298 . gular meeting of th e City Council: Austin, Texas, August 15, 1912. The Council was called to order by the May : Roll called : Present Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and approved. Reports of City Officers: The Mayor laid before the Council the report of the Sanitary Inspector for the month of July 1912, which was read and ordered filed. Councilman Bartholomew presented the report of the Supt Water & Light Plant for the months of April & May 1912, which were ordered filed. Councilman Powell presented the report of the City Engineer for the month of July 1912, which was ordered filed. On m tion of Councilman Hart ,the Fire ordinance was made the special order for 10 o'clock Am Tuesday, Aug 20th 1912. On m tion of Mayor Wooldridge ,leave of absence for the month of Sept 1912, was granted to Councilmen Bartholomew & Hart.by the following vote : Leave absence Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Bartholomew & Hart Nays none. Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following transfers of the East Avenue Park fund be made: The sum of twenty five dollars ($ 25.00) from the salary of Keeper to Band Transfer funds Stand appropriation. The sum of twenty five dollars ($ 25.00) from the salary of Keeper to soil, gravel and grading appropriation. The sum of twelve hundred eleven and 63/100 dollars ($ 1,211.63) from improvements 15th to 19th street sto Soil, Gravel and Grading appropriation. The sum of seventeen and 78/100 dollars ($ 17.78 ) from improvements 15th to 19th streets to Tools and incidental appropriation. Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following transfers in the Fire Dept be made: Transfer the sum of Nine hundred and fifty three dollars (953.00) from "Miscellaneou s Items " appropriation to first and second paymen ts on Chemiac al apparatus appropriatin. Transfer the sum of seventeen and 43/100 dollars ($ 17.43) from miscella-neous items"appropration to Repairs to Fire Halls appropriation. The Mayor laid before the Council the following resolution : --- Page break --- 299 Be it resolved by the City Council of the City of Austin: That seven hundred and fifty ($ 750.)) dollars out of the general contingent fund of the City of Austin for the current year, be and the same is hereby appropriated to the following items of expenditure for the City Hall: $ 250.00 for fuel for the current year. $ 250.00 for improvements for the current year ,and $ 250.00 for incidentals for the current year. The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That one hundred ,fifteen and 52/11 ($ 115.52) dollars ,be and the same is hereby trans-ferred from the item of "Miscellaneous expenses for all Parks " to the item of "Expense of curbing a nd cement walk at Wooldridge Park." The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That two hundred dollars ($ 200.00) out of the appropriation for repairs for the current year at Pease Park, be and the same is hereby transferred to the improvement of East Avenue Park from 15th to 16th streets, and one hundred dollars ($ 100.00) out of the item of "Tools and incidental expenses at Pease Park",be and the same is likewise transferred to incidental expenses at East Avenue Park for the current year. Mayor Wooldridge offered the following resolution: Be it resolved by the City Council of the City of Austin: That five dollars ($ 5.00) out of the general contingent fund ,be and the same is hereby transferred and appropriated to the expense of Municipal Literature for the Mayors Dept for the current year. Councilman Hart offered the following resolution: Mrs HW Heflin It appearing to the Council that a cow belonging to Mrs H W Heflin was impounded, for pound fee which she paid the sum of $ 1.75. for release, that the animal broke out of the enclosure where she was confined ,that the Lady is a widow and does not allow her cow to run at large, and the Chief of Police recommending the remittance of this fee;therefore, Be it resolved by the City Council of the City of Austin: That said fee be and is hereby remitted and the money still being in the hands of the Clerk Clerk of the Corporation Court ,said Officer is hereby authorized and directed to refund said money. Councilman Hart offered the following resolution : Whereas, upon petition of J L Clayton hereto attached ,it appearing to the City Council that this is the first time that the cow of the petitioner has been in the City Pound and the territory from which she was taken has been recently enclosed in the Pound limits,and the Supt of Police and Public Safety recommending the remission of the pound fee; therefore , Be it resolved by the City Council of the City of Austin : That the sum of $ 1.50mpaid by J L Clayton ,the petitioner, be and the same is hereby remitted,and the money still being in the hands of the Clerk of the Corporation Court ,said officer is authorized and directed to refund same. Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : That permission and authority to Edwin Blackburn to erect ,operate and maintain a blast furnace at the corner of Colorado and 5th streets in this City ,be and the same are hereby refused. The Council was called to order by the Mayor with all members present: Councilman Bartholomew offered the following resolution : Whereas the Rockdale Lignite Co ,Lignite mine at or near Rockdale,Texas, has taken fire and it has been found necessary to close the mine to extinguish the fire,which closing may continue for an indefinite time,and, Contract for Lignite Aug 15th 1912- to Aug 15th 1913 Awarded Ryan & Perry Whereas, said Rockdale Lignite Co has asked to be relieved from its contract to furnish the City of Austin with Lignite for the Water,Light and Power Plant for the balance of the year 1912, and Messrs Ryan and Perry of Rockdale ,Texas, have signified their willingness to carry out the contract with certain qualifications; Now therefore, Resolved that the Supt of Parks and Public Property be authorized to contract with Messrs Ryan and Perry for Lignite for the City of Austin, Texas, for the year commencing August 15th 1912, and ending August 15th 1913, at $1.35 per ton f o b Austin,Texas, under similar contract to that with the Rockdale Lignite Co; with the proviso that when the City of Austin can receive power from the dam now being erected across the Colorado River above the City of Austin ,it shall not be obligated to take only such lignite as shall be required for additional power ; and provided also that the City of Austin shall have the option of extending the contract for Lignite with Messrs Ryan & Perry until Jan 1st 1914, upon the same terms by giving the said Ryan & Perry notice of such desired extension 30 days before the expiration of the proposed contract.
