Austin Street Repairs & City Parks Initiative 1906

Police and Personnel Changes: City replaced a resigning policeman and filled an alderman vacancy following resignations, with J.M. Parr elected as the new officer.

Regular meeting of the City Council Corsicana, Texas, October 01, 1906 Hon W.D. Sheley, Mayor, presiding. Roll Called Present Aldermen Armstrong, Crooker, Cunninghame, Mackie, Moore, Petri, Powell, Scrivener 9 Absent Aldermen Wellen, Redd, Shumate, Smith, and Van Rosenberg 5 On motion the minutes were approved as recorded by the Clerk, without reading. Petitions, Miscellaneous building permit By Alderman Macken, petition for permission to erect an iron clad building within the five limits. Read and on motion the petition was granted. C.W. Jones Pay for hog By Alderman Shaynes, petition of Geo. Jones asking pay for hog, that was impounded by the City, and died in the pound. Read and on motion referred to the Claims and accounts Committee. Reports City officers Reports of City officers The Mayor laid before the Council the reports of the Assessor, Collector and City Clerk for the month of Sept, which were on motion referred to the Finance Committee without reading. Reports Standing Committees Reports of Standing Committees Alderman Powell for the Police Committee to Police Marshals whom was referred the reports of the Marshal reports for the month of August 1906, presented a report stating that same had been examined and found correct. The report of the Committee was adopted. C. & A. Ed Reinsle Pound fees Alderman Petri for the claims and accounts Committee to whom was referred the petition of Ed Reinsle asking to have certain pound fees refunded presented a report recommending that the petition be granted. On motion the report was adopted. Alderman Smith & Wellen declared the Council Chamber Unfinished business The Mayor laid before the Council an ordinance Ex. Loan & Steamy appropriating the sum of $400.00 for the purpose of paying for extra street laborers. The ordinance was read the third time and on motion of Alderman Crooker was laid on the table subject to call. Pet. J.M. Crawford damages Alderman Wellen presented a petition from J.M. Crawford asking for damages to property caused by defective streets. Read and on motion was referred to the Street and Claims & accounts Committees. --- Page break --- 584 New business Resignation J M Tharp Policeman Resolution in regard to Temporary Capital grounds for Parks Oliver Busch Paving New business By Alderman Powell – Resignation of J M Tharp as Alderman, which was read and on motion accepted. Alderman Powell moved that the City Marshal be requested to Submit the name of some one for Confirmation as Policeman to fill the Vacancy caused by the Resignation of J M Tharp, which motion prevailed. The Marshal submitted the name of J M Parr The Mayor appointed Alderman Powell Miller and Dillow. The Tellers announced the following as the result of the ballot 11 Hart 11 Dale. The Mayor declared J M Parr duly elected a Policeman to fill the unexpired term caused by the resignation of J M Tharp. Alderman Redd entered the Council Chamber. Alderman Eames offered the following resolution In line with the leading improvements now in process in our beautiful City both Municipal and private, as instances of paving, and building of the new City Hall etc, and in view of the absolute necessity of Public Parks for the benefit of our people therefore be it resolved that the Mayor is hereby instructed to appoint a Committee of eight to consist of the present Park Committee and three Citizens together with our Representatives the Hon. Jas. Robinson and John H. Keller whose purpose shall be principally the passage of a petition to the forthcoming Legislature asking for a a donation for Park purposes of the old Temporary Capital Site. Alderman Moore offered the following as a Substitute for Alderman Eames Resolution “That the Representatives to the Legislature are respectfully requested to use their influence in the State Legislature to appropriate a sufficient Sum to beautify the Vacant lots at the Cor of 1st St and Cong Ave. The Substitute was adopted by the following, Vale Nays Alderman Crookton Haynes Wratton Miller Moore Parr Smith Wilson Yeas Alderman Armstrong Eames Powell Redd Smith Tharp Wilson.” City Attorney Hart stated to the Council that in the case of the City Vs. Oliver Busch for paving on 6th Street that Mr. Busch had paid to him the amount of the judgment for said paving, and that he wished instructions from the Council as to the disposition of the made in paid. On motion of Alderman Wratton the City Attorney was instructed directed to pay over to Mr. Brown the Paving Contractors the money, when he had paid to him to build paving --- Page break --- 585 Alderman Moore moved that the Council stand adjourned until 8 o'clock P.M. Thursday Oct 4th 1906, which motion was lost by the following vote Yeas Aldermen MacKen Moore Petri Smith 4 Nays Aldermen Armstrong, Crooker Earnest Haynes Weller Powelle Redd &Wilhelm 8 Fines remitted At the request of the City Attorney the following amounts of unpaid fines imposed in the Mayors Court were remitted Estella Gibson Fines $100 – paid $50. remitted $50.00 Lillie Roberts “ “ $100. “ $50 “ $50.00 Annie Lowe “ “ $100 “ “ $65 “ $35.00 Owners To Redeem By Alderman Haynes an Ordinance to permit owners of property sold for Real estate purchased by the City at foreclosure sale to redeem taxes the same at any time within thirty days from the taking effect of this ordinance The ordinance was read the first time and passed under suspension of the rules by the following vote Yeas Aldermen Armstrong, Crooker, Earnest Haynes MacKen Miller Moore Petri Powelle Redd Smith &Wilhelm 12 Nays none Alderman Moore offered the following resolution which was read and adopted Whereas there has been passed by the City Council of M K & T Ry the City of Austin a resolution requesting the City Attorney To repair streets and City Clerk to notify the M.K.&T. Ry. Co To repair the streets in and around their tracks in accordance with their promise as to do when permitted a franchise and whereas the said M.K.&T. Ry. Co has been so notified and they have not taken any steps towards such improvement but have gone ahead using such franchise and are now using streets and crossing streets upon which they have no franchise Therefore be it resolved that the City Attorney again call their attention to this matter and in the event the said Railroad Company does not comply with said request at once legal steps be taken against said Company. Waste paper By Alderman Moore an ordinance prohibiting ordinance the throwing or hanging and placing of loose paper on papers of any kind or debris in the streets and Alleys of the City of Austin, and providing a penalty therefor The ordinance was read the first time and on motion was referred to the ordinance Committee $25. to repair By Alderman Wilhelm an ordinance appropri– Cemetery entrance –ating the sum of $25.00 for the purpose of repairing the entrance to the City Cemetery The ordinance was read the first time and passed --- Page break --- under suspension of the rules by the following Vote Yeas Aldermen Armstrong, Crooks, Dunn & Haynes Knack, Miller, Moore, Petri, Powell, Reed, Smith & Roach — 12— Nays None. Shelley Mayor, presiding Roll Called Present Aldermen Armstrong, Crooker, Ounses, Haynes Petri, Powell, Smith, Von Rosenberg, Wilhelm Absent Aldermen Wackman, Weiler, Webers & Schunale - 5 Petitions, memorials etc. Petitions are By Alderman Crooker - Petition of Jere Griffith for permission Jere Griffith to to obstruct certain streets temporarily - on motion the petition obstruct streets was granted. temporarily By Alderman Crooker communication from the Cemetery Cem association Association regarding travel through the Cemetery by teamsters etc. passing through Read and on motion referred to the Cemetery Committee grounds New Business New Business Alderman Haynes offered the following resolution which was Hydrants on paved read and adopted: streets leaking Whereas, several of the City hydrants located on the paved streets are and have been for a long time in a leaky condition, and in one place especially at the corner of 8th and Congress Avenue, has caused a bad depression in the paved street Therefore be it resolved, that the City Engineer be and is hereby instructed to call the attention of the water & Light Board to the matter and request that they have each and every one of the hydrants on or near the paved streets inspected at once and where found to be in a leaky condition have the matter remedied as early as practicable Be it further resolved, that the Paving Committee be and are hereby requested to examine the depressions in the pavement above referred to and have the Contractor repair that and any other such places as may be found after a careful inspection of the streets that have been paved. Alderman Powell offered the following resolution which was read and on motion referred to the Fire Committee Be it resolved by the City Council of the City of Austin that West Austin Fire West Austin Fire Company be and is hereby furnished one Co Telephone telephone free for five years. The Mayor laid before the Council a communication from Alderman Schunale tendering his resignation as Alderman Alderman Schunale from the 6th Ward. On motion the resignation was accepted. resignation Alderman Haynes presented a communication from accepted citizens asking Ben H.A. Seats to become a candidate for Alderman from the 6th Ward, together with ten others BHSeats declined acceptance of the nomination. Alderman Alderman Haynes nominated Ben H.A. Seats for Alderman from the 6th Ward to fill the vacancy caused by the resignation of Alderman Geo Schunale. The Mayor appointed Aldermen Haynes and Von Rosenberg as tellers. --- Page break --- 588 Alderman Moore entered the Council Chamber The tellers announced the following as the result of the ballot. F. A. Scott. 8 Votes, No 1 Vote The Mayor declared Ben F. A. Scott elected as Alderman from the 6th Ward to fill the Vacancy caused by the resignation of Alderman Shurmate. Note. Before the taking of the Vote for Alderman, Alderman Armstrong moved to postpone the Vote until the next regular meeting, which motion was lost by the following Vote. Yeas Alderman Armstrong Smith Rosenberg - 3 Nays Alderman Brooks Duncan Haynes Ford Powell Hoihelm. - 6 Exchange of $320,000 By Alderman Haynes an Ordinance To authorize and W & L bonds provided for Provide for the exchange and delivery of three hundred and twenty thousand Dollars of the Refunding bonds of the City in exchange for three hundred & twenty thousand dollars X / of Water & Light bonds of the City. The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Alderman Armstrong Brooks Duncan Haynes Moore Petri Powell Smith Vote Rosenberg Hoihelm - 10 Nays - 0 On Motion the Council adjourned.
