Regular meeting of the City Council: Austin,Texas,April 17, 1913. The Council was called to order by the Mayor;Roll called: Present Mayor Wooldridge, Councilmen Bartholomew,Hart,Haynes & Powell 5 Absent none. The minutes of the regular meetings of April 3rd & 10th 1913,1913,and subsequent recessed meetings were read and adopted . Councilman Hart offered the following resolution : Be it resolved by the City Council of the City of Austin : That upon the recommendation of the Supt of Police and Public Safety Henry Grimes be and he is hereby appointed and confirmed as one of the Assistant Operators of Combination Chemical and Hose wagon No 2,during the absence of Geo Poindexter ,Chief Operator, and shall receive the compensation fixed for Assistant Operator from April st ,1913. To the Hon Mayor and City Council., City of Austin, Texas. Gentlemen : As required by the City Charter, I beg to report the following as the result of the election held in this City on Monday April 7th 1913, for the purpose of electing a Mayor and four Councilmen , to serve this City for the ensuing two years, as same has been reported to me by the Judges of Election in the various wards of the City Report of City Clerk of Election Total number of votes cast in said election 3415 For Mayor A P Wooldridge Received 3262 votes 896 For Councilmen : W B Anthony received 2155 votes E C Bartholomew received 2845 " Andy J Byas received 528 " Jas P Hart received 1390 " H L Haynes received 2939 " P W Powell received 2704 " Jas P Wallace received 690 " The report was received, read and ordered filed and recorded in the minutes of the Council. City Officers declared elected & sworn in The Mayor declared the following as duly elected as Mayor and Councilmen for the two years ending April 1915, viz : Mayor , A P Wooldridge, Councilmen W B Anthony, E C Bartholomew, H L Haynes & P W Powell. The newly elected Councilmen were then sworn in by the Mayor, after which the Oath of Office was administered to the newly elected Mayor by Councilman Bartholomew, Mayor Pro Tem. The following address by Ex-Councilman Hart was read and ordered recorded in the minutes of the Council : To the Mayor and Council : In severing my connection with the City Administra-tion. I desire to express my appreciation to you Mr Mayor and you gentlemen of the the Council for the courteous consideration shown me during the period of our association . Three of you besides my self went into office four years ago when the commission form of government was first inaugurated , and one of you two years ago . All of this time we have labored together harmoniously and I believe for the best interest of the City , as we saw it. Under this administration Austin has been made a cleaner , better and more progressive City. The improvements made have been phenomenal, both morally and physically, and the improvements now under way will throw Austin far to the front as the most progressive City in the State. Since coming into this office I have alienated many friends because of my unalterable determination to do what I conscientiously believed was right in administering the affairs of the department assigned me, and, as I believed --- Page break --- 481 Duties of City Councilmen Announced. to the best interests of the City and people. Perhaps in some instances my judgement was at fault,but regardless of all personal or selfish motives and much to my detriment I have conscienciously discharged every duty incumbent upon me without fear,favor or hope of reward. No personal consideration has actuated me in the discharge of what I conceived to be my duty, but I have acted with an eye singly for the good of our City, to enforce the law as I construed it,and make Austin a cleaner, better City, the pride of our people and of our State; but a certain class of the Citizens of Austin resented this and the consequence is that in a few minutes I shall give back to the people the trust confided to me feeling that the trust so given has been faithfully and conscientiously discharged and that the work performed in the department represented by me will bear good fruit and it will be a pleasing memory to me to feel that I have been the humble instrument in doing some good for the City I love and the people who have honored me; and to the men whom I had the honor to appoint and who assisted me so faithfully in the discharge of these duties all honor is due,and may those of them who were faithful receive their reward of duty well and faithfully performed. To my successor I can truthfully extend congratulations ,but will extend my sympathy, which perhaps he will not appreciate at this time but will before his term of office expires, and I also desire to assure him of my good will and tender to him any assistance in my power to assist him in the arduous duties which he assumes- the past so far as I am concerned is buried, and all I desire is the good of Austin and her people. Jas P Hart. The Mayor stated that the next business in order would be the distribution among the Council of the different duties of the members of the Council. Unfinished business : Sidewalk The Mayor laid before the Council a resolution ordering the construction of E. 5th certain sidewalks and curbs on East 5th street in the City of Austin,Texas. The resolution was read and adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony,Bartholomew,Haynes & Powell 5 Nays none. Sidewalk The Mayor laid before the Council a resolution ordering the construction W. 6th of certain sidewalks and curbs on West 6th street in the City of Austin,Texas. The resolution was read and adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony,Bartholomew,Haynes & Powell 5 Nays none. The Mayor laid before the Council a resolution ordering the construction of certain sidewalks and curbs on East 6th street in the City of Austin,Texas The resolution was read and adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony,Bartholomew,Haynes & Powell 5 Nays none. New Business: Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following grades be ,and the same are hereby established as the Street Grades permanent grades for the alley between 5th & 6th streets from Brazos to San Alley bet 5th & 6th Jacinto streets ,elevations being taken from the top of the fire plug at the Brazos & San Jacinto S E corner of Brazos and 6th streets ,sea level elevation 494.2. Councilman Powell offered the following resolution : Resolved, by the City Council of the City of Austin, Texas: 1st That a temporary grade be given to J M Crawford ,for curbing at N W corner of Congress Grade bulletin City ave Elizabeth Avenue and Elizabeth street South Austin, the grade of said curbing at a point at right angles 217 to Congress Avenue lot 9 at the S E corner of his building to be the same level as present grade of car track opposite to same, and the grade of curbing at a point at right angles to the Congress Avenue line at the northeast corner of his building to be 3'-1 1/2 "above the present level of the car track opposite to same. 2nd, That the aforesaid temporary grade be revocable by the City Council at any time on thirty days notice. 3rd. That the aforesaid temporary grade be and is given with the proviso that no concrete sidewalk shall be constructed thereon ,and that the plank or gravel walk shall be put in with a safe and convenient run-off to the adjoining sidewalk. Also two hundred ninety eight and 60/100 ( $ 298.60) dollars from Permanent Street fund to General Street fund--Also eleven ($11.00) dollars from Permanent fun'd to General Street fund. Transfer funds Street funds The Ma yor laid before the Council the following resolution : Whereas, it is desired to construct a building upon Lot 1 Block 123,ori ginal City of Austin ,this being located on the northeast corner of Congress Avenue and 10th street; and, Whereas , the building now located on that lot encroaches upon 10th street at the west end of the building 1.35' ,which encroachments have been in existence as shown by the attached affidavit for a period of forty five years, thus giving the owners prescriptive rights to the present occupancy of the grounds; and, Whereas, a building upon lot 2 encroaches upon lot 1,to the extent of 1' 2" this distance being taken to the middle of the party wall making it neces-sary for the owners of lot 1 to continue an encroachment upon 10th street in order toXXXxxXretain possession of the full width of the lot,namely 42 2/3 '; therefore , Be it resolved by the City Council of the City of Austin : That the 10th street line now occupied by the building upon said lot No 1, Block 123, be recognized as the permanent line of said lot on 10th street, and that the owners of said lot No1, be and are hereby allowed to construct their building upon said line. The Mayor laid before the Council an ordinance authorizing the Mayor of the City of Austin to execute and deliver certain certificates of debt of the City of Austin,Texas, to the Austin Sewerage Co,upon the conditions named in this ordinance;making appropria-tions for the cash payment, due said the Austin Sewerage Co and for certain interest to become due;and levying taes for the payment of said certificates of debt and interest thereon. Contract paving Red River St The Mayor laid before the Council a resolution ordering the improvement of a certain portion of Red River street, in the City of Austin, and approving specifications, proposals, contract and bond therefor. Contract paving Trinity St The Mayor laid before the Council a resolution ordering the improvement of a certain portion of Trinity street in the City of Austin, and approving specifi-cations , proposals, contract and bond therefor. The Council then recessed subject to call . Wednesday April 23rd 1913. Church Ladies to Creak Sign The Council was called to order by the Mayor with all members present The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City Of Austin : That permit be and is hereby granted to the Ladies of the Calvary Baptist Church of this City to erect and maintain for forty-eight hours or so much of that time as they may desire, a canvas sign across the sidewalk in front of the store-house situated at 906 Congress Avenue . The canvas sign herein authorized is to be at least nine feet above the ground, to be securely attached to the building or awning, or both, in front of which it is placed, and is to have the words " Dinner"- Calm vary Baptist Church " printed thereon. The Council was called to order by the Mayor with all members present: Councilman Powell presented bids for putting in Sewers ,in accordance with advertise-ment , from the following named parties,xiz; J W Moore & Son F D Horton Johnson & Carr, which bids were read and referred to the Engineer in charge of Sewer work for calculation and report, The Council then recessed until 10 O'clock A M tomorrow April 23 dr 1913. Bids for Sewer contract Austin, April 23rd 1913. The Council was called to order by the Mayor with all members present. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : (1) That contract No 7, for sewer work in East Austin , be and is hereby awarded ,for the price of $ 6,711.08, to the firm of Jonson & Carr of Austin, Texas. (2) That contract No 8, for laying the sewer of mains in East Austin, is hereby awarded to J W Moore & Sons of Fort Worth, for the price of $ 14,828.51, (3) That contract No 9, likewise for laying of sewer mains in East Austin, be and is hereby awarded to F D Horton of Houston, for the price of $ 9,605.69 Be it a further resolved: That the Mayor be and he is hereby instructed to return to each of the above named bidders the checks representing their unsuccessful bids. Be it resolved by the City Council of the City of Austin: That fifty ($50.00) dollars out of the General contingent fund be and the same is hereby Appropriation for Sons of Herman Meeting. appropriated to assist in the decoration of the streets of the City of Austin upon the occasion of the meeting of the Sons of H erman in this City for four days in the year 1913, beginning on the 20th day of April. Whereas, East 5th street will be paved with Bitulithic from Congress Avenue to East Avenue in this City; and, Whereas, it is the fixed policy of this Council in all instances to remove the obstructions from the streets preliminary to the permanent paving of the same.
