Austin City Hall Construction Dispute

City Hall nearing completion: The council reviewed progress on Austin's new City Hall building and approved a $4,331.75 payment to contractors for completed work, with only the stairway and vestibule remaining unfinished.

Heated debate among aldermen: Committee members disagreed sharply on how to handle the incomplete staircase work, forcing the council to adjourn and reconvene the next day to reach a compromise.

Contractor deadline set: The council gave contractors Belger & Bryson 45 days (until late February 1908) to complete the stairway and vestibule, or the city would hire someone else to finish the work at the contractor's expense.

Withheld payment as leverage: The city retained $1,500 from the final payment—roughly one-third of the outstanding balance—to ensure the contractors completed their remaining obligations according to original specifications.

Hon F M Maddox,Mayor,presiding : Roll called; P resent Aldermen Armstrong Crooker,[illegible],Cuneo,Haynes,Moore,Petri, Scott,Smith,Sutor & Wilhelm A bsent Aldermen Meredith,Miller,Moreland & Redd Alderman[illegible] [illegible] [illegible] [illegible] The following call of the Council was read ; Austin,Texas,January 8th 1908; A special meeting of the City Council of the City of Austin Texas is hereby called to meet in the Council chamber,Smith Office buildingon West Sixth street this the eigthj day of January 1908 at 8 oclock P M for the following purposes towitFirst for purpose of receiving and acting upon the report of the City Hall Committee on the City Hall. Second :To make an appropriation out of the general fund for the further payment on said City Hall. F M Maddox,Mayor C W Moore Henry Petri C B Moreland, H L Haynes Austin,Texas, January 8th 1908. I hereby certify that I have served the within call for a special meeting of the City Council by having same read by Officers Rutledge, Griffin and Mayrield to each of the following named Alderman towit: W D Miller,W C Redd,A E Cuneo,L M Crooker,W J Sutor,Tom D Smith, C J Armstrong,Henry Petri,C J Wilhelm,H L Haynes,F A Scott,C W Moore,C B Moreland and by leaving a copy of same at the place or business of J M Meredith ,he being out of the City. Gentlemen : We,the undersigned members of your City Hall Committee, beg leave to report : First : We,together with Mr C H Page,Architect for the City Hall,about two weeks ago carefully went over said building,and noted such further work as we thought should be done on all of said building,except the stairways and stair vestibule,and directed said Architect to notify the Conyractors in writing of such work,and when same was completed to make his report to your Committee. Second : We attach hereto the report of Messrs G Page & Bro,that the work has been done,and attach an estimate No 9 ,dated Jan,8t ,1908, for $4331,75 on said building,leaving still to be paid on said building; to Belger & Bryson the sum of $ 1500,00 to be paid on final estimate on completed or stairway and stair vestibule. Third : We recommend that all of said building,except the stairway and stair vestibule be received or accepted by your Honorable body,and that an appropriation of $ 4331,75 be made ,out any money in the General fund not otherwise appropriated,to pay said Contractors as per estimate of Called Council Rept I. in Supl. Alderman Moore asked permission to withdraw his report, which was granted. On motion the report was referred to a special Committee consisting of Aldermen Moore, Crooker, Haynes, Sutor, Cuneo & Armstrong . The special Committee retired, and after a time returned with a verbal report that they were unable to agree. A motion was then made to adjourn until 8 oclock P M Jan 9th 1908, at which time the Committee could probably agree upon a report, which motion prevailed by the following vote: Yeas Aldermen Armstrong, Crooker, Cuneo, Haynes, Moreland Petri Scott, Sutor & Wilhelms Nays Aldermen Moore Redd & Smith Jno. O. Johnson City Clerk Adjourned called meeting of the City Council, Austin Texas, January 9th 1908. Hon F M Maddox, Mayor presiding : Roll called; Present Aldermen Armstrong, Crooker, Cuneo, Haynes Meredith Moore, & Wilhelm 7 Absent Aldermen Miller, Moreland, Petri, Redd, Scott, Smith & Sutor 7 Alderman Moore moved a call of the Council, which was seconded and the Marshal directed to bring in the absentees. Aldermen Smith, Sutor, Moreland, Petri & Scott entered the Council Chamber and answered to their names. On motion the call was suspended. Alderman Moore for the special Committee presented the following report, as a supplement to the report of the City Hall Committee. Austin, Texas, Jan 9 1908. To the Honorable City Council of the City of Austin. Gentlemen: We have carefully considered the matter of the partial acceptance of the the City Hall and would make the following suggestion, subject to your approval: We would suggest that such contract as the City has with Messrs Belger & Brydson be left in its present form, and that the City accept the building under the present contract from Messrs Belger & Brydson, except the stairway and stair vestibule, which is not yet completed; that the City retain from the contract price the sum of $ 1500.00, which said sum of $ 1500.00 shall be paid to Messrs Belger & Brydson upon the completion of the stairway and stair vestibule, according to the plans and specifications heretofore adopted and agreed upon covering that portion of the contract. We recommend that 45 days from this date ,namely, Jan. 9, 1908, be given Messrs Belger & Brydson in which to complete the stairway and stair vestibule, according to the plans and specifications heretofore adopted covering the stairs and stair vestibule, and that, in the event such stairway and stair vestibule be not completed according to the plans and specifications within said 45 days, the City of Austin be authorized to have same completed
