Railroad Expansion: Council approved multiple ordinances to allow private railroad companies (M.H. Voss, Felix Chirico, and others) to build and operate spur tracks across city streets, subject to penalties and conditions.

School Bond Financing: The city hired broker T.S. Johnson to sell $75,000 in school bonds (issued July 1, 1910) to cover education expansion; Johnson successfully sold the bonds to Spitzer & Company of Toledo, Ohio, with installment payments through 1911.

Property Redemption: Homeowners who lost property to the city through foreclosure sales were granted a 10-month period to redeem their land.

Infrastructure Improvements: Council approved storm sewer installation on Congress Avenue (shared cost with the electric streetcar company) and adjusted sidewalk placement on 11th Street to avoid interfering with private fences.

585 Regular meeting of the City Council: Austin,Texas ,October 27, 1910. The Council was called to order by the Mayor : Roll called : Present Mayor Wooldridge,Councilmen Hart & Powell Absent Councilmen Barthelemew,Gracy The Council then recessed until 2 P M this day. Oct 27th 1910 2 P M The Council was called to order by the Mayor with all members present.except Gracy The minutes of the last regular and subsequent adjourned meetings were read and approved. Reports of City Officers: The Mayor laid before the City Council the report of the Sanitary Inspector for the month of August 1910,which was read and ordered filed. Unfinished business : Judgement claim The Mayor laid before the Council an ordinance making an appropriatim to pay the H Reasonover judgement claim of Harry Reasonover against the City of Austin,which was read the third time and passed by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 — 0 Nays none. Spur RR track The Mayor then laidbefore the Council an ordinance to grant to M H Voss and Voss & Kooch O L Kooch the right to construct,maintain and operate a railroad track upon and across certain streets in the City of Austin ,subject to certain conditions and penalties,which was read the third time and passed by the following vote: Yeas xx laid over. Redemption of - The Mayor then laid before the Council an ordinance to permit owners of Real property & and foreclosures estate purchased by the City of Austin at foreclosure sale to redeem the same at any time within ten months from the taking effect of this ordinance,which was read the third time and passed by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 — 0 Nays none. Petition Judgement to Councilman Bartholomew moved that the petition of Judge Jas W Smith in regard remove requirement to charges for meter rent on certain meters,be not granted,which motion prevailed by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 — 0 Nays none. Felix Chirico,Spur The Mayor then laid before the Council an ordinance to grant to Felix Track Chirico the right to construct ,maintain and operate a railroad track across a certain alley in the City of Austin,subject to certain conditions and penalties. The ordinance was read the third time and passed by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 — 0 Nays none. The Mayor then laid before the Council an ordinance regulating the use Drains, Waterways etc and improvement of Drains and Waterways ,which was read. Ordinance Councilman Powell offered a substitute for the ordinance,which was read and adopted by the following vote : Yeas Mayor Wooldridge ,Councilmen Bartholomew,Gracy,Hart & Powell 5 — 0 Nays none. Councilman Bartholomew moved to amend the ordinance by striking out Section 2,and renumbering [blank space] same accordingly,which motion was lost , --- Page break --- 586 Marshaly instructed to remove fences Bouldin addition Yeas .Councilmen Bartholomew & Hart Nays Mayor Wooldridge & Councilman Powell 2 On motion of Councilman Powell the ordinance was laidover for further investigation . Councilman Powell o ffered the following resolution: Be it resolved by the City council of the City Of Austin: That the City Marshal be instrusted to have the fences removed and the alley opened in Block "E" in the J E Bouldin Addition ,South Austin,from First to Second street. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart & Powell 4 Absent Councilman Gracy 1 Councilman Hart offered the following resolution : It appearing that on Sept 1st ,1910.,a certain brown horse mule about ten years of age ,fourteen hands high with harness marks on shoulders and back unbranded was impounded in the City pound;that said mule was legally advertised and sold by the City Marshal on Sept 12th 1910,and was bought by Julius Alexander for the sum of $ 53.00. That according to the City ordinances of the City of Austin ,fees amounting to the sum of $ 5.50 by reason of the impounding ,advertising and selling of said mule have accrued ,leaving a balance in the hands of the City Treasurer of $ 47.50,which under Article 19of the Revised Ordinances of the City of Austin and amendments thereto,is due and pay-able to the owner of said muleupon proper proof of ownership being made,and Whereas A P Jennings of the City of Austin has made satisfactory proof of ownership as per affidavit filed and made a part of this resolution, therefore , Be it resolved by the City Council of the City of Austin : That said sum of $ 47.50 be and is adjudged to be the property of the said A P Jennings,and that the City Clerk is hereby authorized and directed to issue to said A P Jennings a warrant for said amount and that the same be charged to the miscellaneous account of the Police Dept. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart & Powell 4 Absent Councilman Gracy 1 Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Mayor of this City ,in the name of this Council and in behalf of the City ,be and he is hereby authorized to invite the John B Hood Brigade Association of Texas to hold its annual reunion for the year 1911 in the City of Austin ,Texas. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart & Powell 4 Absent Councilman Gracy 1 The Council then recessed subject to call of the Mayor. The Council was called to order by the Mayor, with all members present. The Mayor laid before the Council the following communication : Austin, Texas , October 29, 1910. To the Hon Mayor and City Council, Austin, Texas. Gentlemen : I will undertake to sell for the City of Austin $ 75.000 School Bonds, dated July 1, 1910, at par and accrued interest upon the following terms : The bonds are to be delivered to , and paid for by the purchasers in Toledo, Ohio, or New York City, as the purchasers may elect. The purchasers are to take up and pay for $25.000 of said bonds as soon as they are approved by their Attorneys, and $ 10.000 of said bonds are to be taken up and Proposition T. S. Johnson to sell School Bonds. $ 10.000 on the first day of January ,1911, and $ 10.000 on the first day of each month thereafter until all are delivered, accrued interest on each installment is to be paid up to the respective dates of delivery. All past due coupons at time of delivery shall be clip:ped from the bonds before shipment . The purchasers are to have the option of taking up all, or any part , of said bonds at any time, paying accrued interest on those so taken up , up to the time of delivery, and the bonds are to be delivered to the purchasers consecutively according to their numbers unless otherwise directed by the purchasers. All proceedings leading up to and culminating in the issuance of the bonds, are to be to the satisfaction of the purchasers attorney prior to their paying for said bonds, or any of them, and they are to be furnished with a full certified copy of all proceedings had in connection with the issuance of said bonds and such other proceedings as their attorney may require. Said attorneys conclusions are to be reported to you within twelve days from the time the transcript is delivered to me. Upon my selling the bonds upon the terms herein stated , you are to pay me a commis-sion of $ 750.00 , the same to be paid in sums proportionate to the several install- -ment of bonds as they are delivered and paid for as herein provided. Should I not succeed in selling the bonds for any reason you are to be under no obligation to pay me any sum whatsoever . Respectfully submitted , (sgd) T S Johnson. The Mayor laid before the Council the following resolution: Whereas, T S Johnson of Austin, Texas, has made a proposition in writing, said proposition of date October 29, 1910, and now on file with the City Clerk of the City of Austin, proposing to sell for the City the City of Austin $ 75.000 School bonds , dated July 1, 1910, at the price and upon the terms in his said proposition set out; and, Whereas, the City Council of the City of Austin deems it to the best interest of the City to accept said proposition; therefore, Be it resolved by the City Council of the City of Austin , that the said proposi-tion of said T S Johnson be , and the same is hereby adopted, and that said T S Johnson be employed to sell said bonds according to the terms of said proposition and he is hereby directed to proceed to sell said bonds according to said terms. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 . Nays none. --- Page break --- 589 The Mayor laid before the Council the following resolution : Whereas, the City Council of the City of Austin entered into a contract of date October 29,1910,with T S Johnson of Austin,Texas,employing and authorizing said Johnson to sell $ 75,000 School Bonds of the City of Austin Texas,dated July 1,1910,at the price and according to the terms and condi-tions set out in said contract;and, Whereas,said T S Johnson has reported in writing under date of October 29, 1910,said report now on file with the City Clerk,that he has sold said bonds to Spitzer & Company ,of Toledo,Ohio,at par and accrued interest,and under terms and conditions set out in his said report;and, Whereas,said sale of the bonds is in compliance with the terms of the contract so made with said T S Johnson : now therefore, Be it resolved by the City Council of the City of Austin ,Texas,that said bonds be ,and are hereby, awarded to said Spitzer & Company at the price and according to the terms of said sale as reported by said T S Johnson, and the City Treasurer is hereby directed to deliver said bonds to said Spitzer and Company upon compliance by them with the terms of the sale of the bonds to them . The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. On motion the Council recessed subject to call of the Mayor. Austin,October 31st 1910. Inst press To Contract Councilman Powell offered the following resolution : with Street Ry Co Be it resolved by the City Council of the City of Austin : To put in storm That the Superintendent of Streets and Public Improvements be permitted to sewer in South Austin enter into a contract with the Austin Electric Railway Company to put in a storm Sewer and fill the roadway in the ditch in Congress Avenue in South Austin ,in front of Eek's store ,for the distance of about one hundred feet Engineer's estimate $ 625.00.Street car company to pay one-half. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. Councilman Powell presented the following communication from the City Engineer : Austin,Texas,Oct 3rd 1910. To the Hon P W Powell ,and Hon D B Gracy, Commissioners ,City of Austin,Texas. Gentlemen : x Powells. In running the line for the sidewalk on the south side of 11th Street Line Rio street from Rio Grande street east we find we are unable to place the sidegra[illegible] -walk at the correct distance from the curbing on account of interfering with the fences in several locations. In order that we may miss the fences I recommend that we place the outside line of the walk 8.5 'from the new curb line ,which would be 28.6'from the newly established center line ,instead of 32 3/4 ' which would be the correct distance.The distances from the inside line of the walk to the --- Page break --- fence at the various corners would then be as follows: West line of Rio Grande street 1.50' West line of Nueces st: 1.88' East line of Nueces st 2.56' West line of San Antonio st 5.30' East line of San Antonio st no fence West line of Guadalupe st .24' East line of Guadalupe against fence West line of Lavaca st .47' East line of Lavaca Sidewalk already along State prop erty . At the east side of San Antonio street there is already a walk in place , but this is 2.73 ' outside of the recommended line .The sidewalk along the State property is too far in to be used farther west. The fence west of Rio Grande street is so far north that the entire walk if ex-tended would come inside the fence,and this block cannot be regarded in giving a line .The line recommended will not hit any trees. As the center line of west 11th street has been established ,I see no reason why the sidewalk should be changed as recommended,but believe they should be placed in their true position .Upon further investigation however I believe that above line is the best possible. The Council then recessed subject to call of the Mayor. November 1st 1910. The Council was called to order by the Mayor,with all members present. Councilman Gracy offered the following resolution : Beit resolved by the City Council of the City of Austin : That the City Treasurer be directed to transfer $ 433.55 from the Paving fund to the Street Improvement fund ,on account of Inspector J G Watts receiving his salary out of the Street fund when it should have been paid out of the Paving fund. That the City Clerk be instructed to furnish a copy of this resolution to the City Treasurer. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. The Mayor laid before the Council an ordinance granting to M H Voss and O L Keese the right to construct ,maintain and operate a railroad track upon and across certain streets in the City of Austin ,etc,which was read the third time and passed by the following vote: Yeas Mayor Wooldridge,Councilmen Gracy & Hart 3 --- Page break --- 590 .
