84 Regular meeting of the City Council : Austin,Texas, Jany 4th 1911. The Council was called to order by the Mayor: Roll called : Present Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted. Reports of City Officers. The Mayor laid before the Council the Annual report of the City Assessor and Collector for the year 1911, which was read and ordered turned over to the Mayor. Citizens of North 19th St. Councilman Powell presented a petition of Citizens for street work on 27th street, which was read but no action taken . Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin : That the center line of Guadelupe street from the Colorado River to 19th street be and is hereby established as follows : For the center at the south side of second street ,set a stake one (1') foot foot west of a point the correct distance as measured from the center line of Congress Avenue.This stake will be exactly forty ( 40) feet east from the corner of Schneiders brick store on the southwest corner of the intersection second and Guadelupe streets. For the center at the south side of eighth street set a stake one (1') foot west of a point the correct distance as measured from the center line of Congress Avenue.This stake will be forty one and three tenths ( 41.3') feet east of theeast edge of the stone fence foundation on the southwest corner of the intersection of Guadelupe and west eighth streets, and thirty eight and eight tenths ( 38.8') feet from the fence on the east side of Guadelupe street. For the center at the south side of nineteenth street set a stake six (6') feet west of a point the correct distance as measured from the center line of Congress Avenue. This stake will be thirty nine and five tenths( 39.5') feet east from the small wooden store building on the southwest corner of the intersection of nineteenth and Guadelupe streets. A straight line run between the three above described points is hereby established as the permanent center line of Guadelupe street from the Colorado River to Nineteenth street. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Councilman Powell offered the following resolution : St. Line San Antonio 1st to 7th St. Be it resolved by the City Council of the City of Austin : That the center line of San Antonio street from first to seventh streets be es -tablished as follows : For the center at the north side of first street set a stake four (4) feet west of a point the correct distance from the center line of Congress Avenue. This stake will be exactly forty (40) feet from the fence line on the west side of the street. For the center at the south line of seventh street,set a stake four (4') feet west from a point the correct distance from the Congress Avenue center line. This stake will be forty one and four tenths feet ' 41.4' )east from the center of an iron post at the southwest intersection of seventh and San --- Page break --- 85 .Antonio streets and thirty eight and eighty two one-hundredth s (38.82')west from the p property line on the opposite side of San Antonio street. . A straight line run between the two above described points is hereby established as the permanent center line of San Antonio street from first to seventh streets. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following grades be and the same are hereby established as the permanent grades for San Antonio street from sixth to fourth street. Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That consent is hereby granted Councilman Hart the mover thereof to withdraw from the consideration of the City Council ,the two following described ordinances now pending before the City Council : (1) " An ordinance amending Articles ,197,198,199,200,201,202,203,204,205, 206,207, 208 ,209,210,211,212,213, 214,215,216,217 ,218,219,220,221 & 222 of the Revised ordinances of the City of Austin ,relating to the organization of the Fire Department of the City of Austin ", (2) " Anordinance relating to the organization and regulation of the Fire Department of the City of Austin, and repealing all ordinances and parts of ordinances in conflict therewith ". Ordinances Organization Fire Dept withdrawn Which latter ordinance was introduced by Councilman Hart as a substitute for the first ordinance here named next above . Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : Ordinance Contract F H Jones Withdrawn That authority and consent is hereby granted to A P Wooldridge, Mayor,mover of an ordinance entitled " An ordinance authorizing the Mayor of the City of Austin to make a certain contract with F H Jones and Mrs Mary A Robinson , concerning the drainage of water through certain property of said Jones and Robinson in the City of Austin, and declaring an emergency ",and filed on December 30th 1911,and read for the first time on said date,to withdraw the same. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart ,Haynes & Powell 5 Nays none. S L McCullough Pound Remitted Councilman Hart offered the following resolution : Whereas, upon investigation, it appearing to the City Council that the statements made in the attached communication from S L McCullough are true and that the mule referred to was made to break out by reason of the firing of crackers near the barn where the mule was confined : therefore, upon the recommendation of the Supt of Police and Public Safety , Be it resolved by the City Council of the City of Austin : That the pound fee of $ 1.50 paid by the said McCullough he and the same is hereby remitted ,and the money having been paid over to the City-Collector , the City Clerk is hereby authorized and directed to draw a warrant in favor of Slad McCullough for said $ 1.50 . Hernandez Pound fee Refunded check paid permit Councilman Hart offered the following resolution : Whereas, it appears to the City Council that one H. Hernandez was the owner of a certain bay filly ,fully described in the attached affidavit ,impounded in the City Pound ,and not having been redeemed in the time prescribed by law ,was duly advertised and sold by the City Marshal at public sale, and at such sale brought the sum of $ 7.00, that the fees due the City amounted to $ 5.50,leaving a balance of $ 1.50 in the hands of the Clerk of the Corporation Court ,and the said Hernandez having made proof of ownership as required by law ; therefore, Be it resolved by the City Council of the City of Austin : That said balance of $ 1.50 be paid over to said Hernandez, and said money being in the hands of the Clerk of the Corporation Court ,said Officer is authorized and directed to pay the same over to said Hernandez. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Bettie McCraven pound remitted Councilman Hart offered the following resolution : Whereas, it appearing to the City Council that a black horse belonging to an old negro woman ,Bettie McCraven, was impounded on Nov 30th ,and was held in the pound for several days before being claimed ,that the claimant is pennyless, the horse worthless and she promises to send the horse out of the City if released,wherefore the Supt of Police and Public Safety recommends the release of the horse and remittance of the pound fees amounting to $ 3.50; therefore, Be it resolved by the City Council of the City of Austin : That said $ 3.50 be and the same is hereby remitted. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart ,Haynes & Powell 5 Nays none. Besserer & Marshall Granted time to comply with Moving Picture Ordinance Councilman Hart offered the following resolution : Whereas, the attached petition of the Besserer and Marshall amusement company having been presented to the City Council ,and it appearing that said company is attempting to comply in good faith with the City ordinances regarding moving pictures ,and under the circumstances it appearing nothing but just to said company to give them further time in which to comply with the law ; therefore, Be it resolved by the City Council of the City of Austin : That the time in which to complete the changes in their business as required by said ordinance be and is extended to February 1st 1912. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart ,Haynes & Powell 5 Nays none. Building Permit Carl Belish The Mayor laid before the Council the following resolution : That consent is hereby granted to Carl Belish the owner of the south half of Lot 3, block 97 in the City of Austin ,to erect above the one-story frame building on said premises fronting on Congress Avenue ,an addition above the same,consisting of an iron front,and to be of the dimensions of sixteen feet in height by twenty-four feet in length and effectually braced into the roof of the building on said premises and tied the adjacent side walls. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart ,Haynes & Powell 5 Nays none. --- Page break --- 88 Ordinance an Inimelie proportion to Change Fire Dept By Councilman Hart, An ordinance concerning the submission to the qualified voters of the City of Austin the pro position as to whether or not the Fire Department shall be changed from a volunteer to a paid Department. The ordinance was read the first time and a motion made to suspend the rule and place it on its second reading, which motion was lost by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, & Hart 3 Nays Councilmen Haynes & Powell 2 The Council then recessed subject to call. Austin, Jany 6th 1912. The Council was called to order by the Mayor with all members present except Councilman Bartholomew. Ordinance fixing Salary & Prescribing duties of Engineer By Councilman Powell an ordinance amending Section 2 of an ordinance entitled a an ordinance to repeal Articles 493 and 499 and to amend Article 494 of the Revised ordinances of the City of Austin and to fix the salary and prescribed the duties of the City Engineer and to fix the fees of engineering work and the manner of their payment and to prescribe penalties for the violation of the provisions thereof . The ordinance was read the first time and the rule suspended and it placed on its second reading by the following vote : Yeas Mayor Wooldridge, Councilmen Hart ,Haynes & Powell 4 Absent Councilman Bartholomew 1 The ordinance was read the second time and laid over. The Council then recessed subject to call. Austin Monday Jany 8th 1912. The Council was called to order by the Mayor with all members present. Geo Fiegal Jr discharged The Mayor laid before the Council the following resolution : Resolved that the discharge of Geo Fiegal Jr,Foreman of the Electric Light and Power Dept, by the Supt of Parks and Public Property be approved. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Hart, Haynes & Powell 4 Not voting Councilman Bartholomew 1 The Council then recessed subject to call . Austin Tuesday Jany 9th 1912. The Council was called to order by the Mayor with all members present . Councilman Hart offered the following resolution : C W Vann Fine remitted It appearing to to the City Council that one C W Vann ,has been convicted in the Corporation Court of Assault and fined $ 25.00 and cost,amounting in the aggregate to the sum of $ 36.45,that he has worked and laid out on said fine the sum of $ 13.50,and has paid to the Corporation Clerk the sum of $ 10.00 cash ,thereby being entitled to a credit on said fine in the amount of $ 23.50 leaving a balance unpaid of $ 12.95,from the best information the Supt of Police and Public Safety can obtain he finds that the defendant is a man of family, dependent on him for support,that he is pennyless, that he is repent-ant of his act and his friends promise for him that he will never again be guilty of violating the law,taking everything into consideration,the Supt of Police and Public Safety recommends that the balance of said fine,to-wit: $ 12.95 ,be remitted,therefore, --- Page break --- Be it resolved by the City Council of the City of Austin : That the remainder of said fine Against the defendant C W Vann be and thesame is hereby remitted : The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none.
