705 . Regular meeting of the City Council : Austin, Texas, February 19, 1914. The Council was called to order by the Mayor: Roll called : Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted: Councilman Haynes presented the report of the Sanitary Inspector for the month of January 1914, which was read and ordered filed. Councilman Powell presented the following resolution : Be it resolved by the City Council of the City of Austin, Texas: That the City Treasurer be and is hereby instructed to transfer the sum of Ninety one & 10/100 ($ 91.10 ) dollars , from the Sanitary Sewer fund to the Sanitary Sewer Earnings fund to reimburse said fund for this amount which was erroneously drawn out of said fund , see warrant No 266; The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Unfinished business : The Mayor laid before the Council An ordinance regulating the storage and handling of Gasoline and other volatiles and inflamable liquids , within the City of Austin, and providing penalties. The ordinance was read the 2nd time. Councilman Haynes offered the following resolution : Resolved by the City Council of the City of Austin, Texas: That the sum of onehundred and sixty nine dollars and ninety two cents, ( $ 169.92) for interest on overdrafts owing by the City of Austin from January 8th 1914, to February 15th 1914, be charged against the following funds and in the following amounts: Water & Light fund on its overdraft of $ 4,946.49 $ 21.31 General fund on its overdraft of $ 8,310.24 34.90 Parks on its overdraft of $ 320.00 1.38 Oakwood Cemetery fund on its overdraft of $ 309.60 1.30 Cemetery Purchase fund on its overdraft of $ 2,125.00 8.92 Hospital Building fund on its overdraft of $ 62.22 .26 General Street fund account on its overdraft of $ 5,435.68 21.82 Permanent Street fund Account on its overdraft of $ 10, 759.11 45.73 Sanitary Sewer fund account on its overdraft of $ 7,677.28 32.24 Sanitary Sewer Earnings fund account on its overdraft of $ 491.74 2.06 Ther resolution was adopted by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That two hundred and fifty ($ 250.00) dollars be and is hereby charged to the General contingent fund of the City of Austin, Texas, for the year 1914, and when so charged: Be it resolved that it is hereby appropriated , or so much thereof as may be proven to be necessary, to the expense of correctly locating the East line of the City of Austin, Te Ref. Whereas, it appears to the satisfaction of the City Council ,that the horse of Felix Chericoo placed in the City pound had been turned out of his lot by persons who had about that time burglarized his premises; and Whereas, the said horse was out of the owners lot without any fault of the owner ,the said Felix Cherico. Now , therefore, Resolved by the City Council of the City of Austin : That the pound fees ,amounting to $ 1.50, levied and collectoer in said case be and the same are hereby remitted . And it further appearing to the City Council that said pound fees ,amour-ing to $ 1.50 have been deposited by the Police Clerk with the Assessor & collector of this City , Now , therefore, Resolved by the City Council : That $ 1.50,be and the same is hereby appropriated out of the Contingent fund of the City of Austin for the year 1914, as a refund to the said Felix Cherico for said pound fees collected as hereinbefore stated . Pound fees Felix Cherico remitted appro of Pounds fees refunded F Cherico The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas; That A P Wooldridge, Mayor of the City of Austin,Texas, and his successors in office ,be and he and they are hereby authorized to execute and deliver quit claim deeds to any owner or any other person having an interest in lands or lots heretofore sold to the City of Austin,Texas, under decree of Court in any suit or suits brought for the collection of taxes thereon ,or sold by the Collector of taxes of the City of Austin,Texas, within two years from November 19th 1913; provided that such persons having an interest in said lands or lots in the City of Austin, Texas, shall pay the amount of taxes for which the sale was made ,together with all costs ,penalties and interest now required by law ,and shall also pay all taxes , interest ,penalties and costs on or against said lands or lots at the time of said redemption .; provided that the vendee in such quit claim deed or release shall pay for the proper acknowledgements. Deeds to be made to owners of lands or lots sold for taxes on payment of taxes and all costs The Mayor laid before the Council the following resolution : Be it resolved by the City Council of the City of Austin ,that the contract by and between J W Maxwell and the City of Austin ,for the collection of delinquent taxes, made on the 7th day of December 1912, be and the same is hereby renewed for one year from December 7th 1913, to December 7th 1914, which said contract is of record in a minute book of the City Clerk of the City of Austin,in Book 5, page 93, reference to which is here made for all the obligations and conditions in said contract. Cont with J W Maxwell for Col Taxes renewed --- Page break --- 707 The Mayor laid before the Council the following resolution : Whereas, the petition of the Central Barber Shop to erect an electric sign at its place of business in the Littlefield Building on East 6th street in this City, is approved by W L Fyres, Sign Inspector of the City of Austin. Now, therefore, Resolved by the City Council : That a permit be and is hereby granted. Said sign is to be a doublefaced sign ; to be built of 26 gauge galvanized iron; size 6 feet 6 inches by two feet 9 inches; the letters are to average 7 openings for use of crystal bull's eye lens; all wiring is to be done in the conduit and all on the inside of the sign ; Said sign is to be illuminated by 18 -25 Watt Lamps. Be it further resolved by the City Council : That the permit hereinabove granted is granted and must be accepted as strictly temporary and revocable at the pleasure of this , or any subsequent City Council . The Mayor laid before the Council the following resolution: Resolved by the City Council of the City of Austin : That a permit be and is hereby granted to Looks Restaurant to establish and maintain at its place of business at 111-113 West 6th street in this City an electric Light sign of about the following description : Said sign is to read " LOOK'S REsTuaRanT" in two lines; is to be doubled faced; the base to be built of No 26 gauge galvanized iron ; the size of the sign is to be 8feet 10 longby two feet 9 inches inwidth; yhe letters are to be 10 inches high ,with an average of 7 crystal bulls & eye lens to the letter; the illumination of this sign is to come from twenty two 25 Watt lamps inside of the sign ; all wiring is to be done in the conduit; The sign is to be wired with two circuits for the use of a two way flasher ; the sign is to have two blue smalls background white letters and to be edged in black; the sign is to hang not less than 8 feet above the sidewalk and to be within the curbline, and is to be securely attached to the building in front of which it is placed. Be it further resolved : That the permit here granted is granted and must be accepted as strictly temporary and revocable at any time in the pleasure of this ,or future City Councils . The permit hereinabove granted is recommended by W I Eyres, Sign Inspector of the City of Austin, Texas. Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin : That the sum of onehundred two & fifty cents ($ 102.50) be and the same is hereby appro-priated out of the General Contingent fund of the City of Austin, Texas, as a commission ot 15 Per centum upon six hundred eighty three and forty seven cents ($ 683.47) of taxes --- Page break --- collected upon credits placed upon the assessment rolls of the City of Austin, Texas, for the year 1913, at the sole instance of Messrs Hill & Long, special tax collectors for the City of Austin under their contract with the City of Austin , dated Sept 26th 1913, as per the attached statement of taxes collected ,dated Feby 17th 1914. Mayor Wooldridge offered the following res olution : Resolved by the City Council of the City of Austin : That the sum of twenty six ($ 26.00) dollars be and the same is hereby appropriated -ated out of the appropriation for damages and costs in the general street fund of the City of Austin,Texas, in payment of the bill of W Quebedeaux for damages sus-tained by him at his place of business on the corner of 4th street and Neches street in this City at the time of the flood of December 1913, by reason of the fact that the [illegible] carrying off storm water accumulated adjacent to his premises was insufficient at the time to carry off such storm water . The bill for this appropriation is attached to this res oluti.nand made a part of the same. The Council was called to order by the Mayor with all members present: Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin : That the petition of the Fraser Auto Supply Co, to install and maintain at 117 West 6th street , in this City, a gasoline tankwithin the property lines of the building located at 117 West 6th street ,is hereby granted . Resolved further :That permission is granted the said Fraser AutoSupply Co to install and keep a combination pipe and hose outlet from the tank author-ized to be located in said building, which hose must be suspended from the awning above the sidewalk in front of said 117 West 6th street , with allowance to drop the same when in use to a position above the curb line in front of said pre mises . Be it further resolved : That the permit hereby granted must be carried into effect under the immediate supervision of the Supt of the Dept of Streets and Public Improvements, and the work must be done subject to his approval. Be it further and finally resolved : that this permit is expressly granted as temporary and must be so received, and must be held as subject to revocation at any time in the pleasure of the City Council . Approved, A P Wooldridge, Mayor. --- Page break --- 709 W R Young & J R Hutson refund Liquor License The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That six dollars and thirty three cents ( $ 6.33) be and the same is hereby appropriated out of the general contingent fund of the City of Austin for the year 1914, as a refund to W R Young and J R Hutson,and made payable to The Austin Mercantile Company,upon their malt liquor dealers license No 605, issued by the City of Austin on the 6th day of May 1913 and for the period of oneyear. Sewer Connection Ordinances & Penalties The following ordinances were handed the Clerk on the 21st day of February 1914. and are here noted ,together with endorsements on same: An ordinance requiring connection withthe sanitary sewer system of the City of Austin in certain cases; regulating the use of the sanitary sewers and drains; declaring the construction and maintenance of cesspools and surface closets a nuisance in certain cases; and prescribing penalties for the violation of the terms of this ordinance. The above ordinance has endorsed upon the back of same the following: " Feb 12 1914 Read first time, Feby 19th 1914, Read 2nd time. Feby 20th 1914, Rule suspended , Read 3rd time and finally passed , Yeas 5. " Establishing Sewer Department Rules & Regulations An ordinance creating and establishing the Sanitary Sewer Department of the City of Austin; prescribing rules and regulations for the conduct of the business of said department; and adopting a schedule of rates for sewer service: The above ordinance has endorsed upon the back of same the following: " Feby 16/1914, Moved that rules be suspended and placed 1st & 2nd readings. Read 3rd time,Yeas 5, Feby 20th /1914, Finally passed Yeas 5 " --- Page break --- 710 Fines for speeding reduced L .Councilman Anthony offered the following resolution : Whereas, the City Council deems ten dollars ($10.00) and costs a sufficient punishment for first offence for fast driving with motorcycle in the following numbered cases pending in the Corporation Court in the City of Austin,Texas, to-wit Cause No 8294, City of Austin vs E S Horner ; Cause No 8296, City of Austin vs Vivian Taylor . Now, therefore, Resolved by the City Council : That upon payment of costsand fine in said causes in the amount of nineteen dollars and eighty cents each $ 19.80 that the same shall be deemed settled and closed as to said defendants, The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none.
