Alderman Petri for the Claims & Accounts Committee to whom was referred the petition of J B Thornton,asking to have unearned Liquor license refunded, presented a report stating they had investigated the matter and found that there was due him the sum of $ 20.97 ,and recommending that this sum be paid to A Montgomery as agent upon the surrender to the Assessor & Collector of the license issued to him.On motion the report was adopted .
Ben Morrall Hayes. Alderman Petri for the Claims & Accounts Committee to whom was referred the petition of Ben Morrall asking for correction of assessment ,presented a report stating that the Council was without authority to correct an assessment made by the Board of Equalization ,and therefore reported adversely on the petition . On motion the report was adopted .
Mrs Rosa Klein. Alderman Petri for the Claims & Accounts Committee to whom was ereferred the Taxes petition of Mrs Rosa Klein for correction of assessment,presented a report recommending that the petition be granted .On motion the report was adopted . Mike Oats demages .On motion the report of the Committee was adopted . The Mayor laid before the Council a petition from Mike Oats,asking the Council to pay him for his house which had been torn down and destroyed by order of the Council.On motion the petition was referred to the Committee on Claims & Accounts . The Mayor laid before the Council the following report from the Paving Committee.
Austin,Texas,July 5th 1908 . To the Hon Mayor and City Council ,City of Austin,Texas . Gentlemen : Paving bids W 6th st We ,your Paving Committee,beg leave to report that with a view of preparing for the paving of West sixth street from the alley west of Congress Avenue to the west side of Guadelupe street,we advertised for bids in the Austin Statesmanfive days,and in the Dallas News. Two bids were received and opened at 5 P M Monday June 15th,one being from St John & Rex,of Austin,at $ 2.24 per square yard including excavation,and the other from Ockender Bros of Waco.for $ 2.36 per squase yard for paving and 40 cents per cubic yard for excavation,with a guar-antee that no claim would be made for excavation to a greater depth than 9/10 of a foot The excavation at this limit would amount to 12 cents per surface yard,making a total of $ 2.22 per square yard for the paving . As this latter bid is 2 cents per square yard lower than the bid of St John & Rex ,Ockander Bros were informed that they were awarded the contract subject to ratification by the City Council. Gentlemen : Spe Garbage C.- Your Special Committee to whom was referred the construction of a garbage destructor for the City of Austin beg leave to report: That your Committee has received propositions from various manufactures of garbage creamatories and found them all too expensive for this City.This Committee by resolution of your honorable body,was instructed to go to Houstonand examine a garbage destructor now being

Your Committee in followin: your instructions went to Houstonon the 15th day of June.Mr Thompson and Mr Duller of that City extended to us courtesies and information that could not have been obtained by any other means .We found that they had discarded a large oramatory costing: $ 12000,00,as unsatisfactory and had erected a destructor of their own, erected under plans furnished by Mr Thompson,one of the Commissioners,and built entirely of scrap material . We examined the plant and saw it in operation and can say that it meets all of our requirements in every respect.This destrutor has been patented by Mr Thompson and is now on the market under the control of the Webber-Duller Construction Co of Houston,Texas .Hence cannot be built by anyone without paying a royalty to said Construction.We interviewed the Construction Company through its manager,Mr Duller, and agreed to the following proposition,subject to your approval: The Company will furnish all plans and specificationsand make two inspections for the sum of $ 500,00,said sum to be paid in installments as follows:$ 300,00 upon acceptance of plansand $ 200,00upon the completion of the destructor.They will furnish you with a special foreman for $ 3.50 per day.We can under this proposi-tion build this destructor for approximately $ 9000,00,a net saving to this City of $ 3000,00 to $ 10,000,00. We would suggest that bids be asked for upon the construction of destructoren plans and specifications ,omitting the patented smokestack,which will cost $ 500,00 This Committee would further suggest that the health of our City,the lives of our people,rest upon the action of your honorable body.For years past ,your garbage of whatever kind imaginable has been dumped on the river front and burned. The result has been that this refuse has not only caused sickness,but has become a public nuisance,and we should avail ourselves of this opportunity of getting a destructor at a nominal cost and thereby receiving the thanks of our constituency. Fines On motion the report of the Committee was adopted. Clara Hoffman The Mayor reported that he had remitted a fine assessed in the Recorders Court Lula Carreon against Mrs Clara Hoffman,and had also remitted the fine of Lula Carreon, Remitted except the costs,and asked that the Council confirm his action.On motion the action of the Mayor was confirmed . Dam & repair. The Mayor laid before the Council a communication from Eli Testerof New York City in regard to the rebuilding of the dam,also copies of letters written by him to Mr Tester on the subject,which were on motion referred to the Water & Light Commis-sion.

The ordinance was read the first time On motion of Alderman Haynes the ordinance was referred to the Special Committee on Creamatory, together with the Finance & Paving Committees , with instruction to report at an adjourned meeting of the Council to be held Thursday July: 9th 1908 ,at 8 oclock P M . Alderman Miller offered the following resolution ,which was read and adopted .
Be it resolved by the City Council of the City of Austinthat Fred Malone leave absence Fred Malone, Bridge Keeper of the bridge across the Colorado river at the foot of Congress Avenue, be and he is hereby granted a leave of absence for ten days ,beginning with Tuesday , July 7th 1908 ,with full pay On motion the Council adjourned until Thursday July 8th 1908 ,at 8 oclock P M .

Present Aldermen Armstrong,Crooker,Cuneo,Haynes,Moore,Moreland,Smith & Wilhelm 10 Absent Aldermen Miller,Redd Scott & Sutor Alderman Crooker moved a call of the Council ,which was seconded,and the : Marshal directed to bring in the absentees . Aldermen Miller Redd & Scott entered the Council chamber and answered to their names.On motion the call was suspended . The report of the special Creamatory Committee was read.Alderman Crooker moved that the City Attorney be directed to draw a resolution transferring the sum of $ 1000,00 from the Permanent Paving fund to the General fund,which motion prevailed . Creamatory Cm report The Mayor stated to the Council that he had remitted a fine imposed in the Recorders Court against Adolph Heffellder,and asked the Council to approve of his action.On motion the action of the Mayor was confirmed . Alderman Cuneo offered the following resolution which was read and adopted: Resolved that the special Committee on Garbage Creamatory and the sanitary Committe be instructed to advertise for bids for the construction of said Creamatory,and tha that the Mayor be instructed to enter into a contract with the Webber Duller Co for their part of the contract as agreed upon by the Committee and the Webber Duller Co . Alderman Moore for the City Hall Committee presented the following report which was read and adopted : To the Hon Mayor and the City Council of the City of Austin; Gentlemen : We your City Hall Committee heretofore appointed be; leave to report that after much labor and many meetings in which we have sought to safeguasd the interest of the City ,we have finally accepted the remaining portion of the City Hall and here and now recommend to the Council the acceptance of said building as a whole and request the discharge of R M M Moore this Committee Respectfully C W Moore J M Meredith Henry Petrick Tom D Smith A E Cuneo Report City Hall Cm accepting building Alderman Moore moved to reconsider the vote by which the report of the City Hall was adopted,which motion prevailed .A motion was then made to strike out of the report that part which discharges the Committee,which motion prevailed,and the report as amended was Adopted .
