Regular meeting of the City Council : Austin, Texas, Dec 14th D The Council was called to order by the Mayor : Roll called : Present Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Absent none. The minutes of the last two regular meetings and subsequent Recessed meetings were read and approved . Reports of City Officers: The Mayor laid before the Council the reports of the City Clerk, the Marshal, the Assessor and Collector, the Health Officer and Asst, the matron of the Hospitalthe Sexton, which were read and ordered filed. Unfinished business : Gas Ca Sewers The Mayor laid before the Council an ordinance granting to the Austin Gas Light Co the right to construct and maintain an underground sewer in the City of Austin. The ordinance was read the third time and p assed by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. New business : On motion of Councilman Hart a pound fee paid by J M Wells was remitted and the Clerk J M Wells of the Police Court was directed to return him the amount, $ 1.50.by the following vote pound fee Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Councilman Powell offered a resolution fixing grades on Brazos street between 10th & 11th streets, which was read and laid over . Councilman Powell presented a bill of L A Robbins ,for repairs to L A Robbins Damage to Auto Autimobile, caused by running into an open ditch at San Jacinto & 6th street, which was allowed and ordered paid by the following vote : Yeas Mayor Woolridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. The Mayor laid before the Council the following decl aration. Austin,Texas , December 13th 1911. The undersigned Mayor and Councilmen of the City of Austin, here make decla-ration that on this 14th day of December, 1911, in our presence, Refunding Bond Purchased X Bond No 345, in the amount of Five hundred ( $ 500.00) dollars ,dated July 1st 1901,and due July 1st 1931, together with all attached coupons beginning with January 1st 1912,was destroyed by burning in the furnace at the City Hall in this City. We further here direct that this statement be recorded in the minutes of the proceedings of the City council of th e City of Austin,Texas,as a record of the above transaction. A P Woolridge,Mayor. The Council was called to order by the Mayor with all members present except Councilman Bartholomew. The Mayor laid before the Council the following resoluti on : J Stanley Ford Taxes. Whereas satisfactory proof in the affidavit of J Stanley Ford has been sub-mitted to this Council to the effect that lots 5 & 6,Outlot 23 Division "D" in Hoats addition to the City of Austin,Texas, were, during the year 1909,exclu-sively used for educational purposes ;therefore, Be it resolved by the City Council of the City of Austin: That said lots 5& 6, Outlot 23, Division "D",be and they are hereby declared to be exempt from municipal taxation for said year 1909, and the Assessor & Collector of the City of Austin ,Teax, is here authorized to take credit upon his his assessment rolls for the year 1909 for the exemption herein and hereby allowed. The resolutionwas adopted by the following vote : Yeas Mayor Woolridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. R.S. Lovinggood Taxes. The Mayor laid before the Council the following resolution : Whereas it is shown to the City Council of the City of Austin to its satisfac-tion by the affidavit of R S Lovinggood ,President of the Sam Huston College, in this City, that lots Nos 3,4,5& 6,in Block 45, Outlot "B" City of Austin, Texas, were on the first day of January of the present year,occupied and used e exclusively for educational purposes; therefore, Be it resolved by the City Council of the City of Austin : That said lots Nos 3,4,5 & 6,in block 45,Outlot "B" City of Austin,Texas, be and the same are hereby declared to be exempt from municipal taxation for the year 1911. --- Page break --- 73 The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart, Haynes & Powell 4 Nays none. The Mayor laid before the Council the following resolution: Whereas, it appears to the City Council from the affidavit of Mrs Alice L Walden , owner and occupant of the premises hereinafter described ,that lots 1 & 2, Block 16, Grooms Addition to the City of Austin,Texas, wre on the first day of January 1910,and for the whole of the year 1910,used exclusively for educational purposes; therefore, Be it resolved by the City Council of the City of Austin : That said lots 1&2, Block 16, Grooms addition to the City of Austin,Texas, be and the same sre hereby declared to be exempt from municipal taxation for the year 1910,; and, Be it further resolved : That the City Assessor and Collector of the City of Austinis hereby authorized to take credit upon his assessment rolls for the year 1910 for the exemption of the property herein allowed. Mrs Alice L. Waldon Taxes The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Hart, Haynes & Powell 4 Absent Councilman Bartholomew 1 . The mayor laid before the Council the following resolution: Whereas, we believe it to be a fact that Wm Von Rosenberg Jr,was chiefly instrumental in the improvement of Duval street from about 25th street to the City limits and beyond; and , Whereas, in addition to the work said Von Rosenberg induced the County to do upon Duval street, he has done a great deal of work upon said street largely for the Public's advantage as well as his own private good; therefore, Be it resolved by the City Council of the City of Austin : That one hundred and thirty five ( $135.00) dollars is hereby transferred from the General fund of the City to the street fund and appropriated from said street fund for and in behalf of reimbursing in part said Wm Von Rosenberg Jr,for the work done by him and procured to be done by him on Duval street in this City. Wm Von Rosenberg Refunded for amt for work done on Duval The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Hart ,Haynes & Powell 4 Absent Councilman Bartholomew 1. The Council then recessed subject to call of the Mayor. Saturday December 16th 1911. The Council was called to order by the Mayor with all members present. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the resolution passed by the City Council on the 7th day of September 1911, directing that the alley between 4th & 5th streets ,between Congress Avenue and Colorado street ,and the alley between 4th & 5th streets ,between Congress Avenue and Brazos streets ,be paved with wood blocks, be and the same is hereby repealed . Resolution Paving alley bet 4th + 5th St. repealed The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart, Haynes & Powell 5 Nays none. --- Page break --- 74 Miss McKelvey Taxes The Mayor laid before the Council the following resolution: Whereas, it appears to the satisfaction of the City Council of the City of Austin, by the affidavit of Miss M E Kelley,principal of the Kelley School in this City, that Lot 9, Outlot 34, Division "D",City of Austin, was, on the first day of January 1911,and thereafter during the year 1911, exclusively used for educational purposes; therefore, Be it resolved by the City Council of the City of Austin: That said Lot No 9, Outlot 34, Division "D",and the improvements thereon situated,are hereby declared to be exempt from municipal taxation for the year 1911, and the Assessor & Collector of the City of Austin is hereby authorized to take credit upon the assessment rolls for the year 1911 by the amount of th the exemption herein and hereby allowed. The resolution was adopted by the following vote : Yeas: Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays: none. Taxes Paid by J J McKelvey from refund The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin: That nine & 54/100 dollars ( $ 9.54 ) erroneously paid by J J McKelvey upon the personal property of E E Zimmermann for the year 1910 under the wrong impression that said personal property tax was a debt against the Homestead which said J J McKelvey had acquired of said E E Zimmermann,situated upon Lots 16,17 & 18,Block7, Hyde Park, Austin,Texas,be refunded to the said J J McKelvey,and an appropriation of Nine & 54/100 dollars ( $ 9.54 ) is hereby made out of the General contingent fund of the City to cover this refund. Be it further resolved : That the Assessor & Collector give credit against the homestead of said J J McKelvey for the taxes hereby remitted and charge the same to E E Zimmer-mann. The resolution was adopted by the following vote : Yeas: Mayor Wooldridge ,Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays: none. Fines remitted Councilman Hart offered the following resolution : Whereas, it appearing to the City Council that the following named parties are now confined in the City jail under conviction for misdemeanor offenses and are due on fin es certain balances,to-wit : Shugg Atkins -intoxication- balance $ 3.80 Geo Payne -gaming.- balance 17.80 Wm McKoy -intoxication- balance 2.55 The defendant Shugg Atkins,is a negro woman and the City has no work for women and she is a dead expense to the City. The defendant Geo Payne, is sick and full of diseaseand is totally unfit for work. The defendant Wm McKay ,is a negro boy about 17 years of age but is not able to do a Man's work ,and it appearing to the best interest of the City that these parties be discharged,therefore upon recommendation of the Supt of Police and Public Safety: Be it resolved by the City Council of the City of Austin : That the above fines be and they are each hereby remitted. --- Page break --- Grades Brazos St 10th & 11th Electric Sign Capital City Auto Co. --- Page break --- 76 Bids for Coal & Oil W.L. Plant Contract awarded Councilman Bartholomew offered the following resolution : Whereas in response to an advertisement for bids to be received until 12 o'clock Noon, Tuesday Dec 5th 1911, for furnishing the City Water, Light and Power Plant for the year 1912, with about 1200 tons per month of Lignite Co al ,or 50 to 75 barels of Fuel oil of 42 gallons per barel per day, the following bids were received: For Lignite: The Rockdale Lignite Company $ 1.38 per ton American Briquette Company 1.38 " Ryan & Perry 1.43 " Austin Coal & Wood Company 1.43 " J A Griffith 1.52 " For Fuel Oil : Magnolia Petroleum Company 92 ½ cents per barel The Texas Company 93 cents per barel Ayres Oil Company 94 cents per barel Gulf Refining Company 97 cents per barel And, Whereas, the bids of The American Lignite_ Briquette Company and the Rock -dale Lignite Company for lignite made in response to the advertisement, were equal ($ 1.38 per ton); and whereas the Council was unable to decide to which company to award the contract,should Lignite Coal be chosen,and request -ed The American Briquette Company and the Rockdale Lignite Company ,to submit new bids to be opened at 11 o'Clock A M ,Dec 18th 1911.; and, Whereas, The American Lignite Briquette Company submitted a bid of $ 1.48per ton ,and the Rockdale Lignite Company a bid of $ 1.36 per ton; therefore, Be it resolved that the contract for Lignite for the Water,Light and Power Plant of the City of Austin for the year 1912be awarded to the Rockdale Lignite Company at $ 1.36 per ton f o b Austin,Texas,and the mayor is author -ized to sign contract and approve bond to be furnished by the Rockdale Lignite Company ,for compliance with the contract.
