41 .Called meeting of the City Council Austin Texas January 03, 1908 + on F M Maddox Mayor, presiding;Roll called; Present Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller,Moore,Petri, Scott, Smith,Sutor & Wilhelm 12 Absent Aldermen Moreland & Redd 2 Alderman Crooker moved a call of the Council,which was seconded,and the Marshal directed to bring in the absentees Alderman Moreland entered the Council chamber and answered to his name ;A motion was then made to suspend the call, which motion was lost by the following vote; Yeas Aldermen Armstrong,Crooker,Cuneo, Haynes,Meredith,Moreland Petri,Smith & Wilhelm 9 Nays Aldermen Miller Moore,Scott & Sutor 4 Alderman Redd entered the Council chamber and answered to his name. On motion the call was suspended . (Call suspended. See page 20) Clerk Alderman Crooker moved that the Council proceed with the order of business by commencing at the bottom and going up as mentioned in the call .Alderman Redd moved as a substitute that the matters be considered in the order as named in the call .The substitute was lost by the following vote : Yeas Aldermen Miller Moore,Moreland,Redd,Scott & Sutor 6 Nays Aldermen Armstrong Crooker,Cuneo, Haynes,Meredith,Petri Smith & Wilhelm 8 The motion of Alderman Crooker was then adopted by the following vote ; Yeas Alderman Armstrong,Crooker,Cuneo,Haynes,Meredith,Petri Smith & Wilhelm 8 Nays Aldermen Miller,Moore,Moreland,Redd,Scott & Sutor 5 Order business Dam Ordinace Resolution Water Light & Power [illegible] The Mayor laid before the Council the Dam ordinance ,which was read the third time The ordinance was then passed by the following vote ; Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Moreland Petri, Scott, Smith & Wilhelm 10 Nays Aldermen Miller ,moore,Redd & Sutor 4 Alderman Moore offered the following resolution ; Whereas,the gross annual earnings of the Water Light and Power Plant are now One Hundred and Ninety two Thousand,Five Hundred ( $192,500.00 ) Dollars and the annual cost of fuel now required to run said Water Light and Power Plant is Twenty -four Thousand and Ninety ( $ 24,090.00 ) Dollars; and Whereas,the total annual operating expenses of said plant ,including repairs and fuel,(according to statement made by Superintendent R C Brooks ) will not exceed Seventy five Thousand ($75,000.00 )Dollars,which annual operating expenses wil in the near future be further reduced not less than Six Thousand ($6,000.00 ) Dollars, which will leave a net annual earning of One Hundred and Twenty three Thousand ,Five Hundred ( $ 123,500.00 )Dollars; and Whereas,our Water Light and Power Plant has been paying Twenty two Thousand,Five Hundred ( $ 22,500.00 )Dollars annually on the purchase of the old water company plant and Judgements-having paid since April 1st 1905,One Hundred and twelve thou thousand Five Hundred Dollars ( &112,500.00. ) and expenses will,annually hereafter,on April 1st of each yearpay Twenty two Thousand,Five hundred ( $22,500) Dollars,on said purchase,until April 1 1917 when the last payment of Twenty two Thousand nine hundred and ninety three 45/100 ( $ 22,993.45 )dollars thereon will have been paid : and, Whereas,it is apparent that the net annual earnings of our Water, Light and Power

. plant ,at the present rates and number of consumers, will be sufficient to pay the annual estimated operating expenses, and the annual installment o f Twenty two Thousand Five Hundred ( $ 22,500.00 ) dollars, and have an a mnual balance of One Hundred and one thousand ( $101,000.00 ) dollars,:and Whereas, the people of the City of Austin, in order to obtain cheap power a nd the beautiful lake, are very desirous of having the dam and power h ouse re-built in a substantial ,permanent and lasting manner, and to h ave same so re-built, are willing ,if necessary, to have the present w ater, light and power rates maintained ; therefore, B e it resolved by the City Council of the City of Austin: F irst ; In our opinion the time has arrived when our Water, Light and P ower Commission can and should take steps to re-build said dam and power h ouse. S econd: That our Water Light and Power commission be requested to a nnually depoaite ,to the credit of a fund to be called and known as the "D "D am Fund ", all the net earnings of our Water, Light and Power Plant, for t he purpose of re-building the dam and power house, and placing therein the n ecessary machinery to economically use the power created by such r e-building . T hird : That our Water, Light and power Commission, be further requested to, a t once ,employ a competant and skilled Engineer, to make a thorough and com c omplete survey and soundings of the site for said dam and power h ouse ,and to make full, complete and detailed plans and specifications f or said dam and power house, together with a full, complete and careful e stimate of the cost of said work . F ourth : That as soon as Two Hundred Thousand ( $ 200,000.00 ) dollars s hall have been accumulated in said " Dam Fund " by said annual deposits , t hen our Water, Light and Power Commission shall advertise, for not less t han four weeks, in not less than four newspapers published in the State o f Texas, and such other newspapers published outside of the State as they m ay deem necessary, for sealed bids, to be addressed to the Water, Light and P ower Commission, at ,Austin, Texas, for the re-building of said dam and p ower house-requiring each bidder to accompany his bid with a check c ertified by some solvent Bank or Trust Company doing business in the State S tate of Texas, for ten (10 % ) per cent of the amount of their bidr eserving the right to reject any and all bids. Said certified check to g uarantee that a good and sufficient bond for an amount or not less than t wenty -five ( 25 % ) percent of his bid will be given thirty (30 ) days a fter the awarding of same ,that he will build and complete said dam and p ower house ,as shown and required by the plans and specifications of t he Engineer, within two ( 2 ) years from the date of award of bid . F ifth : That the City Clerk be ,and he is hereby requested and directed t o send to the President of the Water, Light and Power Commission a c ertified copy of this resolution . 43 10 Bid for Rutledge . Scott, Smith & Wilhelm Propose [illegible] Alderman Scott for the Street Committee, presented a report stating that they Bids = $1745. had advertised for bids for cutting down Colorado and West 5th streets near the New City Hall ,and recommending the acceptance of the bid of J W Rutledge,for the sum of $ 1745.00 , On motion the report was adopted and the Mayor directed to enter into contract with Mr Rutledge for said work at his bid On motion the Council adjourned Jno. P etitions,Memorials,etc; Quisenberry to By Alderman Redd, petition of Mr & Mrs Quisenberry for permission to close a close alley certain alley ,The petition was read and on motion was referred to the St Com The Mayor laid before the Council the following petitions,which were read & referred Pound fees. Tom Roberts Tom Roberts, C I L Crockett, S H Weaver ,for refunding pound fees,referred to the C I L Crockett, S H Weaver Committee on Claims and Accounts One from Citizens to open E 5th street, Citizens then ask to open which was referred to the Street Committee ,and one from the Ladies Cemetery streets Association which was referred to the Finance Committee ; Lee Wilson in By Alderman Smith ,petition of Lee Wilson asking that the Council to refund to jury accident him amount paid for a substitute driver while he was unable to drive,caused by being thrown from his wagon and for his Doctors bill On motion the petition was granted
Reports of Officers R eports of City Officers Referred The Mayor laid before the Council the reports of the City Assessor & Collector, the Marshal,the Clerk,and the Sexton,which were on motion referred to their appropriate Committees without reading. Reports of Standing Committees ; Reports of Standing Comm. Alderman Redd for the Fire Committee to whom was referred a petition from the Driskill Laundry Driskill Laundry for permission to put a roof over stairway within the fire limits on stairway presented a report recommending that the petition be granted,which report was adopted adopted. Purchases Alderman Miller for the Committee on Purchases, presented a report recommending Bids accepted that certain bids for supplies for the term ending June 30th 1908, be accepted and contracts awarded;On motion the report was adopted City Hall Comm. Alderman Moore for the City Hall Committee presented a report stating that they Rostrum & Station had advertised for, and received, bids for Rostrum and other stationary furniture R. A. Plume in the New City Hall ,and recommending that the bid of R A Plume for $ 1100.00 be accepted accepted and that he be awarded the contract, and that the Mayor be authorized and directed to enter into contract with him in accordance with his bid;On motion the report was adopted
