Petitions etc. Petitions, Memorials etc. J. Eckhart - pound fees By Aldermen Smith - Petition of J. C. Eckhart to refund pound fees paid by him, Read and on motion referred to the Committee on Claims & accounts.
C. P. Randolph to extend By Aldermen VonRosenburg - Petition of C. P. Randolph City Limits for school for to extend Corporate limits for school purposes, for to purposes. include a portion of his property - Read and on motion referred to the ordinance Committee.
Sanitary inspection The Mayor laid before the Council a communication slaughter houses in from Sanitary Inspector Russell, regarding slaughter houses City limits in the City limits - which was Read and on motion referred to the Committee on Sanitation & Sewerage.
Citizens to open By Aldermen Moore - Petition of Citizens asking that Navasota St. Navasota Street be opened from 12th St to the Creek Read and on motion referred to the Street Committee.
Drains work By Aldermen Crocken - Petition of Mrs. Ainsworth to to correct assessment correct assessment. Read and on motion referred to the Committee on Claims & accounts.
Decorating Com. for The Mayor laid before the Council a communication from permission to tear up the Decorating Committee asking permission to decorate pavement. over a Arch on Congress Avenue during the Street and also for permission to erect a erect an Arch on Congress Avenue at the intersection of 12th Street. On motion the request was granted, except that the pavement on Congress Avenue shall not be disturbed by any Arch.
Citizens for Bridge By Aldermen Petri - Petition of Citizens asking that a @ 12th St. wagon bridge be built over Waller Creek at 12th Street. Read and referred to the Street Committee.
Reports City officers. Reports of City officers. The Mayor laid before the Council the reports of the Treasurer, the Clerk, the Physician, the Engineer, the Collector, for the month of June 1906 which were on motion referred to the several committees without reading.
Standing Com. Reports of Standing Committee Street, H. G. & R. R. to Aldermen Smith from the Street Committee, to whom Close passage way was referred the Petition of the H. G. & R. R. for permission to close passage way under bridge, presented a report recommending that the petition be granted on condition

543 Finance Reports by officers named in the report. On motion the report was adopted. Alderman Haynes for the Finance Committee to whom was referred the reports of the Assessor & Collector & City Clerk, for the month of May 1906. Presented a report stating that they had been examined & checked & found correct. The report was read and adopted. Purchasing Com Purchase Contracts Alderman Von Rosenberg for the Committee on purchases presented a report stating that they had advertised for and received bids for supplies, etc, for the City for the term ending Dec 31st 1906, and recommending the acceptance of bids mentioned in said report. On motion the report was adopted and the Mayor authorized to enter into Contracts with the parties mentioned in said report. Unfinished Unfinished business Corporation Court The Mayor laid before the Council an ordinance establishing a Corporation Court etc, for the City of Austin. The ordinance was read the third time and passed by the following Vote Yeas Aldermen Crooker, Ernest, Haynes, Moore, Petri, Powell Von Rosenberg, Wilhelm 8 Nays Alderman Armstrong, Miller, Redd & Smith 4 Alderman Petri moved that the Council now proceed to the election of a City Recorder, Alderman Redd moved that action be postponed until the next regular meeting of the Council, which motion was lost by the following Vote Yeas Aldermen Armstrong, Green, Miller, Redd & Smith 4 Nays Aldermen Crooker, Haynes, Moore, Petri, Powell, Redd Von Rosenberg, Wilhelm 8 Alderman Moore renewed the motion to proceed to the election of a City Recorder, which motion prevailed. The Mayor appointed Aldermen Moore, Powell & Haynes as tellers. Alderman Powell nominated Fred Carleton Alderman Moore nominated Judge Stuart Alderman Wilhelm nominated Von Rosenberg Jr The tellers announced the following as the result of the first ballot Viz: Von Rosenberg Jr 8 votes Fred Carleton 4 " Mrs Von Rosenberg Jr Judge Stuart 4 " Elected Recorder Mrs Von Rosenberg Jr having received a majority of all the Votes Cast, the Mayor declared him duly elected as City Recorder for the term ending April 1907. Amending ordinance The Mayor laid before the Council an ordinance amending the awning ordinance. The ordinance was read the first time. Alderman Haynes moved to lay the ordinance on the table which motion prevailed by the following Vote Yeas Aldermen Armstrong, Crooker, Haynes, Moore, Petri Powell & Wilhelm 7

544 Nays Aldermen Crooker Willen Redd & Smith. Yeas Aldermen 5 That Mayor laid before the Council the following Veto Message Austin, Texas, June 28th 1900 To the City Council Mayors Veto Gentlemen:- I return herewith, without my approval, Plumbing ordinance an ordinance seeking to repeal an ordinance entitled "An ordinance providing for and regulating the tapping of sewers and Cesspools, Creating a board for the examination of plumbers to be known as the Examining and Supervising Board of Plumbers, Creating the office of Inspector of Plumbers, providing for the examination and licensing of plumbers, providing how sewer connections shall be made, providing for the obtaining of permits to make sewer connections and repairs, and providing the manner and means of making connections, and providing the duties of plumbing inspector and his Salary, the fees for inspection, and providing penalties for the violation of this ordinance", for the following Reasons. First, The state law requires all cities and towns, having a population of Ten thousand inhabitants, to provide by ordinance for regulating the tapping of sewers and Cesspools, regulating house drainage and plumbing, creating a board for the examination of plumbers, &c Second, The ordinance sought to be repealed has, I am advised by the examining and supervising Board of Plumbers (with but few exceptions given entire Satisfaction (See communication of the Board here with attached) Third, The approval of the repealing ordinance would leave the city without supervision of house drainage, tapping of sewers, cesspools, etc. which would, in my opinion, result in serious, if not fatal, injury to the health of the community. Fourth, The ordinance may, in many respects, be illegal and not enforceable in the Courts, but such illegal or objectionable features can be corrected or amended without repealing or impairing the entire ordinance. Alderman Crooker moved to reconsider the vote by which the ordinance was passed, which motion prevailed. Alderman Cupp moved that the ordinance do now pass Not withstanding the Mayor's objection, which motion was lost by the following vote: Yeas Alderman Crooker Ames Powell Redd Smith Von Rosenberg & Wilhelm. 545 Alderman Haynes moved to adopt the report of the minority of the special Committee of the Council, which recommended that the petition be not granted, which motion prevailed. New Business The Mayor laid before the Council a communication from L. E. Loden, resigning his position as Policeman On motion the resignation was accepted. Alderman Worrels submitted the name of J. A. J. A. Ooley Confirmed Ooley for Confirmation as Policeman the nomination Policeman was Confirmed. Alderman Woolley submitted the name of J. A. Richardson J. A. Richardson for Confirmation as City Attorney Confirmed City to represent the City in the Corporation Court Attorney On motion the nomination was Confirmed. Alderman Redd nominated Gus Browne for Corporation G. W. Browne made Court Clerk, and he was unanimously elected. Clerk Corporation Alderman Moore offered the following resolution Court Be it resolved by the City Council of the City of Austin That as the H & T C R. R. Co. has removed its Car shops and H. & T. C. R. R. Co. round house from Atayac Street and whereas said desired to grade Company has left said street between the H & T C Street R. R. in impassible condition for Vehicles that the City Attorney and City Engineer be hereby instructed to order said Atayac Street graded by said H & T C R. R. Co. and maintained in such condition that Vehicles may pass over same in safety from H & T C R R. On motion of Alderman Porwell the resolution was referred to the street Committee. Alderman Haynes offered the following resolution which was read and adopted Be it resolved by the City Council; Mayor & Finance That the Mayor, Council and the City Treasurer be and they Committee authorized are hereby authorized to purchase for the Sinking fund to purchase bonds of Water & Light bonds of the City. Such bonds to be for sinking fund $17.971.58. will buy, and when purchased, said bonds to be deposited with the Treasurer to the Credit of the Sinking fund for Water & Light bonds. Be it further resolved, that as there is now on the Sinking fund of bonds issued prior to May 1890, $18.500.00. of X bonds of the City of Austin, and as there are no bonds outstanding for issued, that the Treasurer be and he is hereby directed to transfer from the Sinking fund for Water and Light bonds, the said $18.500.00 to paid and Close the Sinking fund account until issued. Mon May 1890. Alderman Haynes from the Finance Committee offered the following resolution which was read and adopted.

546 Be it resolved by the City Council of the City of Austin: City Treasurer That the City Treasurer of the City of Austin, be and he is hereby directed to open new accounts and directed to open two new funds to be designated accounts and to close as "Interest Fund Water Light bonds", and "Interest Fund." certain other accounts Refunding bonds". That the said Treasurer is further instructed to put in the sinking fund for Water and Light bonds, all moneys that may be collected on account of Interest and Sinking fund collected on taxes for 1904, and all prior years; and that the Collector is directed to make all deposits accordingly. That all funds for which taxes are levied in the respective funds, from loans are made, and all funds now in the Interest Sinking fund 1904 account, are to remain in said fund to be drawn out on appropriations regularly made by the Council to pay interest and interest for the sinking fund, respectively, as the Council may thereafter, decide. That the funds known as "Bonded Indebtedness", "Interest prior to 1890," and "Interest and sinking fund 1904" be and the same are directed to be closed.

Contractor for placing Street Signs requested to correct name. Be it resolved by the City Council that the Contractor for placing names on all streets be requested to correct the name of Wellen Street, or any other Street which has been mispelled. By Aldermen Smith an ordinance appropriating the sum of $100 for the purpose of paying for extra Street labor. The ordinance was read the first time passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Crooker, Elmest, Haynes, Miller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg Wilhelm nays none.
To pay for City maps By alderman Powell an ordinance appropriating the sum of $30.00 for the purpose of having prints of new map made. The ordinance was read the first time and passed by the following Vote Yeas Aldermen Armstrong, Crooker, Elmest, Haynes Miller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg Wilhelm nays none.
Is a Peyton for extra Services By Alderman Smith an ordinance appropriating the sum of $60.00 for the purpose of paying Ed Peyton for extra services & guarding prisoners. The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Crooker, Elmest, Haynes, Miller, Moore, Petri, Powell, Redd, Smith Von Rosenberg, Wilhelm nays none.

By Alderman Cetri An ordinance appropriating the Sum of $100.00 for the purpose of building a suitable approach to the entrance to west Austin Fire Hall. The Ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Alderman Armstrong, Droken, Comer, Haynes, [illegible] [illegible], Moore, Petri, Powell, Reed, Smith, Von Rosenberg & Wilhelm. Nays None Alderman Moore offered the following resolution, which was read and adopted. Be it resolved by the City Council of the City of Austin That the Mayor appoint a Committee of 3 Aldermen to get up an amended plumbing ordinance – The Mayor appointed Aldermen Moore Armstrong and Powell to such Committee By Alderman Powell an ordinance amending the Dog ordinance – The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Croken, Comer, Haynes, [illegible] Moore, Petri, Powell, Reed, Smith, Von Rosenberg, Wilhelm. 12 Nays None On motion City Engineer Leonard was authorized to put Kirk Day on the Pay Roll for 3 days time lost while unable to work.
