Re: Mr. Epps refund of taxes By Councilman Hart petition of Citizens Association, southside, granted asking the removal of stock pens from south Austin. The petition was read. Councilman Hart moved that the City Attorney be instructed to prepare and submit to the Council at the earliest possible time, not later than the next regular meeting, an ordinance on the subject of stock pens within the City limits, and that Citizens interested be invited to meet with the Council ,at a time to be set for consideration of the ordinance ,and discuss same ., which motion prevailed by the following vote : For Citizens for Yeas Mayor Wooldridge, Councilmen Bartholemew, Gracy, Hart & Powell 5 removal of stock pens Nays none. from South Austin. Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That the collection of the fine of $ 10.50 entered in the Corporation Court against Fine of $10.50 suspended Bill Hewitt for intoxication be and the same is hereby suspended until the further order of the City Council , for the reason that the defendant is a very old man, an inmate of the Confederate Home ,and promises that the offence will notagainoccur The resolution was passed by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. Whereas, the Superintendent of Streets and Public Improvementhas not located the Track [illegible] [illegible] street [illegible] [illegible] line [illegible] track line for a street railway for Claud V Burkhead and Associateson South Congress Avenue in the City of Austin,at anypoint on said street south of the intersection of said street with the Fredriksburg road ,which act on the part of said Superin-tendent is made a condition to the placing of a street railway track by said parties thereon,by the certain ordinance passed July 1st 1910; and, Whereas,it has come to the knowledge of the City Council that Claud V Burkhead and Associates and their agents and employees have and are now digging in South Congress Avenue at a point beyond the said intersection of said street and have placed and are placing obstructions thereon and in said street,Therefore, Be it resolved by the City Council of the City of Austin : That Claud V Burkhead and Associates and their agents and employees be and they are hereby required to stop immediately all digging in said streetsouth of said intersection ,and to restore said streetto the condition in which same was before said acts of said parties;and said parties are further required to remove at once all obstructions from said street. Be it further resolved ,that a certified copy of this resolution be served upon John E Shelton,Esq,Attorney for said parties. 576 C & B & Associates To make power of attorney to anyone to represent them *Mayor Wooldridge laid before the Council the following resolution: Whereas, Claud V Burkhead and Associates,operating under a certain fran-chise granted them on July1st 1910,to construct,maintain and operate a street railway in the City of Austin,,have through certain parties made demand upon the City Council for the proper grade linesand the location of the track line upon South Congress Avenue in the City of Austin south of the intersection of the Fredricksburg Road;and, Whereas,the said Claud V Birkhead and Associates is not a Corporation with with duly constituted agencies through the business of said grantees,may b be transacted with the City of Austin; and, Whereas,it has not been disclosed to the City Council,who the said Associat are ,and no one has exhibited the authority to the City Council,nor purported to act for said grantees to the extent of binding said grantees in any agreement,that may be made between the City of Austin and said grantees in any matters regulating the construction and maintainance of a street railway over the streets of the City of Austin; and Whereas,it is necessary for the proper protection of the public that in any transactions that may hereafter be had with said grantees by the City Council ,definite authority be shown by any party or parties pur-porting to represent said grantees in all agreements between the City Council and said party or parties; now therefore, Be it resolved by the City Council of the City of Austin: That any party or parties appearing before the City Council or otherwise dealing with the City of Austin purporting to represent said grantees, be and they are hereby required,to file with the City Clerk a power of attorney made and executed by each and all of said grantees,reposing in said party or parties full and plenary authority to act for them in all matters relating to the construction and maintainance and operation of said railway in the City of Austin,and that such power of attorney shall in addition,designate some person who resides in the City of Austin as that upon whom services of notices and legal process may be had;and, Be it resolved further ,that a copy of this resolution be served on John E Shelton and H A Dawson. Oct 18th 1910. The Council was called to order by the Mayor,with all members present. The Mayor laid before the Council the following resolution: Whereas Claud V Birkhead and Associates,have asked for alime for their street railroad on south Congress Avenue,therefore, Be itresolved by the City Council of the City of Austin : That the City Council of the City of Austin,Texas,shall anddoes hereby designate the following line on South Congress Avenue as the line on which said street railway shall be laid;all measurements given are from a lime which is a contin-uation of the center line of North Congress Avenue,and is also the true center line of South Congress Avenue in all portions except between the Bouldin Creek culvert and the south end of the revine between James and Gibson streets. Starting at the Congress Avenue bridge said street railway shall,within sixty feet,curve from the track on the bridge to the center line of the Avenue,and shall continue along said center line to a point of the curve to the west into the Fredricksburg road.At this point the line shall leave the center ,and by a reverse cury shall take a position eighteen feet (18')from said center of Con-gress Avenue to the center of the track.The line shall continue in thisposi- -tion parallelto said center line of Congress Avenue until it reaches a distance of approximately two thousand feet (2,000) from the south end of the Colorado River bridge. From this point said track shall,by areverse curve ,take a position elevenfeet (11') from said center line of Congress Avenue to center line of said track,and shall continue in this position as far south as said Claud V Birkhead and Asso-ciates shall construct said track.Positions of all curves,frogs,switches,etc, are to be given by the Superintendent of Streets and Public Improvementsthrough the City Engineer. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That all the streets entering or passing to the State Capitol grounds on the east side of the Capitol building may be closed to vehicles ( other than those in the parade) from the hour of 10 A M to 2 P M of October 27th 1910,during the ceremonies pertaining to the unveiling of the John B Hood monument. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Gracy & Hart 3 Absent Councilmen Bartholomew & Powell 2 Councilman Hart offered the following resolution: Be it resolved by the City Council of the City O f Austin: (1) That the Austin Fire Dept be and is hereby requested to take part in the parade to take place at 9.30 O'clock on the morning of October 27th 1910,in the celebration of the unveiling of the John B Hood Brigade Monument .It would be gratifying to the Council if the different Compa-nies would appear in uniform with their apparatus. (2) That a copy of this resolution be at once transmitted to the Chief of the Fire Dept with request that he give the matter his special attention .
