The minutes of the regular meetings of April 13th & 20th & subsequent recessed meetings were read and approved . The Mayor laid before the Council the reports of the Supt of the Water , Light & Power Plant for the months of Jan,Febty & March 1911,which were ordered filed . Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following lines be and the same are hereby established as the center line of West Fourth street: Measure along the center line of Congress Avenue the correct distance according to City map on file in the General Land Office ,from an iron pipe in the center of the intersection of Congress Avenue andsix sixth street,and turn a right angle to the west. For point "A" set a pin in the west side of Congress Avenue 6/10 foot south of this right angled line. For point " B " set a pin in the east side of West Avenue on the right angled line. A straight line joining these two points to be the established center line of West Fourth street. This line will check within 15/100 foot the building at the S W corner of Congress Avenue and Fourth street.It will also check very closely the biuldings at N E,S E and S w corners of 4th and Colorado street,and at N E and S E corners of 4th and Lavaca streets. At the west side of San Antonio street it will be very approximately midway between the two property lines.West of San Antoniothe street angles somewhat to the south ,but the above line will fit the general conditions as well as practicable. Resolution directing Sidewalks & Curbing Certain Streets By Councilman Powell a resolution ordering sidewalks and curbing to be built on the following streets ,to-wit:East 8th street from Brazos to Trinity street,East 5th from Brazos to Trinity street,East 4th from Colorado to West Avenue,on both sides of these streets, Be it resolved by the City Council of the City of Austin : (1) That East 4th street from Brazos to Trinity street,East 5th street from Brazos to Trinity streets,and West 6th street from Colorado street to West Avenue,on both sides of these streets,be and the same are hereby ordered and directed to be sidewalked and curbed,in accordance with the general specifications heretofore adopted by the City Council,regula-ting the width of sidewalks and the dimensions of curbing. (2) That in default of consent within thirty days on the part of the holders of property on said east 4th street from Brazos to Trinity street East 5th street from Brazos street to Trinity streets,and West 6th street from Colorado street to West Avenue to sidewalk and curb their respec-tive properties,then the Superintendent of Streets and Public Improve- -ments be and he is hereby instructed to have said property sidewalked and curbed in accordance with the provisions of the ordinances of the City of Austin,Texas,in such case made and provided. Taxes refunded to Mrs Lucy Perry 699 . The Mayor laid before the Council the following resolution : Whereas on the 31st day of March ,A D 1908,Mrs Lucy Perry paid to the City of Austin the sum of $ 45.25,as taxes for the year of 1907,said taxes having been assessed against certain notes amounting to $ 2,470,said notes having been executed and delivered by W T Payne to E Perry and Lucy Perry on the 24th day of April 1906; and,
Whereas satisfactory evidence has been produced before the City Council which in its judgement is sufficient ,to show that said E Perry and Lucy Perry became the holders and owners of said note after January 1st,1906,and sold and assiassigned all their right ,title and interest in and to said notes before the 1st day of January,A D 1907,and on said date were not the owners and holders of said notes;and
Whereas on account of said facts,said taxes were erroneously assessed against said E Perry and Lucy Perryand was not a lawful tax against said parties at the time said amount was paid by said Lucy Perry; Now therefore be it resolved by the City Council of the City of Austin : That the sum of $ 45.25 be and the same is hereby refunded to Lucy Perry on account of the reasons hereinabove stated,and the Mayor be and he is hereby authorizedauthorized and instructed to cause the City Clerk to issue a warront for said amount payable to the order of said Lucy Perry.
