Austin Paves Streets, Adjusts Taxes, Settles Suit

. Regular meeting of the City Council : Austin , Texas, March 06, 1913. The Council was called to order by the Mayor : Roll called: Present Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Absent None. The minutes of the last regular and subsequent recessed meeting were read and approved by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Petitions, etc: The mayor laid before the Council a petition from Citizens asking that the alley between 10 & 11th Streets and West of West Avenue to Shoal Creek, be opened and cleaned by the City teams. The petition was read and ordered filed. Reports of City Officers : The Mayor .laid before the City Council the reports of the Health Officer and Fire Marshal ,which were read and ordered filed. Unfinished Business : The Mayor laid before the Council a resolution ordering the improvement of a part of West 6th Street, in the City of Austin, and approving specification proposals, contract and Bond therefor, which was read and adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. The Mayor laid before the Council a resolution ordering the improvement of a portion of East 5th street, which was read and adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. The Mayor laid before the Council a resolution ordering the improvement of a portion of San Jacinto Street in the City of Austin and approving specifications, proposals, contract and bond therefor, which was read and adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Haynes offered the following resolution : That the City Treasurer and Assistant City Treasurer and Auditor are hereby authorized to transfer the sum of four hundred twenty & 50/100 ( $ 420.50) dollars from the Permanent Street BOND improvement fund to the Permanent Street Improvement fund. Approved, A P Wooldridge, Mayor Approved, H L Haynes, Supt Receipts , Disbursements & Accounts. --- Page break --- 455 Transfer funds Cemetery Bond .Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Treasurer and Assistant City Clerk be and they are hereby instructed to transfer the sum of eighty four & 10/100 ($ 84. 10/100 ($ 84.10) dollars from the Cemetery Bond Fund to the Cemetery purchase fund, the latter account to be opened for the purpose of segregating the Cemetery fund from the funds to be used in purchasing addition land for Cemetery. Cemetery Purchase Fund Created Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Treasurer and Assistant City Clerk be and they are hereby instructed to open an account to be designated " Cemetery Purchase " and to transfer from the Cemetery fund to said " Cemetery Purchase" Account the sum of six thousand, eight hundred thirty five & no/100 ($ 6835.00) dollars. This for the purpose of segregating the cemetery fund from the funds to be used in purchasing additional lands for Cemetery. Approved H L Haynes, Supt Receipts, Disbursements & accounts Paving Lavaca st. 19th Councilman Powell offered the following resolution : A resolution finally accepting pavement of 19th street from East side of Lavaca to the East side of Congress Avenue. Whereas, The Supt of Streets and Public Improvements has filed his report with the City Council to the effect that the Texas Bitulithic Company has completed the work of Paving and improving 19th street from the East side of Lavaca street to the East side of Congress Avenue under contract with the City and that said work has been fully done in strict accor-dance with said contract and specifications adopted by the City ; therefore, Be it resolved by the City Council of the City of Austin : That the said work of improving be finally accepted by the City and that the final esti-mate due by the City to the said Company be paid. Fowl ordinance amended Mayor Wooldridge offered the following ordinance : An ordinance amending an ordinance entitled " An ordinance to prohibit the running at large of Fowls within a prescribed district within the City of Austin, and providing a penalty therefor", passed August 15th 1912. The ordinance was read the first time and passed under suspension of the rules by the following vote ; Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. --- Page break --- 456 Paving Lavaca Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the sum of one thousand, fifty eight and 73/100 dollars, be and the same is herebyappropriated out of the Permanent Street Improvement fund to pay for Bitulithic Paveing on Lavaca street in front of Block 125. This is the paving in rear of the Governor's Mansion in this City ,and this appropriation is made with the expectation of the amount being reimbursed to the City of Austin by an appropriation on the part of the State Legislature The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Deed to City Cemetery Substitute deed Union The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : That the Mayor of this City be and he is hereby authorized to execute for the City of Austin a substitute deed to Lot 522 in Oakwood Cemetery to the Austin Typographical Union No 138 ,in place of the deed heretofore executed to said lot by W A Saylor , then Mayor, upon the 5th day of September 1882, the deed by the said Mayor W A Saylor, not having been acknowledged for record. Fixing rate for Assessment of Insurance Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : Whereas, the banking capital of the City of Austin for the year 1912 was assessed at 80% of its Book Value ,and Whereas ,it appears to be just and reasonable to assess all other securities on the same basisof Valuation,and, Whereas, the securities of the Globe Surety Company of Kansas City Mo, The American National Life Insurance Co of Lynchburg Va, The Commonwealth Bonding and Casualty Co of Phoenix ,Arizona,The Equitable Surety Co of St Louis Mo, The Lumber Insurance Co of New York City, The Security Life Insurance Co of America of Va,The Southern Surety Co of Muskogee ,Okla,have been assessed on the tax roll of 1912 at a valuation of 100% or $ 1.00. Therefore be it resolved by the City Council of the City of Austin that the Assessor and Collector be and is hereby authorized to correct the assessment of all of the above mentioned companies and to value the securities of the said companies on deposit with the State Treasurer at 80% and to collect the taxes for 1912 on said basis and tak e credit on his books for the difference of said change. The Council was called to order by the Mayor with all members present: Councilman Haynes offered the following resolution : Whereas certain assessments of securities of Corporations on deposite in the State Treasury and the banking capital of the City have been allowed at 80% of the face value , ad and whereas taxation should be just and equal . Therefore be it resolved by the City Council of the City of Austin : That the Assessor and Collector be and is hereby authorized to assess for the year 1913 all notes and other securities rendered by the owners or holders thereof at 80% of the face value of such notes or securities. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Nays none. Fixing Rate of Assessments - funds on deposit State Treasury Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Treasurer and Assistant City Clerk be and they are hereby instructed to transfer the sum of five hundred ($ 500.00) dollars from the hospital bond account to the Hospital Building fund. Councilman Hart offered the following resolution : It appearing to the City Council that the LAST NOTEexecuted for the construction of the tenth Ward Fire Hall ,endorsed by numerous citizens and assumed by the City in the sum of twenty five hundred ($ 2,500.) dollars and the further sum of $ 419.89 being two years and six days interest, and now held and owned by the Austin National Bank is now due and unpaid. That an appropriation of twenty five hundred ($ 2,500.) dollars was made in the present budget in the Fire Dept for the payment of same,but not including amount due for interest ; Therefore, Be it resolved by the City Council of the City of Austin : That a warrent be drawn in favor of the Austin National Bank,the present holders and owners of said note, for said sum of $ 2,500.,as appropriated, and the further sum of $ 419.89,the interest due thereon, ; upon the presentation of said note properly cancelled,the payment of these amounts being in full satisfaction of all indebtedness due upon said Fire Hall.The interest to be charged to the appropriation made in said budget for repairs to Fire Halls. Councilman Powell offered the following resolution : Be is r solved by the City Council of the City of Austin : That the suit of Mrs Erin Rutherford Vs The City of Austin ,No 25852, in the District Court of Travis County ,53rd Judicial District of the State of Texas, be compromised, adjusted and settled upon the following terms: The City agrees to build a proper retaining wall of suitable height and proper finish entirely around said premises from the West end of Lot 7, Block 96, City of Austin,Texas, on 9th street to San Jacint to street a distance of about 128 feet and to a servant's house on the property line of said property on San Jacinto street'. The City of Austin also agrees to build a curbing entirely ar round said premises both on 9th street and on San Jacinto street . It likewise agrees to provide suitable concrete steps from the sidewalk to the level of the groundon the North side of said premises at such location as may be designated by Mrs Erin Rutherford. It likewise agrees to build a concrete sidewalk of proper width, thickness and finish in front ofr said premises on 9th street and to the curb line of the street on San Jacinto street . It likewise agrees to take down and restore the plank fence on the East side of said premises for a distance of about 30 feet at the place to be designated by said Mrs Erin Rutherford ; and in addition thereto it agrees to pay the cost accrued in this suit , which to date amounts to $ 18.25, and, finally ,it agrees to pay in cash to Mrs Erin Rutherford the sum of $ 50.00, All of the above work to be done in accordance with a p plat prepared by the City Engineer . Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : Contract That M M Shipe be paid the sum of four thousand ($ 4,000.) dollars ,out of the General M.M. Shipe Street Improvement fund on account of the following work: Pd. Ltrs. Rec'd Speedway from 24th street north 4 3,500.00 Avenue " G " . 250.00 Avenue " F " 250.00 This being a portion of the sum of eight thousand six hundred ($ 8,600.) dollars ,set t apart out of the above fund in the budget for the year 1913, Work to the value of four thousand ($ 4,000. )dollars having already been done. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Councilman Haynes offered the following resolution : Jas. Whereas, the improvements on lots 5 ,Block 7, Outlots 2& 3 Division " B " ,were assessed W.H. Crawford against W H Crawford ,owner, for the taxes of 1912, at $ 1,000.00 valuation; and, Correct Whereas, the said W H Crawfordmakes affidavit that the same is erroneous and excessive; and, Whereas, the Assessor and Collector ,through his deputy has made an inspection of said improvements, and places the valuation for same for taxation at $ 400.00; therefore, Be it resolved by the City Council of the City of Austin : That the Assessor and Collector be and he is hereby authorized to correct said erroneous assessment by reducing the valuation of said improvements to $ 400.00 for the taxes of 1912, and to collect the taxes accordingly.
