190 . Regular meeting of the City Council : Austin ,Texas, April 11, 1912. The Council was called to order by the Mayor : Roll called : Present Mayor Wooldridge, Councilmen Hart & Haynes 3 Absent Councilmen Bartholomew & Powell 2 On account of the absence of the Clerk, the reading of the minuteswas postponed until a later date. Reports of City Officers: The Mayor laid before the Council the Reports of the Matron of the Hospital, The City Health Officer and his Assistant, the City Marshal, and the Clerk, which were read and ordered filed. Mayor Wooldridge offered the following resolution : Paving W 7th St. A resolution ordering the improvement of a portion of West 7th street ,in t Colorado to Guadalupe the City of Austin;and approving specifications proposal, contract and bond therefor. Whereas, it is deemed necessary to improve the following streets of the City of Austin within the following limits, to-wit: West 7th street ,from west property line of Colorado streetto the east prop -erty line of Guadalupe street; and, Contract awarded Whereas, the City Engineer of this City ,has this day filed with the City Texas Bitulithic Co Council complete specifications for the said work, by paving the said street with the said Bitulithic pavingupon the five inch gravel concrete foundatin with concrete gutters along curb lines eighteen inches wide, and necessary excavation; and, Whereas, the Texas Bitulithic Company has filed with the City Council a proposal to do said work at and for the following prices, to-wit: For earth and loose rock excavation $. 35 cents per cubicyard For excavation solid rock 3.00 " " For Bitulithic paving including 5 inch gravel concrete foundation as specified and concrete gutters with five year 's maintenance bond $. 2.21 per Sq yard,and Whereas, the City Attorney has prepared a contractfor said work, between the City and the Texas Bitulithic Company and also a bond for the construc-tion and maintenance thereof by the said Co ,with the United States Fidelity and Guarantee Co as surety ,and has submitted the same to the City Council; therefore, Be it resolved by the City Council of the City of Austin : (1) That, the said street to be improved by paving the same with the Bitulithic pavement within the limits above named with five inch gravel concrete foundation, necessary excavation and concrete gutters, all as set forth in said specifications. (2) That the said specifications for said work prepared by the City Engineer be and the same are-hereby-approved;-and that the proposal to the Texas-BiBitulithic Company to perform the said work be accepted and the said work let to the said Company; and that the certain contract prepared and submitted by the City Attorney for the performance of said work on said street be and the same is hereby approved; and that the Mayor of the City be and he is hereby directed upon the taking effect hereof to execute said vcontract on behalf of the Cityand in its name and the City Clerk to attest the same --- Page break --- 191 with.the impress of the Corporation seal; that the form of the construction and mainte-nance bond submitted by the City Attorney for the execution by said Texas Bitulithic Co in connection with the work of improving said street, be and the same is hereby approved, and the United States Fidelity and Guarantee Company be and the same is hereby approved as surety thereon, and that the same be accepted by the City of Austin upon execution by said principal and surety. (3) That the cost of the said improvement shall be paid as follows, to-wit: The City shall pay to the said Contractor the whole cost of the improving the intersection of other streets with said street named to be improved; the remainder of the cost of the said improvement shall be paid by the owners of property abutting thereon ,and assessed against them and their property in accordance with the Charter and ordinances of this City provided that no assessment shall be made against any owner or his property in excess of the actual benefits to the said property in enhanced value by means of said improvement, nor until after notice and hearing to said owner as provided by said Charter and ordinance (4) That this resolution shall remain on file with the City Clerk for public inspection for one week before the final passage or adoption thereof and shall then be finally adopted. The resolution was read the first time and laid over for one week. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin: That a cordial invitation be and is hereby extended to the Modern Order of Pretorians to hold its annual convention for the year 1913 in the City of Austin, Texas. That should the Praetorians honor us with their presence in convention next year, the act will be deemed a compliment to our City ,and our people upon that occasion will vie with one another in extending to the Praetorians the most generous hospitality of this City. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew & Hart 3 Absent Councilmen Haynes & Powell 2 The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That four and 95/100 ($ 4.95 ) dollars ,be and the same is hereby appropriated out of the General contingent fund of the City of Austin ,to re-imburse J D Dillingham who has improperly paid the same ,a part of the costs in a suit for taxes to the City of Austin against J L King in cause No 24,450 ,District Court of Travis County, Texas, vs E L King et al. The costs improperly paid and illegally charged in this cause grew out of the fact that John & Jake Dillingham were improperly and illegally made parties defendant in this cause. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Hart & Haynes 3 Absent Councilmen Bartholomew & Powell 2 The Council then recessed subject to call. Invilation Praetorians Costs re-taxed refunded J.D. Dillingham --- Page break --- 192 Appropriation for Chief Horse drawn Auto Fire Chief . Monday April 15th 1912. The Council was called to order by the Mayor with all members present. Councilman Hart presented the following resolution : It appearing to the City Council that there is a balance of $ 500.00 due C Colorado Hose Co No 2,on the purchase price of the Chief Engineer's motor p propelled fire apparatus,and it further appearing to the Council that thes is sufficient funds in the miscellaneous item in the present budget in the Fire Dept for the purchase of Hose ,etc, out of which this amount can be paid without detriment of other needs of the Dept at this time; therefore, Be it resolved by the City Council of the City of Austin : That said sum of $ 500.00 be paid to Colorado Hose Co NO2 in full settle-ment for said Chief's Fire Wagon. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Additional operator Chemical Auto Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Supt of Police and Public Safety be and he is hereby authorized to appoint one additional man to operate the Chemical Fire Apparatus at a salary not exceeding Seventy dollars per month ,said employee to be quartered at a station of Colorado Hose Co No 2. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Harper Nation Allu[illegible] Owt Operatin Fire Auto Councilman Hart offered the following resolution: Colorado Hose Co No 2,having recommended for appointment ,Harper Nations, a member of said company,as a sober capable man for the position of Assistant in operation of Chemical Fire Apparatus,and the Supt of Police and Public Safety having made the appiontment, Be it therefore resolved by the City Council of the City of Austin : That the appointment of said Harper Nationsbe and the same is hereby confirmed and approved to be effective from and after May 1st 1912,and the salary of said assistant is hereby fixed at the sum of $ 70.00 per month. The resolution was adopted by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Haynes & Powell 4.
