Councilman Bartholomew "reconsidering" Vote by which Council donated church to Negroes Dog Muzzling Ordinance --- Page break --- 545 as a refund and payment over to the Austin School Board of the accrued interest earned and paid upon the $ 150.000.00 issued July 1st 1912,up to and at the date of their purchase from the City of Austin. The resolution was adopted by the following vote : Yeas Mayor Woolridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none,. Approved, A P Woolridge, Mayor. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Treasurer and the Book-keeper of the Sanitary Sewer Dept be and they are hereby directed to open an account to be designated " Sanitary Sewer Earnings Fund " and they are hereby further directed to credit to said fund all monies received in payment of Sewer rental charges. The resolution was adopted by the following vote : Yeas Mayor Woolridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Woolridge, Mayor. Councilman Powell offered the following resolution : Whereas, the Supt of Streets and Public Improvements has filed his report with the City Council to the effect that the Texas Bitulithic Company has completed the work of Paving and improving North Congress Avenue from the Capitol Grounds to 19th street ( with exception of paving in front of properties belonging to John Granger at N E corner of Congress Avenue and 18th street, Judge L D Brooks N W corner of Congress Avenue and 18th street and T J Everett at S W Corner of Congress Avenue and 19th street,) under contract with the City and that said work has been fully done in strict accordance with said contract and specifications adopted by the City; therefore, Be it resolved by the City Council of the City of Austin : That the said work of improvement be finally accepted by the City and that the final estimate due by the City to the said Company be paid . Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following center line of Blanco street from 6th street to 10th street be and the same is hereby established as the permanent center line: For point "A" place a stake 28.32' East of the S W corner of Blanco street and the alley running west north of 6th street. For point "B" place a stake 27.72 ' west of the fence at the N E corner of Blanco and 10th streets , this point being the center of Blanco street as now fenced at the north side of 10th street. A straight line joining these two points and extending to 6th street to be the established center line. The Mayor laid before the Council the following resolution: It appearing to the Council that the Board of Equalization assessed improvements Assessment for Block "A" 39 "O" upon Lot 2, Block "A" Out lot 39 Div "O" to the amount of $ 300.00, by reason of Cancelled the fact that a building permit in said amount was taken out for improvements upon said lot ; and, Whereas, it is a fact that the improvements contemplated in said permit were made upon Lot 1, Block "A", Out lot 39 Div "O" instead upon Lot 2; therefore, Be it resolved by the City Council of the City of Austin: That said assessment of improvements in the amount of $ 300.00 upon lot 2, Block "A" Outlot 39, Div "O", be and the same are hereby cancelled, and the Assessor & Collector is hereby authorized to adjust his rolls accordingly. The Mayor laid before the Council the following resolution : Whereas, Owen G Carroll has exhibited to the City Council two notes executed by him ,one for $ 500.00 ,dated May 14th 1909, and due at four years and payable to N H Carroll, and Assessment O G Carroll Corrected ✓ the other for $ 750.00 ,dated January 12th 1909 and due on or before three years, payable to the First National Bank of Sigourney, Ia, both of which notes were outstanding obligations on the part of said Owen G Carroll and more than offset the annulled credits against him for the year 1911, in the amount of $ 640.00; Now therefore, Be it resolved by the City Council of the City of Austin : That said credits assessed against Owen G Carroll for the year 1911 in the amount of $ 640.00 ,be and the same are hereby cancelled and annulled, and the Assessor & Collector entitled to take credit accordingly. Be it further resolved : That the Assessor & Collector be declared entitled to take credit in accordance with the provisions of this resolution. Assessment C A Peterson Corrected The Mayor laid before the Council the following resolution : Whereas, it appears from the attached affidavit of C A Peterson that a portion of the credits assessed against him for the year 1912 represented notes which he had sold prior to said year to L N Goldbeck of this City, save and except one note of $ 1,000.00; and, Whereas, he makes affidavit that against this credit he had outstanding a note by debt to the Citizens Bank and Trust Company for $ 5,000.00 , and also on the 1st day of Jany 1912a note to K C Miller for $ 1,500.00 ; therefore , Be it resolved by the City Council of the City of Austin : That the credits assessed against C A Peterson for the year 1912, amounting to $ 1,720.00 be and the same are hereby stricken from the assessment rolls of this City for said year, and the Assessor & Collector is hereby declared entitled to take credit in accordance with the provisions of this resolution . Assessment J Gordon Brown Cancelled The Mayor laid before the Council the following resolution : Whereas, it appears from the attached affidavit of J Gordon Brown, that the promissory note in the sum of $ 25,000.00 , signed by Andrew Hamilton, dated December 19th 1910, and due January 1st 1912, assessed against him represented an incomplete transaction on the 1st day of January 1912; Now therefore, Be it resolved by the City Council of the City of Austin : That said assessment against said J Gordon Brown in the amount of $ 25,000.00 for the year 1912, be and the same is hereby cancelled. Be it further resolved: That the Assessor & Collector of this City is hereby declared entitled to take credit upon his rolls in accordance with the provisions of this resolution. Allison Corrected ✓ The Mayor laid before the Council the following resolution : Whereas, it appears from the attached affidavit of D K Allison, that on the 1st day of January 1912, he owed by note $ 1,500.00 ,which is much in excess of the $ 868.00 credit assessed against him as of the 1st day of January 1912; Now therefore, Be it resolved by the City Council of the City of Austin : That the assessment of credits in the amount of $ 868.00 against D K Allison for the year 1912, be and the same is hereby cancelled, and the Assessor & Collector of this City declared to be entitled to take credit accordingly. Rogan Corrected ✓ The Mayor laid before the Council the following resolution : Whereas, it appears from the accompanying affidavit of Jas S Rogan that on the 1st day of January 1912, he had debts by note much in excess of the credits of $ 800.00 assessed against him for the year 1912; and, Whereas, he had already ,as set forth in said affidavit,prior to January 1st 1912, transferred said notes to Chas Rogan of Austin, Texas; Now therefore, Be it resolved by the City Council of the City of Austin : That the assessment of credits against said Jas S Rogan for the year 1912, amounting to $ 800.00 be and the same is hereby cancelled and annulled. Be it further resolved : That the City Assessor & Collector take credit upon his assessments for the year 1912,by the amount of said $ 800.00 so assessed against said Jas S Rogan. Assman Corrected ✓ The Mayor laid before the Council the following resolution : Whereas, it appears from the attached statement of J Gregg Hill ,Special Tax Collector for the City of Austin for the year 1913, that an error has been made in the assessment of credits against the Estate of Geo P Assmanand against his widow,Mrs Hattie Assman. Now therefore, Be it resolved by the City Council of the City of Austin : That the credits assessed against the Estate of Geo P Assman for the year 1911 be reduced from $ 4,370.00 to $ 3,225.00 ,and fixed at that sum ,and the assessment for $4,670.00 against the Estate of Geo P Assman for the year 1912, be and the same is hereby reduced to $ 2,250.00,and fixed at that sum . Be it further resolved : That the assessment in the amount of $ 500.00 for the year 1911 and $ 400.00 for the year 1912 against Mrs Hattie Assman having been paid off prior to January 1st 1911 and 1912,re respectively ,are hereby cance lled and annulled. Be it further resolved : That the City Assessor & Collector take credit upon his rolls for the years 1911 & 1912 in accordance with the provisions of this resolution . Bo it further resolved : That the Assessor & Collector is entitled to take credit in accordance with the provisions of this resolution . The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : That the assessment of money and credits against Jas H Raymond Jr, for the year 1912, be, and is as set forth in the attached affidavit ,fixed at the following sums: Cash $ 2,000.00 .Credits $ $ 4,500.00 at 80 % .3,600.00 Total amount for 1912, $ 5,600.00 Be it further resolved : That the Assessor & Collector be authorized to adjust his rolls in accordance with the provisions of this resolution for the year 1912. The Mayor laid before the Council the following resolution : Whereas, it appears from the attached statement from Abe Frank that in the early part of the year 1903he became insolvent and made an assignment of all his assets for the benefit of his creditors ; and , Whereas, it further appears that about nine years ago said Frank applied to be adjudged a bankrupt ,and listed all of his creditors the names of whomhe could recall ,he not being in possession of his books by virtue of his volun-tary previous assignment ; Now therefore , In consideration of the fact of the first insolvency and subsequent bankruptcy of said Abe Frank, and the very long lapse of time since the personal property tax was assessed against him ,to-wit: 20 years ; Now therefore, Be it resolved by the City Council of the City of Austin : That the assessment of personal property against the said Abe Frank for the year 1893 and amounting to $ 4,000.00 be and the same is hereby cancelled and stricken from the rolls ,and the Assessor & Collector ishereby entitled to take credit accordingly.
