552 .Regular meeting of the City Council: Austin,Texas, July 10, 1913. The Council was called to order by the Mayor : Roll called: Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynen & Powell 5 Absent none. The minutes of the last regular and subsequentrecessed meetings were read and approved . Reports of City Officers: The Mayor laid before the Council the reports of the Assessor & Collector, the Asst City Clerk, The Sexton, the Matron of the Hospital, the Inspector Weights and Measures & the health Inspector for the month of June 1913 ,whicg were read and ordered filed. . Councilman Hayne& Bartholomew presented the following report: Austin,Texas, July 9th 1913. Whereas ,in reply to bids requested by the City on certain buildings located on lots purchased by the City in the "Annex" to Oakwood Cemetery the following named parties were the highest bidders for the buildings at the prices and on loca-tions stated below, Jas Thomas , building at 1400 East 18th street for $ 30.05 " " " " 1402 " " " .101.05 " " " " 1400, 16th " " 151.05 T G Buttery Building . 1402 16th " " 100.00 " " " " 1404 " " " 100.00 G S Hamby " " 1406 " " " 103.00 " " " " 1408 " " " 103.00 C M Browne " 1703 Concho Street 413.13 Thos A Plummer " .1701 " " 275.00 Therefore ,Be it resolved by the City Council of the City of Austin : That the said parties be awarded the properties in accordance with their bids upon the payment of the amount bid in each case in cash and the buildings,etc, in each case to be removed within a reasonable time . Councilman Powell presented the following resolution : Be it resolved by the City Council of the City of Austin ;; That the City Treasurer and the Book-keeper of the Street Dept be and they are hereby authorized to transfer from the Sanitary Sewer fund to the Permanent Street fund the sum of $ 112.33, this being an amount drawn out of the Perma-nent Street fund ,and should have been taken from the Sanitary Sewer fund: The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes '& Powell 5 Nays none. The Mayor laid before the Council an ordinance amending an ordinance regulating the muzzling of Dogs ,and prescribing a penalty for the violation thereof. The ordinance was read the second time and laid over. --- Page break --- 553 Sidewalk Ordinance The Mayor Laid before the Council an ordinance regulating the construction of sidewalks within the City of Austin ; defining the term "Sidewalk" ; requiring the construction of sidewalks by abutting property owners ;providing the manner of determining ,after due notice by process of law ,the amount of special benefits to abutting property and to the owners thereof on account of the construction of sidewalks ;providing for the assessment of the cost of such sidewalks against such owners and their property ,and for the collection and enforcement thereof; and repealing all ordinances in conflict herewith. The ordinance was read the first time and passed under suspension of the rules by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : Paving width of 31st Street That the roadway of 31st street between Main street and University Avenue ( this portion being commonly called the Speedway) be established as 36 'in width between curbs,and that curb lines be located 13' from the center line established by this City Council today. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. xxxxxxxxxxpppoooaaxxxoxxpxxxpxxxaaxxxxxx Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the center line of 31st street between Duval Street and University Avenue be established as follows: For point "A" place a stake 29.6' from the present fence corner at N E corner of 31st street and Helm street,and 28.8' from the fence on the opposite side of the street. For point "B" place a stake 30.2' from the present fence at N W corner of 31st street and Duval Street,and 29.3 ' from fence on opposite side. A straight line joining the two points to be the established center line. ( This line is as near the center of the street as at present fenced as is practicable..) The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Councilman Powell laid before the Council a bill from the Texas Bitulithic Co for paving on Lavaca street in front of a part of Lot 7 Block 126, which was allowed and ordered paid by the following vote : Yeas Mayor Wooldridge Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. ( The amount of this bill was $ 11.51.) Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the following grades on 31st street ( the Speedway )between Main street and the University Avenue be and the same are hereby established as the permanent grades ,the bench mark being the fire hydrant at the S W corner of 31st and Main streets,elevation 577.45 : --- Page break --- 554 . Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That the bid for supplying Drugs for the City of Austin for 6 months beginning July 1st 1913, be and the same is hereby awarded to J W Graham , as per schedule of bids filed with Hon H T Haynes, Supt Receipts, Disbursements & Accounts, and which schedule of prices is attached to this resolution and made a part of the same. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : That two hundred ninety two and 32/100 ($ 292.32) dollars be and are hereby appropriated out of the General Contingent fund in purchase of a strip of land 25.35 feet wide by 560.25 long, out of the Billingsley Estate on East Avenuein Grades for Helm Street Contract for Drugs Purchase of land street purposes &c --- Page break --- 555 Austin, Texas, as conveyed to the City of Austin by deed from Jno E Koller to said City of Austin , dated July 8th 1913. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That permit be and is hereby granted to W B Abadie Jr to install and maintain in front of Nos 211, 13East 5th street a gasoline tank and a gasoline pump .The tank is to be placed under the sidewalk and not under the roadway ,and the pump is to be installed at the sidewalk curb line. The work under this permit is to be done exclusively under the supervision and direction of the Supt of Streets and Public Improvements and only don: under his authoriza-tion and direction. Be it further resolved: That this permit is granted and is to be accepted as temporary, and revocable at any time in the judgement of this or any subsequent City Council . Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That whereas it appears to the satisfaction of the City Council that the costs accrued against J H Johnson, and his present vendees,many years ago, upon the West half of Lot 3, Outlot 1, Division "B" of the sub-division of the north half of the same, in the amount of $ 16.72, are are not a charge against the present owners of said property, because the improper parties were originally made defendants in said suit; Now therefore, Be it resolved by the City Council of the City of Austin : That said costs against said property in the amount of $ 16.72, are released against the above described property , and the Assessor & Collector of this City declared entitled to take credit upon his Accounts for the same. Johnson Terminated Councilman Haynes offered the following resolution : Whereas, from the attached affidavit of Martha A Elmore, and the accompanying opinion of the City Attorney of the City of Austin ,Texas, it is apparent that the credits of said Mrs Martha A Elmore are not subject to taxation in Austin,Texas, when the domicile of her Husband , which is also her legal domicile ,is at Covington, Indiana; Now therefore, Be it resolved by the City Council of the City of Austin : That the credits assessed against Mrs Martha A Elmore for the year 1912 in the amount of $ 3,700.00, be and the same are hereby ordered stricken from the assessment rolls,and the Assessor & Collector is authorized to take credit upon his rolls in accordance with this resolution . Councilman Haynes presented the following resolution : Be it resolved by the City Council of the City of Austin : That the credit standing against Mrs H Digman for the years 1911 & 1912 are fixed at 80% of $ 640.00 for each year, or in other words at $ 512. 00 for a each year; and Be it further resolved : That the Assessment standing against Mrs H Digman for said years 1911 & 1912 in the amount of $ 640.00 each are hereby cancelled and annulled , and $ 512.00 for each year is substituted therefor. Be it further resolved : That the Assessor & Collector may take credit accordingly upon his rolls for th the years 1911 and 1912. The nominations were confirmed by the following vote : Yeas Councilmen Anthony, Bartholomew, Haynes & Powell 4 Not voting Mayor Wooldridge 1 Keeper Resolution grounds unchanged Councilman Bartholomew offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Supt of Parks and Public Property be authorized to employ a Keeper for the Reservoir and grounds connected thereto at a salary of $ 50.00 per mon month. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the amount of sixhundred ($ 600.00) dollars be and the same is hereby transferred from the sub-account of the street Dept entitled "Miscellaneous" --- Page break --- 557 to the sub-account entitled " Grading and Graveling under contract", this additional amount being needed to pay the balance due on account with M M Shipe, which the latter account was intended to cover. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : appropriation That the amount of one thousand four hundred and sixty ($ 1,460.00) dollars be and is M M Shipe hereby appropriated out of the unpaid balance in sub- account of the Street Dept entitled " Grading and Graveling under contract" to pay the balance due M M Shipe under the agree-ment with him to grade and gravel the Speedway and various streets in Hyde Park. The Council then recessed subject to call. July 16th 1913. The Council was called to order by the Mayor with all members present: Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : appropriation That the sum of sixty one & 66/100 ($ 61.66 ) be and the same is hereby appropriated out of for redemption bonds. the Interest and Sinking fund for the purpose of paying interest on the following bonds which were redeemable on July 1st 1913, but through oversight provision for their redemption was not completed until later: Sanitary Sewer Bonds $ 5,000.00 Permanent Street Improvement 5,000.00 Cemetery Purchase Bonds 2,000.00 The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 4 Nays none.
