Halloween Prank Costs Man Pound Fee: George Wilson's horse was untied and released into the street by an unknown prankster on Halloween night. Despite Wilson taking precautions to prevent such mischief, he was charged a $1.50 impound fee. The council voted unanimously to refund the fee, deeming it unfair given the circumstances.

Street Planning Study Shows No Quick Solutions: Councilmen investigated how Dallas and Fort Worth handle street lines and grades, hoping to improve Austin's disorganized system. They found those cities faced identical problems with unclear property lines and encroachments, and neither city had discovered better solutions. The councilmen submitted no expense report, finding the trip yielded minimal benefit.

Permanent Street Grades Established: The council officially set permanent elevation grades for West Avenue (between 9th and 12th streets) and 23rd Street (between Guadalupe and Rio Grande streets), with detailed measurements to guide future construction and property development.

Telegraph Company Gets Pole Lease: The Southwestern Telegraph and Telephone Company received permission to attach one of its poles to a city pole at West Avenue and 10th Street, with either party able to terminate the lease with 30 days' notice.

Cemetery Deed Corrected: The council authorized the mayor to execute a duplicate deed for a cemetery lot originally recorded without proper acknowledgment in 1888, allowing the current owner to properly record her property.

591 • Regular meeting of the City Council : Austin,Texas,November 03, 1910. The Council was called to order by the Mayor : Roll called : Present Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Absent none. The Minutes of the last regular and subsequent recessed meeting s were read and approved. Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Pound fee of $ 1.50 assessed and collected from George Wilson by reason of theimpounding of his horse on the morning of Nov the 1st ,1910,be and the same is hereby remitted for the following reason,to-wit: Pound fee refunded From the statement of Mr Wilson the horse was tied inside of his yard near one Geo Wilson of the windows of his residence ,that during the night of Oct 31st (Halloween ) some person untied the horse and turned him into the street,supposedly out of pure mischief,that he anticipated some prank of this kind and had taken every precaution against it. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. • The Mayor laid before the Council the following report: Austin,Texas,Oct 26th 1910. To the Mayor and City Council, City of Austin,Texas. Gentlemen : Under a resolution of the City Council passed Oct 21st 1910,I went Report Councilman to Dallas and Fort Worth to ascertain the policy adopted by those Cities in regard Gracy. Streets, etc., in to location of street lines and grades and removing encroachments on the streets Fort Worth & Dallas and also whether payment was made by said Cities or isthere of them where private property was damaged by the grades. At both Cities I found that street lines are as indefinite as they are at Austin; very few established corners and from these cornersno two surveyors could not or would not agree on the same line,and both of said Cities make the street lines conform as nearly as possible to the improvements;encroachment on the streets are pushed back if possible,and if the owner of such encroachments refuse to move back without suit,same are left until some future date . When it is decided to establish a permanent grade on any particular street the City Engineer is directed to make a profile of such street,and recommend a permanent grade ,but before same is established all property owners are notified to appear before the Council and show cause why such grade should not be adpoted . All property in the business section is required to be filled or excavated to the established grade ,but in the residence section the grade is made to conform to the natural surface of theground as nearly as practistcable,and when a street slopes to the side ,a cut is generally made. Ciurb and sidewalk lines are generally a matter of compromise and are put in the best way possible. When curb and sidewalk lines have been given by a former City Engineer,and found to be incorrect but the property owner has improved according to those lines all new workis done at the expense of the City. --- Page break --- 592 . No damages is paid to property damaged by grading . Both Cities are now in a turmoil ,Dallas on account of her fair and Fort Worth on account of her celebration of the 175 % increase in population ,but I met the Mayors,Commissioners and City Engineers of both Cities and conversed with them about the street situation,and see no benefit to be derived by the City of Austin from my trip,beyond ascertaining the factthat the Cities of Dallas and Fort Worth have not solved the street problem,and are doing as Austin is now doing,the best under the present circumstances, and as the City of Austin receives no benefit from the trip except such as stated above ,I do not believe that the City should be at any expense in the matter and therefore no expense account is rendered. Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : (1) That the thanks of this Council are due and are hereby expressed to Councilmen P W Powell and D B Gracy for their recent careful investigation into streets and sidewalk conditions in the Cities of Dallas and Fort Worth (2) That the sum of $ is hereby appropriated out of the miscel-laneous appropriations of the General fund for the expenses of Councilman Powell incurred upon this trip,and that the sum of $ is likewise appro-priated to reimburse the expenses incurred by Councilman Gracy . The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart & Powell 4 Not voting Councilman Gracy . 1 Duplicte Deed To Martha Nitzsher Cemetery Lot Mayor Wooldridge offered the following resolution: Whereas,a deed executed by Joseph Nalle,Mayor,in April 1888,to Martha Nitz-eher to the southwest quarter of lot 541 in Oakwood Cemetery was not Acknowledged ,and whereas the present owners of said property,the said Martha Nitzsher,desires to have a deed to such property properly acknowl-edged for record ,therefore, Be it resolved by the City Council of the City of Austin : That A P Wooldridge,Mayor,be and he is hereby authorized to execute a duppli-cate substitute deed for said deed executed by Joseph Nalle,Mayor,to the Southwest quarter of Cemetery Lot No 541,dated April 1888,and the City Assessor and Collector is hereby authorized to prepare said duplicate sub-stitute deed for execution as herein above recited . Councilman Bartholomew offered the following resolution : Ull Mayor authorized to sign lease To Southwes Tel Co To use poles. Resolved that the Mayor and Superintendent of Parks and Public Property be authorized to sign a lease with the Southwestern Telegraph and Telephone Comppermitting said Co to buy one of its poles to a pole belonging to the City on the Northeast corner of West Avenue and Tenth street,such lease to be subject to termination on thirty days notice by either party. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : Line 23rd Guadalupe To Rio Grande That the center line of 23rd street from Guadalupe to Rio Grande streets ,be established by measuring thirty (30) feet from the building on the northwest corner of 23rd & Guadalupe streets,& 30 (30) feet from the northwest corner of 23rd street and the alley between San Antonio & Nueces streets ,and also,that the permanent grade of 23rd street at Rio Grande street be 97.3,and at Nueces street 98.0, referring to the profile on file in the City Engineer's office,which makes no change in the grade at these two points.
