Petition S H Weaver Petitions, memorials, etc: By Councilman Hart, petition of S H Weaverasking the Council to remit a Pound fee paid by him. The petition was read and on motion the Council refused to grant it by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none.
Unfinished business: Paving W 6th St approp The Mayor laid before the Council an ordinance appropriating the sum of $ 75.00 for the purpose of paving West 6th street. The ordinance was read the third time and on motion was laid on the table.
Approp Salaries Regular Employees St. The Mayor laid before the Council an ordinance appropriating the sum of $ 80.00 for the purpose of paying salaries of regular employees street Dept for 1909. The ordinance was read the third time and passed by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none.

Invitation Hose Co 4 The Mayor laid before the Council an invitation from East Austin Hose Co No 4 asking the Council and their families to attend their annual Ball to be given at their Hall on January 1st 1910, which was read and accepted. The Council then recessed to meet in the Office of the Mayor and take up and consider appeals from the action of the Board of Equalization.

By Councilman Powell an ordinance appropriating the sum of $ 225.00 for the purpose of paying weekly pay rolls street Dept. The ordinance was read the first time, the rule suspended and the ordinance placed on its second reading by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none. The ordinance was read the second time and laid over until the next regular meeting.
Resolution J. Schapiro The Mayor laid before the Council the following resolution: Whereas, Garden street is a public street of the City of Austin, between Navasota and Waller street and in parallel lines with Canterbury street , and said Garden street is of a uniform width of 50 feet between said points: and, Whereas Joseph Schapiro, claims to be the owner of lots 54, 55and 56, Division " O " of the City of Austin, which lots have a frontage on said Garden street of 50 feet each, and have a uniform depth of 128 feet, as shown by various maps and plats on record in the office of the County Clerk of Travis County, Texas

408 and, Whereas,the said Joseph Schapiro has fenced up that portion of Garden street,beginning at the original southwest corner of said lot 54,Thence in a southerly direction29.4 to a corner,Thence in an easterly direction 150 feet to a corner,Thence in northerly directa 36 feet,to the original southeast corner of said lot 56,by which ac -tion the said Joseph Schapiro has appropriated to his own use andb benef it an erea of 4905 square feet of land,all of which land is a part of said Garden street,and all of which area of land has heretofore been dedicated for the use and benef it of the public; therefore be it , Resolved by the City Council of the City of Austin; That the action of the said Joseph Schapiro in fencing up said portion of said Garden streetbe and the same is hereby declared an encroachment upon said Garden street to the extent and in the manner above recited,and that said encroachment is and the same is hereby declared to be a Nuisanceh in that it deprives the public of the free use of said street,and that the user of said fenced area of land by said Joseph Scapiro is inconsistant with and in violation of the dedication of said street,and an unlawful encroachment upon and an obstruction of said street;and be it further, Resolved,that the City Engineer and the City Marshal,be and they as are hereby instruceted to abate said nuisance and to remove said encroachment from said street,and to placesaid fence upon the truae southern boundary line of lots 54,55 and 56,and thereby def ine the true northern boudary line of said street in front of said lots.
