578 Regular meeting of the City Council: Austin, Texas, August 14, 1913. The Council was called to order by the Mayor: Roll called : Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted. The Mayor laid before the Council the following reports from City Officers: Sanitary Inspector for the months of June & July. The City Sexton for July 1913. Supt of Streets, Street Dept for June, and the Sanitary Sewer Dept for July1913 Health Inspector for June & July1913. All of which were read and ordered filed. The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin : That leave of absence be and is hereby granted to Hon H L Haynes for thirty days beginning Monday August 18th 1913. This vacation may be taken by Councilman Haynes for such number of days and at such periods of time during the months of August & Sept as may suit his pleasure and convenience. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. H. L. Haynes Leave absence Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That leave of absence be and is hereby granted to Fred Sterzing, Assessor and Collector, for the period of two weeks, beginning Monday August 18,th 1913. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Fred Sterzing Leave absence Councilman Bartholomew presented the following resolution : Be it resolved by the City Council of the City of Austin : That the fourth penstock referred to in the general specifications for rebuilding the dam be eliminated as suggested by Consulting Engineer, A C Scott, and the Consulting Engineer and Resident Engineer of the City Water Power Company. And in lieu thereof the improvements in the Power house amounting to $ 1,082.00 recommended by those Engineers, be approved, the City Water Company allowing a credit of $ 467.00 for Penstock and $ 115.00 cost of iron railing around gallery, leaving a balance of $ 500.00, which amount is hereby appropriated out of the Earnings fund of the Water & Light Dept. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. The Mayor then laid before the Council the reports of the Fire Marshall and the Inspector of Weights and Measures for the month of July 1913, which were read and ordered filed . --- Page break --- 579 Adoption Purchase of Negro Church Block 101.✓ Mayor Wooldridge offered the following resolution: Be it resolved by the City Council of the City of Austin: That the City Council of the City of Austin agrees to pay to the Metropolitan African A M E Church for vacating the North West one quarter of Block 101 of the City of Austin, Texas, and for conveying to the City of Austin, Texas, all their rights, title, interest, claim and posse --ssion in and to said North West one quarter in Block 101 in the City of Austin, Texas, or any part thereof, the price of five thousand ($ 5,000.00) dollars , and the right and the obligation upon the part of the Metropolitan A M E church to tear down and remove from said premises the brick church building now thereon situated, the same being the property of said Metropolitan A M E church . The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony & Powell 3 Nays Councilmen Bartholomew & Haynes 2 Approved, A P Wooldridge, Mayor. Councilmen Bartholomew & Haynes presented the following as their reasons for their vote: We vote against the proposition to donate to the Metropolitan A M E church the buildig purchased from the Trustees of that church for the following reasons: The City Council contracted with the Trustees for that building over one year ago , at the price of $ 5,000.00.Now it is proposed to give the building to the same parties if they will remove it .This is practically donating to the church $ 5,000.00whic, in our opinion , the City cannot legally do . The building is a good one ;is said to have originally cost $ 17,000.00 , and being located on the extreme West end of the half block ,occupying only about 40 feet of the 276 feet of same , it can be made useful for Library purposes. The Mayor has suggested that the City secure from Mr Carnegie $ 50.000.00with which to erect a Library Building . To obtain this fund the City must vote an annual tax of $ 5,000.00to support a Library . The City has not yet voted a perpetual annual tax for that purpose ,and may not do so. Under the circumstances it appears to us.poor judgement to sell( much less give away) a building costing the City $ 5,000.00until this question is settled. In case it is to be found desirable in the future to remove the building ,we have assurance that the material will sell for a good portion of the amount the City originally contracted to pay for it . However worthy the object we have no right to give away the peoples money. Endorsement Panama Exposition August 15th 1913 The Council was called to order by the Mayor with all members present: Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the West curb line of San Gabriel street between 23rd & 24th streets be and the same is hereby authorized to be placed parallel to the established center line of San Gabriel street and 26 feet from the east curb and that from 23rd street south on the west side of the street the curb shall be placed on an angle so as to join a curb now in on the north side of 22 1/2 street . The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved , A P Wooldridge, Mayor . Councilman Haynes offered the following resolution : Be it resolved by the City Council of the City of Austin : That the City Treasurer be and he is hereby instructed to transfer the sum of eleven hundred and twenty five ( $ 1,125.00) dollars from the Sanitary Sewer Earnings fund to the Interest and Sinking fund to re-imburse the last named fund the payment of the above amount out of the said fund instead of out of the Sanitary Sewer Earnings fund ,said payment being interest on twenty seven sewer certificates from April 1st 1913, to July 1st 1913. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved ,A P Wooldridge, Mayor. Mayor Wooldridge offered the following resolution : Whereas, our National legislative bodies have designated San Francisco, California, as the official place for holding an International exposition ,in celebration of the opening of the Panama Canal and appropriated large sums to aid in placing exhibits for the same ,and Whereas, eighteen States of the Union have thus far appropriated an aggregate of three million dollars for placing exhibits and twenty seven Foreign Governments have Officially accepted the invitation to participate in said exposition ,and Whereas, an unprecedented opportunity is afforded by said Panama Pacific exposi-tion for exploiting the resources of the great State of Texas ,with a view to the greater development of such resources and increasing the revenues to the people of the State, by procuring better and more extensive marketing conditions for their farm and manufactured products ,and Whereas, it has been declared by the Attorney General of the State of Texas, to be contrary to the Constitution of this State ,for any appropriation to be made by the legislature of the State from any funds accruing from the taxation of the people ,therefore Be it Resolved : That we the members of the City Council of the City of Austin ,do hereby proclaim our hearty endorsement of the Panama Pacific International Exposition to be held in the City of San Francisco, California, from February 20th 1915,to December 4th 1915, and Resolved : That we endorse any action of the Legislature and the Governor of the State ,in authorizing and appointing a Commission to procure funds and --- Page break --- 581 effect the establishment and maintenance of an exhibit at the Panama Pacific Exposition that will reflect credit upon our State and its people; and Resolved : that we urge upon the people of Austin and the State of Texas, the importance of contributing liberally to the funds for the establishment of such exhibit and prompt action to the end that the best results may be obtained . Councilman Anthony offered the following resolution : Be it resolved by the City Council of the City of Austin : Fire Hose purchased That W B Anthony , Supt Police and Public Safety , be and he is hereby authorized to purchase 1000 feet of the Paragon brand of Eureka Fire Hose , for the sum of $ 1,100.00, the same being purchased at the rate of $ 1.10 cents per running foot. The resolution was adopted by the following vote : Yeas Mayor Wooldridge , Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Councilman Anthony offered the following resolution : Be it resolved by the City Council of the City of Austin : Transfer funds Fire Dept That one thousand ($ 1,000) dollars be and the same is hereby transferred from the appropri-ation of $ 1,890.00 for " Salaries of three additional men for North Austin Hose Co No.6" and made available for the purchase of Motor apparatus, hose and miscellaneous for the Fire Dept of the City of Austin for the year 1913. Councilman Powell presented his reports of Expenditures from the General and Permanent Street funds for the month of July 1913. which were read and ordered filed. Councilman Anthony offered the following resolution : Be it resolved by the City Council of the City of Austin : For sufficient cause thereunto shown , the City Council hereby remits to Amos Mason a balance of $ 9.55, in cause No 7894, in the Corporation Court of the City of Austin . Be it further resolved: That for sufficient cause thereunto shown , the City Council remits to Joe Sell, a balance of $ 9.55, in cause No 7895, in the Corporation Court of the City of Austin, Texas. The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor. Due Sell Remitted ✓ Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin : That the Supt of Streets and Public Improvements be and he is hereby authorized to purchase a C H & R Power Driven Man-hole Pump , for the sum of $ 237.20, delivered in this City. Purchase Pump St. Dept ✓ The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays n one. Approved, A P Wooldridge, Mayor. Councilman Bartholomew offered the following resolution: Be it resolved by the City Council of the City of Austin : That the sum of $ 435.50, this day deposited by the Citizens principally of East Austin, to the credit of South East Avenue Park, be set apart and appropriated to the cost of a music stand at South East Avenue Park. Funds deposited to credit South East Avenue Park Citizen Contribution ✓ The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew & Powell 4 Absent Councilman Haynes 1 Councilman Bartholomew offered the following resolution: Be it resolved by the City Council of the City of Austin : That the sum of $ 54.90, be and the same is hereby transferred from the account of " Soil, gravel and grading at Wooldridge Park " to the account of Music Stand at South East Avenue Park. V Councilman Bartholomew offered the following resolution: Be it resolved by the City Council of the City of Austin: That the sum of $ 44.11, be and the same is hereby transferred from the account of " Tools and incidental expenses at Wooldridge Park " to the cost of Music Stand at South East Avenue Park . The resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Bartholomew , Anthony & Powell 4 Absent Councilman Haynes 1 Approved, A P Wooldridge, Mayor. The Council then recessed subject to call. August 18th 1913. The Council was called to order by the Mayor with all members present except Councilman Haynes. The Mayor laid before the Council the following resolution: Be it resolved by the City Council of the City of Austin: That the petition of Doc Stewart & Jno O'Brine to erect and maintain a tent 50X 80 feet in dimensions on East Avenue between 7th & 8th streets , be and the same is hereby granted for a period of 10 days from and after this date. Be it further resolved: That said Doc Stewart & Jno O'Brine are hereby authorized to conduct a show in said tent for the above stated period of 10 days. Be it further resolved: That this permit is subject to revocation at any time in the pleasure of the City Council.
