716 Regular meeting of the City Council : Austin,Texas,March 05, 1914. The Council was called to order by the Mayor: Rollonalled: Present Mayor Wooldridge, Councilmen Anthony,Bartholomew, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted. The Mayor laid before the Council following resolution: Resolved by the City Council of the City of Austin: That seven thousand ,four hundred and fifty seven dollars and thirty one cents ($ 7,457.31) be and the same is hereby appropriated out of the unapplied balance in the Permanent Street Improvement fund to pay the Citys part for paving with Bitulithic pavement West 8th street from Congress Avenue to Colorado street, and to defray the cost of the additional necessary expenses incident to this work. The resolution was read the first time. The Mayor laid before the Council the report of the City Treasurer for the month of February 1914, which was read and ordered filed. Councilman Powell offered the follwing resolution: Whereas, the City of Austin did on October 30th 1912, enter into contractwith R V Dixon ,for the construction of a reinforced concrete bridge across Waller Creek on Duval street between 44th & 45th streets; and, Whereas, the City of Austin did require of said R V Dixon a bond for the sum of four hundred dollars & 00/100($ 400.00) ,guaranteeing the faithful completion of said Bridge; and, Whereas, said R V Dion’s part of the work was completed on or about April 1st 1913 1913; Now therefore, Be it resolved by the City Council of the City of Austin: Texas: That said R V Dixon be and is hereby released from said bond. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Councilman Powell offered the following resolution: Be it resolved by the City Council of the City of Austin,Texas: That the sum of thirty seven hundred and fifty ($ 3,750.00) dollars be and is hereby appropriated out of the General Street fund for the purpose of paying the Citizens Loan and Investment Company for grading and graveling Stone Road from South Congress Avenu to the East property line of Travis Heights. This appropriation has been passed in the Budget for General Street Fund, 1914. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Councilman Bartholomew offered the following resolution: Resolved that the Supt of Parks and Public Property be authorized to purchase and lay a 6 inch or 8 inch waterpipe, whichever may be deemed desirable, and install necessary fire hydrants around the State Capitol ,and to connect the same with the 16 inch water main on Congress Avenue, with the approval of the Governor of Texas, and the State Supt of Public Buildings and Grounds, with the understanding, that a 8 [Left Margin] appropriation to pay City's part for paving 8th St. from Congress R. V. Councilman Powell offered the following resolution : Be it resolved by the City Council of the City of Austin, Texas: That the Supt of Streets and Public Improvements be and is hereby authorized to build a Storm Sewer and Laterals as follows : 21st street from SanAntonio street to the alley east of Rio Grandestreet 24" Alley East of Rio Grandestreet from 21st to 23rd street 24" 23rd street from alley east of Rio Grande street to and across Rio Grande street 20" Rio Grande street from 23rd street east to 23rd street west and across same 20" Lateral on 22nd street from alley east of Rio Grande street to the east side of Nueces street 18" Lateral on 23rd street from alley east of Rio Grandestreet to east side of Nueces street 18" Lateral to north side of 23rd street at alley east of Rio Grande street 18" Short laterals at all corners to which water drains 15" Be it further resolved , that this work is to be done and paid for out of appropri-ations provided for in the 1914 budget for the Permanent street Improvement fund. Councilman Powell offered the following resolution : A resolution finally accepting pavement and improvement of west side of Guadalupe street, to 19th street to 24th street. Whereas, the Supt of Streets and Public Improvements has filed his report with the City Council to the effect that the Texas Bitulithic company has completed the work of paving and improving of West side of Guadalupe street from 19th to 24th streets, under contract with the City and that said work has been fully done in strict accordance with said contract and specifications adopted by the City ; Therefore, Be it resolved by the City Council of the City of Austin, Texas: That the said work of impro ement be finally accepted by the City and that the final estimate due by the City to the said company be paid. Mayor Wooldridge offered the following resolution : Resolved by the City Council of the City of Austin : That ,A P Wooldridge, Mayor, be and he is hereby authorized to draw against the appropriation to the credit of Charity of the City of Austin in the budget of 1914, the sum of $ 400.00 to reimburse to the United Charities a deposite in that amount by the United Charities to the credit of the Charity appropriation of the City of Austin in the year 1913, made on December 30th 1913. The resolution was read the first time. Councilman Powell offered the following resolution : A resolution designating owners and their property on Congress Avenue in the City of Austin, Travis County, Texas, from the south curb line of 13th Street to the south curb line of 19th Street who have failed or refused to agree with the City Council as to the special benefits of improvement on said Congress Avenue and the apportionment of the cost of such improvements to be assessed against each of them and directing the City Attorney to file with the County Judge of Travis County a statement thereof. Be it resolved by the City Council of the City of Austin : Whereas, the City Council has heretofore ordered the improvement of Congress Avenue from the south curb line of 13th Street to the south curb line of 19th Street by grading, and paving and guttering the same, and has given a notice and hearing to the owners of prop -erty abutting the same concerning the benefits of the said improvement and the amount and proportion of the cost thereof to be assessed against them ; and Whereas, the said hearing has been held and all of said owners have been given an opportunity to be heard before the City Council concerning the said matters ; and Whereas, some of said owners have agreed and consented with the City Council concern -ing the benefits of said improvements to their property and the amount to be assessed a against the same ; and Whereas, others have failed and refused to agree with the City Council as to the special benefits of said improvement and the amount and apportionment of the cost thereof to be assessed against them and their property; and Whereas, said improvements have been fully completed and accepted by the City of Austin on the 3rd day of July 1913; 1st . That the City Attorney is hereby directed to file with the County Judge of Travis County, Texas, a statement hereof as provided by Section 4 of an ordinance in such cases made and providedpassed by the City Council of the City of Austin, February 23, 1911; and further to take such stepsfor the appointment of Commissioners and for the determination of the amounts of said assessments as are provided by said ordinance. 4th. That this resolution take effect from and after its passage. The Council was called to order by the Mayor with all councilmen present. The Mayor presented the following resolution: Resolved by the City Council of the City of Austin: That the unexpended balance of money in the Permanent Street Improvement Fund be and is hereby pledged by the City Council to be expended in permanent street paving and work connected (improvement and paving) therewith east of Congress Avenue in this city, less the cost of filling gaps in West 6th Street and North Congress Avenue. Flury sign The Mayor offered a Resolution granting the application of G. Flury, Agent, for authority to install and maintain at 1420 Congress Avenue in this City an electric light sign in accordance with the terms of his petition therefor for the Paris Cafe, Said sign is to be installed and maintained under the supervision of the Water, Light & Power Department of the City of Austin. Said permit is revocable at any time in the pleasure and judgment of the City Council. The resolution was adopted by the following vote: Yeas - Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell. 5 The Mayor offered the following resolution: Whereas, it has been made apparent to the City Council of the City of Austin that the City Water, Power Company has complied with its franchise in the work done City Water Power Co Hartford Con. Complied with and cash expenditures since March 9th, 1913, to Feb. 9th, 1914, that it has paid on said contract and franchise during the said period, being the seventh period of its franchise, more than Six Thousand ($6,000) dollars required according to the franchise; that it has satisfied this Council that it is entitled to a credit of two hundred and seventy-seven (277) days of time lost during the seventh period by floods, rains and other causes not within its control; therefore, Be It Resolved By The City Council Of The City Of Austin: That the City Water Power Company of Hartford, Conn., has complied with the provisions of its franchise to rebuild the Austin Dam, and that the eighth period of said franchise and contract between the City Water Power Co., and the City of Austin, Texas, begins on Feb. 9th, 1914, and that said City Water Power Co. has expended more than the amount of money required to be expended during the seventh period of its contract under its franchise with the said City of Austin. The resolution was adopted by the following vote: Yeas - Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 The Council then adjourned. The Mayor presented the following resolution: Mrs M E Gooch Whereas, J. Gregg Hill, Special Tax Collector for the City of Austin, Texas, assessment certifies that Mrs. M. E. Gooch was erroneously assessed $500.00 as cash on hand cancelled for the year 1913. Now Therefore, RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That said assessment of cash against the said Mrs. M. E. Gooch for the year 1913 be and the same is hereby cancelled and annulled. The resolution was adopted by the following vote: Yeas - Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Councilman Haynes moved that the Assessor & Collector be and is hereby authorized to correct the assessment in accordance with a statement by J. Gregg Hill, attached to said resolution and to take credit therefor. The report of the Water & Light Department for the month of December, 1913, was presented, read and ordered filed. The following reports for the month of February, 1914, were presented, read and ordered filed. City Physician, City Marshall, P. S. Spiller Cashier, Sewer Earnings fund. Also P. S. Spiller, cashier, Sewer Earnings fund from April 1st, to Dec. 31, 1913. The Mayor introduced the following Resolution: Whereas, Fred C. Von Rosenberg is the present owner of certain lots in the City of Austin described in suit No. 28752, pending in the District Court of Travis County, Texas, 53rd Judicial District, which lots are in arrears for taxes, and which lots had been sold to him, the said Fred C. Von Rosenberg, under tax sale F C Von Rosenberg in a suit wherein the State of Texas was plaintiff for itself and the County of Trav taxes reduced & paid & is; and deeds issued by City Whereas, the said Fred C. Von Rosenberg proposed in adjustment of the taxes to certain property. owing the City against said lots to pay the principal of said taxes for the year 1910, taken as a typical year, and to multiply the taxes owing for 1910; said taxes being in arrears for fourteen years, by fourteen, which will give $143.78 as the principal of said taxes; and Whereas, the said Fred C.
