392 . Regular meetin: of the City Council: Austin ,Texas,November 28, 1912. The Council was called to order by the Mayor: Present Mayor Wooldridge,Councilman Bartholomew . On motion the Council adjourned until 10 O'clock A M ,tomorrow Nov 29th 192 Friday November 29th 1912.The Council was called to order by the Mayor with all members present: The minutes of the last regular and subsequent recessed meetings were read and adopted . Mayor Wooldridge moved that the bill presented at the last meeting ,of Mr Maddox bill for newspaper printing disallowed H W J W Maddox, which was read and ordered filed,be taken up and that the same be disallowed, which motion prevailed by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. The Mayor laid before the Council a protest from L A Hill at al ,against Protest Citizens Paving E 6th st. paving on East 6th street, which was read and filed. Councilman Hart offered the following resolution : it appearing to the Council that certain stock belonging to Hume & Gouldy were running at large and were impounded by the City Pound Master that part of the stock was not at large through the negligence or careless-ness of the owners, as appears from the attached statement,the amount Pound fees Hume & Gouldy paid for this stock was $ 4.50,the other amount for one head of stock asked to be remitted was at large through carelessness; under the circum-stances the Supt of Police and Public Safetyrecommends the remission of the sum of $ 4.50and the refusal as to the $ 1.50; therefore: Be it resolved by the City Council of the City of Austin : That said pound fees of $ 4.50 be and are hereby remitted and the pound fee of $ 1.50 is refused,and it appearing to the Council that the fee of $ 4.50 has been paid into the City treasury,the City Clerk is authorized and directed to draw a warrant in favor of Hume & Gouldy refunding the same. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. . Mayor Wooldridge laid before the Council the following resolutions: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: Costs City Council VS Von Boeckman ordered paid That the sum of Six and 85/100 Dollars ($6.85), being balance of costs due and unpaid in suit of the City of Austin vs. Von Boeckman-Jones Co., No. 16914, be and the same is hereby allowed to be paid out of the General Contingent Fund of the City of Austin for the current year That the City Assessor and Collector of Taxes be declared entitled to take credit by the amount of $19.50, costs paid and to be paid in this case. The resolution was adopted by the following vote: Yeas: Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes and Powell 5. Nays: None. RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: --- Page break --- 393 That the sum.of Fifteen Dollars and Sixtyfive Cents ($15.65) be and the same is hereby allowed to be paid out of the General Contingent fund of the City of Austin for the current year, to defray the expenses of J. B. Rector, City Attorney, in attendance upon the meeting of the City Attorneys of the State of Texas at Houston, Texas. The items of this bill are set forth in the attached bill which is made a part hereof. The resolution was adopted by the following vote: Yeas: Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes and Powell 5. Nays: None. J.B. Rector expense meeting City Attorney The Council then recessed subject to call. Saturday, November 30th, 1912. The Council was called to order with all members present. Mayor Wooldridge laid before the Council the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That permission be and is hereby given to L. Loewenstein to place and maintain at his place of business, 217 East Sixth Street in this city, two canvas signs of the dimensions of three feet by six feet. Said signs to be placed eight feet above the side- walk, and, if desired, at rightangles to the sidewalk. The permission hereby granted is limited to the month of December, 1912, and is granted subject to revocation at any time in the pleasure of the City Council. The resolution was adopted by the following vote: Yeas: Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes and Powell 5. Nays: none. L. Lowenstein sign The Council then recessed subject to call. Tuesday, December 3rd, 1912. The Council was called to order by the Mayor, with all members present, save Councilman Bartholomew. The Mayor laid before the Council the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That E. H. Warner be and he is hereby appointed Assistant City Clerk, pro tem. The resolution was adopted by the following vote: Ayes: Mayor Wooldridge, Councilmen Hart, Haynes and Powell 3. Absent Councilman Bartholomew. Nays: none. Mayor Wooldridge not The Mayor laid before the Council the following resolution: voting. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That permission is hereby granted to the firm of Bohn and Shelby ,doing business at 221-23 East 6th Street ,to stretch two cloth signs in front of their place of business and across the sidewalk, extending not more than sixteen (16) or eighteen (18) inches below the awning ,the same to be securely fastened to strips attached to said awning. Upon said sign the words" once a year Clearance sale " are permitted. This permit to extend if desired to the 1st day of Jany 1913, revocable at any time at the pleasure of the City Council . and not less than eight feet above the sidewalk . These signs are to bear upon them : Sighn No.1, "Warren's big sale of clothing and shoes ", Sign No 2," one hundred pounds free candies free to most popular Sunday School". County Judge of Travis County, Texas: We, the undersigned special commissioners appointed by Your Honor to hear Report Commission testimony and to fix the assessments, if any, to be made against George SouthernPaving Assessment wood and wife, Mattie Southernwood, owners of the West 46 feet of Lot No. 1, Geo Southernwood Block No.76 in the City of Austin, fronting on 6th St. and against R. B. Hamwife blen and wife, O. C. Hamblen, owners of the West 23 feet of Lot No. 2 and the East 23 feet of Lot No. 1, Block 76 in the City of Austin, Texas, fronting on Sixth Street, which hearing was had pursuant to appointment by Your Honor and pursuant to proceedings of the City of Austin, Texas, for the improvement of said 5th Street, hereby report to Your Honor: That after notice served upon the said owners as provided by law and the Charter and Ordinances of said City of Austin, Texas, the said hearing was opened on the 5th day of October 1912 at 10 o'clock A. M. at the Mayor's Office in the City of Austin, Texas, at which hearing after hearing the evidence as to amount of benefit, if any, to the said property of the said owners by means of the said improvements in enhanced value of the said property, and hearing all the evidence produced by the City of Austin and said owners with regard to the said matter, the same was then closed and we, your commissioners, after considering the evidence in the matter, are of the opinion that the benefits of the said improvement in the enhanced value of said property of said George and Mattie Southernwood is in excess of the sum of $303.53 and the said amount is a just and fair assessment against the said owners and against their said property for the improvements and we, your commissioners, are of the opinion that the benefits of the said improvements to the property of the said R. B. Hamblen and wife, O. C. Hamblen, in the enhanced value thereof, is in excess of the sum of $293.53, and that said sum is a fair and just assessment against the said owners and against the said property for the said improvements and in accordance with the said findings, we, your commissioners do hereby fix the amount to be assessed against the said Southernwood and wife and their property at the said sum of --- Page break --- 395 $370.53 and against the said Hamblen and wife and their property at the sum of $370.53, which sums are hereby declared and adjudged to be secured by a lien against said premises respectively, and to be a personal claim and liability, enforceable against the said respective owners. Statement by Commissioners of Costs Accrued Before Them and against Whom Adjudged. Under Section 8 of the Paving Ordinance of the City of Austin, we are each entitled to $2.00 for each and every adjudication or assessment made by us in the above hear- ing on October 5th, we made two adjudications or assessments, and are therefore entitled to to four dollars ($4.00) each for our services which should be taxes as costs accruing before us. We therefore adjudge six dollars ($6.00) costs against George Southernwood and six dollars ($6.00) costs against R. B. Hamblen, making twelve ($12.00) dollars in all. (signed) JNO. E. KELLER, T. B. The Mayor laid before the Council the following resolutions: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That permit be and is hereby granted to M. Frank to place a canvas sign three feet high by twenty feet long in front of his place of business at 203 East Sixth Street. This permit is to be good for the month of December only, and subject to revocation at any time in the pleasure of the City Council prior to that date. It shall bear upon it these words "Pre-Christmas Sale". The resolution was adopted by the following vote: Yeas: Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes and Powell 5. Nays: none. RESOLUTION Wm Jones BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: Sign. That William Jones is hereby granted permit to stretch across the sidewalk in front of his place of business at 112 West Fifth Street, a cloth sign, nine by three feet in dimensions, upon which the words "Home Restaurant" are to be printed. The sign shall be at least eight feet above the sidewalk and securely attached to the building in front of which it is placed. This permit is limited to the month of December, and made absolutely revokable at the pleasure of the City Council at any time prior thereto, but in no event is this permit to extend beyond the first day of January 1913.
