192 Regular meeting of the City Council: Austin, Texas, December 21, 1908: Hon F M Maddox, Mayor, presiding: Roll called: Present Aldermen Armstrong, Crooker, Cunes, Haynes, Miller, Moore, Petri, Scott & Wilhelm Absent Aldermen Meredith, Moreland, Redd, Smith & Suter Alderman Crooker moved a call of the Council, which was seconded and the Marshal directed to bring in the absentees. On motion Alderman Moreland was excused from attendance at this session of the Council Aldermen Smith & Suter entered the Council chamber On motion the call was suspended. The minutes were approved, without reading. Petitions, etc. Petitions, etc: Citizens Hyde Park Annex for lights The Mayor laid before the Council a petition from Citizens of Hyde Park Annex, asking for an extention of light wires to that part of the City, which was read and on motion referred to the Water & Light commit-tee. Austin Coal & Wood Co for ordinance to compel The Mayor laid before the Council a petition from Austin Coal & Wood Dealers to give full measure Co asking the passage of an ordinance compelling persons selling wood to give full measure, which was read and referred to the ordinance committee. J L Washam for Damages By Alderman Crooker petition of J L Washam asking damages on account of a fall on one of the streets. Read and on motion referred to the Claims & Accounts committee and the City Attorney. W W Moore Sidewalk By Alderman Scott petition of Warren W Moore in regard to street and W 8th Guadalupe Sts side walk West 8th & Guadalupe streets. Read and on motion referred to the street, with instructions to report at the next meeting. Reports Standing Coms Reports of Standing Committees: St. Electric R.R. Co Alderman Scott for the street committee to whom was referred a resoluReport -tion demanding that the Austin Electrical R R Co place its tracks in the centre of the street at Rio Grande & 5th streets, presented a report recommending, the passage of the resolution . On motion the report was adopted. Street - H H Glissman Alderman Scott for the street committee to whom was referred a proposiLand for Street Purposes -tion from H H Glissman proposing, to deed to the City a certain strip of land for street purposes, upon certain conditions, presented a report recommending, that the proposition be accepted . On motion the report was adopted . Ordinance Comms Alderman Cunes for the ordinance committee stated that owing to severreport -al sickness he had been unable to call his committee together to act on several matters before that committee, and asked for further time in which to report on these matters. On motion further time was granted . Cemetery Alderman Crooker for the Cemetery committee to whom was referred the Report report of the City Sexton, presented a report stating that it had been examined and found correct . The report was adopted . City Hall Alderman Moore for the City Hall committee made a verbal report recommTrees out around -ending that trees be cut out around the City Hall. Alderman Haynes City Hall. moved that the Committee draw up plans, etc, for same, which motion prevailed .

Pavings on paying Connections for purchases furnished . Alderman Reid for the Paving committee presented the following report,which was read and adopted .
Austin,Texas,Dec21,1908 To the Hon Mayor and City Council,City of Austin,Texas. Gentlemen: We, your Paving committee and City Engineer,wish to report that on account of the building of the new bridge across the Colorado river on Congress Avenue,the contractors will not be able to go ahead with the work of paving from First street south.As they have undelivered on the ground 9500 bricks ,and have done considerable work grading,we would recommend that an estimate of $369.80 be allowed them to reimburse them for money paid out,with the understanding that the bricks become the property of the City,and that the amount of the estimate be deducted from the amount of subsequent estimates made in accordance with their contract when the paving is completed.Following is the itemized estimate : 9500 bricks at $ 14.00 per thousand 133.00 Hauling brick to Congress Avenueand fist street at $1.25 per thousand 18.88 Freight on brick to Austin 75.92 300 su yards ,fill at 43 cents 129.00 4 months rent of store house from Raymond PlattAug,Sept,Oct and November , at $ 5.00 per month 20.00 Total $ 369.80 Yours very truly W C Redd,P A Scott ,C W Moore Paving committee G S Iredell City Engineer Alderman Redd for the Paving committee presented the following report,which was read and adopted . Austin,Texas,Dec 21,1908 Mr A C Goethe,Chairman Paving Committee, City of Austin,Texas. Dear Sir : On account of several unforeseen circumstances the cost of the storm sewer on west sixth street will be somewhat more than originally estimated. The items causing additional expense are as follows: 1st.It was found necessary,on account of the location of the 20"water main on the south side of the street,to lower the grade of the sewer,in order to get under the mainwith the laterals running from the south side. 2nd. After the estimate was made,I was instructed by the Mayor and paving committee to work in conjunction with the Water and Light Department in taking out an old main on the north side of the street,that department agreeing to pay for the additional work necessary. 3rd. A gas main and sanitary sewer were encountered which made additional excava-tion necessary.The companies using them have agreed to pay the additional ex- -pense involved,and bills have been rendered them. 4th. It was found necessary ,after the work was in progress,to increase the thickness of the concrete beyond what was originally intended. 5th. The three inlets which were purchased for this work at a cost of $ 28.75 and paid for out of this appropriation,while they do first class workand are economical

. for a short uous sewer. It was therefore, necessary to have wooden moulds made at an additional expense of $ 53.40. The company from which the steel moulds were purchased have promised to dispose of them for us if possible, or we may be able to trade them for pipe moulds for general use. These moulds are on hand in good order, and can be used for other sewer work. For this reason they are not really chargeable to this account, but should be charged to general equipment. 6th. Owing to unknown persons interfering with our lamps placed on the ditch at night, by stealing, breaking or throwing them into the ditch and leaving traffic unprotected, it was found necessary to put on a night-watchman at an additional expense. There should altogether, including the moulds, the amounts to be received from the sewer and gas companies, and the Water and Light Commission, be a credit of about $ 525.00, on this account. As these credits, however, I am told, must go into the general fund, and are not available directly on this particular account, I would recommend that $ 800.00 additional be appropriated out of the Permanent Paving fund for the purpose of paying current pay rolls and bills. I estimate that it will cost about $ 800.00 more to complete the work, which, with the credits noted above deducted, will make in the neighbor-hood of $ 175.00 more than the original estimate, due to the several reasons previously noted.
I have watched this work very carefully, and believe it is being carried on as economically as possible, and there is no question that the City is getting a first class storm sewer. The original appropriation was $ 7125.00. With the additional amount stated the cost will be brought up to a figure approximating the lowest bid we had on this work. If the bid had been accepted, however, the contractor would have had to be paid extra for the additional excavation, so that we should still come out ahead. I would respectfully ask that the $ 800.00 be appropriated.

On motion the report was adopted. The Mayor stated to the Council that he had written the Receiver for the I & G N R R Co in regard to the building of the bridge across Shoal Creek on west 3rd street, but as yet had not received a reply. The Mayor recommended to the Council the remission of fines assessed against the following persons in the Recorders Court, stating his reasons for the recommendations, viz: Lula Bonner, Elberta Higgins, Mamie Brown, Fannie Johnson and A B Haigler. On motion the fines were remitted, as recommended.

195 Unfinished Business: The Mayor laid before the council an ordinance appropriating the sum of $ 75.00 for the purpose of paying salary of Assistant to the Engineer for the month of Danny, Asst Engineer December 1908. The ordinance was read the second time, and a motion made to suspend the rule and place it on its third reading, which motion was lost by the following vote: Yeas Aldermen Crocker, Meredith, Moore, Redd, Scott, Smith & Sutor 7 Nays Aldermen Armstrong, Cuneo, Haynes, Miller, Petri & Wilhelm #6
New Business: By Alderman Scott an ordinance appropriating the sum of $ 300.00 for the purpose Street Labor of paying the weekly pay rolls for street work. The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crocker, Cuneo, Haynes, Meredith, Miller, Moore, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none.
By Alderman Scott an ordinance appropriating the sum of $ 800.00 for the purpose West 6th Storm of building a storm sewer on West 6th street. The ordinance was read the first Sewer time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crocker, Cuneo, Haynes, Meredith, Miller, Moore, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none.
By Alderman Moore an ordinance appropriating the sum of $ 50.00 for the purpose Tuberculosis Exhibit bonds. of obtaining the turgid saloix exhibit for the City of Austin. The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crocker, Cuneo, Haynes, Meredith, Miller, Moore, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none.
By Alderman Haynes an ordinance appropriating the sum of $30,590.00 for the Interest on Refunding purpose of paying the Interest due January 1st 1909 on Refunding Bonds. bonds The ordinance was read the first time and passed under suspension of the rules by the following vote: Yeas Aldermen Armstrong, Crocker, Cuneo, Haynes, Meredith, Miller, Moore, Petri, Redd, Scott, Smith, Sutor & Wilhelm 13 Nays none.
Alderman Haynes offered the following resolution, which was read and adopted: Treasurer instructed to Be it resolved by the City Council of the City of Austin: That the City Treasurer pay Overdrafts on of the City of Austin?Texas?, be and he is hereby instructed to pay overdrafts,on Sinking fund Account of " Interest and Sinking " fund for an amount sufficient to pay any balance of interest due January 1st 1909 on the bonds of the City, over and above the amount now in said fund.
