437 Reports City Officers for Feby 1913 Regular meeting of the City Council : Austin,Texas,Feby 6th 1913. The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meeting were read and approved. Reports of City Officers: The Mayor laid before the Council the reports of the Assessor and Collector,the Treasurer, The Health Officer and his Assistant, the Matron of the Hospital ,the Fire Marshal for the month of January ,and that of the Supt of the Water & Light Plant for the month of December 1912, which were read and ordered filed. The Mayor laid before the Council the following petition: Austin,Texas, February 5th 1913. To the Mayor and City Council, Gentlemen : Petition H & T C We, the H & T C R R Co.respectfully petition your honorable body that we be R. R. By Co. To extend permitted to extend our Consumers Ice Co track now on 4th street, West to the East lines of track Neches street,the right to make this extension being conditioned upon our taking care of any objection,if any, the M K & T R R Co may have to the extension of this track. The petition was read but no action taken on same. Councilman H. 'represented the following resolutions : Pound fees Mrs It appearing from the attached communication that the horse of Mrs E W Herndon was turned E. W. Herndon out of her yard by some person unknown ,and that she was in no way responsible for his Remitted being at large ,the Supt of Police & Public Safety recommending the remission of the pound fee of $ 1.50; therefore , Be it resolved by the City Council of the City of Austin : That the pound fee of $ 1.50 be and the same is hereby remitted and the City Clerk authorized to draw a warrent in payment of same. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Fine of It appearing to the City Council from the attached statement and from an investigation C. C. Huddlestrom made by the Supt of Police & Public Safety that there is an element of doubt as to the Remitted mental condition of C C Huddlestrom,the defenent, at the time of his trial, upon the recommendation of the Supt of Police & Public Safety; Be it resolved by the City Council of the City of Austin : That the fine and cost ,amounting to the sum of $ 10.80, assessed against s id defendent be and the same is hereby remitted and the same being still in the hands of the Clerk of the Corporation Court ,said Officer is authorized and directed to refund same. Approved A P Wooldridge ,Mayor. --- Page break --- 138 A aGage Pound fee refunded It appearing to the Council that three head of horses belonging to R A Gage were found in the pound limits and were taken in charge by the pound master,for the release of which Mr Gage paid the sum of $ 4.50,The applicant lives near the corporate limits and he was after the stock at the time they were impounded,and their being no intention of violating the law ,and he being a poor man, and it being the first offense, and the Supt of Police and Public Safety recommending the remission of the fees; therefore, Be it resolved by the City Council of the City of Austin : That said pound fees amounting to $ 4.50, be and are hereby remitted and the money being still in the hands of the Clerk of the Corporation Court,said Officer is authorized and instructed to refund same. Pound fee J J Butler refunded It appearing to the City Council that 7 head of Cattle belonging to Jno J Butler, a resident of the south side of the City,were at large within the pound limits and were properly impounded ,for their release Mr Butler paid the sum of $ 10.50 It further appearing from the attached statement that the cattle escaped from the premises of Mr Butler without his knowledge or desire through the act of some one else; therefore, on the recommendation of the Supt of Police and Public Safety , Be it resolved by the City Council of the City of Austin : That the pound fees of $ 10.50 paid by Mr Butler be and the same are hereby remitted ,and the Clerk of the Corporation Court is authorized to refund same. Fine C L Barrow remitted Whereas on the 4th day of January ,1913, one C L Barrow, on a plea of guilty, was fined in the Corporation Court, the sum of $ 5.00 and costs,amounting in the aggregate to $ 19.80.for exceeding the speed limits,the evidence of several representative citizens is to the effect that the young man is a student working his way through college in his endeavor to get an education,is of good character and not believed to have intentionally violated the law,that he has been driving automobiles for responsible persons after hours,and this is the first time he has been accused of violating the law,and no damage has resulted, and believing that the young man has been sufficiently punished ,the Supt of Police & Public Safety recommends that the fine and cost be remitted and refunded; therefore, Be it resolved by the City Council of the City of Austin : That said fine cost be and is hereby remitted and the same ordered refunded. Approved, A P Wooldridge, Mayor. --- Page break --- 439 Name of street – Changed from Myrtle to Wooldridge Street Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin: That the name of the street in Outlot10 Div "D" in the Susan Moore sub-division, now designated on the City map as Myrtle street, be and the same is hereby changed and shall hereafter be known as Wooldridge Street. Pavement on Lavaca St. 7th to 11th accepted Councilman Powell offered the following resolution: A resolution finally accepting pavement and improvement of Lavacca street from north side of 7th street to south side of 11th street. Whereas, the Supt of Streets and Public Improvements has filed his report with the City Council to the effect that the Texas Bitulithic Company has completed the work of paving and improving Lavacca Street from north side of 7th street to south side of 11th street under contract with the City and that said work has been done in strict accordance with said contract and specifications adopted by the City ; therefore, Be it resolved by the City Council of the City of Austin: That the said work of improvement be finally accepted by the City and that the final estimate due by the City to the said Company be paid. Xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx Budget and General fund fully approved The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That the Budget of the Mayor approving the General fund for the year 1913, as set out in said budget and bearing date February 1st 1913, be and the same is hereby approved, and the appropriations therein recommended be and the same are hereby adopted and made. The resolution was read the first time and laid over. The Council then recessed subject to call. Tuesday Feby 11th 1913. The Council was called to order by the Mayor with all members present. Tax Rolls 1-418 Supplemental Rolls approved Councilman Haynes offered the following resolution: Be it resolved by the City Council of the City of Austin: That the regular tax roll of the year 1912,pages 1 to 418, inclusive,and including supplemen-tal list No 1 to 60, inclusive, be and the same are hereby approved; and, Be it further resolved: That the supplemental tax roll on the rolls of 1912 for the following years 1899,1900,1901, 1902, 1903, 1904, 1905, 1906, 1907, 1908, 1909, 1910, 1911be and the same are hereby approved. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. --- Page break --- 440 March 20/907 Ben 23 Swisher addition remitted declared exempt Councilman Haynes offered the following resolution : Whereas, it appears from the attached affidavit of J T Parker that lots 7&8 in Block 23 , Swishers addition to the City of Austin,Texas, were used exclusive-ly for church purposes on the 1st day of January 1902 and subsequently thereto during said year; therefore, Be it resolved by the City Council of the City of Austin : That said property is hereby declared to be exempt from City taxation for the year 1903,and the tax against said property for said year is hereby remitted. Be it further resolved: That the City Assessor and Collector be and he is hereby declared entitled to take credit in accordance with the provisions of this resolution . Mayors Bridge & Water & Light Dept ref. Read Rail over The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : That the Budget of the Mayor of the City of Austin for the Water, Light and Power Department for the year 1913, and bearing date Feby 10th ,1913, recommend-ing appropriations in the amount of $ 387,995.80,be and the same is hereby approved ,and the recommendations in said budget submitted ,be and the same are hereby made. The resolution was read the first time and laid over . Councilman.Powell off ered the following resolution : Be it resolved by the City Council of the City of Austin : That three hundred,nineteen and 3/100 ( $ 319.03)dollars be and the same are hereby appropriated out of the Permanent Street Improvement fund in payment to the TexasBitulithic Company of three notes ( two of $ 104.84 each ,and one of $ 104.83) and interest,executed by Mrs R B Hamblen and Kyle S Hamblen . These notes are given for pavement put down by the Texas Bitulithic Company at the instance of the City of Austin ,Texas, in front of the west twenty three feet of Lot 2 ,and the east twenty three feet of Lot 1,Block 76,City of Austin,Texas. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Approved ,A P Wooldridge, Mayor. appropriation to City paving Ways & Bd Rpt Sanitation - auth to purchase Paving Notes Councilmam Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the sum of three hundred ,therty seven and 30/100( 337.30) dollars and interest be and the same is hereby appropriated out of the Permanent Street Improvement fundin purchase of five notes of sixty two and 90/100 ) dollars and interest executed by George Southernwood and Wife to the City of Austin,Texas, in payment of Bitulithic pavement in front of the west 46 feet of Lot 1,Block 76, in the City of Austin,Texas. --- Page break --- The work represented by these notes has heretofore been done by the Texas Bitulithic company at the instance of the City of Austin with the representation made to the Texas Bitulithic company that the amount of the price would be paid by the City to the Texas Bitulithic company when the work was done.
