The minutes of the last regular and recessed meetings were read and approved.
Petitions, Memorials, etc: Pet Consumers Fuel & Ice Co To reduce water rate The Mayor laid before the Council a petition from the Consumers Fuel & Ice Co. asking a reduction in rates for water for certain seasons of the year, which was read and referred to Councilman Bartholomew for investigation and report.
Pet. Phil Bosche to put in oil tanks The Mayor then laid before the Council a petition from Phil Bosche, asking for permission to put in 3 gasoline tanks in the alley in rear of lots 2 Block 29 of the City of Austin, which was read and referred to Councilman Powell for report. Invitation to Barbecue at State University The Mayor laid before the Council an invitation from the President of the State University to the Council to attend a reception, etc at the University on Saturday Feby 18th 1911, which was read and accepted. The Mayor laid before the Council the annual report of the Austin Street Railroad Co. which was read and ordered filed.
The Council then recessed until 2 P M this day.

Ordinance Prohibiting distribution of medicines The Mayor laid before the Council the following ordinance: An ordinance to prohibit the distribution of samples, packages of medi-cines or other articles containing ingredients dangerous to health and prescribing a penalty for the violation thereof. The ordinance was read the first time and the rule was suspended and it placed on its second reading by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none.
The ordinance was read the second time and laid over. Fine R.T. Roughton remitted Upon the recommendation of Councilman Hart, a fine assessed in the Recorders Court against one R T Roughton for abusive language, amounting to $ 21.35, was remitted, except the amount of $ 10.00, by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Gracy, Hart & Powell 5 Nays none.
Resolution to Felix Cherico for Sidewalk platform on lot 1 The Mayor laid before the council the following resolution : Be it resolved by the City Council of the City of Austin : Section 1 . That Felix Cherico, his heirs and assigns, be and he is hereby granted the right to elevate above the level of the street and maintain, the sidewalk on the west side of Lot No 1 Block 32, between 3rd & 4th and San Jacinto and Trinity streets by means of a wooden platform one hundred (100) feet in length including the approaches thereto, four (4) feet high and ten (10) feet wide, for the purpose of handling freight to and from the warehouse situated on said lot, subject to the terms, conditions and

penalties hereinafter stated. Section 2 1.That said Felix Cherieo,his heirs and assigns,are reqired to give access to such sidewalk from the North and South ends thereof by means of a sloping approach of the same width of said sidewalk and of not less than three (3) feet to each foot of elevation;provided that all work must be dome under the supervis-ion and to the satisfaction of the Superintendent of Streets and Publie Improvements Section 3. It is furthe rprovided that said Felix Cherise ,his heirs and assigns, be required to keep said sidewalk and the approaches thereto in good and repair and to keep same at all times in such a condition; also that said sidewalk may be easily accessible to the public.
Section 4 . That the privileges herein granted are upon the express condition and it is made a considereation hereof that said Felix Cherieo ,his heirs and assigns,shall indemnify and hold the City of Austin harmlessfrom any and all damages that may result to any person or property by reason of the construstiom and main-tenance of s such elevated sidewalk. Section 5 . That the privileges herein granted may be rescinded and repealed at the will of the City Council;provided,that nothing in this ordinance shall be con-strued to repeal any of the penal ordinances of the City of Austin nor shall same abridge any of the right and power of the City Council in its exclusive control over and regulation of said street at said point. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none. The Mayor laid before the Council an ordinance to prohibit the distribution of sample packages of medicines or other articles containing ingredients dangerous to health and prescribing a penalty for the violation thereof. Resolved further, That any excesses of monies appropriated but not expended in any of the departments during the current year shall be subject to transfer and re-assignment within his department by the head of each department. Where such transfers shall exceed the sum of Two Hundred and fifty dollars ( $ 250.00) ,notification of transfer shall be made by the head of his department to the City Council. Be it further resolved by the City Council of the City of Austin, that the said Lucy Binford be given her liberty, and the collection of the fine in this cause be held in obeyance until the further order of the City Council in this case. The entire expense of this department is paidout of the General Expense fund. Special Appropriations. Survey for Sewer System for East Austin $ 300.00 To the above items of expense must be added $ 4,595.95.00 to cover the contin-gent expenses of this City for the current year,including the overdraft of $ 1,865.85 against the General expense fund on Dec 31st 1910.
In closing this Budget I have pleasure in submitting the financial condition of the City as it existed on Dec 31st,1910,with its condition on Dec 31st 1909. The total overdrafts of the City on Dec 31st 1909,less an outstanding warrant of $ 6,500.00 issued to the School Board ,amounted to $ 31,529.37,arising as follows: General fund $ 15,542.13 Street Improvement fund . 5,312.93 Interest and Sinking fund 3,150.10 Park Fund 576.16 Cemetery fund 888.03 Total $ 31,529.37 Against this overdraft was only the balance of $ 3,521.10 in the Permanent Paving fund,leaving a net overdraft of $ 27,705.27.

662 .This unsatisfactory condition of the City's finances at the end of 1909 ad principally arose from the fact that no Budget of the City's receipts and disbursements was provided for the year 1909, and as a consequence both the old Government and the present government had to do business in more or less in the dark during that year. On Dec 31st 1910, the only overdraft owing by the City (exclu-sive of the School warrant of $ 6,500.00 ) was an overdraft against the General expense account of $ 1,065.55. Against this overdraft in the general expense fund the City had cash credits in the General fund of the City on Dec 31st, 1910, amounting to $ 19,249.42,or net credits after deducting the $ 1,065.55 from the $ 19, 249.42 of $ 18,183.57. Add this net cash credit of $ 18,183.57 of Dec 31st,1910,to the net overdraft of $ 27,708.27 on Dec 31st ,1909, and we have the City $ 45,891.84 better off in cash on Dec 31st 1910,than it was on Dec 31st 1909. I wish also to add that every known debt owing by the City (except its bonded debt) was paid or charged in 1910. We paid not only December salaries , but all December bills in 1910, or thirteen months bills in twelve months time. I am informed by the City Officials that this has never been done before in our City. There is in the budget a credit of $ 67,915.85 to Interest and Sinking fund .The interest charges on the City's entire bonded indebtedness amounts to $ 63,770.00 .Deducting this sum from the estimated Interest and Sinking fund for the present year and there is left a balance of $ 4,145.00, at least $ 3,000.00 of which ought to be used in the redemption of some of our refunding bonds. I will submit a separate budget for the Water and Light Department for 1911, when I shall have received the report of that department. I am looking for the same within the next few days. I will only state here that its report will show a surplus on Dec 31st,1910, after everything is paid , of $ 75,249.01. Add this to the $ 18,183.57. in the general fund and we have net cash on hand in all Departments on Dec 31st, 1910, amounting to $ 93,432.57. I beg to accompany this budget with the full and clear reports of all the departments, save that of the Water and Light department. The report of this department which is a large one, has been unavoidably delayed. Respectfully, A P Wooldridge Mayor of the City of Austin.
