The Mayor laid before the Council a communication from Maggie Claim Maggie M Anderson M Anderson,stating that her House had been damaged from Blasting by some O.L. Albright Allowed of the City's employees,and filing bills,one to O L Albright for $ 2.50 and one from C K Miller for $ 2.50. On motion the Bills were allowed and ordered paid by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Gracy,Hart & Powell 5 Nays none.Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : Resolution sidewalk That the act of the City Council by resolution adopted February 9th,1911, Capital Lodge I.O.O.F. exempting for the period of one yearCapital Lodge No 23,I O O F of the repealed City of Austin,from the requirements of the ordinances heretofore made to build a sidewalkon the north side of its property on the corner of east ninth and Brazes streets in this City,be and the same is hereby set aside, cancelled and annulled. The resolution was read and laid over. Mayor Wooldridge offered the following resolution: Be it resolved by the City Council of the City of Austin: $175.00 to W B Walker That the sum of one hundred and seventy five ( $ 175.00)dollars ,or so Damages Sidewalk much thereof as may be necessary,be and the same is hereby appropriated out of the cost and damage fund of the street appropriatin fund ,for the purpose of paying to W B Walkerdamages incurred by sidewalk construction ordered at his placeon the corner of east ninth and Trinity streets in this City. The expenditures under this appropriation and work to be done,if said W B Walker will not accept said $ 175.00 in full of all damages,are to be made under the supervision of the Commissioner of Streets and Public Improvements. Nays Councilmen Gracy & Powell 2 The Council then recessed subject to call of the Mayor.
Saturday February 25th 1911. The Council was called to order by the Mayor with all members present except Councilman Gracy. The Mayor laid before the Council the following resolution: Whereas an erroneous assessment of taxes on the personal property of the Eagle Loan Co., for the year 1905 was made by the Assessor, in that a sum of $ 2,500.00 in unassessed credits was assessed in Austin, after same had been assessed and paid in Bexar Co Texas, the head quarters of the said Eagle Loan Co., as affidavits on file with the City Council will show, and Whereas the Eagle Loan Co agrees and is willing to pay the sum of $ 10.34 for taxes rendered for the year 1905, which is sufficient to pay the amount justly due Therefore, Be it resolved that the sum of $ 10.34 be accepted from the said company as the full amount due the City of Austin, and that said erroneous assessment is hereby corrected by striking from the assessment rolls the $ 2,500.00 assessed and levied as credits of the Eagle Loan Company, for the year 1905. The Mayor laid before the Council a communication from Ed Johnson, asking the Council to refund to him an amount of $ 7.50 paid by him on a fine assessed against his wife in the Recorders court. The Council refused to grant the request by the following vote : Yeas Councilman Powell 1 Nays Mayor Wooldridge, Councilmen Bartholomew, Gracy & Hart 4
The Mayor laid before the Council the following resolution : Whereas on the 23rd day of April 1910, a man by the name of Steve Wilson was arrest-ed by the Police for being drunk and sleeping in a public place , and upon trial of the cause pleaded guilty and was fined $ 1.00 and costs, aggregating the sum of $ 10.50 ; that the man was a resident of Bastrop County ,had come to the City to purchase necessaries for his family, because intoxicated spent his money, and when fined had no means to pay his fine. A friend and relative, a poor man working for wages, paid the fine. The man fined is very poor with a wife and six children, and I am informed has a hard time to support his family. The man who paid the fine is also a man of family and does not make more than enough to support them by his daily labor. The man fined is not addicted to drinking and I am informed has not drank since. Under this statement of facts I feel that the ends of the law have been satis-fied, and that it would be a humane act to refund to this family the amount of this fine and Costs; Therefore, Be it resolved by the City Council of the City of Austin : That said fine and costs against the said Steve Wilson be and the same is hereby remitted, and the City Clerk is authorized and directed to draw a warrant for said $ 10.50 to refund said amount. Councilman Hart offered the following resolution : Whereas,in Sept last,T H Deats plead guilty in the Corporation Court to being drunk and asleepin a public place.He admits his guilt and.does not complain of the action of the Court, but he assures me,and I am also assured by others,that he has abstained fromdrink since that time. He further assures me that he has been sick for a long time,has been unable to work,has a family to support,and that the sum of $ 10.50,which was the amount of fine and cost assessed against him,would materially help his family at this time; therefore, Be it resolved by the City Council of the City of Austin: That as the requirements of the law have been accomplished and the needs of the family of the said Deats would to some extent be alleviatedby them remission of said fine and cost,it is therefore ordered that the same be and is hereby remitted,and the City Clerk be and he is hereby directed to draw a warrant payable to said Deats for said sum of$ 10.50,the amount of said fine and cost.
