Petitions Memorials,Etc : By the Mayor petition of Felix Cherico,asking the Council to refund certain pound fees,On motion the petition was granted . By the Mayor petition of Mrs N J Dorris ,asking to have certain pound fees refunded,On motion the petition was granted . By the Mayor petition of J L Costley asking to have party occupying; a portion of the street at East 1st and East Avenue remove out . On motion of Alderman Moore the petition was granted,and the Marshal directed to remove obstructions,under the instruction of the City-Atty with 30 days . Aldermen Read & Scott entered the Council Chamber . The Mayor laid before the Council a petition from M V Crenshaw asking; permission to occupy a portion of the street at the corner of East Avenue and first street for twelve months longer .On motion of Alderman Moore the petition was rejected . The Mayor laid before the Council a communication from T W Powell,asking payment of salary as Keeper of Parks for the months of March & April 1908 . On motion the communication was referred to the Park Committee ,with instructions to report at the next regular meeting of the Council . By the Mayor petition of Citizens asking; that a road be opened through Fair View Park in South Austin Road and on motion referred to the Street Committee. By the Mayor petition of Citizens asking to have certain street work done in Hyde Park Road and on motion referred to the street Committee . By the Mayor petition of Citizens of Hyde Park asking that Fire plugs be put in on certain streets in the Park .Read and on motionreferred to the Water & Light and Fire Committee .to report at next meeting . By Alderman Read petition of Mrs A Ganus,asking permission to repair building within the Fire limits.On motion the petition was granted . By Alderman Read,by request,Petition of Citizens Against the passage of the dog muzzling ordinance The petition was read and on motion was laid over to come up with the ordinance on the subject .
Reports of City Officers : The Mayor laid before the Council the report of the City Treasurer for the month of April 1908,which was on motion referred to the Finance Committee,without reading. Reports of Standing Committees : Alderman Scott for the Street Committee made a verbal report as to certain work being done by the street gang . Alderman Haynes for the Finance Committee presented a communication from Milton Morris who was employed to Audit the report of the Water & Light Commission for the year 1907 ,stating progress made,and asking further

Ordinance Dog Muzzling ordinance Cemetery [illegible] report time in which to complete their report .On motion further time was granted . Alderman Cuneo for the Ordinance Committee to whom was referred a petition from Citizens for the Muzzling of Dogs,presented a report recommending the passage of an ordinance submitted by the Committee.On motion the report was laid over to come up with the ordinance submitted by the Committee. Alderman Crooker for the Cemetery Committee to whom was referred the report of the Sexton for the month of April 1908,presented a report stating that same had been examined and found correct,On motion the report was adopted . Alderman Moore for the Water & Light Committee presented the following commu nication from the Water & Light Commission ,
Water & Light Dam Work Austin,Texas, May 18th 1908. The Honorable the City Council of the City of Austin,Austin ,Texas . Gentlemen : Under instructions from the Water,Light and Power Commission ,I herewith transmit to you a copy of report of F M Maddox,Mayor,suggesting a plan for the rebuilding of the Austin dam,which report has been adopted by this Comm-mission . I was instructed to hand this copy to you ,to give you official notification of the same,and to set forth to you in an official manner,the views of this Commission in reference to the rebuilding or said dam,power house,etc . We are now engaged in making a series of borings with a view of determining the formation of the foundation of the old dam site,and when said borings shall have been completed -which we hope will be within the next month-a more detailed statement and accurate estimate will be prepared by Mr Walter G Kirkpatrick and his associate Engineers in charge of the work,at which time this Commission will ask at your hands further action thereon,as they deem wise and expedient . W & L Comm. [illegible] further [illegible] On motion of Alderman Moore the communication was received and ordered filed . Alderman Moore for the Water & Light Committee presented a Communication from the Water,Light and Power Commissioners regarding sale of certain Lots,Buildings and Machinery belonging to the City Power House recently used by the City , together with a resolution authorizing the Mayor to make a deed to same to Walter Tips to such Lots,Buildings and Machinery . The communication was read .Alderman Moreland moved that the communication and resolution be returned to the Commission without the approval of the Council, which motion prevailed by the following vote:Yeas Alderman Armstrong,Crooker,Cuneo,Haynes,Herron,Moreland,Petri, & Wilhel- 3 Nays Alderman Miller,Moore,Redd,Scott,Smith & Sutor 5 Alderman Sutor for the Sanitary Committee to whom was referred the petition of Henry Stokes et al for an extension of the Sewer on West Avenue presented a report recommending that the petition be referred to Guy A Collett Manager ,with the request that he submit the petition to the Directors of the Sewerage Company with the request that they grant the petition .On motion the report was adopted. Mayor's Veto opening street Hyde P[illegible]
In accordance with the power vested in me as Mayor by the Charter of the City of Austin,I herewith return to you without my approv -al the report of the majority Committee ,of date may 4,1908,and resolu-tion of the Council adopting said report . The petition , date January,1,1908 ,addressed to the Mayor and members of the City Council of the City of Austin,requesting the open-ing of fourth street in Hyde Park,Travis County,Texas,where the same connects Avenue H with Duval street,was filed by certain Citizens living in the northern portion of the City of Austin,and after its filing representations were made to the Cityby parties interested in the granting of said petition to the effect that ,if the City Council would order the street opened in accordance with said petition,the Citizens interested in the granting of said petition would pay to the City all expense necessary to the opening thereof .That the petition,the report of a majority of the Committee ,and the resolution adopting the report of said Committee,bear no record of these promises ,and there has been up to this date no money placed at the disposal of the City or any of its officers towards defraying the expenses incident to the forcible opening of said street by the City .
The City of Austin is now close run and in need of funds with which to care for and work the streets which have already been thrown open to the public,and has no money with which to condemn and open new streets . Therefore,until the parties interested in the opening of Fourth street see fit to give to the City of Austinthe money necessary to defray the expense of the opening of said street,I must return the resolution authorizing the City to open said street with my veto Respectfully submitted F M Maddox,Mayor .
Alderman Crocker moved to reconsider the vote by which the Council adopted the report of a majority of the street Committee ,granting the petition of Citizens asking the Council to open Fourth street in Hyde Park Connecting the same with Avenue H and Duval Streets,which motion prevailed .Alderman Reed moved to adopt the report,notwithstanding the Mayors objections,which motion was lost by the following vote ; Yeas Aldermen Reed & Wilhelm 2 Nays Aldermen Armstrong,Crocker,Cuneo,Haynes,Meredith,Miller Moore, Moreland,Petri,Scott,Smith & Sutor 12
Alliances Yard Serv makes Munit [illegible] Alderman Haynes offered the following resolution : Whereas,under the police regulations of the City,all wagons with wood, Cotton,Hay,Corn and other country produce,are now prohibited from standing on the business streets of the City,And Whereas,it is necessary to the public that some place be designated where such wagons,for the sale of such products,may be allowed to stand during the day , Therefore Be it resolved by the City Council of the City of Austin,

113 . that the Public Square or Block ,located on East 5th,between Neches and Trinity Streets,be and is hereby designated for such public use,and the City Marshal is hereby instructed to indicate points on said square where wagons for sale of as each character of product,may stand,and that he take the necessary steps,without delay ,to have said block cleared for the purpose indicated and to permit no cotton or other product to remain stored on said block,which must at all times be kept openfor public use . Extension of time By Alderman Crooker An ordinance extending the time to complete one mile of Rail Way track within the limits of the City of Austin,under an ordinance granting a R W Carroll right of way and other privileges over,along and on the streets and Avenues of Interurban Road Austin,Texas,originally in the name of Ralf W Carroll of New York City ,his associates and assigns,passed by the City Council of Austin,on the 4th day of June A D 1905 and approved by the Mayor of Austinon June 5th 1905,and under subse-quent ordinances amending the same .The ordinance was read the first timeand passed under suspension of the rules by the following vote : Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller,Moore ,Moreland, Petri,Redd,Scott,Smith,Sutor & Wilhelm 14 Nays none . 1905 . 114 Adjourned Regular meeting of the City Council
Austin, Texas, May 21st 1908;
Hon F. M. Maddox,Mayor Presiding; Roll called: Present Aldermen Armstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Absent Alderman Meredith 1 On motion Alderman Meredith was excused,on account of sickness in his family Dog ordinance The Mayor laid before the Council An ordinance providing for the muzzling of all dogs running at large in the City of Austin, together with the report of the ordinance Committee, recommending its passage. Alderman Redd moved to adopt the report of the Committee, which motion prevailed. The ordinance was read the first time, and on motion the rule was suspended and the ordinance placed on its second reading by the following vote: Yeas AldermenArmstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none. The ordinance was read the second time. Alderman Cuneo moved to amend same by adding, " Section 5. That the part of this ordinance which provide for the muzzling of dogs shall not be operative except during the months of June, July, August September & October of each year "The amendment was adopted and the ordinance as amended was passed under suspension of the rule by the following vote: Aldermen Armstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none. W & L Com. resolution Alderman Wilhelm offered the following resolution which was read & adopted: Spot in Hydrants Be it resolved by the City Council ,that the Water & Light Commission @ 12-St be and are hereby instructed to place a Fire hydrant on East 12th and Poquito streets. Claim of Miss Wright By Alderman Haynes an ordinance appropriating the sum of $ 475.00 for the purpose of paying the claim of Miss A Wright for damages. The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none. Petitions Alderman Redd moved to suspend the regular order, and to return to grants permit petitions, which motion prevailed. By Alderman Redd petition of Earl B fence Walker for permission to erect a Galvanized Iron Fence within the Fire limits. On motion the petition was granted by the following vote: Yeas AldermenArmstrong, Crooker, Haynes, Miller, Moore, Petri, Redd, Scott Smith & Sutor 10 Nays Aldermen Cuneo, Moreland & Wilhelm 3 Fines remitted The Mayor reported to the Council that he had remitted fines for the following persons, Viz:H T Whitesides, E Whitaker, T B Colemank Will Moore, also the following pound fees, viz:D L Mc Farland & Tillman Moore. On motion the action of the Mayor was approved.

115 Board of Equalization appointments. The Mayor stated to the Council that he had appointed Messrs R P Bull Jas P Hart & H M Metz as a Board of Equalization, and asked that the Council confirm the appointments. The appointments were confirmed by the following vote: Yeas Aldermen Armstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Smith, Sutor & Wilhelm 13 Nays none.
City Cemetery work By Alderman Crooker, an ordinance appropriating the sum of $ 200.00 for the purpose of paying for work done in the City Cemetery . The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Aldermen Armstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none.
Dog Catcher Election Alderman Cuneo moved that the Council now proceed to the election of a Dog Catcher, which motion prevailed. The Mayor appointed Aldermen Wilhelm, Moreland & Smith as Tellers. Alderman Crooker nominated Los Evans, Alderman Moore nominated C P Rankin, Alderman Scott nominated Wilson Leecroy. On motion nominations were closed The Tellers announced the following as the res result of the ballot, Viz: Evans 8, Rankin 3 Leecroy1 Mallory1. Los Evans having received a majority the Mayor declared him duly elected Dog Catcher for the ensuing term.
Hitching Posts City Hall By Alderman Moore an ordinance appropriating the sum of $ 175.00 for the purpose of paying for Hitching Posts and rails around the City Hall. The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none.
Cuneo & S. Boyce By Alderman Scott an ordinance appropriating the sum of $ 155.00 for the purpose of paying Commission to Guy S Boyce as Supervising Engineer on retaining wall and paving work on Congress Avenue . The ordinance was read the first time and on motion of Alderman Moore was referred to the Ordinance Committee with instructions to report at the next regular meeting of the Council . Alderman Haynes moved that the Marshal be authorized and directed to procure a
Dog pound dog pound. Alderman Cuneo moved to amend the motion by adding "and Police Committ," Alderman Smith moved as a substitute"that the Marshal select a place and report at the next meeting of the Council " The substitute was adopted .
A.G. Ferris Services By Alderman Scott an ordinance appropriating the sum of $ 75.00 for the purpose of paying A G Ferris for services doing profile work . The ordinance was read the first time and on motion was referred to the Ordinance Committee with instructions to report at the next meeting of the Council .
Approved Accounts Street Dept By Alderman Scott an ordinance appropriating the sum of $493.98 for the purpose of paying Approved Accounts Street Dept . The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crooker, Cuneo, Haynes, Miller, Moore, Moreland, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none.

On motion of Alderman Haynes the ordinance was referred to the Finance and Paving Committees . Alderman resolution Cranberry Cotton Yard property Alderman Moore offered the following resolution. Be it resolved by the City Council of the City of Austin;That S C Cranberry as custodian and Manager of the Farmers Cotton Yard be and is hereby granted permission to remove such property that belongs to the

117 .Farmers Cotton Yard corrislir, of alleys, fences, platforms & houses belongin to them Alderman Haynes moved that the resolution be referred to a Special Committee of three, together with the City Marshal, with power to act. Alderman Cuneo moved that the parties be allowed 50 or 60 days time in which to comply with the resolution . The motion of Alderman Cuneo was lost by the following vote : Yeas Aldermen Cuneo, Miller ,Redd & Sutor 4 Nays Aldermen Armstrong, Crooker, Haynes, Moore ,Moreland, Petri, Scott, Smith & Wilhelm Motion adopted The motion of Alderman Haynes was then adopted . The Mayor appointed Aldermen Haynes, Cuneo & Moreland as such Committee . Resolution adopted The resolution of Alderman Moore as amended was then adopted . W&L Com. requested to Alderman Moore offered the following resolution which was read and adopted . Place light at Willow Be it resolved by the City Council of the City of Austin, that the Water and Navasota St Light Commission be requested to place an Arc light on East Willow & Navasota St By Alderman Cuneo an ordinance appropriating the sum of $ 200,00 for the purpose Bartons Creek road o repairing and improving the street leading from Bartons Creek Bridge to the Colorado River Bridge . The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Aldermen Armst rong, Crooker, Cuneo, Haynes, Miller, Moore ,Moreland, Petri, Redd , Scott, Smith ,Sutor & Wilhelm 13 Nays none . Chicken Ordinance By Alderman Scott an ordinance prohibiting the running at large of Fowls within a prescribed district within the City of Austin, and providing a penalty therefor; The ordinance was read the first time; Alderman Cuneo moved to refer it to the Police Committee, which motion was lost by the following vote : Yeas Aldermen Cuneo, Redd & Wilhelm 3 Nays Aldermen Armstrong, Crooker, Haynes, Miller, Moore ,Moreland, Petri, Scott, Smith & Sutor 10 A motion was then made to suspend the rule and place the ordinance on its second Reading, which motion was lost by the following vote : Yeas AldermenArmstrong, Crooker, Haynes, Moreland, Scott, Smith & Sutor 7 Nays Aldermen Cuneo, Miller, Moore, Petri, Redd, & Wilhelm 3 By Alderman Scott an-ordinance-appropriating the sum of $ 200,00 for the purpose offered the following resolution: Resolved that the Mayor be authorized to $200,00 for Duval St. gurantee to the County Commissioners Court $ 200.00 to build one mile of street 18 feet wide on Duval street within the City limits , provided the County has to pay a like amount; provided the Street Committee shall designate where such street between -The resolution was adopted by the following vote : Yeas Aldermen Arm strong, Crooker, Cuneo, Haynes, Moreland, Scott & Wilhelm Smith 8 Nays Aldermen Miller ,Moore ,Petri Redd & Sutor 5 On motion the Council adjourne : Jno.
