Austin: Dam Rebuild, Street Paving, City Mare

702 . Regular meeting of the City Council, Austin, Texas, May 04, 1911. The Council was called to order by the Mayor: R. M. Wooldridge. Present Mayor Wooldridge, Councilmen Bartholomew, Hart, Leckridge & Powell 5 Absent none. The minutes of last regular and recessed meetings were read and approved by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Leckridge & Powell 5 Nays none. The regular order of business was suspended and the matter of paving on 5th street taken up. Messrs R R Walling, Frank Heierman, Chas Wolf & T C Thomason, citizens interested in paving on 5th street, addressed the Council on the matter of Guarantee on said paving. The Agent of the Company was present and explained the manner of Paving etc, after which all parties present expressed themselves satisfied with the action of the Council. The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That M M Shipe, A C Goeth, Jno H Robinson Jr, Harvey Harrell and Jno Orr, be and they are hereby appointed by the City Council a special committee, to consult with and advise upon such matters pertaining to the rebuild-ing of the Austin Dam as may, from time to time, come before the City Council for consideration and action thereupon. Advisory Dam Committee Councilman Leckridge moved that the names submitted be voted upon sepa-rately, which suggestion was adopted. The vote was first taken on the name of M M Shipe, and he was confirmed by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart & Powell 4 Nay Councilman Leckridge 1 The vote was then separately taken on all the other names submitted, and they were confirmed by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Leckridge & Powell 5 Nays none. The resolution was then adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart & Powell 4 Nay Councilman Leckridge 1 Councilman Leckridge filed the following reason for his vote: I vote NO on the final adoption of the resolution for the reason Mr M M Shipe is named as one of the Committee. Councilman Lockridge, opened bids for the City Treasurship for the next two years as follows,: J W Hodges,interest bid 3 1/4 cents on daily balances C P Randolph do 5.63 do do Chester Thrasher do 6.02 do do T H Davis do 4.62 do do The matter of election of a City Treasurer was postponed until the next regular meeting. Bids for City Treasurership Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Superintendent of Streets and Public Improvements be and he is hereby authorized tosell one old condemned Mare,which was formerly used by the Street Foreman,and for which the City has no more use,at a price of $ 25.00. The resolution was adopted by the following vote : Yeas Mayor Wooldridge ,Councilmen Bartholomew,Hart,Lockridge & Powell 5 Nays none. Supt. to sell Condemned Mare Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : That the resolution of the City Council passed April 14th 1910,establishing permanent sidewalk grades on the south side of East 9th street,between SanJacinto and Trinity streets,be and the same is hereby reconsidered,revoked andannulled, and the resolution of the City Council of Dec 19th 1910,establishing apermanent grade of of the sidewalkon the south side of East 9th street,between San Jacinto and Trinity streets,be and the same is hereby revived and re-enacted. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart,Lockridge & Powell 5 Nays none. Fix walk grade E 9th Street Friday May 4th 1911. The Council was called to order by the Mayor with all members present. The Mayor laid before the council the following resolution : Resolution ordering the improvement of portions of 5th,6th,7th,8th,9th and 10th streets,in the City of Austin,Texas : Approving specifications,proposals,contracts,and bonds therefor,and,appropriating funds therefor. Whereas,it is deemed necessary to improve the following streets of the City of Austin within the following limits to-wit: 5th street from East curb line of Colorado street to West curb line of Trinity street. 5th street -from West line of San Antonio street to East curb line of West Avenue. 7th street,from East curb line of Colorado streetto to West curb line of Brazos street. 8th street,from East line of Congress Avenue to West curb line of Brazos street. 9th street,from East curb line of Colorado street to to West curb line of Brazos street. Street Paving Council --- Page break --- 704 .19th street,from the East curb line of Colorado street to West curb line of Brazos street,and Whereas,the City Engi neer of this City has this day filed with the City Council complete specifications for the performance of the said work,by paving the said streets with the Bitulithic paving upon thr five inch gravel concrete foundation with concrete gutters along curb lines eighteen inches wide and necessary excavation;and, Whereas,the Texas Bitulithic Company has filed with the City Council a proposal to do said work at and for the following prices,to-wit: For earth and loose rock excavation 35cents per Cu yd For excavation solid rock $ 3.00 per Cu yd For Bitulithic paving including 5 inch gravel concrete foundation as specified and concrete gutters,with five years maintenance $ 2.21pr sq yard. .And whereas,the City Attorney has prepared contracts for the said work,between the City and the Texas Bitulithic Co mpany and also bonds for the construction and maintenance thereof by the said company ,with the United States Fidelity and Guarantee Company as surety ,and has sub-mitted the same to the City Council : therefore, Be it resolved by the City Council of the City of Austin : (1) That the said streets be improved by paving the same with the bit-ulithic pavement within the limits above named with five inch gravel foundation,necessary excavation,and concrete gutters,all as set forth in said specifications: (2) That the said specifications for said work prepared by the City Engineer be and the same are hereby adopted,and that the proposal of Texas Bitulithic Company to perform the said work be accepted and the said work let to that Company,and that the contracts prepared and sub-mitted by the City Attorney for the performance of said work on each of the said streets ,be and the same are hereby approved,and that the Mayor of the City of Austin is hereby directed upon the taking effect thereof,to execute said contracts on behalf of the City and in its name, and the City Clerk is directed to attest the same with the impress of the Corporation seal; that the form of construction and maintenance bond submitted ,by the City Attorney for execution by said Texas Bitu-lithic Company ,and the United States Fidelity and Guarantee Company be and the same is hereby approved as surety thereon,and that the same be accepted by the City of Austin upon execution by said pri ncipal and surety. (3) That the cost of said improvements shall be paid as follows to-wit: (a) The City shall pay to the said contractor the whole cost of improving intersections of other streets and alleys with said streets named to be improved,except so much thereof as may be occupied by the rail tracks of any,railroad company and twelve inches on the out-side of said rails,within which limits the cost of such improvement; shall be born by said street railway company,and,such owners shall also --- Page break --- 705 .bear and pay the cost of said improvements between and inside of their said rails and tracks and twelve inches on the outside thereof, upon other portions of said streets named to be paved in addition to said intersections; (b) The remainder of the cost of said improvements shall be paid by the owners of property abutting thereon,and assessed against them and their property in accor-dance with the Charter and Ordinances of the City of Austin,provided,that no asses- -ment shall be made against any owner or his property, in excess of the actual benefits to the said property in enhanced value by means of said improvement nor until after notice and hearing to said owner as provided by said Charter and ordinances; and all payments to said Bitulithic Company for the performance of said work shall be made in accordance with the said specifications hereby adopted. 4 That the sum of Eleven thousand dollars ($11,000.) or so much thereof as may be necessary ,is hereby appropriated and set apart from the Permanent Paving fund of the City of Austin ,not heretofore appropriated ,for the purpose of paying the portion of the cost of said improvements payable by the City of Austin under the terms hereof and that said sum hereby set apart is declared to be a special fund which shall not be drawn upon or diverted to any other purpose except the payment of the City's portion of the said cost. 5. That this resolution shall remain on file with the City Clerk for public inspection for one week before the final passage or adoption thereof and shall then be finally adopted. The resolution was read the first time and the rule suspended and it placed on its second reading by the following vote : Yeas Mayor Wooldridge,Councilmen Battholomew,Hart,Lookridge & Powell 5 Nays none. The resolution was then read the second time and laid over . N B . The above resolution.was presented to the City Council ,and action thereon had at a recessed meeting of the City Council held on the 4th day of May A D 1911, but was not handed the Clerk until after the minutes of a later date had been entered,hence are entered after wards.
