215 Regular meeting of the City Council: Austin, Texas, May 16, 1912. The Council was called to order by the Mayor: Roll callou: Present Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Absent none. The regular order of business was suspended, and a Committee of Citizens appeared before the Council, offering their co-operation with the Council in the matter of improvements of the City, which are to be made with the money derived from the sale of bonds, After the hearing from the Citizens, the Council resumed the regular order of business. The minutes of the last regular and subsequent recessed meetings were read and adoptedMr Geo S Dowell Attorney, appeared before the Council and presented the following petition: To the City Council of Austin, Texas, Austin, Texas. Gentlemen: Your petitioner, W B Abadie Jr., respectfully petitions your body to cancel and correct the error that has been made in his assessment for the year 1911 (City taxes) in that, he is charged with owning on the 1st day of January, 1911 4 certain promissory notes, $ 350.00 each, dated August 1, 1908, payable February 1, 1911, 1912, 1913 and 1914, at 8 % interest, secured by the vendors lien on Lot No six and the east part of lot No 5, block No 1, Outlots 2 & 3 in Div "B" City of Austin, when in truth and in fact said notes had been paid before that time. Petitioner on June 5th 1910, as per written transfer which was recorded on Sept 3 1910, in book No 242, page 31 bought from C E Booth, the 4 notes above described; and on the 3rd day of Sept 1910, by written release he released and marked said notes paid in full, as per written release on record in book No 242, page 29, of the deed records of Travis County Texas, to which reference is here made. From these facts it can be seen that petitioner could not have owned said 4 notes on the 1st day of January, A D , 1911. The money derived from the payment of said notes petitioner invested in an automobile, which was duly assessed in the 1911 assessment and the taxes on due thereon have been paid to the City of Austin. Wherefore the petitioner asks that the City Council by proper order cancel and correct his City tax assessment in so far as that it relates to the assessment of these 4 notes, amounting to $ 1,400.00, so that he will not be held for the taxes for 1911 on these notes, because of the reasons above stated . Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : That a cordial invitation be and is hereby extended to the Independent Order of Red Men of Texas to hold their next annual convention in this City. The City of Austin will deem it an honor to entertain the Grand Council of the Red Men of Texas, at their next annual convention and should they come to us and our people will vie with each other in extending their most cordial hospitality, both individually and as a community . The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Assessment W B Abadie Jr Corrected Invitation Red Men --- Page break --- 216. The Mayor laid before the Council petitions from Citizens asking for street work on East 17th street between Sabine and Neches, and one East Avenue and East 24th streets, which were read and referred to Supt Powell, for investi-gation Councilman Bartholomew presented a petition from Citizens of South Austin, asking some action towards improvement of a certain street in that part of the City extending from H W Luckets residence to the City limits,wh which was read and referred to Supt Powell, Councilman Hart offered the following resolution: It appearing to the City Council that the following named parties have paid fees to the Clerk of the Corporation Court for allowing their stock to run Pound fees remitted at large within the pound limits,to-wit: Marvel Cooper 2 horses $ 3.00 Susie Bishop 1 horse 1.50 H Miller 1 horse 1.50 H L Moore 1 cow 1.50 Conrad Steiner 1 cow 1.50 Jno Green 1 colt 1.50 That all of said stock was running at large in the outskirts of the City. The stock of Moore, Steiner and Green by accident as they do not let their stock run at large intentionally, and as to Cooper,Bishop and Miller,they were unable to pay the fees, and promise that they will not again allow their stock to be at large,it being the first violation of the law in so far as the Police Dept is aware, and the territory where the stock was found being recently embraced within the pound limits,the Supt of Police and Public Safety recommending theremission of said fees,therefore, Be it resolved by the City Council of the City of Austin : That said fees be and the same are hereby remitted and the Clerk of the Corporation Court not having paid the same to the City Collector, said officer is hereby authorized and directed to pay said amounts to the respective parties. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Councilman Powell offered the following resolution : Resolution accepting pavy Colorado St 7th to 8th A resolution finally accepting pavement and improvement of Colorado street between the north line of seventh street and the south curb line of 8th street. Whereas, The Supt of Streets and Public Improvements has filed his report with the City Council to the effect that the Texas Bitulithic Company has completed the work of paving and improving Colorado street from the north line of 7th street to the south curb line of 8th street under contract with the City and that said work has been fully done in strict accordance with said contract and specifications adopted by the City ; therefore, Be it resolved by the City Council of the City of Austin : That the said work of improvement be finally accepted by the City and that t the final settlement due by the City to the said company be paid. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. --- Page break --- 217 .Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : Section 1. That the City Engineer be and he is hereby instructed to immediately prepare and filewith the Supt or Streets and Public Improvements ,complete specifications for the paving with concrete the alleys between 3rd and 5th streets and Colorado and Brazos streets ,in the City of Austin,Travis County,Texas. Section 2. That upon the filing of said specifications by the City Engineer ,the Supt of Streets and Public Improvements be and he is hereby authorized and instructed to advertise for bids ,said paving to be done in accordance with said specifications ,said bids bids to be submitted to the City Council for its action not later than 10 O'clock on the 23rd day of May ,1912. Section 3. That all resolutions or parts or resolutions in conflict with the provisions of this resolution be and the same are hereby repealed. Damages Chas Sollans The Mayor laid before the Council a bill of Chas Sollana Jr ,for balance due on Judgement for damages, amounting to $ 258.10, which was ordered paid by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart ,Haynes & Powell 5 Nays none. The Council then recessed subject to call. --- Page break --- 218 A Austin,May 22nd 1912. A The Council was called to order by the Mayor with all members present except Councilman Haynes. The Mayor laid before the Council the following resolution : Whereas, on the 3rd day of February 1881 ,Fred Sterzing,Assessor & Collec -tor of taxes in this City, conveyed to the City of Austin by deed of said Quit-claim Deed Dennis Corwin date ,for taxes due by said Dennis Corwin for the year 1875, on the property herein described,and, Whereas, said Sterzing also ,on the 5th day of September1885, conveyed to the City of Austin for taxes due by said Dennis Corwin for the year 1 1884 the following, with other property,to-wit: the East half of Lot 1, Block 2,in the sub-division of Out Lot 5½,Division "B" in the City of Austin,Texas; and, Whereas, the taxes on said land for said above named years have long since been paid to the City; Now ,Therefore, Be it resolved by the City Council of the City of Austin: That A P Wooldridge, Mayor of the City of Austin,be and he is hereby authorized to execute a Quit claim deed for the City of Austin to said Dennis Corwin,his heirs and assigns to the afore herein above mentioned property. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart & Powell 4 Absent Councilman Haynes 1 The Mayor laid before the Council the following resolution : Sam Fayad Sign, Be it resolved by the City Council of the City of Austin : 1. That permit is hereby granted to Sam Fayad to erect and maintain a drop light shade ,to be illuminated by electric lights in front of his place of business in the Smith Office Building on west sixth street in this City . The drop light authorized under this permit shall be securely attached to a two by four inch Joist now in position in front of said Smith Office building ,and attached thereto by a quarter inch pipe. The globe authorized hereunder is to be about the dimensions of sixteen by sixteen inches ,and to have painted thereon the words " Pool Room " 2. The permit herein granted is to be carried out under the supervision of the City Engineer of this City and to deemed absolutely temporary, and revocable at any time at the pleasure of the City Council. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart & Powell 4 Absent Councilman Haynes 1 The Mayor laid before the Council the following resolution : Geo Fiegel Jr Gasoline Tank Be it resolved by the City Council of the City of Austin : (1) That permit be and is hereby granted to Geo Fiegel Jr. to place and maintain a 120-gallon Gasoline tank under the sidewalk in front of his place of business at 217-219 West Sixth Street ,in this City. (2) That the work to be done under this permit is to be done under the --- Page break --- supervisi on of teh Supt of streets and Public Improvements,and to be subject to his approval,and the tank to be placed under this permit must be placed not less than two feet under the surface of the ground where it is placed ,and said tank shall have the latest and best appliances for protection against accident or injury. (3) That the permit hereby granted is deemed temporary and revogable at any time at the pleasure of the City Council . The resolution was adopted by the following vote : Yeas Mayor Woolbridge, Councilmen Bartholomew,Hart & Powell 4 Absent Councilman Haynes 1. Councilman Bartholomew presented the following as his reasons for his vote : I am opposed to the location of these tanks on the streets, but as the Council has granted this privilege to a garage adjoining I vote for this although not favoring it.
