Regular meeting of the City Council Austin, Texas, June 18, 1906 Hon. W. D. Shelley, Mayor, presiding Roll Called: Present: Aldermen Crooker, Duncan, Haynes, Muelker, Moore, Petri, Powell, Smith, Von Rosenburg, & Wilhelm 10 Absent: Aldermen Armstrong, Macker, Redd & Shurmate 4 On motion the minutes were approved as recorded by the Clerk without reading. Petitions, Memorials etc. Petitions etc. By Alderman Petri, Petition of the St. L. & S. F. R. R. Company St. L. & S. F. R. R. to close for permission to close passageway under bridge 703 & 704. Passageway Alderman Macker, seconded by Alderman Crooker, Alderman Moore moved to refer the petition of the St. L. & S. F. R. R. Co. to the Street Committee, which motion prevailed by the following Vote: Yeas: Aldermen Crooker, Macker, Muelker, Moore, Petri, Powell, Von Rosenburg, & Wilhelm 8 Nays: Aldermen Duncan, Haynes, Redd & Smith 4 Ellis Monroe By Alderman Haynes, Petition of Ellis Monroe, to to remit fine remit fine in Mayors Court. Read and a motion made to grant the petition, which motion was lost by the following Vote: Yeas: Aldermen Haynes, Moore, Petri & Smith 4 Nays: Aldermen Crooker, Duncan, Macker, Muelker, Powell, Redd, Von Rosenburg & Wilhelm. 8 Reports of City Officers Reports City The Mayor laid before the Council the reports of the Assessor Officers & Collector, & the Treasurer for the month of May 1906, which were referred to their appropriate Committees without reading. Standing Coms. Reports of Standing Committees Alderman Petri for the Claims & accounts Committee to Eva. J. Shaparo whom was referred the petition of J. Shaparo to remit Pound fees certain pound fees paid by him, presented a report recommending that the petition be granted, On motion was referred and adopted. Alderman Wilhelm for the Cemetery Committee to Cemetery Com. whom was referred an ordinance to authorize the City Recommendation to of Austin to purchase a Cemetery, presented purchase lots a report recommending that the ordinance be passed and recommending that the City of Austin purchase from the Said Association, 200 of the 400 fees or lot from the said Association 200 of the fees or lot the lots owing by said Association. The report was read and adopted. Street Ordinance Alderman Smith for the Street Committee to whom Bridge Waller was referred an ordinance appropriating $7000 to build Creek a bridge across Waller Creek, presented a report.

536 recommending the passage of the ordinance. On motion the report was laid over to come up under the head of unfinished business. Special order for Geo. Washington Alderman Moore for the special Committee appointed to investigate the Sanitary Condition of Geo. Washington, presented a report stating that they had carefully examined same and recommending that said pen be removed from the City. On motion the report was adopted. Ordinances on Corporation Court or ordinance Alderman Quines for the ordinance Committee to whom was referred an ordinance establishing a Corporation Court for the City of Austin, presented a report recommending the passage of the ordinance, with Certain Amendments. The report was read and on motion laid over to come up with the ordinance under the head of unfinished business. Special Austin Ice Company to lay pipes Alderman Whaken for a majority of the special Committee to whom was referred the petition of the Austin Ice Company for permission to lay pipes in the street, presented a report recommending that the petition be granted. Alderman Haynes for a minority of said Committee presented a report, recommending that the petition be not granted. Both reports were read. Alderman Mori moved that the petition with both reports be referred to the Water Light Commission, which motion prevailed by the following vote: Yeas Aldermen Grovener, Haynes, Miller, Petri, Powell Stoddard, Von Rosenberg & Wilhelm 8 Nays Aldermen Quines, Whaken, Moore & Smith 4 Unfinished business. Plumbing ordinances Alderman Von Rosenberg called up the Plumbing ordinance which had heretofore been laid on the table subject to call. Alderman Moore moved that it be referred to the ordinance Committee, which motion was lost by the following Vote Yeas Aldermen Whaken, Miller, Moore, Petri, Stoddard 5 Nays Aldermen Grovener, Quines, Haynes, Powell, Smith, Von Rosenberg & Wilhelm 7 The ordinance was then passed by the following vote Yeas Aldermen Grovener, Quines, Haynes, Moore, Miller, Powell, Stoddard, Smith, Von Rosenberg & Wilhelm 10 Nays Aldermen Moore & Petri 2 Corporation Court The Mayor laid before the Council the ordinance to or ordinance establish a Corporation Court for the City of Austin, together with the report of the ordinance Committee submitting certain amendments. On motion Alderman Grovener the report of the Committee was adopted.

Bridge across The Mayor laid before the Council an ordinance appropriating Waller Creek the sum of $750.00 for the purpose of building a bridge across Waller Creek. The ordinance was passed under suspension of the rules by the following vote Yeas Aldermen Crooker, Dumes, Haynes, Wacker, Miller, Moore Petri, Powell, Redd, Smith, Von Rosenberg & Wilhelm 12
G.O. Brown for The Mayor laid before the Council an ordinance appropriating Asphalt the sum of $250.00 for the purpose of paying G.O. Brown for asphalt for [illegible] a car [illegible] freight in Steam Roller The ordinance was read the third time and passed by the following Vote Yeas Aldermen Crooker, Dumes, Haynes, Wacker, Miller, Petri, Powell, Redd, Smith, Von Rosenberg & Wilhelm 11 Nays Alderman Moore 1
Amending The Mayor laid before the Council an ordinance Amending Ordinance the [illegible] Ordinance. The ordinance was read the first time. Alderman Moore moved to lay it on the table, which motion was lost by the following Vote Yeas Aldermen Dumes, Haynes, Moore, Petri & Wilhelm 5 Nays Aldermen Crooker, Wacker, Miller, Powell, Redd Smith, Von Rosenberg 7 A motion was then made to suspend the rule and place the ordinance on its third reading, which motion was lost by the following Vote Yeas Aldermen Crooker, Wacker, Miller, Redd, Smith 5 Nays Aldermen Dumes, Haynes, Moore, Petri, Powell, Von Rosenberg & Wilhelm 7
New Business New Business Alderman Von Rosenberg presented a proposition from the American Dist. American District Telegraph Co. to abolish and put in a Tel. Co. give Five Alarm system for the City of Austin, which was read Alarm system [illegible] Parker was invited to address the Council and explain the proposition. Alderman Crooker moved that the proposition be referred to the Fire Committee, which motion prevailed
W.T. & Tel. Co. By Alderman Dumes An ordinance to authorize the Conduits Western Telegraph and Telephone Company to construct under ground conduits etc. The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Crooker, Dumes, Haynes, Wacker, Miller, Moore

538 Petri Powell Redd & Smith Von Rosenberg & Wilhelm 12 Nays None Vacancy in City By Alderman Smith an ordinance providing for filling Officials how Filled Vacancies for City officers. The ordinance was read the first time and passed under Suspension of the rules by the following Vote Yeas Aldermen Crooker, Cuneo, Haynes, Meachem, Miller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg & Wilhelm 12 Nays None The Mayor laid before the Council the following Communication Austin, Texas, July 18th 1900 To the Mayor and City Council Austin, Texas Sirs: Resignation of City I hereby tender my resignation as City Physician of Physician Joe Gilbert Austin to take effect immediately. Allow me to express my thanks to you for the support you have given me since my election. Yours respectfully Joe Gilbert. On motion the resignation was accepted. Alderman Haynes moved that the Council now proceed to the election of a City Physician to fill the unexpired term of Dr Gilbert. Which motion prevailed. Alderman Haynes nominated Dr J.M. Loving Alderman Moore nominated Dr R.S. Graves The Mayor appointed Aldermen Haynes Powell and Cuneo as Tellers. The Tellers announced the following as the result of the first ballot. J.M. Loving Dr J.M. Loving 5 Votes. Dr R.S. Graves 6 Votes, one ballot elected City Physician had the names of both Dr Loving and Graves on it. over R.S. Graves The Mayor declared Dr Graves elected. The question was raised that there had been twelve ballots cast and that six Votes did not Constitute a majority. The Mayor then ordered another ballot. The Tellers announced the following as the result of the second ballot. Dr J.M. Loving Seven Votes Dr R.S. Graves five Votes The Mayor declared Dr J.M. Loving duly elected to serve as City Physician until the next general election. The Mayor submitted to the Council for Confirmation as Board of Equalization the Board of Equalization for the ensuing term the & Marcuse names of Henry on Louis Marcuse Alex Gardner and Alex Gardner Fred A. Heath. The nominations were Confirmed by F.A. Heath. the following Vote: Yeas Marcuse 10 Votes, Gardner 9 Votes, and Heath 8 Votes.

539 Alderman Macken Alderman Macken tendered his resignation as tendered resignation Alderman from the 4th Ward. as alderman On motion the Council refused to accept the resignation by a Vote of 3 ayes to 8 nays – Alderman Macken not Voting On motion Alderman Macken was excused from further attendance at this session of the Council By Alderman Smith An ordinance appropriating the sum of $400.⁰⁰ for the purpose of paying for extra street labor Ex. at labor & team & teams. The ordinance was read the first time and on motion the rule was suspended and the ordinance read on its second reading by the following Vote Yeas Aldermen Crooker, Aunes, Haynes, Weller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Wilhelm 11 Nays None. The ordinance was read the second time, Alderman Redd moved to Amend same by striking out in the caption & body of the ordinance $400.⁰⁰ and inserting in lieu thereof $401.⁰⁰ which Motion prevailed The ordinance was then passed under suspension of the rules by the following Vote Yeas Aldermen Crooker, Aunes, Haynes, Weller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Wilhelm 11 Nays None. Interest on By Alderman Haynes An ordinance appropriating Refunding Bonds the sum of $19,252.54 for the purpose of paying Interest due July 1st 1906, on Refunding bonds of the City. The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Crooker, Aunes, Haynes, Weller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Wilhelm 11 Nays None. Interest on Water By Alderman Haynes An ordinance appropriating the bonds. sum of $4000.⁰⁰ for the purpose of paying the Interest due July 1st 1906, on $320.000.⁰⁰ of Water Light bonds The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Crooker, Aunes, Haynes, Weller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Wilhelm 11 Nays None. The ordinance was read the first time, and a motion was made to suspend the rule and place it on its second reading, which motion was lost by the following vote Yeas Aldermen Crookes, Guay, Haynes, Wilson Petri, Powell Smith, Von Rorehberg & Wichelson 9 Nays Aldermen Moore, Redd 2 Alderman Smith presented the following, Austin, Texas, June 15th 1906 To the Hon Mayor W. D. Shelley & Board of Aldermen of the City Council Gentlemen: We, the undersigned, have been Austin street instructed by the street Paving Committee to present to paving your honorable body the following resolution, which was adopted by said Street Paving Committee at a Meeting held June 15th 1906, at the office of the City Attorney. "Resolved that the Street Paving Committee recommend to the City Council of the City of Austin - that the City Attorney be instructed to bring suit against Oliver C. Read and adopted Alderman Redd moved to reconsider the vote Purchase of Cemetery by which the Council refused to suspend the rule lots, and place on its second reading an ordinance appropriating the sum of $5000. for the purpose of purchasing Cemetery lots from the Austin Cemetery Association which motion prevailed The ordinance was then passed under suspension of the rules by the following vote Yeas Aldermen Crookes, Guay, Haynes, Wilson, Moore, Petri Powell Redd & Smith, Von Rorehberg & Wichelson 11 Nays none Alderman Guay offered the following resolution, which was read and adopted Frank Creese Be it resolved by the City Council of the City of Austin that placed on City the name of Frank Creese be placed on the rolls of Pay Roll the Cemetery Department and that his salary be fixed at the sum of fifty dollars per month The resolution was adopted by the following vote Yeas Aldermen Crookes, Guay, Haynes, Wilson, Moore Petri, Powell, Redd, Smith, Von Rorehberg & Wichelson 11 Nays none

Resolution regarding Condition of City Hall etc
Alderman Raynes offered the following resolution Whereas! The leaky condition of the roof of the City Hall demands attention, and the general dilapidated condition of the Council Chamber and offices of the City Clerk is a disgrace to the City, and, Whereas! The building is a very substantial Stone structure, which, it is thought by many of our Citizens, can be enlarged and converted into a handsome Modern building, sufficient for all needs of the City for years to come, and at a moderate cost Therefore be it resolved, by the City Council of the City of Geneva, that the Committee on Markets be and are hereby instructed to advertise for plans and specifications and bids for modernizing and Converting the present City Hall into a three story building, an additional story to be made on the Ground Floor and to contain offices of the Mayor and City Marshal, the Courtroom, with Prison Cells attached, the present Council Chamber to be enlarged by the removal of the Prison cells and raising of the roof sufficient to allow a Visitors Gallery, offices of the City Clerk and City Engineers to remain on said floor, The entire building to be thoroughly remodeled with new floors, ceilings, windows and doors, and to be faced with all necessary lavatories, the outside coated to be stuccoed in cement and laid off in blocks, the front to be ornamented with terra Cotta trimmings and to have observatory, tower and Colonial Gallery! The plans to include any stairways, bids to be advertised for on such general lines as may seem best to the Committee, and to be opened in the presence of the Council, the Council reserving the right to reject any and all bids Alderman Moone moved to table the resolution which was lost by the following vote Yeas Aldermen Crooker Aines Fuller Moone Reed 5 Nays Aldermen Haynes Petri Powell Smith Von Rosenberg Kirchhofer 6 Alderman Haynes moved to adopt the resolution which motion was lost by the following vote Yeas Aldermen Haynes Petri Smith Von Rosenberg Kirchhofer 5 Nays Aldermen Crooker Aines Fuller Moone Porcell Reed 6 On motion the Council adjourned J M Folger City Clerk
