405 Regular meeting of the City Council: Austin, Texas, December 12, 1912. The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Bartholomew, Hart, & Haynes 4 Absent Councilman Powell 1 The Minutes of the last two regular and subsequent recessed meetings were read and approved. The Mayor laid before the Council the following report from the City Clerk, which was read and ordered recorded in the minutes: Austin, Texas, Dec 2nd 1912. Hon Mayor and City Council, City of Austin, Texas. Gentlemen: As required by the City Charter, I have the honor to report the following as the result of the election held in this City on the 27th of November 1912: Cemetery proposition: For Proposition No 1, 688 votes For Proposition No 2, . 259 " Majority for proposition No 1 429 " Interurban Proposition: For the Proposition 902 votes Against the proposition 34 " Majority of for the proposition . 868 " Respectfully submitted, Jno O Johnson, City Clerk Hon Mayor and City Council, Austin, Texas. Gentlemen: We, your Committee appointed to verify the report of the City Clerk, have checked the returns from the different wards and find the same to be correct as certified by the City Clerk. Respectfully, H L Haynes, Supt Receipts, Disbursements & accounts Jas P Hart, Supt Police & Pub Safety. The Mayor laid before the Council the following monthly reports from City Officers: The Marshal, the Sanitary Inspector, the City Health Officer and Assistant, the Matron of the Hospital and the City Auditor, which were read and ordered filed. Unfinished business: The Mayor laid before the Council a resolution authorizing the Supt of Parks and Public Property to purchase certain pipe for extensions to the proposed Reservoir, and making an appropriation for same, which was presented and read at the last regular meeting and laid over until this meeting, which was read, and the resolution adopted by the following vote: Wooldridge, Councilmen Bartholomew, Hart & Haynes Absent Councilman Powell Councilman Bartholomew moved to amend the resolution by striking out in line 8 the letter "B" and inserting the letter "A", thus making the pipe to be purchased Class "A", instead of Class "B". The amendment was adopted, and the resolution as amended, was adopted by the following vote: City Clerk Report Election Cemetery Proposition Supt Public Works to purchase pipe --- Page break --- 406 Registration of Sewer Bonds Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart & Haynes 4 Absent Councilman Powell 1 Mayor Wooldridge offered the following resolution: A resolution authorizing the registration of certain Sanitary Sewer and Street Improvement Bonds ,of the City of Austin,Texas. Whereas, it has been made to appear to the City Council of the City of Austin,that William R Compton Company,of St Louis,owns bonds Nos 109 to 120 both inclusive,of an issue of Street Improvement bonds of the City of Austin, Texas, dated July 11st 1912, bonds 109 and 110,being due July 1st 1923, and bonds No.111 to 120, both inclusive,being due July 1st 1924,and also owns bonds bonds numbered 103 to 110,both inclusive,QixxxsxxfxkxAustinxTxxaxfxxx 118 to 120,both inclusive,and 129 to 130,both inclusive, of an issue of Sewer bonds of the City of Austin ,dated July 1st 1912, bonds 103 to 110,both inclusive due July 1st 1928,bonds 118 to 120,both inclusive being due July 1st 1929,and bonds 129 and 130,being due July 1st 1930,and Whereas the said William R Compton Company have entered into a contract of sale for each and all of said bonds,to the Ladies Catholic Benevolent Association ,and, Whereas, it is desired by the purchasers of said bonds ,to have same duly registered by the City of Austin,and a certificate of registration noted upon said bonds ; Therefore, be it resolved by the City Council ,of the City of Austin . Section 1. That the City Treasurer of the City of Austin be, and he is hereby authorized and directed to register each and all of said bonds in a well bound book,to note same on the bond records of the City of Austin, and also to enter the following certificate on each of said bonds. Approved ,J Bouldin Rector , City Attorney The resolution was adopted by the following vote.: Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart & Haynes 4 Absent Councilman Powell 1 Fine of Jas Reynolds Remitted Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : Upon the recommendation of the City Marshal and Supt of Police and Public Safety ,and for the reasons set out in the attached statement that the two fines against the defendant Jas Reynolds ,to wit: one of $ 5.00 and the other of $ 19.30 ,be and the same are hereby remitted. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart & Haynes 4 Absent Councilman Powell 1 --- Page break --- 407 Mrs. Brazeal Pound fee Councilman Hart offered the following resolution: Be it resolved by the City Council of the City of Austin: That the pound fees paid by Mrs Geo Brazeal amounting to $ 3.00 for the impounding of two head of cattle,the same is hereby remitted,the applicant being a poor woman and dependent to a large extent upon her cows for support,and having escaped from her control by accident,and the money still being in the hands of the Clerk of the Corporation Court,said officer is hereby authorized and directed to refund same. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart & Haynes 4 Absent Councilman Powell 1 W Quebedeaux pound fee Councilman Hart offered the following resolution: The horse of W Quebedeaux having broken down the gate to his lot,was impounded,for which he paid the pound fee of $ 1.50,and it appearing that his being at large was unavoidable, and the Supt of Police and Public Safety recommending the remission of this fee; therefore: Be it resolved by the City Council of the City of Austin: That said fee of $ 1.50 is hereby remitted and the money still being in the hands of the Clerk of the Corporation Court said officer is authoized and directed to return same. The resolution was adopted by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart & Haynes 4 Absent Councilman Powell 1 Paving U.S. Post Office Mayor Wooldridge offered the following resolution: Whereas, the City of Austin,Texas, paved wi th Bitulithic in front of Lots 9,10,11& 12 of Block 70, in this City, fronting the United States Post Office Bui lding,at a cost to the City of Austin of thirteen hundred ,thirty three and 57/100 dollars ($ 1333.57);but, Whereas, the United States Government does not at any time or in any place pay for paving in front of the buildingsowned and erected by it in the various Cities in the United States,as is made apparent to this Council; Now Therefore, Be it resolved by the City Coun cil of the City of Austin : That the charge against the United States Government or lien,if any, established to secure the payment of said charge by reason of paving with Bitulithic in front of or adjacent to Lots 9,10,11 & 12,Block 70,of this City,where said lots front the United States Post Office Building,be and the same is hereby cancelled,annulled and said debt discharged as a claim or lien ,as the case may be, against the United States Government. The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That upon nomination of M C Welborn ,Chief Engineer in charge of the Sewer construction work ,and approved by the Supt of Streets and Public Improvements,W B Erwin be and he is hereby appointed and confirmed by the Council as Rodman on the Sewer construction work,at a salary of fifty ($50.00) dollars per month ,beginning Friday,December 6th 1912. The resolution was adopted by the following vote: Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart,Haynes 4 Absent Councilman Powell 1 --- Page break --- 408 H.Helland appointed Inspector Sewer Work The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That upon nomination of M C Welborn, Chief Engineer in charge of the Sewer work,and approval of the Supt ofStreets and Public Improvements, Hans Helland Jr,is hereby appointed and confirmed by the Council as Inspec-tor on the Sewer construction work,at a salary of eighty ($80)dollars per month ,beginning Monday, December 9th 1912. The resolution was adopted by the following vote : Yeas Mayor Wool.dridge, Councilmen Bartholomew,Hart & Haynes 4 Absent Councilman Powell 1 The Mayor laid before the Council the following petition: Austin,Texas, Oct 24th 1912. To the City Council , Austin,Texas. Gentlemen : This is a request of your honorable body to allow me to place a frame in whic to display Photographs around an electric or Telephone pole situated four feet back from Ave on West 9th street . It is my desire to place a nice frame ( with glass) behind which I expect to keep on display my best Photographs so that the passing public can see them .Any courtesy your honorable body may extendwill be highly appreci-ated . N.Smith allowance for horse killed On motion of Councilman Hart the sum of ten dollars was allowed to N Smith for Horse killed by the City ,by the following vote : Yeas Mayor Wooldridge,Councilmen Bartholomew,Hart & Haynes 4 Absent Councilman Powell 1 The Mayor laid before the Council the following resolution : Whereas it appears to the City Council that the attached affidavit of P R J Lawless ,Trustee, that the Morgan Hamilton estate h d no credits on the 1st day of January 1912,which affidavit is made a part hereof ;therefore H.G.Morgan Hamilton estate assessment reduced Be it resolved by the City Council of the City Austin : That the assessment of thirteen thousand eight hundred and five dollars (13,805.00) credits against the Morgan Hamilton estate for the year 1912 be and the same are hereby cancelled ,and the Assessor and Collector authorized to take credit accordingly. The Mayor laid before the Council the following resolution : Whereas, C H Kehl ,for the Kehl Hardware Co. has filed with this Council an affidavit that from an inventory taken prior thereto the merchandise stock of the Kehl Hardware Co,in Austin,Texas, on the 1st day of January 1912,was of the fair and just valuation of $ 6,500.00 and no more; therefore Be it resolved by the City Council of the City of Austin : That the assessment of the Kehl Hardware Co,of its mercantile stock for the year 1912,be and it is hereby fixed at $ 6,500.00,and the Assessor and --- Page break --- 409. . Collector is entitled to take utredit upon his assessement rolls for the year 1912 accordingly. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart & Haynes 4 Absent Councilman Powell 1 Approved A P Wooldridge, Mayor. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin: That permit is hereby granted to G Flury to establish and maintain an electric Light sign at the corner of West 10th street and Congress Avenue, on the north side of "W" st 10th street Said sign is to be over the awning at this position ,and to extend 5 feet out from the building.It is to be securely attached by steel rods or steel cords to the building in front of which it is placed,and is to be installed subject to the approval of the Assistant Supt of the Water, Light and Power department.Said sign will be in the form of a crescent with about one hundred electric lights in position upon it. This permit is made revocable at any time in the pleasure of this or any subsequent Council. The Council then recessed subject to call. . Saturday Dec 14th 1912. The Council was called to order by the Mayor with all members present except Councilman Powell. Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : That four hundred ($ 400.00) dollars be and the same is hereby appropriated out of the General contingent fund of the City of Austin, as payment under contract of April 24th 1912, to Mrs G F Cox,upon her agreement to sell to the City of Austin the following described propAll that certain lots, tracks,or parcels of land described as follows ,to-wit: Part of Outlet No 73,(seventy three)Division "E" of the City of Austin,Travis County,Texas, particularly described as follows : All of Block No seven (7) and a strip of ground seventy (70) feet inwidth lying immediately south of and adjoining said block No seven (7) bounded on the north by said block No seven (7) ,on the east by a continuation south of the east line of said block No seven (7) on the south by a street seventy (70) feet wide ,theretofore to-wit: on the thirteenth day of September 1880 conveyed by William Thaison to the City of Austin by deed recordedin book 74,pages 284-285 of records of Travis County Texas,and on the west by the Colorado River.Also all the land lying between the western boundary lines of said block No seven (7) and the Colorado River,all in accordance with the map or plat of what is known as the Driskill & Rainey sub-division of part of Outlots No seventy two (72) and seventy three (73) in Division "E" City of Austin,Texas, as appears of record in the Office of the County Clerk of Travis County,Texas, in plat book No one (1) on page 22 to which reference is here made and the same is made a part hereof. [illegible] Rifle Range [illegible] [illegible] The Mayor laid before the Council the following resolution : That the petition of L H Younger ,Catain of Troop "C" Texas National Guard ,to establish and maintain an indoor rifle range for military purposes in the second story of the building known as the Hillebrand Hardware store,at 513-15 Congress Avenue,be and same is hereby granted . The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Hart & Haynes 3 Absent Councilmen Bartholomew & Powell 2 Approved, A P Wooldridge, Mayor. Councilman Hart offered the following resolution : Upon investigation by the Supt of Police and Public Safety,it appearing to the City Council that one Jno Hamilton was fined in the Corporation Court in the sum of $ 5.00 and costs amounting to $ 15.80,for abusive language; that the circumstances proceeding the offense were of such an aggravating character ,if not sufficient to justify at least to mitigate the offense,and the Supt of Police and Public Safety recommending the remittance of said fine;therefore, Be it resolved by the City Council,of the City of Austin : That said fine be and the same is hereby remitted ,and the money being still in the hands of the Clerk of the Corporation Court , said officer is authorized and directed to refund the same .
