121 . REGULAR MEETING OF THE CITY COUNCIL: AUSTIN, TEXAS October 01, 1914. The Council was called to order by the Mayor: Roll called: Present Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Absent none. The minutes of the last regular and subsequent recessed meetings were read and adopted. Reports of City Officers: The Mayor laid before the Council reports of the Dog Catcher, the pound Master, the City Marshal & the Supt of Streets, etc, which were read and ordered filed: Resignation Councilman Anthony presented the resignation of T O Fox as Mounted Policeman, T O Fox a Mtd which was accepted by the following vote: Policeman Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Councilman Anthony nominated J L Fox as Mounted Policeman vice T O Fox resigned, J L Fox appointment which nomination was confirmed by the following vote: Policeman Yeas Mayor Wooldridge, Councilmen Bartholomew, Haynes & Powell 4 Not voting Councilman Anthony 1 Unfinished business: The Mayor laid before the Council an ordinance requiring reports of moving of household Moving Van furniture and household goods and effects from any one portion of the City of Austin, Texas, Ordinance to any other portion of the City of Austin, Texas, and prescribing a penalty for the violation of this ordinance. The ordinance was read the first time, and a motion made to suspend the rule and place it on its second reading, which motion prevailed by the following vote: Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. The ordinance was read the second time. Mayor Wooldridge offered the following resolution: Resolved by the City Council of the City of Austin, Texas: Magnolia Petrol That a permit be and is hereby granted to the Magnolia Petroleum Company to install and Co. Permit maintain for a period of twelve months from the 1st day of October 1914, a gasoline tank of the most modern and approved pattern, to be approved by the Supt of Police and Public Safety, under the sidewalk at 917 Congress Avenue, Austin, Texas. Resolved Further: That in connection with this gasoline tank hereby authorized to be installed, the said Magnolia Petroleum Company is likewise authorized to install and maintain for a period of twelve months from October 1st 1914, a gasoline pump to be located at the curb line in front of 917 Congress Avenue, at a position to be designated by the Supt of Streets and Public Improvements, said gasoline pump to be of the most modern and approved fashion, character, construction and design, and subject to the approval of the Supt of Police and Public Safety. Resolved Further: That the Magnolia Petroleum Company shall install and maintain at the top and upon --- Page break --- 132 .the gasoline pump hereby authorized an electric light of not less than 40 watt power and placed in a globe of not less than ten inches diameter, which electric light must be kept illuminated not less than three hours daily, between the hours of 6 and 12 O'clock P M ,during the existence of this permit. Resolved further: That the hose through which air, gasoline , or other oil or volatile substance is conveyed by pumping or other wise from the store house at 917 Congress Avenue, or from the tank authorized to be placed in front of same , must be kept when not in actual use neatly coiled and stored, either in the receptical in the sidewalk provided for such hose or in the receptical in the pump authorized to be installed and provided for the storing of said hose. Resolved further: That no Garage of any character ,kind or description shall eithr be installed or maintained at 917 Congress Avenue during the life of this permit and the permit heretofore granted , to establish and maintain an autimobile garage at 917 Congress Avenue is expressly repealed . Be it further resolved : That the cut or depression now in front of 917 Congress Avenue heretofore used as an inclined plane for access of autimobiles to the store house 917 Congress Avenue must be removed and the sidewalk in front of 917 Congress Avenue must be laid of the uniform level with the concrete sidewalk both north and south of the premises situated at 917 Congress Avenue. Resolved further : That the work herein under this resolution, authorized to be installed and maintaind must be installed and maintained , where not otherwise assigned , under the immediate supervision of the City Engineer of the City of Austin,Texas, who is hereby authorized to prescribe necessary specifications for the work herein authorized to be done. Resolved further and finally: That this permit is granted and must be accepted as revocable at any time in the pleasure of the City Council . The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew & Powell 4 Nays Councilman Haynes 1 Approved A P Wooldridge, Mayor. Howard Davis Fine Remitted The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin,Texas: That in consideration of the mitigating facts of the case, as clearly shown to the City Council , and inview of the further fact that the present offense is the first offense of Howard Davis , one-half or $ 7.40 of the cost and fine imposed against Howard Davis in cause No 8904,State of Texas vs Howard Davis in the Corporation Court of Austin,Texas, be and the same is hereby remitted, and an appropriation of that amount out of the General Contingent Fund be and the same is hereby authorized. The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That in view of the mitigating factsof the case made fully known to the City Council, and the fact that the defendant , J A Caldwell, was a stranger passing through the City of Austin, and not acquainted with its speed limit laws , and in further consideration of the fact that probably the fine was excessive, $ 17.40,or one-half of the fine and costs imposed in cause No 8894, State of Texas vs J A Caldwell,in the Corporation Court of the City of Austin,Texas ,be and the same is hereby remitted. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Approved, A P Wooldridge, Mayor . The Mayor laid before the City Council the following resolution : Whereas, it appears that the offense of which Calvan Houston was convicted in the Corporation Court of the City of Austin,Texas, on Sept 25th 1914, and fined $ 14.80, including costs, was his first offense and probably an offense committed in uteter igno-rance of the law. Now, therefore, Resolved by the City Council of the City of Austin : That $ 7.40, or one-half of the fine and costs imposed in the Corporation Court of the City of Austin,Texas, on Sept 25th 1914, in cause No 8915, State of Texas, vs Calvin Houston , be and the same is hereby remitted. Be it further resolved: That $ 7.40 be appropriated out of the general contingent fund of the City of Austin, Texas, as a re-fund for one-half of the amount of the fine and costs imposed against the said Calvin Houston in the above numbered cause. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomewm Haynes & Powell 5 Nays none. The Mayor laid before the Council the following resolution : Acting upon the advice of the City Attorney, Mr J Bouldin Rector, and the advice of Mr J W Maxwell, Special Tax Collector of the City of Austin, Texas, and for reasons obviously legal ,sufficient, proper and wise. Be it resolved by the City Council of the City of Austin : That the sum of $ 3,571.41, be and the same is hereby accepted from the representative of the Loomis Estate and certain of the creditors of said estate , acting through the Texas Trust Company ,Receiver, in full payment and complete discharge of all.taxes ,interest and penalties due and owing the City of Austin,Texas, upon Lots Nos 4,5& 6,in Block No 108 of the City of Austin,Texas, together with the costs of Court in certain suits brought for the collection of taxes owing on said property for the years 1897,1898,1899,1900, 1901,1902,1903, 1904, 1905, 1906, 1907, 1908,1909,1910,1911, 1912, 1913.,and, Be it further resolved : That the Mayor of the City of Austin , Texas, is hereby authorized to execute ,upon the 123 --- Page break --- CH Buck Granted free Sewerage Underground Conduits. to locate Light --- Page break --- 125 shooting gallery at 311 East 6th street in this City for a period of 12 months from and after October 1st 1914. Theresolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony, Bartholomew, Haynes & Powell 5 Nays none. Reports of City Officers: The Mayor laid before the Council the report of the City Health Officer, the Matron of the Hospital and the Book-keeper for the Street Dept ,which were read and ordered filed Councilman Bartholomew offered the following resolution : Whereas, there is now pending between the City of Austin and persons owning property abutting on the Colorado River above the Austin Dam, portions of which property will be submerged by the waters of the lake to be formed by said dam,negotiations for the settle-ment of such damages as may accrue to said owners on account of such submersion , which negotiations have not been fully concluded; and Whereas, there is an immediate necessity to clear all of said lands to be submerged of the timber growing thereon , for the reason that said dam is nearing comple-tion; and Whereas, the owners of such lands are as much interested in the clearing such timber as the general public , for the reason that it will be necessary before such submersion to cut said timber in order to make the respective water fronts of such lands available for landing purposes ; Therefore, Be it resolved by the City Council of the City of Austin : That Orin E Metcalfe be and he is hereby authorized and instructed to obtain the consent of the owners of said lands for the City of Austin to eneter upon said lands at once and to cut therefrom all the timber thereon within the proposed submerged arena , making such disposition of the wood as may be agreed upon between said parties ; such action , however on behalf of the City of Austin ,when obtained from said owners, to be without prejudice to either the City of Austin or said owners with reference to the pending negotiations con-cerning said damages. The resolution was adopted by the following vote : Yeas Mayor Wooldridge, Councilmen Anthony,Bartholomew, Haynes & Powell 5 Nays none. Councilman Anthony announced the death of Dr S J Swift, one of the City Health Inspectors, and the City Veterinarian, and nominated Dr N F Pease to be his successor for the unexpired term of Dr Swift. Dr Pease's nomination was confirmed with the affirmative vote of four ayesCouncilman Anthony not voting . .The Mayor laid before the Council the following resolution : Resolved by the City Council of the City of Austin : That a permit be and is hereby granted to Mrs H H Taylor to place the sidewalk in front of of the north ½ of Lot No 6, Block No 44, on the grade shown by the accompanying plat, which plat requires three steps ( 3 rises,2 treads) in the sidewalk between this property and the property adjoining it on the south.
