Councilman Hart offered the following resolution: Be it resolved by the City Council of the City of Austin : That leave of absence for five days starting from the 14th inst,is here granted to John Saunders,Assistant Pound Master. Stacy days ,from Nov 15th ,1910,and the City Marshal is authorized to place a special Officer on duty in his stead during said time without addition expense to the City. To the Mayor and City Council of the City of Austin, Gentlemen : I have examined the records of Travis County,to ascertain the N E Corner of that portion of Out-Lot 43 Division "B"conveyed by said City of Austin to B F Cleveland by deed dated the 7th day of April 1904,and by corrected deed dated the 8th day of June 1909,and find the following facts,viz: Rec d. Enclosed On 12 Jany 1871book U page 97 ,Nathaniel Moore and Wife Eudphia,the then owners of in C.& E. d[illegible] to all of Out-Lot 43,conveyed a part of said outlet to Thos M Puskett,describing said d [illegible] 20" inch [illegible] 18-7"-9" tracts as follows: All that part of Outlet 43 Division "B"in the Government tract d of June 1909. adjoining the City of Austin which is north of the Austin City Cemetery grounds [illegible] 43 as now laid off ,and East of a line running with the West line of said Cemetery grounds ,the land hereby conveyed being the North East Corner of said Outlet No 43 & containing 2 1/2acres ,more or less. * On 21st of April 1890,the Executers of J L Short ,deed conveyed said 2 1/2 acres by same description ,to the City of Austin,Book 96 page 39. I have been informed by Mr Dennis Corwin ,an old Surveyor,that he ran the present --- Page break --- 598 West fence line of the City Cemetery north of the street leading into said Cemetery before the Civil War,and if such is the fact,then the said fence line continued North to 19th street would undoubtedly be the West line of the above described 2½ acre tract. In the deed from the City of Austin to B F Cleveland dated 7th of April 1904,recorded in Book 198,page 505,the discription reads as follows "Beginning 15 feet West of the N E corner of Outlet No 43 Division "B" said City;Thence,with the North line of said Outlet 80½ feet; thence South 128 feet ; thence East 80 ½ feet ; thence North 128 feet to place of beginning; the property hereby conveyed being a rectangle ". This description would locate the above tract in the Jewish part of the Cemetery. In the corrective deed from the City of Austin to B F Cleveland dated 8th of June 1909,,recorded in Book 199,page 115,the description reads as follows : Beginning on the North line of said Outlet,same being the South line of Magnolia Avenue,now called East 19th street,/at a point 15 feet West of the North West corner of that certain 2½ acre tract sold and conveyed to the City of Austin by the Executors of the Esth of J L Short deed by deed dated the 21st day of April 1890,and recorded in in Book 96,page 39 of the deed record of Travis County ,Texas, ; thence Westerly with the North line of said Outlet 80½ feet; thence southerly parallelte the North line of said Outlet .128 feet ; thence easterly parallel to the North line of said Outlet.80½ feet; thence northerly parallel to the East line of said Outlet 128 feet to place of beginning. On the -day of October 1909the City Engineer surveyed the north line of said Outlet 43,commencing at the NorthWest corner of the Cemetery as new fenced,and running westerly with the north line of said Outlet,at 9 feet would intersect the west line of Outlet 40,( the old City Cemetery ) if said west line was continued on to19th street ,at fifteen feet further placed an iron pipe for N E Corner of tract conveyed Cleveland as above stated ,at 70½ feet further placed an iron pipe at intersection of a street leading from the south 36 feet wide at east 19th street; thus giving Cleveland only a depth of 70½ feet on east 19th street ,,when the deed to him called for 80 ½ feet . According to the City Engineers survey ,the west line of the Cem-etery fence is 9feet East of true west line of the Cemetery. I further find that by deed dated the 16th day of January 1904, See B Zimpelman conveyed to the City of Austin ,Book 198,page 537,a part of Outlet 43 Div "B" described as follows :Beginning at the South East corner of Outlet 43 in Div "B" of the City of Austin,said point being on the west line of the City Cemetery,and being also the southEst corner of Lot No 20 of the Forster & Ludlow Sub-division of said Outlet No 43; thence north with the west line of the City Cemetery,same being the east line of Outlet No 43,454 feet to the north east corner Lot No 25of the Forster and Ludlow sub-division of Outlet 43 Div "B": thence [illegible] of the [illegible] said subdivision [illegible] [illegible] [handwritten] Robert C. of Cunningham [illegible] [handwritten] Grace J. Sues Outlot [handwritten] 26B" xxxxxxxxx [illegible] xxxxxxxxxx [illegible] --- Page break --- 599 According to the survey of the west line of the City Cemetery, hence is 100 feet. Far east of and to the north and west of what Cleveland claims. Hope deed from Zimpelman to Cleveland .thence West 15 feet with the north line of said Outlet 25;thence south 454 feet to the south line of said Outlet No 20; Thence East 15 feet to the place of beginning, said property to be used by the City of Austin for the purpose of a public alley. I further find that by a deed dated the ---day of January 1904,and recorded in Book 199,page 113 B F Cleveland conveyed to the City of Austin two tracts of Outlet 43 Div "B" ,described as follows: (1) Beginning at the north east corner of Outlet 26 of the Forgter & Ludlow sub-division of Outlet 43 Division "B"said City;thence north 140 feet : thence west 15 feet ;thence south 140 feet;thence east 15 feet to the place of beginning,and second .Beginning at a point 15 feet west of the north west corner of lot No 26 of the Forgter & Ludlow sub-division of Outlet No 43 Div "B";thence west 24 feet to a point; thence N 19°east 157 feet 5 inches to a point 99 feet west of the east line of Outlet 43 Division "B";thence east 3 ½ feet to a point; thence in a straight line to the place of beginning. According to above deeds from Zimpelman and Cleveland the City owns a strip 15 feet wide west of the west line of the Cemetery,as far as their tracts exist,as to the Zimpelman's part ,same is to be used for alley purposes,but as to Cleveland's part no reservation of any kind made. According to the deed fromCleveland from the City,Cleveland was entitled to a strip 80 ½ feet wide on east 19th street,but to leave a strip 15 feet wide West of West line of the Cemetery,and leave a 34 feet street running into East 19th street, Cleveland would only obtain 70 ½ feet by said deed ,consequently Cleveland would lose lease ten feet of ground ,which should be given to him by the City or payment made to him for the same,or to his Assignee,Mary R Nagle. Councilman Bartholomew offered the following resolution: Be it resolved by the City Council of the City of Austin,that the report of Coun-cilman D B Gracy,regarding the West line of the Austin City Cemetery,be and the Purchase of Land for Cemetery Improve- ments (or Nagle.) same is hereby approved,and, Be it further resolved ,that the City Council of the City of Austin purchase from Miss Mary R Naglethat certain strip of land ten feet in width off of the east end of the tract owned by her,fronting on East 19th street,and running back same width to the North line of the Dawson sub-division of a part of Outlet 43 Division "B" for the sum of two hundred and fifty dollars,and that said sum of two hundred and fifty dollars be appropriated out of the Miscellaneous General fund to pay for the same ,and that Councilman D B Gracy be requested to draw the necessary papers and have same executed in order to vest the title to said strip of land in the City of Austin,and to take delivery of said papers to the City Clerk,duly approved by said Councilman Gracy;that a warrant shall be issued to Miss Mary R Naglefor said amount of two hundred and fifty dollars.
