Austin Street Closures and Circus Licenses 1910

Circus Permits Approved – The city council authorized street closures on Fourth and San Jacinto streets on October 7-8 to allow the Sells-Floto Circus to unload equipment, and approved occupation licenses for both the Sells-Floto Circus ($50) and Barnum & Bailey Circus ($100), plus $5 per side-show.

Livestock Pens and Sidewalk Complaints – Citizens petitioned the council to remove stock feeding pens from East 4th Street and to require property owners near the Capitol to build concrete sidewalks on Congress Avenue; both petitions were referred for investigation.

Street Lighting Upgrade – The council authorized purchasing 45 electric arc lamps from General Electric Company at $17.70 each to light 6th Street, matching the lighting already installed on Congress Avenue.

Judgment Claims Settled – The council approved appropriations to pay two judgment claims against the city: one to Thomas Mills and another to J.H. Gassaway and others.

Minor Fee Disputes – The council rejected a petition to refund pound fees and referred a request to remit a fine for reckless automobile driving for further investigation.

571 • Regular meeting of the City Council : Austin,Texas,October 06, 1910. The Council was called to order by the Mayor.W.M.Holle,called: Present Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Absent None. Petitions,memorials,etc: Petition of Citizens By Councilman Hart petition of Citizens ,asking the Council to take action in To remove Stock hin' regard to Stock Feeding Pens on East 4th street. & west-reels The petition was read and laid over for investigation. The Mayor laid before the Council a petition from Citizens asking the Council to Petition Citizens to have Sidewalk require the owner of lots North east of the Capitol andfronting on the east side built North Cong Ave of Congress Avenue to build concrete sidewalks in front of these lots Read and laid over . Petition Henry Watrous • Councilman Hart presented a petition from Henry Watrous asking the Council to refund fees. refund pound fee paid by him,which was refused by the following vote : Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. G L Southern to • Councilman Hart presented a petition from G L Southern asking the Council to remit fine Huggins refund a fine paid by one Huggins in the Recorders Court,which was read and laid over for investigation. Councilman Powell presented the following resolution: Whereas,for the safety and convenience of the M K & T and H & T C railway comp Sells-Floto Circus and also the Sells Floto Circusand the public of Austin generally,in unloading arranged to close street and re-loading the wagons,aparatus and other property of the Sells Floto Circus , temporarily it is important for a portion of the daythe entrance to fourth street where it crosses San Jacinto street should be closed,therefore Be it Resolved by the City Council of the City of Austin : That the entrance to the north and the entrance to the south across fourth street, at the intersection of San Jacintostreetare hereby authorized and directed by the City Council to be closed under the supervision of the proper City Officials, for the periods of from five to sven oclock of the morning of Oct 7th ,and from eleven to one oclock of the night of Oct 7th and the morning of Oct 8th 1910. The resolution was passed by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart '& Powell 5 Nays none. Reports of City Officers : Reports City Officers The Mayor laid before the Council the report of The Sanitary Inspector fot the month of August ,and of the Fire Marshal ,the Matron of the Hospital,for Sept , and of the Asst Health Officer giving a report of his trip to the meeting of the State Board of Health Officers at Houston,which were read and ordered filed . The Council then recessed until 2 P M this day. Oct 6th ,3 P M . Claims of Councilmen The Council was called to order by the Mayor with all members present. H. Hart The Mayor laid before the Council a claim of J D Randolph for damages to Autimo-bile ,which was read and referred to the City Attorney for investigation & report Dr. Weller, Resident Councilman Hart offered the following resolution: City Hospital Resolved by the City Council of the City of Austin ,that Dr C B Weller,Resident Physician at the City Hospital be and he is hereby required to pay into the City Treasury the sum of $ 15.00 per month for board of his Wife. --- Page break --- 572 Councilman Hart Meeting Health Officers 1910 For Mr. Griffith to remit fine of Son Drain ordinance Lump Thos. Councilman Hart presented a bill from Dr C B Welles for expenses attend-ing the meeting of the Board of Health Officers of the state at Houston Texas,Sept 1910,amounting to $ 20.90,which was allowed and ordered paid by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. The Mayor laid before the Council a petition from Dr F L Griffith , asking the Council to remit a fine assessed in the Recorders Court against his Son F M Griffith,convicted for fast and recklessdriving of a automobile,which was read and referred to Councilman Hart . Unfinished business : The Mayor laid before the Council an ordinance regulating the use and improvement of drains and waterways,whioh was read the second time. The Mayor laid before the Council an ordinance making an appropriation to pay the judgement claim of Thos Mills against the City of Austin, which was read the third time and passed by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. The Mayor laid before the Council an ordinance making an appropriation to settle the judgement claim of J H Gasseway and others against the City of Austin,which was read the third time and passed by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. The Mayor laid before the Council an ordinance amending Article 372, Section 6,Chapter 7,page 207,of the Revised ordinances of the City of Austin,which was read the second time. Mayor Wooldridge offered the following amendment to the ordinance: " Section 6 That the sidewalks on Brazos and Colorado streets shall be ten feet ( 10) in width from the Colorado river to 8th street. The amendment was lost by the following vote : Yeas Mayor Wooldridge ,Counsilman Bartholomew 2 Nays Councilmen Gracy,Hart &Powell 3. A motion was then made to suspend the rule and place the ordinance on its third reading and final passage,which motion prevailed by the following vote : Yeas Councilmen Bartholomew,Gracy,Hart & Powell 4 Nays Mayor Wooldridge 1 The ordinance was thenread the third time and passed by the following vo Yeas Councilman Bartholomew,Gracy,Hart & Powell 4 Nay Mayor Wooldridge 1 The Council then recessed subject to call of the Mayor. --- Page break --- 573 Oct 7th 1910. The Council was called to order by the Mayor with all members present. Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : Section 1. That an occupation tax or license fee of $100.00 be and the same is hereby directed to be charged against the Circus and Menagerie of the Barnum and Bailey Circus ,for their two exhibitions to be made in this City on October 7th 1910. Section 2. That in addition to the above license the sum of five dollars ($5.00) be and the same is hereby directed to be charged for each side-show exhibiting in connection with said Barnum & Bailey Circus. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. Mayor Wooldridge offered the following resolution : Beit resolved by the City Council of the City of Austin ,Texas. Section 1. That an occupation tax or license fee of $50.00 ,be and the same is hereby directed to be charged against the Circus and menagerie of the SellsFloto Circus, for their two exhibitions to be made in this City on Oct 7th 1910. Section 2. That in addition to the above license the sum of five dollars($5.00) be and the same is hereby directed to be charged for each side-show exhibiting in connection with said Sells-Floto Circus. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none. or. 25-0 authorizin Purchase Lamps [illegible] Councilman Bartholomew offered the following resolution : Resolved that the Supt of Parks and Public Property be authorized to purchase from the General Electric Company 45 alternating current multiple Arc Lamps , for lighting 6th street ,similar to these in use on Congress Avenue, at the price of $17.70 each for Austin, Texas.
