Shelley, Mayor, presiding Roll Called- Present Aldermen Armstrong, Crooker, Duncan, Haynes Miller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg & Willhelm 12- Absent Aldermen Macken & Shumate 2- On motion the minutes were approved as recorded by the Clerk, without reading. Petitions etc. Petitions, memorials etc. Citizens to place drain By Alderman Miller, Petition of Citizens asking that a gate in Colorado & Bridge do rail be put on the Colorado Bridge. Read and on motion referred to the Street Committee & City Engineer Citizens to open 31st St. By Alderman Armstrong, Petition of Citizens to open 31st Street. Read and on motion referred to the Street Committee Citizens to open lane By Alderman Petri Petition of Citizens to open a Certain lane South Austin in South Austin. Read and on Motion referred to the Street Committee Eare Smith By Alderman Moore, Petition of Eare Smith, asking to pound fees. have Certain pound fees refunded. Read and on motion referred to the Committee on Claims & accounts J.P. Dawdins By Alderman Corbet, Petition of J.P. Dawdins pound fees asking to have Certain pound fees paid by him refunded. Read and on Motion referred to the Committee on Claims & accounts Smith & Wilcox By Alderman Duncan Petition of Smith & Wilcox for to erect awning permission to erect a Certain kind of awning before on Congress Avenue. Read and on motion referred to the Street Committee Reports of City Officers. Reports City officers The Mayor laid before the Council the reports of the City Treasurer & City Marshal for the month of June 1906, which were on motion referred to the appropriate Committees without reading Standing Committee Reports of Standing Committees Streets, Oil, etc. Alderman Miller for the Street Committee to whom Mufy Co. for switch was referred the petition of the Austin Oil Manfg. Co. for permission to put in a R.R. Switch at clean Hill presented a report recommending that the petition be granted. The report of the Committee was adopted. Finance to Bond Alderman Haynes the Finance Committee presented refunded a report stating that they had refunded Funding bonds of the issue of April 1905, as follows, to wit: No. 31, 81809080. 49, 52003, 121, 134 to 150 and had purchased for the Sinking fund of Wat. Light bonds the Refunding bonds Nos. 15- to 27 inclusive. On motion the report was laid over to come. --- Page break --- 550 Ex a competition & Earnest Taxes for Earnest Taxes Hospital Physician reports Ordinance on building permit ordinance Petition of Citizens for large pipe & five hydrants on State Street up with New Business Alderman Petri for the Committee on Claims & accounts to whom was referred the petition of C.C. Earnest, asking to have his assessment corrected, presented a report, stating that they had examined the same and recommended that the petition is not granted - The report was adopted. Alderman Petri for the Claims & accounts Committee to whom was referred the petition of Mrs. Earnest asking correction of assessment, presented a report, recommending that the petition be granted. On motion the report was adopted. Alderman Armstrong for the Hospital Committee to whom was referred the reports of the City Physician, presented a report stating that they had examined same and found them correct. He also presented a statement of amounts expended for improvement of buildings at City Hospital. On motion the report was adopted. Alderman Lunea for the ordinance Committee to whom was referred a resolution regarding the taking out of building permits, presented a report submitting an ordinance on the subject and recommending the passage of the ordinance. The report was read and on motion laid over to come up with the ordinance. Alderman Armstrong offered the following resolution Which was read and a motion made to refer it to the Water & Light Committee, which motion was lost by the following vote: Yeas Aldermen Armstrong Crooken Lunes Haynes and Von Rosenbery. 5 Nays Aldermen Miller Moore Petri Powell Redd & Wilhelm. 7 On motion of Alderman Powell the resolution was referred to the Water & Light Commission Resolution Whereas the hydrant on the East side of By Alderman Armstrong a petition of Citizens for a large pipe & five hydrants on North State Street and West of Caroline Avenue The petition was read and a motion was made to to the Water Light Committee which motion was lost by the following vote Yeas Aldermen Armstrong Crooken Lunes Haynes and Von Rosenbery. 5 Nays Aldermen Miller Moore Petri Powell Redd & Wilhelm. 7 On motion of Alderman Powell the petition was referred to the Water Light Committee Alderman Von Rosenburg for the Fire Committee to --- Page break --- Fire Committee whom was referred a proposition from the American on proposition for Elec. Co. to install a fire alarm system, presented fire alarm system a report stating the owing to the financial condition of the City they were unwilling to recommend the acceptance of the proposition at present. Alderman Crooker moved that the proposition and report lie on the table subject to call, which motion prevailed. Alderman Von Rosenberg for the Fire Committee presented the following report Austin, Texas, July 14, 1906. To the Hon. [illegible] Washelley, Mayor, and Board of Aldermen of the City of Austin. Fire on purchase Gentlemen: of Hose Your Committee on Fire Dept. beg leave to report that after consultation with the Fire Chief, have authorized Run Wallen [illegible] to furnish fifteen hundred (1500) feet of fire hose, known as the "Warwick Brand" at 66 2/3 cents per foot, delivered, with a five year guarantee. Von Rosenberg W. H. Redd Committee on Fire Dept. On motion the report was adopted. Communication The Mayor laid before the Council a report from the Chief Fire Dept Chief of the Fire Dept, stating that he had authorized Chemical tanks the removal of the Chemical tanks from Washington etc St. H. A. C. Co wagons and putting in place of these tanks extinguishers of 3 gallons capacity - 2 to each wagon Alderman Moore moved to refer the communication to the Fire Committee which motion prevailed. Special Committee Alderman Moore for the Special Committee on plumbing appointed to bring in a new plumbing ordinance ordinance sub presented a report and submitted an ordinance ordinance Amending the Plumbing ordinance. On motion the report was laid over to come up with the ordinance. Paving Committee Alderman Moore presented a report from the Austin Electric Austin Electric Railroad stating that Railroad they had notified the Austin Electric Railroad Company to immediately take steps to have their property, of cross wires removed from third Street to the Colorado River bridge, and that although so notified they had failed to do so and had expressed an unwillingness to do so, and recommending that the Council take such action in the premises, as they may deem necessary. Alderman Moore then presented the following resolution which was read and on motion Same was adopted. --- Page break --- 552 Austin Electric R R Be it resolved by the City Council of the City of Austin; to pave . That the Austin Electric Railway Company be notified to, at once, proceed with the construction of its track, on Congress Avenue between dandbrook and the Austin Bridge, according to plans and specifications heretofore made for such paving by the City Engineer employed by the City to do. That said Austin Electric Railway Company be further notified that they proceed to enter into account, or make a contract, or take active steps within ten days towards the doing of said work that the City Attorney is to bring suit to forfeit their franchise, for non-compliance with its terms. That a Certified Copy of this resolution be furnished to the said Austin Electric Railway Company by the City Clerk. Paving Committee Alderman Moore for the Paving Committee presented Notices to certain a report stating that they had issued Notice to the parties to pave following named persons to appear before the Paving Committee and offer any objection they might have as to why the bid of F. M. W. & Co. for the work of Paving East 6th Street should not be accepted, recommending that unless the said parties accept and adopt the said bid, within 10 days that the City Attorney be instructed to institute the necessary proceedings to have same done. Viz: Chas Krolin, Joseph Malle and A. Z. Dillon J. Silberstein. On motion the report and recommendation were adopted. New Business New Business & D. Platt, leave absence On motion of Alderman Haynes leave of absence for two weeks was granted to Prince Walton & D. Platt Alderman Haynes for the Finance Committee presented the following report which was read and adopted Austin, Texas, July 1st, 1906 To the Honorable W. D. Shelley, Mayor, and the City Council, of the City of Austin Finance Com Gentlemen: Bonds refunded We, your Finance Committee, beg leave to and purchased for the report that we have refunded the following Sinking fund funding bonds of the City of Austin of the issue of April 1st, 1895, Nos 31, 34 & 39, both numbers inclusive, 52 and 80, x 49 121, 126 & 133, both numbers inclusive; and issued in lieu thereof, refunding bonds of the City of Austin in the sum of Five hundred dollars $500 ⁰⁰ each, numbers 201 to 277, both numbers inclusive; and we herewith present the original bonds with this report. The 27 bonds so refunded, the Council hereby authorize their cancellation. --- Page break --- The Committee also reports that, as directed in ordinance and resolution passed on the 20th day of July, we have purchased for the benefit of the sinking fund of Water and Light bonds, the and refunding bonds, Nos 204 to 227, inclusive Respectfully Submitted H. L. Haynes Chairman & Von Rosenberg. Finance Committee Alderman Haynes offered the following resolution which was read and adopted. Resolved by the City Council of the City of Austin. Bonds destroyed That whereas funding bonds of the City of Austin, Nos 31, 34 & 35 both numbers inclusive, 46 to 49, both numbers inclusive, 52, 53, 121, 126 to 133, both numbers inclusive, have been refunded, and refunding bonds of the City of Austin issued in lieu thereof: That the Finance Committee be, and the same are hereby instructed to destroy and Cancel, in the presence of the Council, the said bonds above mentioned, aggregating 27 in number, as above stated, and being funding bonds of April 1st, 1905 for Five hundred ($500.00) dollars each. The Committee appointed to destroy the bonds mentioned in the report of the Finance Committee, presented a Verbal Report, stating that same had been destroyed in the presence of the Council. By Alderman Crooker an ordinance appropriating the sum of $100.00 for the purpose of cutting weeds and purchasing Lime for the Sanitary Dept The ordinance was read the first time and on Motion the rule was suspended and the ordinance placed on its second reading by the following VoteYeas alderman Armstrong Crooker Ashur Haynes Guillen Moore Pehri Powell Radd Smith Von Rosenbery Wilhelm Nays none. 12 The ordinance was read the second time. Alderman Moore moved to amend the ordinance by making the Amount appropriated $200.00 instead of $100.00 The Amendment was adopted and the Ordinance as Amended passed under suspension of the rules by the following vote Yeas Alderman Armstrong, Crooker Ashur Haynes Guillen Moore Pehri Powell Radd Smith Von Rosenberg Wilhelm Nays none. 12 Alderman Willson an ordinance appropriating the sum of $30.00 for the purpose of repairing streets --- Page break --- Austin Hose wagon, The ordinance was read the first time and passed under suspension of the rules by the following Yale. Yeas Aldermen Armstrong, Brocken, Crunco, Haynes, Meller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg Swope, Holm Nays none. 12 Salaries of Dog Catchers By Alderman Powell an ordinance appropriating the sum of $160.00 for the purpose of paying the salaries of Dog Catcher and his assistant. The ordinance was read the first time and passed under Suspension of the rules by the following yeas: Yeas Aldermen Armstrong, Brocken, Crunco, Haynes, Miller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Swope, Holm Nays none. 12 Extra Labor Teams By Alderman Smith an ordinance appropriating the sum of $400.00 for the purpose of paying for extra street Labor Teams. The ordinance was read the first time and passed under suspension of the rules by the following Yeas: Yeas Aldermen Armstrong, Brocken, Crunco, Haynes, Miller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Swope, Holm Nays none. 12 Austin Electric RR to proceed with Paving Alderman Moore offered the following resolution, which was read and adopted Be it resolved by the City Council of the City of Austin: That the Austin Electric Railway Company be notified to, at once, proceed with their proportion of the paving on Congress Avenue between third street and warren bridge, according to plans and specifications heretofore made for such paving by the Engineers employed by the City, to do so. That said Austin Electric Railway Company be further notified that unless they proceed on their own account, or make a contract, or take active steps within ten days towards the doing of said work, that the City Attorney is instructed to bring suit to forfeit their franchise for non-compliance with its terms. That a certified copy of this resolution be furnished to Said Austin Electric Railway Company by the City Clerk. Alderman Armstrong offered the following resolution, which was read and adopted. Hydrant outside Station adjoining the Marsh Whereas the hydrant on the east side of the Season [illegible] standing 10 feet from the curb is dangerous to travel by dark at night. Plumbing Ordinance The Mayor laid before the Council an ordinance submitted by the Special Committee appointed to submit an ordinance Amending the Plumbing ordinance The ordinance was read the first time and on motion the rule was suspended and the ordinance placed on its second reading by the following Vote Yeas Aldermen Armstrong, Crooker, Cunca, Haynes, Willox, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Suivelhelm 12 Nays None. The ordinance was read the second time, Alderman Cunca moved to amend in section 2 under head of the bond to be given by Plumbers, by striking out $200.00 and inserting in lieu thereof $1000.00. The Amendment was adopted and the ordinance passed under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Crooker, Cunca, Haynes, Miller, Moore, Petri, Powell, Redd, Smith, Von Rosenberg, Suivelhelm 12 Nays None Printing Committee to have 1000 Copies Plumbing Ordinance printed Alderman Moore moved that the Printing Committee be instructed to have the Plumbing Ordinance published, and that they also have 1000 Copies of same published in pamphlet form The motion was adopted Street Sign Contractor to place signs on streets South Austin On motion of Alderman Redd the Contractor for placing names of streets of the City on street corners was directed to place said numbers & names on streets of South Austin.
