Regular meeting of the City Council,Austin Texas ,March 16, 1908 : Hon FM Maddox,Mayor,presiding; Roll called: Present Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller,Moore,Moreland, Petri,Scott,Smith,Sutor & Wilhelm Absent Alderman Redd On motion the minutes were approved as recorded by the Clerk,without reading. Petitions, Memorials,etc; By Alderman Moore petition of Citizens of the 7th ward asking to have the pound limits extended;Several Citizens of the ward were invited to address the Council some for and some against the proposition,After which ,on motion of Alderman Crooker,the petition was referred to the Police Committee. The Mayor laid before the Council a petition from the Hume Lumber Co ,asking permission to erect certain buildings within the fire limits,which was read and on motion referred to the Board of Fire Commisioners. Alderman Moore presented a communication from H Faulk Esq giving notice of a claim for damages against St John & Rex ,for injuries to Lem Dillingham,which was read and referred to the Committee on Claims & Accounts. By Alderman Miller petition of Citizens ,asking to have Sewer extension West Avenue .Read and on motion referred to the Committee on Sanitation & Sewerage. The Mayor laid before the Council the report of the Treasurer for the month of Feby 1908,which was on motion referred to the Finance Committee,without reading Reports of Standing Committees: Alderman Moore for the Water & Light Committee to whom was referred a petition from J A & Amos Maupin for permission to erect a tent on land belonging to the City near the Dam,presented a report recommending that the petition be granted on condition that the same should be removed by the mat any time upon notice from the Mayor or City Council;On motion the report was adopted. Alderman Scott for the Street Committee to whom was referred a petition from Citizens to open 4th street in Hyde Park,made a verbal report,stating that Mr Shipe had a proposition to make in reference to the opening of said street,and asked that Mr Shipe be allowed to address the the Council and submit his proposition,which motion prevailed,and Mr Shipe submitted his proposition. Alderman Scott offered the following resolution:Resolved that the City Attorney be authorized to draw up an ordinance carrying out the proposition of Col ,M M Shipe for the M K & T Land co .After considerable discussion,Alderman Haynes moved that the whole matter be referred to the Street Committee, & City Attorney, which motion prevailed. On motion of Alderman Crooker all ex-Aldermen were invited to seats within the bar of the house. Alderman Petri for the Claims & Accounts Committee to whom was referred the petition of Mrs C P Ledbetter & H L Raven asking remission of taxes,presented a report stating that the Council was without authority to grant the petition, On motion the report was adopted. Alderman Petri for the Committee on Claims & Accounts to whom was referred the petition of H Heuss asking correction of assessment for taxes,presented a report stating that the Council had no right to revise the valuations as fixed by the Board of Equalization .On motion the report of the Committee was adopted .

86 C & a - J. B. Nitscheck Taxes . Alderman Petri for the Committee on Claims and Accounts to whom was referred the petition of J B Nitschke for correction of assessment, presented a report recommending that the petition be granted, and the Assessor & Collector be authorized and directed to make the correction on his books, On motion the report was adopted.
Unfinished business:
Rules Board of Health The Mayor laid before the Council the resolution adopting the rules and regulations adopted by the Board of Health for the government of the Board and their appointees. Petitions,Memoria's etc: Petitions etc By Alderman McBee,petition of Citizens of the 7th Ward,asking to extend the pound limits Citizens Petition to West The petition was read.Citizens in favor of,and those against the proposition : were invited to address the Council;after those desiring to do so had addressed the Council,on motion of Alderman Crooker the petition was referred to the Police Committee. Hume Lumber Petition The Mayor laid before the Council a petition from the Hume Lumber Co,asking permission to erect sheds within the fire limits;The petition was read and on motion was referred to the Board of Fire Commissioners. By Alderman Moore,Communication from Henry Faulk Esq,Attorney for L em Dillingham, giving notice to the Council that said Dillingham had a claim for damages against St John & Rex,paving contractors ,The Communication was read and referred to the Committee on Claims & Accounts. Citizens for Sewer Extension By Alderman Miller petition of Citizens,asking to have Sewer extended; Read and on motion referred to the Sanitary Committee. Reports of City Officers: Report of Treasurer The Mayor laid before the Council the report of the Treasurer,for the month of Feby 1908,which was on motion referred to the Finance Committee,without reading. Reports of standing Committees Alderman Moore for the Wat er & Light Committee to whom was referred the petition Jas & Amos Maupin of Jas & Amos Maupin for permission to erect a tent on land belonging to the City up near the dam ,presented a report recommending that the petition be granted, under certain conditions;On motion the report of the Committee was adopted. Alderman Scott for the Street Committee to whom was referred a petition from Citizens ,asking that 4th street in Hyde Park be opened,made a verbal report, 4th St. Hyde Park and asked that Mr M M Shipe be allowed to address the Council and submit a proposition for compromise.Mr Shipe addressed the Council. ,after which Alderman Haynes offered the following resolution;Resolved that the City Attorney be authorized to draw up an ordinance carrying out the proposition of Col Shipe for th e the I & K T Land Co .On motion of Alderman Haynes the whole matter was referred to the Street Committee and City Attorney. Call 200 On motion of Alderman Crooker all Ex-Aldermen in the Hall were invited to seats within the Chamber. Alderman Petri for the Claims & Accounts Committee to whom was referred a petition Mrs. C.P. Ledbetter from Mrs C P Ledbetter & H L Raven,asking remission of certain taxes,presented a report stating that the Council had no authority to grant the request, On motion the report was adopted. Mrs. H. Heuss Alderman Petri for the Claims & Accounts Committee to whom was referred a peti-tion from H Heuss asking revision of assessment made by the Board of Equaliza- -tion,presented a report stating: that the Council had no authority to revise the w work of the Board of Equalization.On motion the report was adopted. Unfinished business: Rules, Board & Health The Mayor laid before the Council the rules and regulations submitted by the Board of Health. On motion the Council took a recess for ten minutes. Adjourned regular meeting of the City Council, Austin, Texas, March 18th. 09 Hon F M Maddox, Mayor presiding; Roll called; Present Aldermen Armstrong, Crocker, Cuneo, Haynes, Merediyh, Miller, Moore, Petri, Redd, Scott, Smith, Sutor & Wilhelm Absent Alderman Moreland 13 1 Invitation To dine On motion Dr T R Sampson was allowed to address the Council for the with Dr. Sampson purpose of extending an invitation to them to take dinner with him one day next week, the time to be fixed by the Council; On motion Tuesday March 24th 1908 was fixed as the time. Rules, Board & The Mayor laid before the Council the rules and regulations as reported by Health the Board of Health for the government of said Board and its Inspectors. The Clerk was directed to read the said rules and regulations for the information of the Council; which being done Dr Matthews of the Board was invited to address the Council. After remarks by Dr Matthews Alderman Wilhelm moved that they be referred to the Sanitary Committee and City Attorney and that they be directed to notice to all parties interested so that they can appear before said Committee and make any suggestions they may have to make in regard to the said rules, and that they report back to the Council the result of their investigation, and such recommendations they may see proper to make, which motion prevailed. Unfinished business: $350.00 to repair The Mayor laid before the Council an ordinance appropriating the sum of W. 5th St. $350.00 for the purpose of repairing West 5th street; The ordinance was reread the second time, and on motion of Alderman Scott was laid on the table. Ordinance regarding By Alderman Scott an ordinance Regarding Electrical Wiring in the City of Electrical Wiring Austin. Read and on motion referred to the ordinance Committee. By Alderman Scott an ordinance appropriating the sum of $57.20 for the purpose of paying the Christian Church balance due on release. The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crocker, Cuneo, Haynes, Meredityh, Miller, Moore, Petri, Redd, Scott, Smith, Sutor & Wilhelm Nays none. 13 Finance Committee Alderman Haynes for the Finance Committee to whom was referred the annual Report report of the Water & Light Commission, with instructions to have same audited, stated to the Council that they had taken the matter up and after talking with auditors had found that it would cost possibly more than the Council had expected, and asked for further instructions, On motion they were re-directed to proceed

89 Pound fee Mrs . The Mayor stated to the Council that he had remitted a pound fee for Mrs Leonard Remitted Leonard, and asked that the Council ratify his action.On motion the action of the : Mayor was approved.
Charges by Jesse Scott The Mayor stated to the Council that Jesse Scott had made --- [illegible] --- Pound Master a complaint in regard to some action of the Pound Master in taking up and impounding: to be investigated s tock, and that the Pound Master demanded an investigation of the matter.On motion the matter was referred to the Police Committee for investigation. Shades City Hall Alderman Haynes moved that the City Hall Committee be instructed to advertise for bids for Shades or awnings for the City Hall, which motion prevailed
WH Richards & Co & W.Alling, Webb Taylor & Perry, AC Ellis, Zier-Phillips Furniture Co J S Simpson Harm The Mayor laid before the Council a petition from WH Richardson & Co, Denne to use Alliance Yard W.Alling, Webb Taylor & Perry, A C Ellis, Zier-Phillips Furniture Co J S Simpson Harm Switch ware Co C B Busch & J Storm ,asking permission to use the Alliance Yard Switch for handling of car load shipments of freight.Alderman Crooker moved to add the name of John Bremond to the petition, which motion prevailed. Alderman Moore moved that the petition be referred to the Street Committee, which motion [illegible] by the following vote: Y eas Alderman Armstrong, Cuneo, Miller Moore, & Wilhelm 5 Nays Alderman Crooker, Haynes, Meredith, Petri, Redd, Scott, Smith & Sutor 8 Alderman Redd moved to reconsider the vote by which the Council refused to refer the petition to the street Committee, which motion prevailed.On motion of Alderman Redd the petition was then referred to the Street Committee. Tom Byrne To By Alderman Crooker petition of Tom Byrne asking Correction of mistake in the Correct assessment Assessment made by him for M Byrne;On motion the petition was referred to the Claim & Accounts Committee. New wheels East By Alderman Redd an ordinance appropriating the sum of $ 130.00 for the purpose Austin [illegible] wagon of putting new wheels on East Austin ,ose wagon;The ordinance was read the first time and passed under suspension of the rules by the following vote; Yeas AldermanArmstrong, Crooker, Cuneo, Haynes, Meredith, Miller, Moore Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none. Fire plug [illegible] Alderman Miller offered the following resolution ,which was read and adopted; [illegible] Be it resolved by the City Council of the City of Austin;That the Water & Light Commission be and they are hereby requested to have a fire plug placed at the corner of Wilson and Crockett streets in South Austin. Engineer to investigate encroachments on Duval st Alderman Scott offered the following resolution; Be it resolved by the City Council of the City of Austin,that the City Engineer be and he is hereby instructed to investigate' encroachments on Duval street at its most northerly terminus,that is,from a point where Duval street intersects the most northerly boundary of the City limits of the City of Austin,or from 27th street to the north limits of the City On motion the resolution was adopted.
Committee to put in effect side walk ord Alderman Cuneo offered the following resolution ,which was read and Adopted;Be it resolved by the City Council of the City of Austinthat the Mayor be and he is hereby instructed to appoint a Committee of two members of the City Council together with three Citizens of the City of Austin,together with the City Engineer and City Attorneyfor the purpose of putting into effect the side walk ordinance of the City of Austin
Marshal et al to enforce the side walk ordinance of Alderman Wilhelm offered the following resolution,which was read and adopted; Be it resolved by the City Council of the City of Austin,that th the City Marshal,the Police force,and the Sanitary Officer,be and are hereby instructed to strictly enforce the ordinance providing a penalty for turning water on the fire hydrants of the City,without hose attached to prevent injury to the pavements and the streets of the City,and be it further resolved that the Marshal give public noticethat said ordinance will in future be enforced.
Side walk [illegible] committee Alderman Scott moved to reconsider the vote by which the Council passed the resolution of Alderman Cuneo for the appointment of a Committeefor putting in force the Side walk ordinance,,which motion prevailed. Alderman Scott moved to amend the ordinance by making the number of Aldermen on the Committee,4 instead of two.The amendment was adopted,and the resolution ,as amended was then adopted .

By Alderman Haynes an ordinance appropriating the sum of $150.92 for purpose of paying approved Accounts;The ordinance was read the first time and passed under suspension of the rules by the following vote; Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller,Moore, Petri,Redd,Scott,Smith,Sutor & Wilhelm 13 Nays none.

Alderman Cuneo offered the following resolution,which was read and adopted; Unum is [illegible] [illegible] Resolved that the Mayor and City Attorney be instructed to close the purchase [illegible] of [illegible] [illegible] from Mr Max Hauschild of the stables for the City and the transfer of Mr Hauschilds lease to the City of Austin. [illegible] allowance for Alderman Haynes moved that the Mayor be authorized to donate monthly,to the Childrens Home Childrens Home the sum of $ 5,00,which motion prevailed. Can to Purchure (Roob) On motion of Alderman Moore Alderman Scott, Moore & Redd with the City Engineer Crusher and Mr A C Goeth were appointed a Committee to go to San Marcos and witness a trial of the rock Crusher that the City Contemplates purchasing.
