New Pavement, Awning Denied, Fines Lifted

  • Major Street Projects Underway:

    The city approved significant new paving and sidewalk construction, including using a "Bitulithic" surface for Colorado Street. Costs for these improvements were to be split between the city (for intersections) and adjacent property owners, following public notification.
  • Public Safety & Procurement:

    After reviewing bids, the council authorized the purchase of 1,800 feet of new fire hose from the Eureka Fire Hose Co.
  • Community Petitions & Leniency:

    The city denied a petition for a cloth awning at a business on 5th and Congress Avenue. However, they also remitted fines for two men illegally riding trains and waived impound fees for accidentally stray livestock, citing leniency.

194 . Regular meeting of the City Council; Austin, Texas, April 18, 1912. The Council was called to order by the Mayor; Roll called: Present Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted. Unfinished business: The Mayor laid before the Council a resolution ordering the construc-tion of certain sidewalks and curbs on Brazos street in the City of Austin,which had been read at the last regular meeting of the Council, and laid over until this meeting. The resolution was then passed by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. The Mayor laid before the Council a resolution ordering the improvement of a portion of West 7th street in the City of Austin; and approving specifications, proposals, contract and bond therefor,which was read at the last regular meeting and laid over. The resolution was passed by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Councilman Powell offered the following resolution: Whereas, the Supt of Streets and Public Improvements has filed his re-port with the City Council to the effect that the Texas Bitulithic Com- -pany has completed the work of paving and improving Colorado street between the north line of 4th street and the north line of 7th street under contract with the City and that said work has been fully done in strict accordance with said contract and specifications adopted by the City; therefore, Be it resolved by the City Council of the City of Austin; That the said work of improvement be finally accepted by the City and that the final estimate due by the City to said Company be paid. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. The Mayor laid before the Council the following resolution: Whereas, it is deemed necessary to improve the following street in the City of Austin within the following limits,to-wit: Colorado street, from the north property line of 7th street,to the sou south curb line of 8th street; and, Whereas, the City Engineer of this City, has this day filed with the City Council complete specifications for the performance of the said work,by paving the said streets with the Bitulithic pavingupon the five inch gravel concrete foundation with concrete gutters along curb lines eighteen inches wide, and necessary excavation; and, Whereas, the Texas Bitulithic Company has filed with the City Council a proposal to do said work at and for the following prices ,to-wit: --- Page break --- 195 .35 per Cu yd 3.00 Pe ou yd .For earth and loose rock excavation For excavation solid rock For Bitulithic paving including 5 inch gravel concrete foundation as specified and concrete gutters with 5 years maintenance 2.21 per sq yd and ,whereas, the City Attorney has prepared a contract for said work,between the City and the Texas Bitulithic Company and also a bond for the construction and maintenance thereof by thesaid company,with the United States Fidelity and Guarantee Company as surety, and has submitted the same to the City Council ; therefore, Be it resolved by the City Council of the City of Austin in : (1) That, the said street be improved by paving the same with the Bitulithic pavement within the limits above named with five inch gravel concrete foundation ,necessary excava-tion and concrete gutters,all as set forth in said specifications . (2) That the said specifications for said work prepared by the City Engineer be and the same are hereby adopted ,and that the proposal of the Texas Bitulithic Company to perform the said work be accepted and the said work let to said company,and thcertain contract prepared and submitted by the City Attorney for the performance of said work on said street be and the said is hereby approved,and the Mayor of the City be and he is hereby directed upon the taking effect hereof toexecute said contract on behalf of the City and in its name and the City Clerk to attest the same with the impress of the Corporation seal; that the form of the construction and maintenance bond submitted by the City Attorney for execution by said Texas Bitulithic Company in connection with the work of improving said street ,be and the same is hereby approved,and the United States Fidelity and Guarantee Company be and the same is hereby approved as surety thereon, and that the same be accepted by the City of Austin upon execution by said principal and suretys; (3) That the cost of said improvement shall be paid as follows,to-wit : The City shall pay to the said contractor the whole cost of the improving the intersection of other streets with said street named to be improved; the remainder of the cost of the said improvement shall be paid by the owners of property abutting thereon.,and assessed against them and their property in accordance with the Charter and ordinances of this City, provided that no assessment shall be made against any owner or his property in excess of the actual benefits to the said property in enhanced value by means of said improvement, nor until after notice and hearing to said owner as provided by said Charter and ordinances (4) That this resolution shall remain on file with the City Clerk for public inspection for one week before the final passage or adoption thereof and shall then be finally adopted. The resolution was read and laid over as provided for in said resolution . The Mayor laid before the Council a petition from Mrs A A Dahlich for permission to put up a cloth awning in front of her building at 5th & Congress Avenue, which was read and the samerfused by unanimous vote of the Council. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That the City Clerk be and he is hereby instructed to deliver to W R Canion the bond for $ 1,000.00 dated June 21st 1911, for the performance of the work called for in his contract of same date, all the obligations of said c contract having been fully performed and satisfied. The resolution was adopted by the following vote : Yeas Mayor Woolridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Bond to W.R. Canion Returned Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin : That the following grades be and the same are hereby established as the per permanent grades for the center line of West 4th Street from Congress Aven to Guadalupe street: Bench mark,top of Fire plug at the S E corner of Congress Avenue and 4th street, elevation -488.59 West side of Congress Avenue 486.47 unchanged East side of alley west of Congress Avenue 486.711 .5' West side of alley west of Congress Avenue 486. 77 ".5' East side of Colorado street 486.22 Out .2' Center of Colorado street 486.10 ".12' Center of Guadalupe street 481.2 unchanged The resolution was adopted by the following vote: Yeas Mayor Woolridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Consisting of C.E. Woodward, Leo Wueller, T. Rice, Dermot Hargraves & The bids were opened , and referred to a Committee of Firemen, for examina- Pat Cain -tion and report. The Committee of Firemen to whom was referred the bids for Fire Hose, made a verbal report recommending that the bid of The Eureka Fire Hose Co be accepted. Bids for Fire Hose Councilman Hart moved that the bid of the Eureka Fire Hose Co for 1800feet --- Page break --- Contract Awarded. at the price of $ 1.10 per foot;which motion prevailed by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. The Council then recessed subject to call. Wednsday April 23rd 1912. The Council was called to order by the Mayor with all members present: Councilman Hart offered the following resolution : Fines of Hickey It appearing to the Council that two young men,viz: S P Hickey and Geo O Murris,were arre & G.O. Murris ted upon complaint of the I & G N R R Co for unlawfully riding upon its cars ,that remitted they each pleaded guilty and were each fined in the sum of $ 14.80,that their appearance and demeanor indicate that they are working men without money and were attempting to get from Laredo to Wichita Falls where they say they can get work on road building from that point,though guilty of violating the law,the circumstances are such that the Council believes that leniency should be shown in these cases: therefore upon recommendation of the Supt of Police and Public Safety, Be it resolved by the City Council of the City of Austin`: That the above fines be and the same are hereby remitted. The resolution was adopted by the following vote : Yeas Mayor Wooldridge ,Councilmen Bartholomew,Hart ,Haynes & Powell 5 Nays none. Councilman Hart offered the following resolution : It appearing to the Council that certain stock have been impounded in the City Pound , and fees paid for the release of same,as follows : Pound fees H F Hodge ,four head of stock ,fees $ 6.00 remitted S R Evans ,five head of stock ,fees $ 7.50 (1) That the stock of H F Hodge were at large by accident and were reported to the Police department by some neighbor, and as Mr Hodge does not violate the law intentionally , the Supt of Police and Public Safety recommends theremisson of these fees. (2) The same state of facts apply to the application of S R Evans ,and the Supt of Police and Public Safety recommends the remission of said fees, Be it resolved by the City Council of the City of Austin : That the above fees,to-wit: H F Hodge $ 6.00and S R Evans $7.50 ,be and the same are hereby remitted,and the money being still in the hands of the Clerk of the Corporation Court , said Officer is authorized and directed to refund the same.
