Dam Ordinance Approved: The city council voted to block any action on the controversial dam ordinance until the Water & Light Commission presents a concrete proposal for dam construction, following input from a citizen committee of fifty.

Street Improvements Funded: The council appropriated $2,200 to pave Congress Avenue between 3rd Street and the Colorado River, and approved purchasing a motorized road roller from Chicago after successful testing showed it was economical and effective.

Park and Sanitation Work: The city allocated funds for park repairs on Rio Grande Street and authorized daily street and gutter cleaning as a public health measure, with a proposed salary increase for street workers on Sundays and holidays.

Real Estate Transaction: The city approved selling property and a building to the Tips Foundry & Machine Company for $3,550, though this decision was controversial with some council members opposing the sale.

Fire Department Funding: The council provided $965 to the Hook & Ladder and Colorado Fire Companies, plus reimbursed the South Austin Fire Company $105 for building repairs.

118 Regular meeting of the City Council, Austin, Texas June 01, 1908: Hon F. Maddox, Mayor, Presiding; Roll Called: Present Aldermen Armstrong, Crooker, Cuneo, H Haynes, Meredith, Moore, Moreland, Petri, Scott & Smith. 10 Absent Miller, Redd, Suter & Wilhelm 4 The minutes were approved, without reading. Petitions, memorials, etc Hon Walter Tips, Chairman of Citizens Committee, presented the following Communication. At a meeting of the Citizens Committee of fifty, held Dam Committee May 21, 1908 at 10o'clock in the Parlors of the Driskill Hotel Austin, report resolution Texas, Hon Walter Tips Chairman, Presiding and William G Bell Secretary. Meeting was held for the purpose of meeting Mr W L Church of the Amburgen Hydraulic Construction Co of Boston, Mass, who is here looking over the situation with reference to rebuilding the Austin Dam. After a general discussion the following resolution was offered by H L Haynes a member of the Committee, on motion duly seconded, resolution was adopted as follows: Resolved; It is the sense of the Citizens Committee of fifty, that the City Council be requested to take no action, looking to nullifying or rescinding of the ordinance, known as the Dam ordinance; until requested to do so, by the Citizens Committee of fifty, called in executive session by the Chairman of the Committee. (Sgd) Wm G Bell Secretary. (Sgd) Walter Tips, Chairman Alderman Wilhelm entered the Council chamber. Alderman Moore moved that the communication presented by Col Tips be received and filed. Alderman Moreland offered the following resolution. Be it resolved by the City Council of the City of Austin, Texas to City Council of the City of Austin; Grant the request of the Citizens Committee of fifty in this, that the said Council take no action towards nullifying what is commonly known as the "Dam ordinance" until requested so to do by said "Committee of fifty". Alderman Cuneo offered a substitute for Alderman Moreland's resolution. Alderman Moore moved a call of the Council, which was seconded, and the Marshal directed to bring in the absentees. Alderman Miller was excused as he was serving on a jury in the District Court and looked up. Alderman Petri entered the Council after he was answered to his name. Alderman Crooker moved to suspend the call, which motion the Mayor ruled was out of order. Alderman Redd entered the Council chamber and answered to his name. The Council being full the call was suspended. Alderman Moreland withdrew his resolution Alderman Cuneo withdrew his substitute and the motion of Alderman Moore to receive and file the communication was adopted. Reports of City Officers : Reports of City officers The Mayor laid before the Council the report of the City Sexton for the month of May 1908 and that of the Water &Light Commission for the quarter ending March 31st 1908 8 which were on motion referred to their appropriate Committees without reading . Reports Standing Com. Reports of Standing Committees : Comm. Alderman Scott for the Street Committee presented the following report,which was read and adopted . Austin, Texas June 1,1908 To the Honorable the Mayor and City Council,City of Austin, Texas. Gentlemen: Street acceptance We your Street Committee, and City Engineer, beg to report that the American Motor Road Roller Road Roller, which was taken on trial from the Austin-Western Company of Chicago has been thoroughly tested ,and proven to be entirely satisfactory for the work for which it is intended .The machine is easily controlled ,consumes no fuel while it is not actually running, and is economical in operation .The consumption of gasoline per day is between 15 and 20 gallons,according to the character of work upon which the rolling is done.Naphtha can also be satis factorily used in the engine at a saving of bout three cents per gallon.We are using the latter on a matter of accrecy,it is really a cost of about $2.00 for an all day run. The engine also operates the rock crusher attachment,there being a large margin of power for this work, and an ample margin for rolling. Since we have had the roller no trouble has developed which could be attributed to improper construction or inefficiency.A crack developed in the cylinder on two occasions on account of defective castings ,which were immediately replaced by the Company ,who guarantee the roller for one year against such defects . We believe the roller to be a good piece of machinery, and of much benefit in making and repairing of streets. We therefore recommend its acceptance by the City, and the payment of the first installment of the purchase price in accordance with the contract . --- Page break --- 120 The report was adopted by the Street Committee and City Engineer Alderman Scott for the Street Committee presented a general report as to damages to streets during the late heavy rains, which was read and ordered filed . Finance officer report Alderman Haynes for the Finance Committee to whom was referred the report of the Assessor & Collector for the months of Feby, March & April and those of the Treasurer for March & April and that of the Clerk for April 1903, presented a report stating that they had all been checked and found correct .On motion the report was adopted . Ordinance Claim Boyce Alderman Cuneo for the Ordinance Committee to whom was referred an ordinance appropriating the sum of $ 155,00 to pay G S Boyce for servi-ces superintending Paving and Retaining wall, presented a report recom- -mending that the ordinance do pass .On motion the report was adopted . City Hall & building Alderman Moore for the City Hall Committee presented a report showing the cost of the New City Hall, which was read and ordered filed . On motion of Alderman Moore the report was ordered published . Finance Paving ordinance Alderman Haynes for the Finance and Paving Committee to whom was referred an ordinance appropriating the sum of $1000,00 for the purpose of paying for paving work on Congress Avenue between 3rd street and the River, presented a report stating that there is now pending a suit for damages against the Contractors and the City and that until said suit has been disposed of or until such time as the Contractors secure the City against loss occasioned by said suit, that the City should hold the money due said Contractors. On motion the report was adopted . Unfinished business : ? Unfinished business Paving Cong Avenue The Mayor laid before the Council an ordinance appropriating the sum of $ 2200,00 to pay for Paving Congress Avenue between 3rd street and the Colorado River .The ordinance was read the third time and passed by the following vote : Yeas Alderman Armstrong, Crooker, Haynes, Meredith, Moore, Moreland, Petri, Redd Scott, Smith, Sutor & Wilhelm 12 Nays none . Chicken ordinance The Mayor laid before the Council the Chicken ordinance, which was read the second time, and a motion made to suspend the rule and place it on its third reading, and said motion was lost by the following vote : Yeas Alderman Armstrong, Crooker, Haynes, Meredith, Moore, Moreland, Petri, Scott & Sutor Nays Alderman Feld, Smith & Wilhelm 2 3 G S Boyce bill The Mayor laid before the Council an ordinance appropriating the sum of $ 155,00 for the purpose of paying G S Boyce for services supt paving and work on retaining wall, together with the report of the Committee stating that the original ordinance had been lost, and offering a substitute ordinance . The substitute was read . Pound fees remitted The Mayor announced that he had released stock taken up by the pound Master, without payment of fees for the following named persons, Viz: C A Ellingson & E S G Griffith, and asked that the Council confirm his action. On motion the fees were remitted. New business: D J O Kane appointed The Mayor stated that the Acting Mayor and the Alliance Yard Committee had Sp. off. at Alliance appointed Mr D J O Kane as a special officer in charge at the Alliance cotton yard, and asked that the appointment be confirmed. On motion the appointment was confirmed. On motion the regular order of business was suspended to allow the special Dog Dog Pound located house Committee to report. The Committee made a verbal report stating that they had been unable to find a place other than the 7th Ward, and recommended a place lower down the river to locate the dog pound. The report of the Committee was adopted. On motion of Alderman Moore the Special Garbage & Creamatory Committee was Garbage & Creamatory authorized to go to Houston and examine a creamatory erected there. Com. to inspect Houston Alderman Moore offered the following resolution which was read and adopted Be it resolved by the City Council of the City of Austin:That the City Treasurer Transfer funds of the City of Austinbe and he is hereby instructed to transfer from the Perma-nent Paving Fund to the Street Improvement Fund the sum of Forty six hundred ( $ 4500,00 ) dollars ,conditioned however,that the Street Improvement Fund shall pay back to the Permanent Paving Fund said sum of $ 4500.00 out of the first collections of taxes for the year 1900 . Wo[d]light Commission to Confirm Sale of Lots etc. The Mayor laid before the Council a communication from the Water and L ight Commission asking that the Council confirm sale of certain Real E state to Walter Tips & Co . Alderman Moreland moved that the Council d ecline to confirm said sale . Alderman Moore offered the following r esolution, viz; Be it resolved by the City Council of the City of Austin, T exas,that the report of the Water, Light, and Power Commission in so far a s said report referred to the sale of the real estate and building t hereon, and no further, is hereby approved and the Mayor is hereby a uthorized and directed to execute and deliver to the Tips Founderyand M achine Company a good and sufficien deed for said real estate and b uilding and deliver possession of same to Tips Foundry & Machine C ompany upon their payment of the purchase price,viz. Alderman Moore offered the following amendment " Amend by making salary street sweepers $ 2.00 per day for legal hollidays and sundays " On motion the resolution and the amendment were referred to the Ordi-nance Committee and City Attorney with instructions to report at the next regular meeting of the Council . Alderman Scott offered the following resolution " Whereas Citizens of Gas oil refuse etc this City desiring to enjoy the pleasure of the sport of fishing on the in Colorado River Colorado River between the R R Bridge and the Avenue bridge which should not be denied them; And whereas the Austin Gas Company by reason of the oil refuse discharged into the river opposite to their plant in a quantity sufficient todestroy all fish spawn below said point, and ; Whereas said Citizens believe that the discharging of said oil refuse into the river should be stopped; Therefore be it resolved by the City Council of the City of Austinth at said Gas Company is hereby instructed to at once disp -pose of said oil in some other manner than the one now employed . This resolution to take effect on and after its passage . On motion the resolution was referred to the Ordinance Committee and City Attorney with instructions to report at the next regular meeting .
