Present Alderman Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller, Moore,Moreland,Petri,Redd,Scott,Smith & Wilhelm 13 Absent Alderman Sutor 1 On motion the minutes Were approved as recorded by the Clerk,without reading.
Petitions,Memorials,etc. Petitions to Ever Dastical Co Improving the By Alderman Moore petition of Officers of Colorado Hose Co No 2,asking for an appropriation of $ 400.00 putting in improvements to Hall of said Co ,Read and laid over to come up with an ordinance appropriating the money for same. Citizens South Austin Arc Light By Alderman Redd petition of Citizens of South Austin asking to have an Arc light placed at the interception of the Fredricksburg road and 1st street in South Austin Read and on motion thr petition was granted. Julius Johnson Pound fee. By Alderman Cuneo petition of Julius Johnson asking to have certain pound fees refunded.Read and on motion the petition was granted. H.W. Stroeter appd. Spec. Inspector Sanitary Inspector Oil Cisterns By Alderman Haynes petition of H W Stroeter asking that he be appointed Special Sanitary Inspector,to oil cisterns,Etc,Read and on motion referred to the Sanitary Committee. Alderman Moore moved that the Sanitary Inspector be directed to confer with the Board of Health ,and if deemed necessary by the to proceed to oil cisterns ,etc. Which motion prevailed . Alderman Sutor entered the Council chamber. Citizens Wichita St to widen Side walks By Alderman Scott petition or Citizens on Wichita street for permission to widen sidewalks and change the width of pathways ,etc.On motion the petition was granted. A.E. Schutze ass't. on Claims. The Mayor laid before the Council a petition from Adolph E Schutze ,asking to have assessment corrected,which was read and on motion referred to the Committee on claims & accounts. Citizens for Fire Plug 9th & Ruiz St. By Alderman Smith petition of Citizens asking to have a Fire plug placed at the corner of 9th & Ruiz streets.On motion the petition was granted. W.A. Barbee to purchase land By Alderman Cuneo petition of Wm A Barbee asking the Council to sell him a strip of land lying south of the I & G N R R tracks ,being a part of the land purchased by the City from Mrs Duval .The communication was read and on motion referred to the Street Committee,City Engineer and City Attorney . Fines remitted The Mayor recommended the remission of the following fines imposeded in the Records Court,viz: Jesse Banner,J Levy,Alma Stephenson,Will Stamps,Cleve Eppright,L B Moffett .On motion the recommendations of the Mayor were adopted.
Reports of City Officers: Reports of City Officers The Mayor laid before the Council the reports of the Marshal and the Sexton for the month of Feby 1909,which were on motion referred to their appropriate Committees ,without reading .

New business : Judges of election 5th Ward. Alderman Haynes reported to the Council that Mr R P Bull,who had been appointed as Judge of election in the 5th ward ,had n o tified him that he could not accept the position,and recommended the appointment of Mrs Schutze to fill the vacancy, also that Mr D B Gracy,who had been appointed one of the Judges in the same ward could not serve ,he being a candidate at said election,and recommended the

228 Resignation of • appointment of Alonzo Cook to fill the vacancy.On motoin the Fred Sterzing as nominations were approved. Ass & Collector Alderman Crooker nominated Mr C A Keuchler as Clerk of election in the 3rd ward ,vice W N Vining who was inelligable,which nomina-tion was cofirmed.Alderman Moore presented the name of Mr Frank George for Clerk of election in the 7th ward in place of Geo Burnes who was inelligable,and the appointment was confirmed . The Mayor laid before the Council the resignation of Fred Sterzing as Assessor & Collector of taxes.Alderman Moore moved that the resination be NOT accepted,and that Mr Strezing be granted a leave of absence until 12 oclock ,Midnight April 19th 1909,which motoin prevailed. Lot in Cemetery for Alderman Moreland offered the following resolution,which was read Confederate Ladies Confederate and adopted. Home Be it resolved by the City Council of the City of Austin,that the Mayor of the City of Austinbe and he is hereby instructed to make a deed of gift of lot no 939 situated in Oakwood Cemetery to the Confederate Ladies Home for burial purposes . Bids Blau & Nitschke Alderman Moreland for the Cemetery Committee,presented bids from Schrivener to make F G Blau and W L Nitschke and from Chas Schrivner for Platting and map City Cemetery making Map of the City Cemetery,also the following resolution, Be it resolved by the City Council of the City of Austin,that the Mayor and Cemetery Committee be and they are hereby instruced to enter into ,the best obtainable contract with bidders for the platting of Oakwood Cemetery . On motion of Alderman Moore the resolution and bids were laid on the table,subject to call. Appropriation for repairs By Alderman Moore an ordinance appropriating the sum or $ 400.00 8th Street Fire Hall for the purpose of making improvements at 8th street Fire Hall. The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller,Moore, Moreland,Petri,Redd,Scott,Smith,Sutor & Wilhelm 14 Nays none. Alderman Wilhelm offered the following resolution,which was read and adopted. Gate to be open at the Be it resolved that the footgates leading into the City Cemetery Cemetery be and are hereby ordered to be opened at once,so that all persons can walk through them as heretofore . Water Supply map By Alderman Moreland an ordinance appropriating the sum or $ 250.00 Cemetery for the purpose of paying for map and plat of Oakwood Cemetery. The ordinance was read the first time ,and on motion the rule was suspended and the ordinance placed on its second reading by the following vote : Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller ?Moore, Moreland,Petri,Redd,Scott,Smith,Sutor & Wilhelm 14 Nays none. Alderman Moore moved to amend name by striking out ,in the caption and in the body of the ordinance " $ 250.00" and inserting in lieu thereof "$100.00" which motion was lost by the following vote : Yeas Aldermen Armstrong,Haynes,Miller,Moore,Petri & Redd & Meredith 7 Nays Aldermen Crooker,Cuneo,Moredland,Scott,Smith,Sutor & Wilhelm & the Mayor 8 On motion the rule was suspended and the ordinance placed on its third reading and final passage by the following vote: Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Miller,Moreland,Scott,Smith,Sutor and Wilhelm 10 Nays Aldermen Meredith,Moore,Petri & Redd 4 The ordinance was read the third time and passed by the following vote : Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller,Moore,Moreland, Petri,Redd,Scott,Smith,Sutor & Wilhelm 14 Nays none . Ordinance abandoning Street Gypsy Grove By Alderman Moore an ordinance relinquishing all the right,title,interest and easement of the City of Austin in and to 33rd street of the City of Austin, being a street heretofore dedicated by the owners of Gypsy Grove Addition to the City of Austin ,and lying south of State street ,and bounded on the East by Guadalupe street and on the West by King street. The ordinance was read the first time.Alderman Cuneo moved to refer to the Street Committee and City Engineer with instructions to report at the next meeting of the Council,which motion was lost by the following vote : Yeas Aldermen Crooker,Cuneo,Meredith,Miller,Smith,Sutor & Wilhelm 7 Nays Aldermen Armstrong,Haynes Moore,Moreland,Petri,Redd,Scott,& the Mayor 8 A motion was then made to suspend the rule and place the ordinance on its second reading ,which motion prevailed by the following vote : Yeas Aldermen Armstrong,Crooker,Haynes ,Meredith,Miller,Moore,Moreland,Petri Redd,Scott & Sutor 11 Nays Aldermen Cuneo,Smith & Wilhelm 3 [illegible] June 21/04 [illegible] On motion of Alderman Scott the ordinance was referred to the Street Committee, with instructions to report at the next meeting of the Council. By Alderman Smith an ordinance appropriating the sum of $ 100.00 for the purpose of paying North Austin Fire Coror installing sub-station in Hyde Park. The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Aldermen Armstrong,Crooker,Cuneo,Haynes,Meredith,Miller,Moore,Moreland, Petri,Redd,Scott,Smith,Sutor & Wilhelm 14 [illegible] [illegible] Nays none . 230 13 Read, Scott, Sutor & Wilhelm Nays none 16/8/09 ord. purchase By Alderman Hoot an ordinance appropriating the sum of $ 240.00 for Land for Jno F. Smith. the purpose of purchasing land of Jno F Smith & Wife for street purposes. The ordinance was read the first time and on motion was referred to the Street and Finance Committees and the City Attorney, w with instructions to report at an adjourned meeting to be held on March 23rd 1909. Alderman Crooker called up the resolution offered by the Cemetery Mayor authorized to Committee, authorizing the Mayor and Cemetery committee to make a make contract to platt contract to platt the City Cemetery. On motion the resolution was adopted Cemetery On motion of Alderman Cuneo the Council adjourned until 8 o'clock P M Tuesday March 23rd 1909 . Geo. O. Johnson City Clerk.

On motion Alderman Moore was excused from attendance at this session of the Council Aldermen Meredith,Redd,Scott & Cuneo entered the Council chamber and answered Apprn for election to their names . On motion the call was suspended. expenses By Alderman Haynes an ordinance appropriating the sum of $ 372.90/100 dollars for the purpose of paying expenses of an election held March 22nd 1909. Annual installment By Alderman Haynes an ordinance appropriating the sum of $ 22,500.00for the Old Water. Co. purpose of paying the 7th annual installment due April 1st 1909,on the purchase of the Old Water Co .
