.Regular meeting of the City Council: Austin, Texas, May 26, 1910.
Hon A P Wooldridge, Mayor presiding: Roll called: Present Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Absent none.
The minutes of the last regular and adjourned meeting were read and approved.
On motion the regular order of business was suspended,and the matter of the purchase of ground for Park purposes in East Austin,taken up. Citizens for and against the proposition to purchase the property known as the Robertson Hill property ,addressed the Council ,but no action taken .The Council then recessed until 2,30 oclock P M .

May 26th 3,P M The Council was called to order by the Mayor,with all members present. The Mayor laid before the Council a petition from J A Littleton for permission to erect a small building on East 5th and Red River streets, within the Fire Limits,for a lunch stand,which was granted by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none.
Reports of City Officers:
Substitute Annual report water & light Dept 1909 Councilman Bartholomew presented a substitute Annual report as Supt of the Water & Light Dept for the year 1909,also Monthly reports for the months of January,February,March and April 1910,which were ordered filed. Councilman Bartholomew offered the following resolution,viz : Whereas the City of Austin on April 1st 1910 paid $ 22,500.00 on the purchase price of the Old water & Light plant,out of the General fund, and,
City of Austin to be credited on amt due for Current Light by Dept paid Old Water & Light Co. Plant $22,500. Whereas, the City of Austin on the 1st day of April 1910,owed the Water & Light departmentthe sum of $ 24,024.00,for water & light furn-ished the twelve months preceding April 1st 1910,therefore, Be it resolved by the City Council of the City of Austin : That the Superintendent of Parks & Public Property be authorized to credit the City of Austinwith $ 22,500.00,on the $ 24,024.00 account the City owes the Water & Light Departmt. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart '& Powell 5 Nays none.

Ordinance regulating Traffic on Colorado Bridge The Mayor laid before the Council an ordnance regulating traffic across the Avenue bridge across the Colorado River at the foot of Congress Avenue,etc: The ordinance was read the third tim and passed by the following vote Yeas Mayor Wooldridge,C ouncilmen Bartholomew,Gracy,Hart & Powell 5. Nays none.
The Mayor offered the following resolution: Resolved by the City Council of the City of Austin : That the Superintendent of the Department of Parks and Public Property be and he is hereby instructed to purchase from the owners thereof ,

Part Exclusion - Robertson property . a tract of land in East Austin, known as the west part of Robertson's Hill, and consisting of about four acres of land; provided that upon pre-examination, the title in the vendors of this property shall be shown to be good, and the area of about four acres of land or say twenty one and one-half (21 1/2) lots of ground of the dimensions of 46 feet by 128 feet, in addition to streets and alleyways there; and provided further, that the purchase of said property can be made for $ 7,500.alltg $ 2,500. of which $ 7,500. shall be cash, about $ 1,500. in receipted taxes; and that an option be given to the City for the purchase of the remaining unpaidpart of said tract of land, about $ 3,500. payable one year hence, and without interest on the deferred payment.

H. L. Raven damages for horse killed New business : Councilman Bartholomew presented a bill of H L Raven for $ 125.00 for horse killed by the City, which was allowed and ordered paid by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart 'A Powell 5 Nays none.
Accounts for power To be Computed Under new schedule for Certain back months Councilman Bartholomew offered the following resolution, viz: Resolved that the Superintendent of Parks and Public Property be authorized to compute accounts for power for the months of Feby, March & April in accordance with the schedule now existing, and he is further authorized to rebate the extra amount that may have been paid by any consumers of power for three months in excess of the present schedule.
The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none.
Court to give abstract to City ordered paid Councilman Bartholomew presented to the Council ,a bill of Costs of Court in the Abadie case, which was ordered paid by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 The Mayor laid before the Council a report of the City Attorney ,in matter of petitions for Spur tracks, etc of different parties which was read & filed. On motion the Council recessed subject to call of the Mayor.
Opinion City Attorney Spur tracks, etc May 27th 1910. The Council was called to order by the Mayor, with all members present. Mayor Wooldridge offered the following resolution, viz: Resolved by the City Council of the City of Austin: That three hundred and eighty four dollars ($ 384.) of the two thousand eight hundred and eighty four dollars ($2,884) appropriated by the City Council to the beginning of the purchase of a Park for East Austin, be and said $ 384.is hereby transferred to and made a general contingent fund of the City for Park purposes. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none.
Proposed Park fund Mayor Wooldridge offered the following resolution , viz: Resolved by the City Council of the City of Austin : That the appropriation of $ 600.00 in the budget of the Waterlight & Sewer Dept for the present year; part pay of salary of Assistant City Clerkat $ 50.00 per month "

476 Payment for Salaries City Clerk. be amended Clerk's exempt from contingent fund. be amended so as to read as follows: "For part pay of City Clerk and Assistant City Clerkin equal proportions of $ 25.00 each per month $ 600.00 " The resolution was adopted by the following vote: Yeas Myr or Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none.
On motion the Council recessed subjot to call of the Mayor.
May 28th 1910. The Council was called to order by the Mayor with all membos present. Mayor Wooldridge offered the following resolution,viz: Resolved by the City Council of the City of Austin; That an election be held,and the same is hereby ordered and directedxxxx xxxxxxxxx
Election ordinance franchise Burckhead, et al Austin Government, repealed
The the resolution of the City Council of the City of Austin,passed May 19th 1910,calling an election of the qualified voters of the City of Austin,which election was to have been held first on the first day of June,and afterwards,by resolution passed May 21st ,1910,changed to June 15th,to pass an ordinance,granting to Claud V Burbes and Associates,their Successors and Assigns the right to construct and operate a line or lines of street railway in the City of Austin,Texas,be and said resolution is in all things repealed,cancelled and annulled. The resolution was adopted by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. Mayor Wooldridge offered the following resolution,viz: Resolved by the City Council of the City of Austin : That an election br held ,and the same is hereby ordered anddirected to be held in the City of Austin,on wednesday,the twenty-second day of June, 1910,from eight A M to seveb P M ,at which eleation the following proposi-tion shall be submitted to the qualified voterg the City of Austin. Proposition. Shall the City Council of the City of Austin pass the following ordinance, to wit: Here follows the ordinance. The resolution was passed by the following Vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. On motion the Council recessed subject to call of the Mayor.
Election on franchise of Burckhead et al ordered.
May 30th 1910. The Council was called to order by the Mayor with all members present. Councilman Hart offred the following resolution,viz: Resolved,That the salaries for the month of May 1910,and therefor ,of the Nurses and Attendants at the City Hospilband the same are hereby contin-ued as heretofore establishd until further order of the City Council. Ordinance Creating Office of Fire Marshal 477 Councilman Hart offered the following ordinance: An ordinance, creating the Office of Fire Marshal, prescribing the duties thereof, pro-viding for its maintenance, and prescribing penalties for violations.
The ordinance was read the first time and the rule suspended and it passed its second reading by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none. The ordinance was read the second time and laid over. Vehicle Ordinance Mayor Wooldridge moved that the vote by which this ordinance was placed upon its third reading on May 19th be reconsidered. The vote to reconsider was reconsidered5 ayes-no noes. Mayor Wooldridge then moved to amend said ordinance by. Striking out section three and to amend section four, so that section four should hereafter read as follows: "That it also be and hereby made unlawful for such public vehicles as described in this ordinance to stand upon any of the other streets of this City in addition to Congress Avenue and Sixth Street, unless the owner, lessee or other person having legal control of the property adjacent to any such street or streets shall consent thereto in writing." Amended & Passed Councilman Bartholomew then moved to amend the amendment offered by Mayor Wooldridge, so that public vehicles for hire could stand upon any of the streets of Austin with the consent of the persons owning or con-trolling the adjacent property. Vote was then had upon Councilman Bartholomew's amend- -ment to Mayor Wooldridge's amendment, with the following result: In favor: Councilmen Bartholomew and Powell. Against said amendment of Councilman Bartholomew: Mayor Wooldridge and Councilmen Gracy and Hart.
The matter then came up for the adoption of the amendments offered by Mayor Wooldridge, and said amendments were adopted by the following vote: Ayes Mayor Wooldridge, Councilmen Bartholomew, Hart & Powell. 4 Nays Councilman Gracy. 1 The ordinance as amended was then read the third time and passed by the following vote: Yeas Mayor Wooldridge, Councilman Gracy Hart & Powell 4 Petition - Maude - Refused To open Street Nays Councilman Gracy. Bartholomew 1 The Mayor laid before the Council a petition from Hudson Maud et al ,asking to have a certain street opened, which was on motion refused by the following vote: Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 On motion the Council recessed subject to call of the Mayor.

478 Austin, Texas June 1st 1910. The Council was called to order by the Mayor. Present Mayor Wooldridge, Councilmen Gray and Hart Absent Councilmen Bartholomew and Powell 2 Resignations of Policeman The Mayor laid before the Council the Council the resignations of Mallory & Bustin Mallory and Bustin, which were accepted by the following vote : Yeas Mayor Wooldridge, Councilmen Gray and Hart 3 Absent Councilmen Bartholomew & Powell 2 Councilman Bartholomew entered the Council chamber and answered to his name. J C White Confirmed Councilman Hart nominated J C White as Mounted Policeman, which nominaabout Policemen -tion was conformed by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew & Gray 3 Absent Councilmen Powell 1 Present not voting Councilman Hart 1 G O Maddox Councilman Hart nominated G O Maddox as foot Policeman, which nomination Confirmed as Policeman was confirmed by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew & Gray 3 Absent Councilman Powell 1 Present not voting Councilman Hart 1 Robt W. Walling The Mayor laid before the Council a petition from Robt Walling to Correct Assessment asking to have his Assessment for taxes corrected, together with his affidavit in regard to same, which petition was granted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew Gray and Hart 4 The Assessor and Collector of taxes was directed to make the correction Fine of B. Sullivan as prayed for and credit Walling on his rolls. remitted On the recommendation of the City Marshal, Councilman Hart moved that a fine assessed in the Recorders court against B Sullivan, amounting to $ 11.25 ,be remitted, which motion prevailed by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew & Hart 3 Nays Councilman Gray 1 Councilman Powell entered the Council chamber and answered to his name. The Mayor laid before the Council the following offers for sale of City Bonds, viz : Bids for sale of Bonds F W Mason & Co Boston $ 3000.00 at 94 ½ cents and Interest to Sinking Fund. F W Mason & Co Boston $ 2,000.00 at 95 cents an Interest. Jas G Cahill St P.Louis $ 6,000.00 at 93 1/4 & Interest M W Halsey & Co Chicago $ 5,000.00 at 98 ½ & Interest. Piel Lemgath & Co Cin $ 10,000.00 at 94 cents & Interest. Bids for Bonds Councilman Bartholomew moved that the Council accept all offers of Bonds accepted offers up to 95 cents & interest; which motion prevailed by the follow-ing vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Gray, Hart & Powell 5 Nays none. On motion the Council recessed subject to call of the Mayor.

479 Bids for building Austin,June1st PM Stables & sheds Councilman Hart submitted to the Council the following bids for building Stable,Sheds, etc,viz. E S Slaughter $ 748.00 J I & J L Pearce 1,095.00 Sam Payne 750.00 W Grimmer 1,250.00 Councilman Hart moved to accept the bid of E S Slaughterand he add"the work to be done according to plans and specifications and enter into bond of $ 300.00 for the faithful performance of the contract",which motion prevailed by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. Councilman Hart offered the following resolution,viz: Budget 1910 In the budget of the Police department for the year 1910 an additional Mounted Amended- patrolman was allowed at a salary of ($ 85.00 )eighty five dollars per month,or$ 1020.00 per year,and it being suggested by the Superintendent of Police and Public Safety that a foot patrolman at a salary of $ 70.00 per month would answer the purpose desired. Be it therefore resolved by the City Council of the City of Austin,that said change be made and the same is hereby grantedand thata foot patrolman at a salaryof ( $ 70.00 ) seventy dollars per month be substituted in said budget for a mounted patrolman at $ 85.00 per month,and that the difference between said amounts and the same is hereby transferred to the miscellaneous item of police departmt. 5 J 3 2The resolution was adopted by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy & Hart 4 Absent not voting Councilman Powell 1 Applications for The following applications for appointment for the position of dog catcherwere read appointment Los,Evans,C H Stelfox,W H Pitsford,H Ries & -Sauls. Dog Catcher Councilman Hart nominated Los Evans for appointment as Do Eg Catcher,which Los Evans confirmed nomination was confirmed by the following vote: Dog Catcher Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy & Powell 4 Not voting Councilman Hart 1 Councilman Bartholomew offered the following resolution,viz: Resolved that contractors building cement sidewalks in the City of Austin,be required to impress in walk at the corners of each street the names or numbers of such street. The resolution was read and laid over.
Pure Food N B . The following proceedings of the Council were had on the 28th day of May 1910 Ordinance but were not reported to the Clerk until after the foregoing minutes were recorded. May 28th 1910. The Council was called to order by the Mayor with all members present. By Councilman Hart an ordinance providing for the exposing for sale and for the sale of pure food stuffswithin the City of Austin;providing for the issuance of permits for the sale of dairy products;etc,etc. The ordinance was read the first time and the rule suspended and it placed on its second reading by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart &Powell 5 The ordinance was read the second time and laid over . At this the Council adjourned, City Clerk.
