473 Regular meeting of the City Council: Austin,Texas, April 10, 1913. The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Absent none. The Mayor laid before the Council the following reports of City Officers, Which read and ordered filed ,viz: The Assessor & Collector; the Sexton, the City Health Officer & Assistant, the Matron of the Hospital ,Health Inspector Decherd& the Fire Marshal. The Council then recessed subject to call- Friday April 11th 1913. The Council was called to order by the Mayor: Present Mayor Wooldridge, Councilmen Bartholomew & Hart 3 Absent Councilmen Haynes & Powell 2 The Mayor laid before the Council the report of the Inspector of Weights and Measures for the month of March which was read and ordered filed . Councilman Hart offered the following resolution: Be it resolved by the City Council of the City of Austin, that upon the recommendation Fines remitted Supt of Police and Public Safety that the fines against the attached list of defendents be and are hereby remitted for the reasons herein given: The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew & Hart 3 Absent Councilmen Haynes & Powell 2 --- Page break --- 474 Witness fees . Councilman Hart offered the following resolution : It appearing to the City Council that the following counts have been collected by the Clerk of the Corporation Court in a case against Milton Nobles, to-wit: Witness fees Ella Lane $ 6.00 . Jack Lane 6.00 Total $ 12.00 and the same paid into the City treasury ; therefore, Be it resolved by the City Council of the City of Austin : That warrants be drawn by the City Clerk in favor of said parties for the respective amounts ,and charged to the " Miscellaneous " item of the Police department. Councilman Hart offered the following resolution : Court Costs It appearing to the City Council that in cause No 2616 of the State of Texas vs Julius Wright,that certain costs were incurred in the Court of Criminal appeals which have been collected by the Clerk of the Corporation Court, amounting to $ 22.00; therefore, Be it resolved by the City Council of the City of Austin: That the City Clerk be and is hereby directed to draw a warrant in favor of the Clerk of the Court of Criminal Appeals in payment of said amount and same be charged to " Miscellaneous" items of Police department. Councilman Hart offered the following resolution : Pound fees Remitted The Supt of Police and Public Safety recommends the remission of the followding pound fees ,for good cause: . Bouldin Wilson for impounding two mules $ 3.00 Tip Robinson for impounding one horse . 1.50 . Therefore; Be it resolved by the City Council of the City of Austin : That said pound fees be and are hereby remitted The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew & Hart absent Councilmen Haynes & Powell 2 Approved ,A P Wooldridge, Mayor. Councilman Hart offered the following resolution : Fine remitted It appearing to the City Council that Mack Blocker was fined in the sum of $ 24.80 ,that the defendant was enjoying his honey moon,was in the outskirts of the City,no time was taken as to speed,and there is doubt as to his guilt. Taking all the circumstances into consideration the Supt of Police and Public Safety recommends the remission of this fine; therefore, Be it resolved by the City Council of the City of Austin : That said fine be and is hereby remitted . Mr McCullough being a recent arrival in Austin, and being the first offense, upon recommenda-tion of the Supt of Police and Public Safety; Be it resolved by the City Council of the City of Austin : That $ 15.00 of said fine and costs be and the same is hereby remitted . The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Bartholomew & Hart 3 Absent Councilmen Haynes & Powell 2 Approved, A P Wooldridge, Mayor. Fine remitted Councilman Hart offered the following resolution : It appearing to the City Council that B C Linscomb was fined in the Corporation Court in the sum of $ 34.80 for exceeding the speed limit; upon investigation by the Supt of Police and Public Safety that the man exceeded the limit only for a short distance, that he is a very poor man ,a very careful, cautious, painstaking driver, and the violation was entirely unintentional, and the law was not intentionally violated and will not be repeated, under the conditions the Supt of Police and Public Safety recommends the remission of this fine; Therefore, Be it resolved by the City Council of the City of Austin : That said fine be and the same is hereby remitted. N B : The following resolutions were introduced ,read and laid over at the regular meeting held April 10th 1913, but were not handed to the Clerk in time to be entered until after the minutes of a later date were entered, hence are entered here and now.viz: Resolution ordering the construction of certain sidewalksand Curbs on East 5th street, and a resolution ordering the construction of certain sidewalks and curbs on West 6th streep also, resolution ordering the construction of certain sidewalks and curbs on East 6th strea all in the City of Austin, Texas. These resolutions were read the first time on April 10th 1913 and laid over for one week. Jno O Johnson, City Clerk. Also the following resolution : An ordinance authorizing the Mayor of the City of Austin to execute and deliver certain certificates of debt of the City of Austin ,Texas, to the Austin Sewerage Co,upon the conditions named in this ordinance; making appropriations for the cash payment due said the Austin Sewerage Co and for certain interest to become due ;and levying taxes for the payment of said certificates of debt and interest thereon. The ordinance was read the first time and a motion made to suspend the rule and place it on its second reading, which motion prevailed by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew, Hart, Haynes & Powell 5 Nays none. The ordinance was read the second time and laid over for one week. Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following rules and regulations be and are hereby approved and adopted as the rules and regulations governing such members of the Austin Fire Dept as are appointed by the Council to operate auto driven Fire apparatus. The resolution was read but no action taken. April 13 th 1913. The Council called to order by the Mayor with all members present. The Mayor laid before the Council the following resolution : Whereas it appears from the report of the City Attorney ,J Bouldin Rector, to this Council that the Court costs accrued in suit No 12808, the City of Austin vs Nancie Scott, in District Court of Travis County ,Texas, are not a proper charge against Lot 8, Block 9, of Out-lot 58, Division "B" of the City of Austin ,because at the time the suit was brought the said Lot 8, Block 9, Division "B" did not belong to said Nancie Scott; and, Whereas it also appears that the costs in suit No 20933, City of Austin vs Unknown Parties ,District Court of Travis County, Texas, did not properly accrue inasmuch as the owner of said property ,towit: Lot 2 ,Block 7, Groom's addition to the City of Austin, could not have been readily ascertained at said time; and, --- Page break --- 478 . Whereas, it appears that the costs in suit No 11551, City of Austin vs H B Wilson are not a proper charge against Lots 7 & 8 ,in Block "H", Eas E Bouldin addition to the City of Austin, because said H B Wilson was not the owner of said lots at the time of said suit; therefore, Be it resolved by the City Council of the City of Austin: That the costs accrued in said suits be and the same are hereby remitted against said several properties ,and the present owner of said several properties , Mr Fred C VonRosenberg ,is authorized to settle for the taxes against said several properties to date ,including principal, interest and penalties, exclusive of costs .. Be it further resolved: That the City Assessor and Collector of this City be and he is hereby authorized to settle with said Fred C VonRosenberg with res-pect to taxes on said several properties as hereinabove set out, and to take credit upon his rolls accordingly.
