to vote upon a proposition to change the City Charter. On motion the petition was granted. Communication from J C Shuter Ex-dog catcher ,stating that in 1904 he as dog catcher sold to one T J Moore two dogsfrom the pound, which he had never called for, and recommending that the amount paid by Mr Moore be refunded to him. O n motion the communication was referred to the Committee on Claims & Accounts By the Mayor petition from Marks Grain Co for permission to move a building within the fire limits. On motion the petition was granted . On motion of Alderman Moore all Ex-Mayors and Ex-Aldermen ,were invited to seats within the Council Chamber . By the Mayor petition of V V Warwick to remit fine assessed against him in the Recorders Court . On recommendation of the Mayor, the petition was granted .

By Alderman Crocker communication from W Ziller in regard to a claim for damages filed with the Council in June last . On motion the communication was referred to the Street Committee . By Alderman Crocker petition of Moore & Morrison asking to have certain pound fees refunded. On motion the petition was referred to the Committee on Claims& Accounts The Mayor laid before the Council a communication from Joe C Kirby in regard to Assessment made by the Board of Equalization ,which was read and referred to the Committee on Claims & Accounts . By the Mayor petition of Citizens asking to have a water ma in put in to block 23 Division C of the City . Read and on motion referred to the Water & Light Committee with instructions to report at the next meeting of the Council . By Alderman Haynes a Communication from Carl Mayor in regard to a building perm Permit . Read and on motion referred to the Claims & Accounts Committee .
By Alderman Crocker Petition of Citizens on the east side of the City asking the Council to consent to a change of the boundaries of the City so as to take in territory on the east side . Read and on motion referred to the Ordinance & Finance Committee ,The Mayor & City Attorney . By Alderman Meredith petition of Citizens asking that 34th street from Guadalupe to Speedway be opened . Read and on motion referred to the Street Committee . By Alderman Petri petition of the Carmichael Co ,Contractors for the new bridge across the the Colorado River for permission to erect certain buildings ,read and on motion the permission was granted . By Alderman Petri Petition of Rheedy & Webber for permission to erect a building within the fire limits. Read and on motion the petition was granted ,provided the application was approved by the Board of Fire Commissioners .

Reports City Officers Reports of City Officers : The Mayor laid before the Council the reports of the City Assessor & Collector,The Treasurer,the Clerk,The Marshal & The Sexton For the month of November 1908.,which were on motion referred to their appro-priate Committees without reading .

Street on petition for Public Weighers Alderman Scott for the Street Committee to whom was referred a peti-tion of John Young and others for a public weigher for the City of Austin,presented a report stating that they had investigated the matter and believed that it was necessary and recommended that the matter be referred to the City Attorney and the Ordinance Committee ,with instruc-tions to prepare an ordinance creating the Office of Public Weigher and prescribing his duties ,etc ,and report back at the next regular memeeting of the Council .On motion the report was adopted .
Deed to City for Lot in Fire Hall Alderman Moreland presented to the Council a deed from Chas Wolf Herman Becker & A J Zilker to Lot No 13 Block No 2 of subdivision of out lot Nos 31 & 32 in Division O of the City of Austin .Said Lots deeded upon condition that that they are to be held for a public fire station ,and that the City shall maintain and keep on said property a public fire station and Hall.On motion the deed was accepted. Alderman Cunze for the ordinance Committee asked for further time in which to report on certain matters that had been referred to that Committee,which request was granted .
Printing Com on Revised Ordinances Com to examine them appointed Alderman Moreland Chairman of the Printing Committee stated that the Revised ordinances of the City had been printed and turned over to the City Clerk,and moved that a committee be appointed to examine same and see if they were correctly printed,which motion prevailed,and the Mayor appointed Aldermen Moreland,Haynes & Meredith as such Committee .
Special on report of Supt on Audit Alderman Moreland for the Special Committee to whom was referred the communication of Mr R C Brooks Supt of the Water & Light Plant ,in answer to the report of Auditor Morris,presented a report ,sustaining the report of the Auditor. On motion of Alderman Cunze the report was adopted and ordered printed.
Direct by Alderman Scott Alderman Scott for Street Committee presented the following Report . Austin,Texas,Dec 7th 1908: To the Honorable Mayor and City Council ,City of Austin,Texas . Gentlemen: 24th street,at the west side of Rio Grande street,and des
several hundred feet west,although intened to be sixty feet wide,is only approximately 55 feet.The properties on the south side of the street

-have encroached on the street,probably on account of the incorrect location of 23rd street and other streets,as these infractions are said to be a foot or more short between 23rd and 24th streets,even with the amount of encroachment added in .Some time ago a curb line was given by a former City Engineer for the property on the southwest corner of 24th and Rio Grande streets,evidently with reference to the existing fence,and a brick curb built on this line. This brings the curb out about four feet nearer the true centre of the street than it should be ,but to throw the curb back to the proper line,viz,15 feet from the centre of the street,would swing it into a line of trees. The property owners to the west of the corner have recently completed a large house on their lot,and are anxious to build a cement sidewalk and curb,and set out trees. As the roadway is the proper width,notwithstanding the curb is out about four feet too far,we,your street committee and City Engineer,recommend that the new curb be allowed to be placed in line with the one now there,and that it be established as the curb line for that block,also that the present north curb line be established as the permanent line,inasmuch as the property owners agree to this,and it will enable the present tree line to be continued. On motion the report of the Committee was adopted. New business : New Business Alderman Haynes offered the following resolution ,which was read and adopted, Resolution on submitting New Charters for City Be it resolved by the City Council of the City of Austin: That whereas an election will be called to be held on Tuesday December 29th 1908,for the purpose of selecting a new charter for the City of Austin,to be presented to the 31st Legislature of the State of Texas. Therefore be it further resolved that all parties desiring to present complete drafts of charter to be considered at said election,be and they are hereby notif-fied and required to file same with the City Clerk on or before Dec 14th 1908, at noon,in order that same may be placed on the Official ballot. St Marys Catholic Alderman Scott offered the following resolution which was read and adopted, Church, use part of Resolved that St Marys Catholic Church be permitted to occupy 7 or 8 feet of the Side walk for entrance side walk on the north side of East 5th street for the purpose of building to building cement steps to the entrance of the building known as the old Catholic Church. Alderman Miller offered the following resolution: Street Committee Whereas, the vast amount of products from the Colorado Valley below Austin,must come to work E 5th over East 5th street,and it is naturally one of the most important thorough-fares to every property owner and resident of the City,and whereas said street is now in a fearful condition from the heavy traffic that passes over it daily, and is dangerous for driving , Therefore,be it resolved by the City Council

. of the City of Austinthst the Street Committee and the City Engineer should give this street needed attention in preference to residence streets and should without delay place it in a good condition. Alderman Moreland moved to amend the resolution by adding "E 1st stre The amendment was lost by the following vote : Yeas Alderman Moreland 1 Nays Alderman Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller ,Moore, Petri,Redd,Scott,Smith,Sutor & Wilhelm 13 The resolution was then adopted . On motion Alderman Crooker was excused from further.attendance at this session of the Council. Alderman Cuneo offered the following resolution,which was read and adopted.. Water & Light Commission requested to place Arc light on trolley pole of R.R. on Cong Avenue. Whereas in Congress Avenue,the City of Austin can boast the handsomest street in all the southland,save and excepting its badly illuminated condition,giving it,at night the appearance ofs deserted and lonely villiage street,and Whereas,the Water & Light systemis now in a condition to furnish better lights to the Citizenship,and because it is is the wish of all our people,therefore be it resolved the Hon Board of Water L & Light Commissioners of the City of Austin are hereby most respectfully requested to place an Arc light on each and every trolly pole of the Austin street R R Co on Congress Avenue Between 11th street and first street in the City of Austin Texas. Alderman Haynes moved to suspend the regular order of business,and allow him to introduce a petition,which motion prevailed. Austin Electric R.R. Co for permission to change track By Alderman Haynes petition of the Austin Electric R R Co asking permission to change its line pknown as the "Blind Institute"line The petition was read and laid over to come up with an ordinance granting the permission . By Alderman Haynes an ordinance permitting the Austin Electric Railway Company to change its track from 17th & San Jacinto streets to East 11th & Brazos street,East 13th & San Jacinto street to a connection with its present tracks on 15th and Congress Avenue . The ordinance was read the firrst time and on motion was referred to the ordinance and Street Committeee . Approved A/cs By Alderman Haynes an ordinance appropriating the sur of $ 1697.31 for the purpose of paying approved Accounts: The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Alderman Armstrong,Cuneo ,Haynes,Meredith,Miller,Moore , Moreland,Petri,Redd,Scott,Smith,Sutor & Wilhelm 13 Nays none . Approved A/cs Street Dept By Alderman Scott an ordinance apropriating the sum of $ 218.74 for the purpose of paying approved accounts,Street Dept . By Alderman Scott an ordinance appropriating the sum of $ 300.00 for the purpose of paying weekly pay rolls of street Dept:The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Aldermen Armstrong,Cuneo,Haynes,Meredith,Miller,Moore,Moreland,Petri,Reid, Scott,Smith,Sutor & Wilhelm 13 Nays none Culvert Avenue " By Alderman Scott an ordinance appropriating the sum of $ 55.00 for the purpose Hyde Parke of paying for a permanent culvert across Avenue " G " at Nays lake Hyde Park. Adjourned regular meeting of the City Council,Austin,Texas Dec 14th 05 Hon F M Maddox,Mayor Presiding,Roll called: Present Aldermen Crocker,Cunee,Haynes,Meredith,Miller,Petri,Redd, Scott & Wilhelme Smith 10 Absent Aldermen Armstrong,Moore,Moreland & Sutor 4 Alderman Moore moved a call of the Council,which was secondedand the Marshal directed to bring in the absentees . Om motion Alderman Moreland was excused from attemdence at this ses-sion of the Council. Aldermen Armstrong,Moore & Sutor entered the Council chamber and answered to their names.On motion the call was suspended . Death of Geo L Hume The Mayor laid before the Council a communication from J P Schneider Announced to Council Vice President of the Water & Light Commission announcing the death of Mr Geo L Hume President of the Water & Light Commission. Alderman Moore moved that the communication be received and filed and Com. to draft resolution that a committee of three be appointed to draft suitable resolutions, and report the same to the Council,which motion prevailed,and the Mayor appointedAldermen Moore ,Crocker and Haynes as such committee. Petitions,Memorials,etc : Excelsior meat Market The Mayor laid before the Council a petition from the Excelsior meat Refund Fees. market,asking to have certain puond fees refunded,which was read and on motion referred to the Committee on Claims & Accounts. The Mayor laid before the Council a petition from Isaac Bledsoe Isaac Bledsoe. Building asking permission to remove a building inside the fire limits.The Permit petition had been approved by the Fire Commissioners.On motion the petition was granted. Mrs Cabiness The Mayor laid before the Council a petition from Mrs Cabiness asking building permit permission to make an addition to building within the Fire limits . The petition was recommended by the Fire Commissioners,and on motion same was granted. New business : Alderman Redd offered the following resolution,which was read and adop -ted: Be it resolved by the City Council of the City of Austin: Fire Committee to That the Fire Committee is hereby instructed to advertise for the advertise for hose purchase of 5000feet of fire hose and four shut-off nozzles . By Alderman Cunes an ordinance ordering an election for the purpose of submitting to the qualified voters of the City of Austin two Election on new Charter propositions for a new charter for the City .The ordinance was read ordered the first time and on motion the rule was suspended and the ordi-nance placed on its second reading by the following Vote: Yeas Armstrong,Crocker,Cunee,Haynes,Meredith,Miller,Moore, Petri,Redd,Scott,Smith,Suter & Wilhelme 13 Nays none . The ordinance was read the second time.The blanks as to places for ho holding said election,and for judgesof election were filled,and the ordinance passed under suspension of the rule by the following vo vote :
