411 . Regular meeting of the City Council : Austin,Texas, December 19, 1912. The Council was called to order by the Mayor: Roll called : Present Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted. Reports of City Officers: The Mayor laid before the Council the reports of Dr S J Swift,Dr Geo M Dacherd,the Plumbing Inspector,which were read and ordered filed : Councilman Haynes offered the following resolution : Whereas, the City of Austin has heretofore,at divers times paid to the Officers of the District Court of Travis County,Texas, certain costs in certain tax suits brought in said Court by said City,an itemized statement of which is attached to this resolution; and, Whereas, it has been made to appear to the City Council that under the law, the City cannot recover from the defendants the costs already paid in the respective suits shown by the attached statement; therefore, Be it resolved by the City Council of the City of Austin that the Assessor and Collector be and he is hereby authorized and instructed to cancel from his books and credits of the City of Austin the items of Court costs shown in said attached statement,and that he shall not hereafter carry same forward to the Credit of said City. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Approved, Mayor. Arises re: Cancellation To cancel items of Costs in Tax Cases. Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Treasurer and Asst City Clerk be and they are hereby instructed to transfer the sum of five thousand sevenhundred Five and 9/100($5,705.09) from the interest and sinking fund Bond account to the interest and sinking fund account. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Transfer funds. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : That the attached bills against the City of Austin for printing the address of Mayor A P Wooldridge ,upon the cemetery question voted upon by the people on the 27th of Nov 1912,be approved, to-wit: One bill in favor of the Daily Tribune for $ 11.48,and one bill in favor of the Austin Statesman for $ 25.80. The Council was called to order by the Mayor with all members present: Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That the sum of fifty thousand and sixty five ( 50,065.00)dollars be and the same is hereby appropriated out of the Interest and Sinking fund for the payment of interest on the bonded debt of the City of Austin due January 1st 1913,as follows : Refunding bonds $ 1,472,000,interest due $29,440.00 School bonds 1910 $ 75,000. " " "" 1,775.00 School bonds 1912, $ 150,000. " " "" 3,750.00 Sanitary Sewer bonds 1912, $ 250,000. " " "" 6,250.00 Permanent Street Improvement bonds $250,000. " " "" 6,250.00 Hospital Building bonds (1912) $ 50,000. Interest due 1,250.00 Cemetery bonds 1912 $ 50,000. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Supt of Streets and Public Improvements be and he is hereby authorized to take up and pay for, out of the Permanent Street Improvement Claim, street Johnson & Hatzfeld street improvement paid fund of the City of Austin, claim of Knox T Johnson against the Estate of Phillip Hatzfeld amounting to $ 882.51,for street paving in front of the property of said estate. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Supt of Streets and Public Improvements be and he is hereby authorized to take up and pay for, out of the Permanent street improvement fund of the City of Austin,claim of J Koppel amounting to $844.80,for street paving in front of the property of said estate. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Councilman Haynes offered the following resolution : Whereas, the City of Austin, out of its general contingent fund,at various times during the year 1912, has advanced to the S. S. & P. S. of said City amounts of money aggregating $ 2,244.45,against which there is a credit of $ 500.00,leaving a balance due owing by the Sanitary Sewer fund of the City --- Page break --- 413 of Austin to the General contingent fund of $ 1,744.45; therefore, Be it resolved by the City Council of the City of Austin : That the sum of $ 1,744.45 be and is hereby appropriated out of the Sanitary Sewer fund of the City of Austin in behalf of and made payable to the General contingent fund of said City and a transfer upon the books of the City Treasurer of the City of Austin in the amount of $ 1,744.45, from the Sanitary Sewer fund to the General fund of the City of Austin is hereby ordered and directed. The Council then recessed subject to call- Austin Dec 23rd 1912. The Council was called to order by the Mayor with all members present except Councilman Hart. Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Treasurer and Assistant City Clerk be and they are hereby instructed to make the following transfers : Transfer the sum of seven hundred eighty & 70/100 ( $ 780.70 100) dollars from the Permanent Street Improvement fund to the General Street fund. Transfer the sum of forty eight & 29/100 ( $ 48.29 ) dollars from the Permanent Street Improvement fund to the General fund. Transfer the sum of twenty & 28/100 ( $ 20.28 ) dollars from the General Street fund to the Permanent Street Improvement fund. All of the above for the purpose of adjusting payments made by one fund for the benefit of another as their interest appear. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Haynes & Powell 4 Absent Councilman Hart 1 Approved, A P Wooldridge, Mayor. Councilman Haynes offered the following resolution : Whereas, J R Morris makes affidavit which is attached hereto and made a part hereof, that at he did not on the 1st day of January 1912, nor at any prior or subsequent approximate date, nor vendors been noted in the amount of $ 2400.00, or any other such sum; Now therefore, Be it resolved by the City Council of the City of Austin : That the assessment of $ 1900.00 of vendor's notes against J R Morris, for the year 1912, be and the same is hereby cancelled ,,and the Assessor and Collector of the City of Austin is hereby authorized to take credit upon his rolls for the year 1912, by said amount. [illegible] --- Page break --- 414 Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Council of the City of Austin hereby contracts with J Gregg Hill, W R Long and J W Maxwellto furnish lists of and make collections or the City taxes upon unassessed personal property subject to assessment upon the assessment rolls of the City of Austin,but not yet upon said assessment rolls. The compensation to be paid Messrs Hill ,Long and Maxwell under this contract is hereby fixed at twelve and a half per cent ( 12½%) of the amounts of City taxes actually collected. Resolved further: That the Mayor be and he is hereby authorized to execute a written contract with Messrs Hill, Long and Maxwell to carry this resolution into effect. Note: Councilman Bartholomew moved to amend the above resolution by fixing the amount of compensation at ten per cent ( 10% ) of the amount of taxes collected.Amendment lost by the following vote : Yeas Councilman Bartholomew 1 Nays Mayor Wooldridge, Councilmen Hart,Haynes & Powell 4 The original resolution then adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Hart,Haynes & Powell 4 Nays Councilman Bartholomew 1 Approved,A P Wooldridge, Mayor. The Council then recessed subject to call. Contract Hill & Long Maxwell, Taxes Tuesday December 24th 1912. The Council was called to order by the Mayor with all members present: Mayor Wooldridge offered the following resolution : Be it resolved by the City Council of the City of Austin : Bond F.D. Horton Contract That the bond given by the Equitable Surety Company of St Louis Mo, and dated the 30th day of September 1912, guaranteeing the performance of a contract made by F D Horton of Houston,Texas, to do certain sewer con-struction work in the City of Austin,Texas, is held and deemed by the City Council of the City of Austin as a construction and not a maintenance bond. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. The Council then adjourned. Jno. A.
