562 .Regular meeting of the City Council: Austin, Texas, Sept 22nd 1910. The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Absent none. The minutes of the last regular and recessed meetings, were read and approved. . Unfinished business: The Mayor laid before the Council a resolution appropriating the sum of $ 2,000.00 out of the General fund for general contingent expenses of the City for the year 1910, which was read the third time and passed Appropriation for by the following vote: General Contingent Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Expenses. Nays none. Amending Art 872, The Mayor laid before the Council an ordinance amending Art 872, Revised Ordinance Sec. 6 Chapter 7 of the Revised ordinances of the City which was read, and laid over for the present. The Council recessed subject to call of the Mayor.
Sept 22nd 1910. The Council was called to order by the Mayor: with all members present: The Mayor laid before the Council the following communication from the City Engineer:
Austin, Texas, Sept 22nd 1910 To the Ho M P Powell, and Hon D B Gracy, Commissioners,
City of Austin, Texas. Gentlemen :
We have been asked to give a curb line on the north side of 20th street from Wichita street east, and on the east side of Wichita Curb Line Wichita street from 20th street north. Street There is already a good curbing on the same side of 20th street in the block immediately west of the above location, lining up for the entire block. This curbing is 5.55' from the center line of 20th street at the east side of University Avenue, and 14.6' at the west side of Wichita street. As 20th street is a 70' street, the distance from the center line accor-ding to the ordinance should be 17.5'. I recommend that we put the new curbing in parallel to the center line and 17.5' therefrom. This will make an offset of 2.9' between the east and west sides of Wichita street.
The curbing mentioned above was evidently put in with the idea of making the roadway 30' instead of 35'. The only way to avoid the offset would be to place the curbing 14.6' from the center line, and parallel thereto,
regarding the roadway as 30' instead of 35'. If curbing on the opposite side of the street were placed 15' from the center line, the actual width of roadway would then be 29.4' in this block. There would be, however, an angle in the north curb at Wichita street.
There is also a curbing, laid in the last two or three years, on the west side of Wichita street from 20th street north, lined with centers placed at 20th and 21st streets, and placed 15' therefrom. I recommend that we run the

563 Curbs on the east side of Wichita street parallel with the above line, and the correct distance from the center,is,15 '. I also recommend that the grade of both curbings be placed on the approximate grade of the streets.

We recommend that the curb line on both sides of Wichita street from 21st st south to 19th street,be placed 15 feet from center of said streetand that the sidewalks be placed 2½ feet from said curbs.That the curb line on both sides of 20th street from Guadalupe street east to the Speedway,be placed 17 ½ feet from center of the street and that the sidewalks on said 20th street be placed 2 ½ from the property line. As regards Wichita street this recommendation is in accordance with a resolution " as we understand it "of the City Council passed 15th of March 1909. Approved . P W Ferrell.D B Gracy. Sept 24th 1910. The Council was called to order by the Mayor,with all members present,except Councilman Powell - Petition A J Speigel for Building permit The Mayor laid before the Council a petition from A J Speigel ,for permission to erect an addition to building on north part of Lot " 2 Block 97,City of Austin building to be of Corrugated iron.The petition was recommended by the Board of Fire Commissioners.The petition was granted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy & Hart 4 Nays none. Leave of absence- R M Riley On motion of Councilman Hart ,leave of absence for 7 days was granted R M Riley, commencing Sept 24th 1910,by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy & Hart 4 Nays none.
Repair of fire app Councilman Hart offered the following resolution : Resolved by the City Council of the City of Austin : That the Superintendent of Police and Public Safety be and he is hereby authorized to expend the sum of ( $ 75.00) seventy five dollars or so much thereof as may be necessary for new springs for wagon of North AustinHose Co No 6,the present springs on said wagon having become from long usage,weak and unsafe. The necessity for this resolution being that the appropriation for repairs to Fire apparatus in the budget of the Fire Dept now in force requires that all expenditures for repairs to apparatus in excess of $ 5.00 is required to be approved by the City Council. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy & Hart 4 Nays none.

564 Ordinance appropiating J H Gassaway Leave of absence for R. D. Weller ins Health officer

Lampasas Street Archway Subdivision
Loan from to Unauthorized to furnish Water to Lone Star Ice Co By Councilman Bartholomew an ordinance appropriating the sum of $ 1,009.25 to settle the judgement claim of J H Gassaway &others against the City of Austin . The ordinance was read the first time and the rule suspended and it placed on its second reading by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy & Hart 4 Nays none.
The ordinance was read the second time and laid over. On motion of Councilman Hart ,leave of absence for 5 days from Sept 25th 1910,was granted Dr C B Weller,Asst Health Officer,to attend Medical Convention at Housta,Texas,at the cost of the City,by the followingvote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy & Hart 4 Nays none. q The Council then recessed subject to call of the Mayor.
Sept 26th 1910. The Council was called to order by the Mayor,with all members present Councilman Powell offered the following resolution : Resolved by the City Council of the City of Austin,Texas,that the center line of east 10th streetbe established in the following manner : Measure the correct distance ,according to the map on file in the Land Office ,from the iron pin at the center of the intersection of Congress Avenue and sixth street ,north along the center line of Congress Avenue to the center of tenth street,and turn a right-angled line . Place point "A" 20 ' east of the center line of Congress Avenue on this right-angled line.i e on the east line of Congress Avenue. Place point " B " on the west line of East Avenue -- 6 1/2 ' north of the right-angled line. A straight line joining points " A " & "B "to be the center line of east tenth street. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. Councilman Powell offered the following resolution : Resolved,by the City Council of the City of Austin,Texas,that the street in the " Archway " sub-division running west from Lampasas street north of thepoint where 26th street enters Lampasas street,from the west be called 26th street,and that the name of the street running east from Lampasas street to Duval street north of the street mentioned above,and heretofore known as 26th street,be changed to 26 1/2 street. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. .Mayor Wooldridge offered the following resolution: Be it resolved by the City Council of the City of Austin : (1) That consent is hereby given to the Lone Star Ice Co of this City to furnish,free of cost,to the City of Taylor,Texas,or to the Commercial industries of said City,the waste water used by the Lone Star Ice Co ,

565 . for cooling purposes at its plant in this City. (2) That this consent is to last and continue so long as the City of Taylor may continue short of its usual water supply . The Mayor laid before the City Council the following petition : Austin,Texas,Sept 24th 1910. Hon City Commissioners, Austin,Texas. Gentlemen : I hereby ask permission to excavate in the alley adjoining the Searbrough building,now being erected at the corner of 6th:street and Congress Avenueand put a in a concrete stairway for entrance to the boiler room of said building,this stairway to begin 26'.8" from the 6th street face of the building and to extend about 24'.9" to the south wall of the building,the 8'' on the south end of this space so excavated to be covered with an iron grating,and the remainder of the space protected by a pipe rail,as shown on the accompanying sketch. E M Scarbrough. Approved F F Powell, I am willing same be granted,D B Gracy. Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin :
E M Scarbrough permission to excavate in alley 6th & Cong. Ave. That permission is granted to Mr E M Scarbrough to excavate in the alley adjoin-ing the Scarbrough building erected at the corner of Congress Avenue and Sixth street of this City,for the purpose of placing therein a concrete stairway for entrance to the boiler room of said building. The stairway here permitted to be constructed is to begin 26 feet 8 inches from the Sixth street face of said building,and to extend 24 feet nine inches to the south wall of said building.The 8 feet 8 inches of the south end of the space so permitted to be excavated is to be covered with iron grating,and the remainder of the space excavated is to be protected by at least two (2) pipe rails. A diagram showing the work to be done in this resolution accompanies the same,and is to be held and deemed a part hereof. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none.
.Councilman Bartholomew offered the:following resolution : Resolved that the walks between Lots Numbers 1092,1129,1130 and 1157,in the north east corner of Oakwood Cemetery ,be vacated,and the same be attached to and made part of said lots 1092,1129 and 1130. The resolution was adopted by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Naysnone.
On motion the Council recessed subject to call of the Mayor.

566 Sept 26th Recd Equalization J.D.

The Council was called to order by the Mayor, with all members present. The Mayor laid before the Council the following report from the Board of Equalization, which was read and ordered filed :
Austin, Texas, September 26th 1910.
To the Hon Mayor and Council of the City of Austin. Gentlemen :
We beg to report that we have completed the work assigned to us as a Board of Equalization for the year 1910 in accordance with requirements of the City Charte, the State Laws and the oath of Office administered by the Mayor to each member of the same. Respectfully, J P Wallace, President, L M Mason, Secretary.
O. H. Hill Shooting Gallery
The Mayor laid before the Council the following resolution: Whereas, O H Hill has complied with the law in that behalf made and provided, therefore, Be it resolved by the City Council of the City of Austin : That permission be granted him to conduct a shooting-gallery at 214 East Sixth street in the City of Austin, Texas, for a period of six (6) m months, beginning on the 26th day of Sept ember 1910, and ending on the 26th day of March 1911.
The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none.
The Mayor laid before the Council the Bond of Claud V Burkhead and others as follows: State of Texas, County of Travis.

That we, Claud V Burkhead and Associates, of Bexar County, as principals, and N A Dawson, Mary Dawson and Theodor Lowe, as sureties, are held and firmly bound unto A P Wooldridge, Mayor of the City of Austin, in Travis County, Texas, in the penal sum of Twenty Thousand ($ 20,000.00 ) dollars, good and lawful currency of the United States of America, for the payment of which to the said A P Wooldridge, Mayor of the City of Austin, we bind ourselves, our heirs, executors and admin-istrators, successors and Assigns.
Dated this the 26th day of September, A D 1910.
Whereas, Claud V Burkhead and Associates were granted a franchise by the City of Austin to build a street car line in said City. Now therefore th the condition of the above obligation is such, that if the above bounden Claud V Burkhead and Associates, their heirs, Executors, successor
and Assigns, shall protect the City of Austin against damages and delays such as may arise in the prosecution of said work, by the said Claud V Burkhead and Associates, their heirs, executors, administrators, success-ors and assigns, then this obligation shall be void, otherwise to remain

.are the identical parties to whom the said City of Austin by an election held on the 22 day of June ,1910,granted the right to construct and operate certain street car lines in the City of Austin as herein stated,provided however this obligation shall be released whenever the above bounden parties shall assign the rights granted under said franchise and the assignee of the same shall file with the Mayor of the City of Austin a good and solvent bond in the amount and conditions as above . § (Sgd) C V Burkhead, N A Dawson , Theodor Low, Mary Dawson. Petition Felix Cherica to_ Put in R.R. Switch The undersigned,your petitioner,asks permission to cross the alley between third and fourth streets with a railroad track,said track to leave the M K & T track somewhere at or near lot 8,block 32,as per blue print attached, and to be laid acrosssaid alley,and to terminate on lots 1 & 2,in said block 32, the latter lots being my personal property. Your petitioner further represents that he desires to erect a first-class brick building ,for the purpose of opening and runninga wholesale grocery business,which latter business will add greatlyto the City,in that it will increase the business done in the City,and will also add to the reputation of the City as a business center.
Your petitioner further represents that if his prayer is granted and he is allowed to cross the said alleywith the track as prayed for,that he will in no way damage or injure any party,but on the contrary will greatly enhance the value of all adjoining property,in that he will reduce the amount of switching to be done at this point ,as the said building will be erected in any event,and if the said permission is not granted,it will be necessary to do from two to three times as much switching in order to transact the business of the firm,as it will be in case this petition is granted,as it will be necessary to take out and place in cars ,that would not be necessary in case this petition is granted. Therefore,all things considered,your petitioner prays the your honorable body grant the above petition ,and that you advise him of your decission at the very earliest possible moment,as it is a matter of considerable importance that Mr he knows your pleasure in the matter without delay.
