submit the name of some person as Policeman to fill the Vacancy caused by the resignation of Wm Caswell- which motion prevailed The Chair appointed Alderman Powell Wilhelm and Von Rosenberg as TellersE.B. Falwell The Marshal presented the name of E.B. Falwell for Elected Policeman confirmation as Policeman to fill the Vacancy caused by the resignation of C.D. CaswellThe tellers announced the following as the result of the Ballot. Viz. For Confirmation 12 Votes. The Chair announced that E.B. Falwell was duly elected a PolicemanRoberts Hawley P. Cms. Reports of Standing Committees. Street. To open E. West Alderman Smith for the Street Committee to whom was referred a petition from Citizens to open East 4th Street from Orion Street East, presented a report recommending that the petition be granted. On motion the report was adopted. Finance Officer reports Alderman Haynes for the Finance Committee to whom was referred the reports of the Assessor & Collector, the Treasurer and the Clerk for the Month of February 1906, presented a report stating that they had examined and checked same and found them Correct, On motion the report was adopted. Fire on West Austin Alderman Von Rosenberg for the Fire Committee Hall. made a Verbal report stating that the lot which had been transferred to the City by the West Austin Fire Co on which to build a Hall, had been found to be unfit for the purpose, and that the Company were negotiating for a suitable lot on which to place their building. St. Comm. for Alderman Powell for the Park Committee to whom was referred the reports of the Marshal for the Month of March 1906, presented a report stating that they had

been examined and found Correct On motion the report of the Committee was adopted. Report of Special Committee A C. Haynes for the Special Dam Committee presented the following report. Austin, Texas, April 14th 1906 To the Hon Mayor and City Council, of the City of Austin Gentlemen, Your Special Committee, appointed to For your consideration the Consolidated Construction Company of New York, to erect a dam and Power house, to fully equip same and to maintain the power thereon for a period of 40 years, for an annual payment of $100.000 ºº per Annum, the City to have entire Control of the plant, the lake and all appurtenances connected therewith, I have the honor to report that after several meetings, the subject having been fully and freely discussed from every stand point, the Committee being divided as to the advisability of recommending the acceptance or rejection of the proposition, and having in the mean time received an amended proposition from the Construction Company eliminating the machinery for the Power House and agreed to accept the payment for $90.000 ºº per Annum for the same period. Your Committee by a unanimous Vote resolved to recommend that the proposition be left with the people to accept or reject, at an election to be held on the 26th Inst. And tax payers and all water and light takers to be allowed to Vote At a later meeting Your Committee, appointed a Sub Committee composed of Messrs L.M. Oppenheimer, L S Burney, A L Both, W. A Hart and K. A. Hroe, to prepare a counter proposition, such counter proposition to be submitted to the Consolidated Construction Company and afterwards to the Council. The report of the Sub Committee, in the shape of the Amended Proposition prepared by them, is herewith submitted to your Honorable body, and in this connection I have to report that in reply to a telegram it is understood that the Consolidated Company have declined to make any change in the last proposition made by them, which is to construct the dam and Power house, to maintain the work and to guarantee a 65 foot head of water for a period of 50 years, for an annual payment of $80.000 ºº per annum. 508 Alderman Crooker received the report of the special Dam Committee he laid over until the next regular meeting of the Council, or at a special meeting called for that purpose, which motion prevailed. Alderman Crooker moved that the communication from Alderman Carroll to regarding the Dam, be referred to the special Dam Committee, which motion prevailed. Unfinished Business Plumbing ordinance The Chair laid before the Council the ordinance. "An ordinance regulating the plumbing and drainage of buildings." which on motion was then made to suspend the rule and place it on its second and third readings and final passage, and a motion was then made that the ordinance be read by its title, which was done, and the question was taken on its passage, and the ordinance was passed by the following vote. Yeas Alderman Crooker Wilken Moore Peters Shimate Frisbie Von Rosenberg 8 Nays Alderman Cuneo Haynes Rudd Wilhelm 4 Gravel for speedways The Chair laid before the Council an ordinance appropriating Hyde Park the sum of $450.ºº for the purpose of graveling the Speedway and Second Street in Hyde Park. The ordinance was read the first time. Alderman Moore moved to amend the ordinance by striking out in the caption and body of the ordinance the words "Four hundred fifty" and insert in lieu thereof the words "Three hundred fifty", also strike out in the caption and body of the ordinance the words "Second street in Hyde Park" and also by adding "that the graveling be done first at or near the bridge on Speedway." The amendments were adopted by the following vote Yeas Alderman Crooker Wilken Moore Peters Powell Frisbie Smith Von Rosenberg 8 Nays Alderman Cuneo Haynes Rudd & Wilhelm 4 A motion was then made to suspend the rule and place the ordinance on its third reading and final passage, which motion was lost by the following Vote Yeas Alderman Crooker Wilken Moore Peters Shimate Frisbie Von Rosenberg 6 Nays Alderman Cuneo Haynes Powell Redd & Wilhelm 7 $75.ºº to employ an The Chair laid before the Council an ordinance appropriating Engineer the sum of $75.ºº for the purpose of employing an Assistant to the Engineer for one month. The ordinance was read the second time and a motion made to suspend the rule and place it on its third reading and final passage, which was lost by the following Vote Yeas Alderman Crooker Cuneo Moore Patrich Smith and Von Rosenberg 6 Nays Alderman Haynes Wilken Powell Rudd Shimate & Wilhelm 6 New Business Frank Pressee as San- On motion of Alderman Moore, the name of itary Inspector. Colorado Bridge Be it resolved by the City Council of the City of Austin that the Street Committee of the City Council of the City of Austin be and they are hereby requested to immediately take up the matter of the repair of the river bridge with the County Commissioners of Travis County, Texas, and report at the next meeting of this Council.
Alderman Powell offered the following resolution which was read and adopted Whereas on the day of March 1906, the West Austin Mayor instructed to deed Lot nº Block nº "110" of Austin to the West Austin Fire Co. City of Austin for the purpose of erecting a fire hall thereon" and Whereas upon investigation it was found that said lot was not a fit and proper place for the erection of said building Now therefore be it resolved by the City Council of the City of Austin that the Mayor be and he is hereby instructed to re-deed said Lot to said West Austin Fire Company. As presiding officer of the City Council, I wish to present through you, to the Council, the following facts! City R. R. Co. for This Company is desirous of extending its line of railway permission to into South Austin. I take it that it would be Cross River on advisable to secure the permission of the City Council County Bridge and of the Commissioners, to cross the Colorado River Bridge, on Congress Ave. If we secure this permission from both these bodies, our intention is to build a double track across the bridge, going in both directions exactly as wagons and other teams now do. There is ample room between the trusses for a car and a wagon to pass, as the clearance is 18 feet. I shall be pleased to have you take up at your very early convenience with the Council If you wish me to appear before them and explain the matter, during the session in which you wish to bring this up, I will endeavor to be there if you will notify me awaiting your early reply I am, Yours Truly [illegible] President

510 Automobile ordinance. The ordinance was read the first time and on motion was referred to the ordinance Committee, with instruction to report at the next regular meeting of the Council. WW Calloway for By Alderman Willen petition of Water trough on asking the location of a water trough at the junction of Congress Ave South of St. San Antonio and Fredricksburg roads on South Austin Artriage Road and on Motion referred to the water fight Committee Alderman Ounea offered the following resolution which was read and adopted as follows Extra Labor Teams. By Alderman Smith An ordinance appropriating the sum of $350.oo for the purpose of employing extra street labor teams – The ordinance was read the first time and passed under suspension of the rules by the following vote Yeas Alderman Crooker Ounea Haynes Miller Moore Petri Powell Radd Shumate Smith Von Rosenberg Weideman 12 Nays none Gravel Speedway Alderman Powell moved to reconsider the Vote by which the Council refused to suspend the rule and place on its Third reading the ordinance appropriating the sum of $350.oo to gravel the Speedway, which motion prevailed A motion was then made to suspend the rule and place the ordinance on its third reading, and final passage, which Motion was lost by the following Vote Yeas Alderman Crooker Ounea Miller Moore Petri Powell Shumate Smith Von Rosenberg 9 Nays Alderman Haynes Radd Weideman 3 Extra Pay to P. Peyton By Alderman Smith an ordinance appropriating the sum of $40.oo for the purpose of paying P.Peyton Guardian of prisoners for the months of March & April 1906 The ordinance was read the first time and passed under Suspension of the rules by the following Vote Yeas Alderman Crooker Ounea Haynes Miller Moore Petri Powell Radd Shumate Smith Von Rosenberg Weideman 12 Nays none Water Lease Not to Alderman Ounea offered the following resolution Close to 5th St. which was read and adopted Resolved that the City Clerk and the City Engineer be instructed to Notify Miss Close or her representatives not to close what is called the old Mill road and leading to the Colorado River until the Street Committee can make an investigation of this matter and report facts to the City Council for their consideration and that the Street Committee be instructed to report back to the Council at its next regular meeting Invitation to attend The chair said before the Council an invitation from Mr. Hick annual celebration to attend annual celebration, which was on motion accepted On motion the Council adjourned J.G. April 19, 1906. This Call is for the purpose of making such appropriations as may be necessary to defray the expense of a Committee appointed by a General Committee of the City Council looking to the sale and settlement of certain bonds and other bond matters of the City of Austin, and to make appropriation for Costs in Court of Civil appeals Your presence is respectfully requested, as this matter is of great importance to the City's interest Respectfully, W.D. Ordinance appropriating expenses of Committee
of the provisions of the charter, Alderman Shumate, the City Attorney, and the City Treasurer, be appointed to Visit St Louis and other Cities in deemed as advisable, for the a Sale of certain bonds of the City, which was unanimously Alderman Haynes then offered an ordinance appropriating the sum of $500.00 to pay the necessary expenses of the Special Committee just constituted The ordinance was read the first time and passed under Suspension of the rules by the following 7 ayes – ayes Alderman Crooker, Quince, Haynes, Klellen, Moore, Clem Powell, Fred, Shumate, Smith, Monroe, Reed nay none.
